Dear Farris:
You probably know that we represent Withlacoochee River
Electric C00perative, inc. one of sixteen rural electric cooper-
atives in Florida. For some time now, we have been involved in
litigation with Tampa Electric Company in which Tampa Electric
has sought to enjoin Withlacoochee River Electric Cooperative,
Inc. from serving two customers Just outside the City limits oi
Dade City. The Florida State Cooperative Association, Inc. has
been assisting us in the litigation and in that connection, have em-
ployed Mr. Lewis Hall, of Tallahassee, as co-counsel.
in the above mentioned litigation, Tampa Electric is attempt-
ing to use to its advantage Section 425. 04, (4), of the Florida Sta-
tutes, which states in part as follows:
"Provided, however, that no cooperative shall distribute
or sell any electricity, or electric energy to any person
residing within any town, city or area which person is
receiving adequate central station service or who at the
time of commencing such service. or otter to serve, by a
cooperative, is receiving adequate central station service
from any utility agency, privately or municipally owned
individual partnership or corporation. "
This section, of course, makes it ultra vires for a rural electric
cooperative to serve or offer to serve a person receiving electric
service from a private power company. There is no similar pro
vision in the Florida Statutes which prohibits private power com-
panies from serving or offering to serve persons receiving elect
ric service from a rural electric cooperative. This gives the
private power companies an unfair advantage over rural electric
cooperatives in the competition for customers in areas where both
the rural cooperatives and the private power companies are auth-

orized to serve.
An effort will be made at the next session of the Legis-
lature to either make the above mentioned prohibition which ap-
plies to rural electric cooperatives also apply to private power
companies and municipalities or to eliminate the quoted portion
oi the statute entirely. We expect that two bills will be intro-
duced; one to delete the above quoted portion of the statute and
the other to make it ultra vires {or a private power company or
municipality to serve or offer to serve persons receiving ade-
quate central station electric service from a rural electric co-
operative. Either bill would relieve the onerous situation which
now exists and which gives private power companies both a shield
and a sword to use against the rural electric cooperatives.
l have been requested to write this letter to you to iind out
what your attitude would be with regard to the two bills which the
cooperatives will seek to get passed in the next session oi the Le-
gislature. This, oi course, assumes that you will be Governor of
Florida at that time, which I sincerely hope will be the case.
I am sending a copy at this letter to Mr. Erie W. McGough,
Vice-President and Manager of Withlacoochee River Electric Co
operative, Inc. .
