No Major Recent Criminal Activity In The Community
It is encouraging to note that, apart from two reported
burglaries this week, and a few other minor incidents, criminal
activities in the community somehow appears to have taken
a back seat as we approach the Yuletide Season of caring and
sharing.
We have reached the point over the last two weeks, where the
assigned magistrate has been out of the courtroom for several
days as she shuffles between San Ignacio and Benque Viejo
Town holding over for the magistrate in that western-most
municipality. Despite the Magistrate's absence from San Ignacio
on other duties, there has hardly been any overcrowding, as in
times gone by, at the San Ignacio Police holding cells.
Unlike the situation in Belize City, it has been several months
since a murder had occurred in this community. Police are
attributing this slow down in major criminal activity to two
possible factors: 1) Most of the trouble makers are currently
incarcerated, either on conviction or on remand at the Hattieville
Central Prison and 2) Word might have been spreading of the
no-nonsense prosecuting skills, and the high rate of convictions,
attained to date by the newest Crown Counsel in the Office of
the Director of Public Prosecutions, in the person of British

PUBLIC UTILITIES Public Utilities Commission (PlC) PUBLIC UTILITIES

The Public Utilities Commission (PUC) hereby serves notice that on December 2, 2009, an objection to its Initial Decision in the Full
Tariff Review Proceeding (FTRP) for Belize Water Services Limited (BWSL) was received from BWSL, in accordance with the Water
and Sewerage (Tariffs) Byelaws (Statutory Instrument 67 of 2002) as amended by Statutory Instrument 102 of 2004 and Statutory
Instrument 89 of 2008.

Grounds for objection as cited by BWSL:

1. The proposed Rate Setting Methodology (RSM) does not seem appropriate for a water utility which has constraints on cash generation
and therefore on obtaining debt financing. BWS has no knowledge of what effect such a methodology has had on other cash-short water
utilities.

2. The proposed Regulated Asset Value (RAV) embodied in the RSM reduces overall assets by subtracting contributions to assets and
missed the key fact that the reason most of these contributions were required is because BWS was not able to fund them due to lack of
cash. Furthermore, the RAV uses historical cost rather than market value or replacement cost on assets. The proposed RAV therefore
significantly understates the cost of providing the services to customers.

3. By extension, the PUC's stated intention to evaluate new projects independently implies that systems with contributed capital would be
charged lower rates than similar systems financed by BWS. BWS believes that this approach would create resistance to BWS-financed
expansion projects and is therefore contra-productive to the expansion of this essential service and to the overall development of the
nation.

4. The PUC is proposing regulatory changes to remove the option for (annual) Notified Items application and impose a requirement for
mandatory annual reviews. The former was recommended by the Independent Expert at the last FTRP in 2004 as a means to avoid the
need for Annual Reviews to adjust for changes outside of BWS's control. The latter seems to assume that Business Plan as approved by
the PUC in the Full Tariff Review would require regular adjustments; such mandatory reviews, especially if not required, would put an
unnecessary cost and overhead on both BWS and the PUC.

5. The proposed Operating Expenses (OPEX) have not been clarified and exclude Finance Charges which would have to be covered by
the proposed Return on RAV in the RSM. The margin between the Return on RAV and the Finance Charges appears too small.

6. The Initial Decision ignores BWS' proposal to restructure the tariffs and reduce the monthly bills for some 7,000 or so
lower-consumption residential customers who use 750 gallons or less.

7. The Initial Decision and its related documents indicated details of Capital Expenditure and a summary of certain expense items but
were incomplete in terms of a full Business Plan, particularly they did not provide projected Balance Sheets, Income Statements and Cash
Flow Statements.

8. The Initial Decision ignores the company's regulatory mandate to provide a fair return to its 1,300 or so shareholders.

9. The critical importance of cash flow appears to have been overlooked as the Initial Decision and proposed RSM seem to assume that
BWS will be able to generate or obtain adequate cash and/or loan funding to invest and meet its commitments; however, this misses the
key point that the company requires adequate cash flows from operations in the first place, before it can be in such a position.

10. The Initial Decision also appears to ignore a number of requirements, issues, influences, and economic assumptions included in
BWS' Business Plan submission and the identified requirements to ensure "that the company can meet the investment needs of
population growth, handle emergency disaster situations, provide fair return to shareholders who have invested hard earned funds, and
ensure the overall viability of BWS".

11. Many of the issues identified above combine to create an uncertain environment for BWS which, especially given the need to obtain
financing for major projects, will have a negative effect when reviewed by lending institutions.

