It's time to "Ask the Governor, when Governor Farris
Bryant answers questions based on letters and comments received
from Florida citizens.
QUESTION: Governor, conservation is a subject much in
the news these days. Many citizens have indicated in their letters
to you that they are vitally concerned with it. Some specific
questions call for your views on the filling in of bay bottoms for
new residential developments.
GOVERNOR: John, that is one of the matters that this
administration has been looking at Very carefully, and we have
made a number of changes in policies and procedures that I think
are helpful. First of all. we don't permit any filling at all
except within the bulkhead lines which have first been set by the
local governmental authority and then are approved by the State
Trustees of the Internal Improvement Fahd. That assures, first
of all, that we have an orderly development and then we don't
permit that filling unless the Board of Conservation has reviewed
the matter and agrees that this can be done without any significant
damage to marine life or fish life or anything of that kind. we
have to oe very concerned about this because fishing and marine
life generally are one of the great attractions for Florida and
we must preserve the areas in which these can be propagated. In
addition to this we receive by letter and some people send their
attorney or come up themselves and we always listen to them --
complaints from people about the notices that they have received
of proposed fillings. And whenever this is done we evaluate their
complaints to be sure that when a filling is accomplished that it
serves the public interest and does not do any unnecessary damage
to those people who live in the area.
QUESTION: In the handling of state-owned lands the
property is not necessarily bay-bottoms but other lands that are
held by the state. When you lease them or sell them is it your
thought that the state is receiving sufficient money for the worth
of this land?

GOVERNOR: No it isn't. We have been working on that
problem and have made some improvements.. Historically an appraisal
has been required for many land sales or the approach has been
taken, well. we sold some land near here for so much an acre last
year and therefore we will get that much this year. Or, well, this
seems like a fair bid this man has made so we will accept it. But
we don't do that anymore. First of all, we require an appraisal by
a qualified appraiser in the field and then if we are not satisfied
with that appraisal we send our own staff people out. We use
aerial photographs and, of course, the members of the Trustees and
the Board of Education/:3: most of this lend themselves, have a wide
knowledge of economic conditions and land values in Florida. and
among the five of us that are sitting around the table there, we
usually have one or more of us that is familiar with the particular
piece of property involved. And all of these things go to assist
us in arriving at a value that is consistent with our interests.
QUESTION: Governor, it is popular to speak and write
about protecting the public interest in land matters as well as
in other Cabinet level actions. We have a correspondent who wonders
what you define as public interest when you approach these problems?
GOVERNOR: Well. I have never worked out philosophically
Just what a 'publiu interest' is. I try, though, in sitting on
these problems or any problems that come before me, to identify
myself with the state's interests. If there is a piece of land
involved or whatever is involved, I try to approach it from s
standpoint of: "If this were mine, or if tnis were my problem. or
what would be my answer to it?". Of course, when you are dealing
with the state there are other considerations. That is to say,
there is that broad thing called the 'general welfare.I Then there
are considerations of mercy and humanity and Justice generally that
must be applied when you are dealing with a balance of power that
the state has which an individual does not have. But the effort
always is to see to it that the broad interest of the people of
Florida is served.
