Governor Jennings and the Trustees of the Internal Itprove'

ment Pund.


Governor Jennings having become so greatly encouraged

by his unprecedented successes in handling extraordinary mats

ters and being so ably assisted by the various members of his

cabinet, upon whom he relies so confidently, and insists that

they are entitled to share equally with him all successes that

come to his administration, undertook the task of mastering

the status of the Internal Improvement Fund which has vexed

the ablest minds that the State has ever produced from Yulee's

time to the present date.

It would seen that he has made this questionn the sup=

reme effort of his of icial life. Ie began the study of this

question early in t h his administration, as will be gleaned

by the policy of the Trustees from the beginning of his ad=

ministration.

Among the first things presented to him was & demand

-y the representatives of railroads for deeds to lands granted

by the legislature. Upon an investigation and a personal

study of the law on the subject he reached the conclusion

that the lands obtained from the United States under the Act

of Congress of September 28, 1850, known as thesvwamp.ad

overflowed"landx grant which vested in five Trustees, created

by the legislature under Act approved January 6, 1855 irrevo

cably, therefore subsequent legislatures were powerless in the

premises during the continuance of the trust for,the reason

that it had parted with the lands and the title thereto,

His associates Trustees, realizing the force of this

opinion, joined in the assertion of this olift of the TrusB

tees and have firmly and uniformly observed it.

The representatives of the railroads, insisting upon the opm

posit. view, instituted suits, one in April 1902, and others

more recently, to force the Trustees to deed the lands under

legislative direction, and now the entire trust fund and its

moneys valued at six million dollars are involved in test

. cases now pending to settle the all important question as to
whether this vast domain and the large sums of money on hand

ie owned by the railroads of State or Is owned by the people

of the State.

,. Governor Jennings seemed to have realized the gravity
of the situation early in his official work, for he announced

in his message d4 the Legislature of 1903 that 'this prob-

lam to-day is the paramount question before the people of

Florida' but the many demands upon his time delayed the won=

derful effort that he has since made to solve the details

of this trust fund.

During the past year he has prepared inquiries and

had statements prepared covering almost every imaginable

phase of the question affecting the lands referred to. A few

of these statements are enumerated below, which can only give

a faint idea of the imJsense amount of labor involved in its

preparation and the volume of information contained in teee

statements made up in tabular form with many pages of figures.

(1) State meant of lands granted and conveyed to xat2

xKsts constructed railroads, showing the number of acres

granted to railroad companies under legislative enactment to

be transferred out of the swamp and overflowed lands patented
to the State. The number of miles of railroad constructed in

Florida.

The number of acres per milo granted to each railroad in

Florida; the number of acres granted under special legislative

grants to each railroad; the number of acres granted in alter-

nate sections within six mile limit; number of acres within

twenty mile limit; total aores granted; name of the railroads

to which grants were made from 1879, being the first grant,

to August 6, 1904; the number of acres deeded to constructed

railroad companies under legislative enactments; the number

of acres deeded under special legislative asamtam grants;

the number of acres embraced in certificates issued by former

trustees, the summary of which exhibits these startling figures:

swampy character, unfit for cultivation, is the total residue

under the special land grant act.

This, it wo'l1d seem, was only the gathering of strong

resolutions declaring the attitude and policy of the Trustees

asserting their rights and powers to the lands vested in them

irrevocably in the long ago and the determination by the Truse

by the Trustees to grant applications for deeds to the lands

embraced in certificates issued by their predecessors to rail=

road companies, embracing 717,842.88 acres; their declining to

istration is that there now the sum of nearly $400.000 4
the Internal Improvement Fund, the greater portion of which is
the proceeds of the sale of lands that were embraced in a

deed In escrow to a railroad company under a land grant when

the Governor was inaugurated, there being a few hundred dollars

in the treasury of this fund at that time.

SUBJECT; Plan Suggested for Financing and Handling
Florida Naval Stores.








