BUDGET SESSION
Budget Session of the House of Assembly will be held at the Assembly Cham-
ber on Thursday, 5th February, 1970 at 10.00 a.m. when the Honourable
Premier and Minister of Finance will deliver his budget address.
A cordial invitation is extended to the general public to attend this function
subject to the following arrangements for seating and standing accommodation.
The general public is hereby notified that approximately 300 chairs will be
available in the Council Chamber proper for accommodation of members of the
Kingstown Town Board, the Chairmen of small Town Boards, and Village Coun-
cils, Senior Civil Servants, the Clergy, other persons prominent in the life of
the community, and the general public. Special seating accommodation will be
arranged for the wives of the members of the House.
Unfortunately there will only be limited standing space available.

NOTICE
SATURDAY HALF HOLIDAY
On the 29th November last it was an-
nounced in a radio release, that Govern-
ment had decided to postpone the intro-
duction of the change of the half holiday
from Wednesday to Saturday for the
Business places, so that further consid-
eration could be given to representation
made by individuals and other organisa-
tions.
Cabinet at a meeting held on Thursday
15th January, 1970, gave very careful
thought to the matter, taking into ac-
count the different views expressed, and
has now decided to introduce the change
for a trial period of three months start-
ing from 15th February, 1970, during
which time the merchants and other per-
sons concerned will be better able to as-
sess how the changeover affects their
business and other activities.

INCOME TAX NOTICES
TO THE GENERAL PUBLIC
ticular attention is directed to the fact
that the term "income" is deemed to
inclh:de not only money but also allow-
ances in kind.
3. Efforts are being made to send
forrn to such persons. It is to be clearly
understood, however, that the Income
Tax Department is under no obligation
to send a return form to anyone and that
a person is not exonerated from the
statutory liability of making a return
even though a form may not have been
received from the Department. Forms
may be obtained, on application, at the
Revenue Offices at Georgetown, Barrou-
allie, Bequia and Union Island, or in
any other district from the Police Sta-
tion situate therein or from the Income
Tax Department, Kingstown, where any
person requiring information in connec-
tion therewith is invited to enquire.
4. The form correctly completed
should be accompanied by all necessary
Statements. Specimens of the form of
account required from small traders and
from occupiers or cultivators of land will
be supplied on request.

Every person, not being an employed
person, is hereby reminded that the
latest date for the submission of Income
Tax Returns for assessment in the year
1970 is the 31st March, 1970, and that
failure to give notice of chargeability is
an offence against the Income Tax Ordi-
nance rendering the person concerned
liable on summary conviction to a penalty
not exceeding ONE THOUSAND DOL-
LARS and in default of payment to im-
prisonment with or without hard labour
for a term not exceeding four months,
and after judgement has been given for
that penalty to a further penalty of fifty
dollars for every day during which the
refusal, failure or neglect to render any
document continues.
2. EVERY PERSON whose income ac-
cruing in, derived from the Colony or
elsewhere and whether received in the
Colony or not for the preceding year,
exceeded the statutory limit of $600.00 is
required to submit a return in the pre-

Be it enacted by the Queen's Most Excellent Majesty, by
and with the advice and consent of the House of Assembly o'
faint Vincent, and by the authority of the same as follows.-
1. This Act may be cited as the Prisons Ordinance, 1967 Short title.
Declaratory Act, 1969. No. 30 of 1967.
2. For the removal of doubt, it is hereby declared always Declaratory
to have been the law that the definitions of "Visiting justice" provision
and "young, prisoner" have formed part of section 2 of the regarding
Prisons Ordinance, 1967, anid that the said definitions continue the Prisons
to form part of the said section 2 of the Prisons Ordinance, Ordinance,
1967. 1967.

AN ACT to provide for the protection and control of the quality
of bananas and for matters connected therewith.
[ On Proclamation. ]
Be it enacted by the Queen's Most Excellent Majesty, by and
with the advice and consent of the House of Assembly of Saint
Vincent, and by the authority of the same as follows:-
1. This Act may be cited as the Banana (Protection and Short title.
Quality Control) Act, 1969.
2. This Act shall come into operation on such day as the
Governor may appoint by proclamation published in the Gazette.
3. In this Act unless the context otherwise requires-
"Authority" means Winban;
"bananas" means bananas of the varieties of or known as
robusta, puerto rique, poyo, lacatan, and such other
varieties as may be prescribed;
"Buying Companies" means Geest Industries Limited-a
company duly incorporated under the laws of the
United Kingdom and Geest Industries (W.I.) Limited-a
company duly incorporated under the Commercial Code
of the State of Saint Lucia;
Limited-a company duly incorporated under the Com-
mercial Code of the State of Saint Lucia;
"Committee" means the Banana (Protection and Quality
Control) Committee established under this Act;