Appointment of an Independent Expert

As a result of BWSL's objection, the PUC will appoint an Independent Expert to review the Schedules and Tariffs within 15 days of the
objection. The Independent Expert, who is to be agreed by the Licensee, will be appointed by December 18, 2009. The Expert will give
due consideration to the interim decision of the PUC and the objections, comments and information submitted by the Licensee and
interested parties in carrying out his review, and should submit his report to the PUC and BWSL by January 18, 2010. Where the PUC

challenge the conclusions of the report, the PUC shall afford the Licensee and such Interested Parties an opportunity to be heard.

The PUC will deliver a Final Decision no later than 50 days after the receipt of the Independent Expert's Report. The Final Decision
therefore, will be delivered on March 10, 2010

CONDITIONS, PARKING, TAXI DRIVERS and
HEAVY DUTY VEHICLE


Dear Editor,
For some time now I have been
contemplating whether to write
to your newspaper about certain
concerns/issues that I have had
but have always put it off until
Tuesday 8th December while
walking home, I had another
more compelling reason to do so.
If you kindly allow me, I would
like to detail below a few
concerns that I have as a citizen
of the town of San Ignacio.
STREET CONDITIONS
On Tuesday of this week, I
noticed that the section of road
in front of Sacred Heart College
on Joseph Andrews Drive was
being scrapped and graded as it
would apparently be re-surfaced.
Sure that idea is welcomed but I
wondered what the engineers
and planners of the town or
ministry are thinking and doing.
That segment of Joseph
Andrews Drive had nothing
wrong with it but was one of the
best parts of the drive. So I asked
myself why would it be scrapped
and worked on if nothing is
wrong with it? They should
better spend the resources on
fixing the entire segment in front
of Lea's Furniture and Falcon
Field that has more holes than
the moon and have been
spewing dust for months now.
There are many other streets
that need fixing and I do not see
the town council or the ministry
of works doing anything about
it.
I was extremely happy to see
that our streets were being
maintained and fixed during the
year after elections but now, I
think they have all forgotten
about that.

question why the town council
or the ministry of works carry
out work on roads/streets/
bridges during peak hours. In
other countries, these types of
maintenance and rehabilitation
work is done during the night
when it will least affect the
residents.
PARKING
The second concern I have is
in regards to parking in the
downtown area.
The majority of parking spaces
in town have been given to
taxi associations leaving the
remainder of the motoring
public with little space to park
when they go do errands in town.
Do we need all those taxis
taking up the majority of space
or could they be managed in a
more efficient way to maximize
the use of the small downtown
area? That is what the town
council and the municipal
traffic department should be
doing. By the way, do we really
know the financial effects of this
move?
TAXI DRIVERS
The third concern is in regards
to the utter and complete
disregard that the taxi drivers
have in general for traffic
regulations.
They park where they want,
when they want and drive the
way they want.
A perfect example is what
happens at the Bullet Tree and
Joseph Andrews Drive junction.
A taxi driver was coming from
downtown on Bullet Tree road
and did not stop at all at the
junction and just sped and turned
left onto Joseph Andrews Drive
going up the hill towards
Benque.
If the other driver coming from
the college going up Joseph
Andrews Drive did not suddenly
stop in the middle of the
intersection (even though that
driver had the right of way)
they would have had a serious
collision! It did not bother one
bit to the taxi driver, he just sped
off and continued on his way.
The municipal traffic
department should put in place
a mandatory special driver's ed
class for all those who wish to
become taxi drivers. The


department must ensure that
they pass both a theory and a
practical exam if not they be
denied a license and this license
should be renewable yearly
based on them passing the
practical exam.
Taxi drivers, I believe, have to
shape up and drive with all due
care and attention because the
other residents are tired of
having to drive for themselves as
well as for the taxi drivers. That
should not be allowed to
continue.
HEAVY DUTY VEHICLE
I live on Joseph Andrews
Drive in San Ignacio and, like so
many of the residents who live
in the area, I am sick and tired
of the incessant noise pollution
that heavy duty trucks cause as
they drive down towards the
cemetery.
My understanding is that they
do not need to make all that noise
but that they choose to do so.
The traffic department should
do something about it and ensure
that this does not continue.

corrected like:
a) perhaps the town council
should consider putting up some
closed circuit cameras at
strategic locations around the
twin towns,
b) due consideration should be
given to the installation of
parking meters,
c) remapping the center of
town to maximize parking space,
d) hiring and professionally
train more traffic wardens and
e) be more strict with
violations and the issuance of
traffic tickets especially to those
taxi drivers that blatantly and
consistently violate the traffic
regulations.
In the final analysis we all
must learn to live together in a
symbiotic relationship as this is
our town.

BWS objects to PUC Initial Decision on BWS FTRP Application

The Public Utilities Commission issued its Initial Decision (2009 Full Tariff Review Proceeding)
for Belize Water Services Limited (BWS) on November 17, 2009. BWS had submitted its Full
Five-Year Business Plan (FFBP) report on October 1, 2009, for the period April 1, 2010 through to
March 31, 2015 to the PUC for their review.