Dear Sir:
The continuation of a manipulated Naval Stores Market during
the year 1907, will, in my opinion, entail a loss upon the Opera-
tors of not less than Two and One-half Million Dollars.
This enormous estimated loss serves to measure the task of
anyone who undertakes to solve the problem and prevent such a loss,
which would otherwise be profit to the Operators in Florida.
There was produced and exported in Florida during the year
1905 a liltle upwards of Twelve and One-half Million gallons of
Turpentine, which was sold at an average value per gallon of 49.9
cents, amounting to $6,485,826.00. During the same period, there
was produced in Florida, 1,345,902 barrels (280 lbs.) of Rosin,
valued at $3,447,418.00, or and average value per barrel of $2.38
for the entire year.
The greatest quantity of Turpentine ever produced in the
United States was during the year 1901, quantity exported aggre-
gating 20,240,851 gallons. There were 2,820,815 barrels (280 lbs.)
of Rosin produced and exported in the United States during the
year 1901.
In 1906, 15,898,813 gallons were produced and exported, worth
$8,902,101.00. During the same year, 2,210,375 barrels (280 lbs.)
Rosin were produced and exported. It is estimated that there will
De produced in Florida in 1907, in round numbers, Twelve Million
gallons of Turpentine and 1,500,000 barrels (280 lbs.) Rosin,
equivilant to one half of the production in the United States.
The production of Naval Stores covers a period of about Nine
(9) months. Suppose that One-half of the Florida production is
financed by Savannah parties; the other One-half to be financed
by Florida people. This, in my opinion, can be successfully done
and a stable market maintained on the following plan:
1. That Operators ship their product in the usual course
through their Factors, as the interests of the Factors and Opera-
tors are identical and dependent upon each other for success in
the production and successful marketing the product, with direc-
tionS that it be stored in the Warehouse, for which a negotiable
Warehouse Receipt Issue of the Atlantic Coast Line Railway Company,
and such other transportation companies as may be approved, and
have the product stored in the tanks and terminal yards subject to
further instructions, which instructions should embrace and fix a
uniform minimum price for which such product should be sold.
2. That sales of all products so represented by Warehouse
Receipts be made at all times to the best advantage of the Opera-
tors and Factors, and when a sale is made, that the proceeds aris-
ing therefrom should be prorated among the holders of Warehouse
Receipts according to the qantity of the product represented there-
by. This would enable the owner thereof to at all times receive
the actual market value of his product, and such sales would ena-
ble the producer to defray his current expenses and prevent forced
sales in a low market.
38 This plan would enable the Factors and Operators to so
regulate the out-put as to enable them to maintain a stable price







and a stable market, governed by the rule of Supply and Demand
without the hazard that follows a manipulated market where the
relationship of creditor and debtor is forced to exist between the
Operator and the Factor, or Export Company, on a cash basis, as
heretofore experienced by the local Export Company. In other words,
the owner of the product, under this plan, either owns his product
or procures a satisfactory price therefore, without forcing anyone
to borrow money to buy the product to prevent a sacrifice. Should
the necessity arise, however, that made it expedient to utilize
the product for the purpose of realizing the money necessary to
carry on the current expenses, the Warehouse Receipts, under this
Plan, could be used as collateral security to practically the same
advantage, and in many instances, much greater convenience, than
the product could be handled.
Should there be practical unanimity among the Operators in
Florida, the scope of such a plan, reaching as it would, a very
large percentage of the product and utilizing the value thereof in
the security offered, insures its success. Any plan of less scope
cannot withstand the assault of the manipulators of the Naval
Stores Market.
The purchase of a few thousand gallons of turpentine by indi-
viduals or companies does not permanently relieve the situation,
but, in many instances, only serves to aggravate and make more
acute a disturbed condition. In other words, it is not a sale to
the consumer or supplying any demand for turpentine, but it is
simply the change of ownership, the product remaining on hand
awaiting the hope of an increased price, which could only result
in either profit or loss to either individual or Company purchas-
ing, and is not of sufficient scope to enter into the question of
solving the great problem of regulating and maintaining a stable
market.
The plan suggested is simple; does not change relationship
between Factor and Operator, nor require an Organization of a Com-
pany with great capital stock, nor entail any great expense. To
finance one-half the product of Florida can, in my opinion, be
done without doubt and upon a reasonable basis. The Operators can
minimize the amount of money required, by
(a) Reducing or arranging their current expenditures until
an actual sale can be made at a satisfactory price of their product.
Thus relieving the Factors in such instances of providing means to
cover any considerable portion of the product in the Warehouse.
(b) By instructing that Rosin be promptly sold, so long, of
course, as prices are satisfactory, using the proceeds for im-
mediate current expenses.
This suggestion may cause you to think that this is placing
the burden upon the Operator. The answer to this suggestion is,
that while that is true in part, every dollar of increase in price
is a dollar of profit to the Operator, because his expenditures
are just as great when turpentine sells at 55 cents a gallon as
when it sells for 75 cents a gallon.
The annual demand is greater for both turpentine and rosin
than the annual supply. The demand is increasing, the supply de-
creasing. The demand is quite uniform during the twelve months of
the year. Why not make the supply and distribution uniform, in-
stead of rushing the year's output on the market in practically
four months? The situation is in the hands of yourselves and your
Factors.
Is not your interest in the two and one-half million dollar
loss to the industry sufficient to justify your especial erfort to
save it? If so, does the plan as outlined meet your approval, and
will you co-operate in inaugurating and maintaining such a plan?

ars, and that for the present no other Counsel be employed; That GWa

Jennings shall undertake to represent the Trustees in all litigation

which is now pending or which may arise during,the year, and to advise

the Trustees upon any matter in which they may ask his legal opinion;

Resolved, further, that the Attorney-General shall be associated with

the Counsel for the Trustees in all litigation in behalf of or against

the Trustees. This action of the Trustees in requesting the Attorney-

General to assist the Counsel for the Trustees being taken upon the

announcement by the Attorney-General of his willingness to render such

assistance.

