Dear Farris:
I have your recent memo transmitting a copy of Freds
letter regarding the Expressway program.
I think it is pretty well conceded by many reasonably
informed local citizens that the Authority has embarked
upon what can properly be characterized as a crash program,
motivated, at least in party. by the forthcoming change in
the administration. I feel too that many of the local
citizenry are of the opinion that at least a part of the
speed with which it is being pursued is intended to
personally benefit certain individuals now connected with
the program who might not reasonably be expected to have
their association continued after the first of the year.
This conclusion has surely been fortified by the public
disclosure of a contractual relation with the present
attorneys calling for their continued participation until
completion of the proposed new bond issue.
On the other hand. the Authority has admittedly done
a good Job in the past and results of their labors have
unquestionably produced one of the finest public improve-
ments which this area has ever acquired. Consequently. I
feel that in any new or extended program emanating from
their offices they are initially. at least. entitled to
a presumption that their continued efforts will likewise
be productive for the public good.
This conclusion is, I think. justified by the fact
that the proposed improvements are already needed and
are to be located within an area of the county of rapidly

increasing growth. It is, of course, true that there
has been considerably more publicity and perhaps more
need indicated for the rebuilding of the Riverside viaduct:
however, the unlikelihood of being able to establish a
new toll facility in that area (unless the city fathers
should waive their objection to restoring tolls on the
Acosta Bridge) appears to render it improbable that the
Expressway people will undertake that particular problem.
Local sentiment appears to paint simply toward continuing
to seek State Road Department assumption of that program.
Also, it is generally speaking. a desirable thing to
acquire new public improvements as expeditiously as a
reasonable and efficient completion of a program will
permit. The public presumably. therefore. would be served
best by not having this program slowed down until and un
less some good cause should arise. It, of course, might
be of personal benefit to certain local individuals (even
including us) for this program to be deferred until your
administration. but nevertheless present circumstances
applicable to the public generally do not warrant any
interference in my own humble judgment.
I do strongly believe. however, that continued care-
ful attention should be directed toward developments.
Specifically, it is my understanding that the proposed
financing calls for a pledge by the county of the gas tax
money and I also understand informally that County Com-
missioners Burnett, Hammond and Mallard are opposed'b
the giving of this pledge. If this is true, it may
ultimately be resolved in at least one of two ways. The
situation may simply be put in abeyance until three new
Commissioners succeed on the first of the year to the posts
presently held by the above named three. At least two of
the incoming three are much more friendly toward the legal
firm representing the Expressway. and this conceivably may
have some effect. Alternatively. I have heard that the
Authority may seek to avoid the necessity of a validation
which I assume would contemplate a completely negotiated
sale.
It occurs to me that this latter procedure, if pur-
sued. would definitely suggest bad faith as far as the

public good was concerned. I would think that there would
be an increased reluctance on the part of investors to
buy the bonds under such circumstances and there is every
reason to believe that such procedure would bring about an
increased interest rate. I am aware that there are juris-
dictions in which validation is not required and in which
bonds are purchased without benefit thereof: but that
appears to me to be considerably different from the
situation existing here where validation is provided for
by law and is almost always customary, particularly in
issues of any substantial amount.
Summarily. therefore. it is my thought that it is
premature for you to take any action at this time other
than that which will be directed toward keeping you well
informed. Should subsequent events begin to point more
concretely toward a course of action which reflects a lack
of concern for the public interests, then I am sure you
will agree that appropriate means should be utilized to
prevent such happening. In such event our State Senator
could perhaps provide very effective assistance.
50 that there can be no possible misconception of the
foregoing. I want you to also be aware of the fact that it
is my understanding that the arrangement whereby this firm
joined with Mr. Trimble in issuing an opinion on the validity
of the prior issue is again possible (but not assured so
far as our participation is concerned) on the forthcoming
issue. However. since I perhaps optimistically feel that
our situation, whatever it might be. would not be adversely
affected under your administration, I assume you will
recognize that there can be no personal motivation in my
recommending for the time against any interference with
the program.