BWS has submitted a formal objection to the PUC regarding the Initial Decision.
There are a number of reasons for this objection, including:
The Initial Decision ignores BWS' proposal to reduce the monthly bills for some 7,000 or so
lower-consumption residential customers who use 750 gallons or less. The BWS proposed tariffs
were specifically designed to minimise the impact on lower income and lower consumption
residential customers. For the 5,000 households (11% of the customer base) who use 500 gallons
or less of water monthly, their bill would actually REDUCE by an average of 20%. Also,
recognizing the cries from San Pedro where the tariffs are higher than on the mainland, the percentage
increase in San Pedro was kept much lower.
The Initial Decision ignores the company's regulatory mandate to provide a fair return to the over
1,300 shareholders who invested their hard-earned funds.
The proposed Rate Setting Methodology (RSM) does not seem appropriate for a water utility
which has constraints on cash generation and therefore on obtaining debt financing. The effect of
such a methodology on a cash-short water utility can be disastrous.
The proposed Regulated Asset Value (RAV) embodied in the RSM reduces the overall asset value
by subtracting contributions to assets and misses the key fact that these contributions were necessary
as BWS was unable to fund them due to lack of cash. Furthermore, the RAV uses historical cost rather
than market value or replacement cost on assets. The proposed RAV therefore significantly
understates the cost of providing the services to customers.
The proposed regulatory changes, which would impose mandatory annual reviews, will add
additional costs and overhead to both BWS and the PUC.
The issues identified above, combined with various other elements of the Initial Decision, will
create an environment of uncertainty for BWS, which, especially with the need to obtain financing
for major projects, will have a negative effect when reviewed by lending institutions.

Overall, the Initial Decision seems to ignore a number of requirements, issues, influences, and
economic assumptions included in BWS' Business Plan submission as well as the company's
requirement to ensure "that the company can meet the investment needs of population growth,
handle emergency/disaster situations, provide fair return to shareholders and ensure the overall
viability of BWS".

BWS feels that this Initial Decision can be improved for the benefit of all stakeholders.

Emory University, and
Dartmouth University.
The objective of the meeting
is to design and launch the
Caribbean Health Outcomes
Improvement Programme
(CHOIP) a non-profit, non-gov-
ernmental programme.
The CHOIP will support
Integrated Health Information
Systems (IHIS), based upon the
success of the Belize model,
in all interested CARICOM
nations.
This comprehensive regional


solution to Health Information
Systems will assist with the
development and deployment of
disease management protocols
throughout the Caribbean.
CARICOM nations partici-
pating in this initiative will
be able to conduct yearly
assessments of the outcome from
the integrated health information
systems.
This meeting also serves as a
means to persuade prospective
funding partners of the merits of
supporting this initiative for
the 20 member and associate

Arson Suspected As The Cause

District, Thursday, December
10, 2009:
Crime investigators are
seriously suspecting arson as the
cause of the fire that totally
gutted an entire 80 X 20 ft
classroom building at Bishop
Martin Primary School in San
Ignacio Town, during the early
morning hours on Friday,
December 4, 2009.
At around 2:40 a.m., a mobile
patrol visiting the police check
point on the Bullet Tree Road,
located just across from the
school, saw smoke coming from
the school compound. They
rushed over to investigate and
found one of the buildings
engulfed in flames while the
watchman was reportedly found
fast asleep on duty. They
immediately contacted the fire
service and within minutes a
team of fire fighters were on the
scene. It was not until around
5:00 a.m., that the ashes were
totally extinguished.
The building, housing the


school's Infant 11 and Standard
IV classrooms and the library,
with all its contents, was
completely destroyed in the
blaze.
Police reports that the Belizean
watchman, Jose Baki, 44,
residing in the nearby Santiago
Juan Layout was detained,
questioned and later released.
While classes for the entire
school was suspended for the
day on Friday, December 4,
activities resumed on Monday,
December 7.

San Ignacio police are this
week reporting two incidents of
burglary, one in Santa Elena, and
the other in San Ignacio Town
with no arrest in both cases as
investigation continues.
In the first incident, at around
9:00 p.m. on Saturday,
December 5, Karen Mahmud,
36, Belizean domestic of a
Santiago Juan Layout address in
San Ignacio Town, reported that
sometime between the hours of
7:00 a.m. and 1:00 p.m. on
Friday, December 4, her house
was burglarized and among the
over $10,000 worth of missing
items were, $7,000 worth of
jewelry, 1 red Dell laptop
valued at $2,000, 1 80GB black
iPod valued at $500, 1 Sony
DVD Player and two bottles of
rum, all for a total value of
$10,090
Police visited the scene and
observed that entry and exit was
gained through a side door as the
exterior burglar bar door and the
interior wooden door were both
pried open. No arrest has been
made and the investigation
continues.

