Dear Howard:

Reference is made to our recent discussions regarding the structuring
of the bid for the above project and my approval to set up the bid on
the basis of individual work items (or individual base bids) to permit
the Using Agency to exercise the maximum flexibility to select work
items (in lieu of a base bid plus alternates).

Howard, please be advised that this procedure is possible only under
condition that you explain to the bidders in the Non-Tech spec, the
basis upon which the State will make the selection of work items. The
basis for determining the selection cannot be arbitrary or merely for
the convenience of the Board or for flexibility. If you can do this,
please reword Paragraph B-24 accordingly. If, on the other hand, you
cannot 'provide a satisfactory explanation, you will have to revert
back to a bidding structure which identifies a base bid plus alternate
bids. Under the latter event, as you well know, selection of alternate
bids must be in sequence Cas described in Paragraph B-24, Non-Tech specs).