W. A-. Hobson and W. S. Jen-
nings, two of the seven Trustees
who persist in a position. to not
accept the Stetson proposition of
$100,000 for the University have
had a communication each in the
Jacksonville Metropolis giving
their reasons, together with the
other five stubborn Trustees,
why they do not join with the
other seventeen Trustees to re-
sign, that this princely sum may
be had, together with the $40,000
from Mr. Carnegie, for the Uni-
versity. Trustees Jennings,
Fletcher, Hobson, Camp, Forbes,
Solomon and Stewart (chaplain)
are the ones who are blocking
the way for the University to
get this $140,000, with the way
open for lots more, and:they will
never make their present position
satisfactory to the friends of the
institution throughout the State.
It is a shame and an outrage that
the school is denied this money
simply for spite work on the part
of these seven Trustees. The
$100,000 Stetson proposition is
before the Board, with no ill
feeling toward a single member.
The condition applies to the
seventeen who will resign as
much as it does to the seven who
refuse to resign. It was the in-
tention of Mr. Stetson to wipe
out and remove from the Uni-
versity all friction in the Board,
to have a board composed of
members who had nothing to do,
or took any part in the recent
trouble. This proposition was
renewed by Mrs. Stetson. It ap-
plies to the entire Board, and
anyone can readily see that the
proposition, in.all its features,
is best for the University. This
$140,000 is not all either. With
a new Board, free from the old
trouble, the institution has a
magnificent future before it.

ous churches, held its regular quarterly
meeting in Jacksonville yesterday after,-
noon and endorsed the action's of ex-
Gov. W. S. Jennings before the board
of Stetson University trustees, as re-
gards the properties of this educational
institution at DeLand.
The delegates present transacted
much other business of importance to
this denomination and relative, to the
Stetson University matter the follow-
ing resolution was introduced by Gov
Jennings and passed after strenuous
opposition on the part of Rev. L. D.
Geiger and Prof. Hare:
Resolved, That it is the sense of e g

bled, that the properties of the John B.
Stetson University should be vested in
the Florida Baptist Convention (incor-
porated), to be owned and controlled by
it in accordance with the spirit and in-
tention of the founders of said univer-

At a recent meeting of the Trustees of The John B. Stetson Univer-
sity I offered a resolution in effect to convey the John B. Stetson Univer-
sity properties to The Florida Baptist Convention, incorporated, which.is
composed of the State Board of Missions, which resolution has since been
published in the "Witness."
The President of the University led the opposition to the adoption
of the resolution, basing his opposition on two general propositions:
(1) That the Baptist denomination should not own and control the
University; and
(2) That the Baptist denomination does not desire to own and con-
trol the University.
We believe that the time has arrived when we are called upon to
determine the question whether the Baptist denomination of Florida shall own
and control what has been universally recognized as a Baptist Institution,
or whether the University shall be owned and controlled by individuals.
Our contetion was and is to the effect that the Baptist denomina-
tion of Florida should own and control the University and its properties,
which we are strongly urging, and as the matter is to be discussed further
on the 19th instant, at an adjourned meeting, I will thank you to write me
your views on the subject, not later than the 18th, that I may have the bene-
fit of your good judgement.

I am glad to hear you say that you will not longer be a "dum-

my no2t mM.", but will do all in your power for the upbuilding .of the

University. It was because Treared you had despaired eve r doing any-

thing more that I despaired and went "grasping for straws" as a drowning

man. Unless Dr. Hulley proves himself able, this year, to influence

other men outside of the qtetson ring, the Trustees will have to find a

man who can influenc- men of means,--or eut down the expenses--possibly

My dear Mr. Moodie:-

I have your letter and have enjoyed it.
I am like you, I like to be rebuked and have my faults shown
to me.

As to the Jennings resolution, I certainly would have c
voted for it in preference to turning the institution over
to a private individual or allowing it to be used as an in-
strument of personal revenge, and I think that was the al-
ternative in the last meeting.

It seems to me that we might possibly get together and
agree by taking the initiative ourselves, and introducing
a resolution at the next meeting, something as follows:
" Whereas there has been a sharp difference of opinion in
the board in the past on a vital issue and as the board has
been divided into two, more or less distinct parties; there-
fdre, be it resolved, that in the interest of perfect harmony
in the board, and for the well being of the university, we
proceed to elect the following named gentlemen to constitute
the board of trustees of the John B. Stetson University. We
could get up a list of names of broad minded, good men and
name them in the resolution, and them proceed to elect them.

In this way we would take the initiative in reorganizing
the board on what I consider to be a safe and valid principle,
namely to eliminate through perfect harmony in the board, all
that might militate against the highest good of the university.
Personally I am perfectly willing to resign and have no schemes
of any kind to offer, but wish simply and wholly to do the right
thing. I do think however as'you say that the fact that when
vacancies were to be filled, they elected such men as Hon and
Wood to fill them shows that their standard for members of
the board is not very high, and that they are securing not
only partisans but actual employees of Mr. Stetson.
