The purpose of this bill is to clarify and strengthen the existing
Trades Practices Act (Chapter 653). which was passed by the 19? Ilorida
Legislature to comply with Public law 15 enacted by the united States Congress
on March 9. 1955.
in the present lav, through inastrtence. the words solicitor' and
"general agent' were omitted. The proposed bill corrects this oversight. and
also includes in the deiinition paragraph I'sel! insurance poole' and 'ssrvice
representatives.I in order to make the existing law comprehensive over the
several entities operating in the insurance business.
The proposed bill clarifies Section 6h3.ou(8)(b)(2) of the pro-ant
law. relating to allowance for direct premium payment of life insurance policies
on the industrial debit plan. by prescribing that such allowances shall be eet
out in the policy. The bill also adds new sub-section (10) dealing with Anti-
coercion. which provision is identical with the language of Section 25 of the
Agents' Qualification Bill (House Bill 26. Senate Bill 3). Other offenses
listed in the present law. and remaining unaffected by this bill. are: (l)
Misrepresentation and raise Advertising of Policy Contracts; (2) False Inform-
ation and Advertising Generally: (3) Defamation: (u) Boycott. Coercion and
lnti idation: (5) False financial Statements; (6) Stock Operations and Advisory
Board Contracts; (7) unfair Discrimination. and (8) Rebates.

penalty for wilful and knowing violation of the forbidden trades practices.
This is done by removing the present penalty 0! a mere cease and desist order.
and substituting the paseible penalty of revocation of a license of an agent.
or certificate cf authority of an insurance company. as the case may be.
This bill has the annroval and endorsement of the Life Ubderwritere
association; Accident and Health underwriters Association; General Agents: Stock
and Mutual Agents Associations. and the Insurance Department feels that this is
necessary legislation to protect the public interest against the practices con-
dsmned in the Act.
