A BILL TO BE ENTITLED
AN ACT RELATING TO THE BUSINESS OF INSURANCE, AND
PROHIBITING INSURANCE AGENTS AND SOLICITORS FROM USING
LICENSE AUTHORITY PRINCIPALLY TO SOLICIT, PROCURE OR
EFFECT INSURANCE UPON PROPERTY FOR WHICH SUCH AGENTS
0R SOLICITORS, 0R THEIR RELATIVES, EHPLOYERS OR
EHPOYEES ARE VENDOR, LIENOR, LIENEE OR MORTGAGEE:
PRESCRIBING PROCEDLRE FOR COMPLAINTS TO AND HEARING
BY THE STATE INSURANCE COHHISSIONER, AND FOR DENIAL
0R REVOCATION OF LICENSE FOR VIOLATION OF THIS ACT.
REPEALING ALL LAWS IN CONFLICT HERENITH, AND PROVIDING
AN EFFECTIVE DATE HEREUF.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF FLORIDA:
SECTION 1. The Legislature of the State of Florida finds that
the existence of certain practices in the insurance business in this
State are detrimental to the public interest and to the welfare and
security of the peoole of Florida, and tend to cause misunderstanding
and prejudice to the insuring public, and hardship to the insured not
fully informed concerning the effect and limitations resulting from
such practices. It is declared to be the policy of this Act, through
the exercise by the Legislature of its constitutional power, to
correct, and as soon as practicable to eliminate such practices,
without curtailing or impairing any presently existing insurance
contracts or policies heretofore lawfully made, and to that end,
hereby to vest necessary power and authority in the Insurance Commis-
sioner of the State of Florida to correct and eliminate such
practices.
SECTION 2. From and after the effective date of this Act. it
shall be unlawful for any insurance agent or solicitor, holding a
license under the insurance laws of the State of Florida, to use or
utilize the authority thereunder principally to procure, receive, or
forward applications for insurance of any kind, other than life,
health or accident; or to solicit, place or effect such insurance,
directly or indirectly,upon or in connection with prOperty for which
such agent or solicitor, or any relative, enployer or eaployee of such
agent or solicitor is or are vendor. lienor, lienee or mortgagee.
whenever the Insurance Commissioner of the State of Florida finds and
determines that the majority of insurance placed or effected annually
by any insurance agent or solicitor is of the foregoing nature. such
determination shall be deemed prima facie violation of this Act by
such agent or solicitor.
SECIIOS J. The Insurance Commissioner of the tate of Florida
may at any time upon his own motion, and shall upon the filing with
him of a written complaint signed by a citizen of the State of Florida,
inquire into any alleged violation of this law, and pursuant thereto
he shall conduct an investigation and hearing in the manner provided by
Chapter 627. Florida Statutes. If, upon such investigation and hearing.
such Insurance Commissioner determines that any insurance agent or
solicitor has violated any grovision of this Act, or determines that
any applicant for a license as such agent or solicitor has so applied
for the purpose of accomplishing the procuring, receiving, forwarding.
soliciting, placing or effectinn of insurance upon property herein
described, it shall thereupon be the mandatory duty of said Insurance
Commissioner forthwith to deny such application for license, or to
revoke or refuse to renew any license already issued, as the case may
be. Such denial or revocation of license shall be in addition to, and
not in lieu of. any other punishment or penalty prescribed by the laws
of the State of Florida.
SECTION 4. If any word, phrase, clause, or section of this Act
be held invalid or unenforceable by any court of competent jurisdiction,
the remainder of this Act shall nevertheless remain in full force and

SECTION 5. All Laws and parts of laws in conflict herewith are
hereby repealed.
SECTION 6. This Act shall take effect at 12:01 A.h. on October
lst. l953.
