SBPO CONSULTATION REQUIREMENTS FOR ADA PROJECTS
Both-Federal and State regulations which implement the Americans
with Disabilities Act (ADA) and the Florida Accessibility Code
(FAC)provide for a consultation process between the State
Historic Preservation Officer (SHPO)and an owner of a qualified
historic building when the owner feels that the full
accessibility requirements of ADA would "threaten or destroy" the
significance of the building. If the State Historic Preservation
Officer agrees with the owner then the ADA requirements may be
lessened with specified alternative minimum requirements.
To initiate this consultation process the owner of an historic
property should request a review from the State Historic
Preservation Officer at:
Bureau of Historic Preservation
Division of Historical Resources
500 South Bronough Street
Tallahassee, Florida 32399-0250
ATT: Phillip Wisley
(850) 487-2333
A review request shall at a minimum include:
A. A statement describing accessibility deficiencies and
photographs indicating existing conditions and architectural
character of the of the property in question.
B. Sketches and narrative statement of all alternatives
considered in the effort to bring the property into compliance
with Federal and State accessibility requirements.
C. A statement describing why it is felt that compliance with
State and Federal accessibility requirements and implementation
of the accessibility alternatives will threaten or destroy the
historic significance of the property.