detention of two persons who

suspects were questioned and
later released as investigation

Israel, we find it insulting to see
the Israeli flag flying above the
Belize flag on the top of this
house in San Ignacio Town,
Cayo.
This is offensive to Belize and
Belizeans; in Israel it is illegal
for Palestinians to fly their flag.
We seriously doubt that anyone
could fly any flag above the
Israeli flag in Israel.
It seems an appropriate time to
write this article as we approach
the celebration of the birth of
Jesus, for those who are
Christians.
There are Evangelicals being
led by a right wing racist church
called Evangelical Christians
United for Israel (CUFI) led by
Pastor John Hagee from Texas.
Of course, he has every right to
his opinion and it is understand-
able that he does so probably for
personal reasons.
Recall, in the Bible, that Jesus
went to the temple overturning
the tables of the moneylenders
and denouncing them; they were
the ones who went to the
Romans to have Caesar deal
with him. Jesus was Jewish;
the moneylenders would be
compared to today's Zionists.
It seems contradictory for any
Christian to promote Zionism.
They have taken Palestinian

The Team From Toledo Is This Year's

Mega Belikin 9 Ball Billiards Champ


Ten mighty teams gathered at the
Multipurpose Complex in Orange
Walk Town. The came from as far
as Toledo in the South, Cayo in
West and Corozal in the North.
They all came to Orange Walk
Town for a two day Billiards
Tournament to prove which team
is the best in the land.
Each came with one mission in
mind and that was to win the
Championship, capture the first
place trophies and take home the
grand prize of $4,000 in cash.
If they were unable to capture the
BIG one they would settle for the
second title of sub-champion, the
second place trophies and the
$2,000.00 cash prize. Failing that,
at least win the third place trophies
with $1,000 cash prize.
On the first day Saturday, the
eliminations started briskly, but
the pace slowed down as both
teams played with more caution.
The elimination games went past
midnight, and when the games
were stopped, it was Cayo
carrying the day with no losses.
On the second day, Sunday,
the last remaining three games of
the elimination games were
completed and the semi-finalist

matches started. Two of Orange
Walk's team, Tijuana's and KD's
had been bombed out early and
did not make the semi-finals. This
was most unfortunate for Orange
Walk. Orange Walk's only hopes
was Hi5, but that remaining hope
died when Cayo slammed Orange
Walk's Hi5 in a very heatedly con-
tested game.
The four teams that made it to
the finals were: Cayo, Advance
from Belize City, Corozal and


Toledo. Each had only brought a
team and, therefore, they were
very strong having selected the
best players of their district.
Corozal trounced Cayo, and
Toledo did the same to Advance
Belize. So it was a Corozal and
Toledo match for first and second
place, and Cayo and Advance for
third and fourth place. Toledo
smashed Corozal taking the


coveted title of Champions and
left Corozal as Sub Champions
while Advance blasted Cayo for
third place. All in all, the games
were all spectaculars and thrillers.
The Mega Belikin 9-Ball
Tournament was a tremendous
success. The teams conducted
themselves in a spirit of good
sportsmanship and were happy
that they had been a part of this
great and historic event in the
sports of Billiards.
A mighty thanks goes to the out-
standing referees: Mr. Willard
Levy, Mr. Damasio, Mr. Rogelio
Cocom, and Mr. Nelson
Demorce. They were all
excellent referees.

into full ownership titles."
In a subsequent interview
Minister Contreras said "I am
not going to wait until a few
weeks before the next general
election to begin giving land to
my people. Politicians can no
longer fool the people with
these kinds of political games
and trickery. My people elected
me to serve them, not only at
election time but for the entire
term in office and I will
continue addressing the needs
of my people in terms of land,
education, health care, housing
and other infrastructure."

STREET CONDITIONS On T uesday of this wee k , I noticed that the section of road in front of S acred Heart Colle ge on Joseph A ndrews Dri v e was bein g scrapped and g raded as it wo u ld a ppar e ntl y be re-s u rfa c ed. S ure that idea is welco m ed but I wondered what the en g ineers and p lanners of the t o wn or m inistry are thin k in g and doin g. T h a t s e g me n t o f J o s e ph A n d r ew s D r i v e h a d n o t h i ng wron g with it but was one of the b e s t p a r t s o f t h e d r ive . So I a s k ed m y sel f w h y w oul d i t b e sc r ap p ed and wor k e d on if nothi ng is wro n g wit h it? T hey s h ould be t ter spen d the res o urce s on f i x i n g t h e e n t i r e s eg m e n t i n f r o nt o f L e a ’ s Fur n it u re a nd Fal c on Field that has m ore holes than t h e mo o n a n d h a v e b e en spewin g dust for m onths no w. There are m any other streets that need fixin g and I do not see the town council or the m inistry of wor k s doin g anythin g about it.