"cutting period" means the period commencing not more
than 36 hours before the announced end of a reception
-period and ending with the end of the reception period;
"exportable bananas" means bananas which have been
reaped or harvested from a holding during a cutting
period and which are not rejectable bananas;
"grower" means a person for the time being in possession or
control of a holding;
"holding" means any parcel of land on which bananas are
grown for export and which is registered as a holding
under the Windward Islands Banana Insurance Ordin-
ance, 1968;
"Local Authority" means the Saint Vincent Banana Growers
Association-a body corporate established under the
Banana Growers Association Ordinance, 1954;
"Member Associations" means the members of Winban;
"Reception Period" means the period from time to time pub-
licly announced or advertised by or for and on behalf
of the Local Authority, the Authority or the Buying
Companies for the delivery of bananas to the Local
Authority or to the Buying Companies;
"reception stations" means the Buying Companies' depots at
which bananas are delivered to the Buying Companies;
"stale bananas" means bananas which have been reaped or
harvested before a cutting period;
"rejectable bananas" means stale bananas or bananas which
are rejectable under regulations made under this Act;
"vehicle" means any truck or other means of conveyance
used during the cutting period in the carriage of bananas
to a private wrapping shed, a buying point shed or a
reception station;
"Winban" means The Windward Islands Banana Growers
Association-a company incorporated under the Laws of
the State of Dominica.
4. Winban is hereby declared and established to be the Banana
(Protection and Quality Control) Authority and as such the
Authority for the purposes of this Act.
5. (5) It shall be the duty and function of the Authority-
(a) to administer and carry out the provisions of this Act;
and
(b) to make recommendations to the Government of
Saint Vincent in regard to all measures necessary for
the better carrying out of the purposes of this Act.

Banana (Protection and Quality Control).
(2) The Authority may, from time to time, delegate any or
all of its functions to the Local Authority.
6. (1) For the purposes of this Act, there is hereby estab-
lished a Committee to be known as the Banana (Protection and
Quality Control) Committee.
(2) The Committee shall comprise:-
(i) The Manager or secretary of the Local Authority;
(ii) two nominees of the Board of Directors of the
Local Authority;
(iii) The Manager or a nominee of the Buying Com-
pany in Saint Vincent;
(iv) a nominee of the Department of Agriculture of
Saint Vincent;
(v) the General Manager of Winban;
(vi) Winban's Director of Research.
(3) The functions of the Committee shall be to advise the
Authority in regard to all matters within the scope and object
of this Act.
7. (1) During a reception period rejectable bananas shall
not be offered for sale to the Local Authority or its agents of to
the Buying Companies or their agents and any such offer shall
be rejected by the Local Authority or its agents or by the Buying
Companies or their agents respectively.
(2) During a cutting period and within twenty-four hours
before the commencement thereof, the Authority or the Local
Authority (or its duly authorised agents) shall have the right
to mark or otherwise identify any stale or other rejectable
bananas belonging to a grower wherever such bananas may be.
(3) For the purpose of the exercise of the powers conferred
upon it by subsection (2) of this section, the Authority, the Local
Authority or its duly authorised agents shall have the right
assisted by a public officer to enter upon any place at any time
during the cutting period or within twenty-four hours before the
commencement thereof.
(4) Any grower who sells or offers for sale to the Local
Authority or its agents or to the Buying Companies or their
agents during the reception period any bananas knowing the
same to be rejectable bananas, shall be guilty of an offence and
shall be liable on summary conviction to a fine not exceeding
two hundred dollars.
(5) Any agent of the Local Authority or of the Buying
Companies who purchases during the reception period, 'ary
bananas knowing the same to be rejectable bananas, shall be
guilty of an offence and shall be liable on summary conviction

8. (1) All exportable bananas shall be wrapped, stacked,
handled and otherwise dealt with in the prescribed manner and
shall be carried in the prescribed manner only in trucks or other
vehicles which comply with the prescribed trucking requirements:
Provided that the Authority may, in the interest of re-
search or with the object of devising and testing new and im-
proved methods of handling bananas, by licence under its common
seal exempt any grower, research officer or other person from
the provisions of this section for the period specified in such
licence, and in that event the provisions of this section shall not
apply to such grower, research officer or other person during that
period.
(2) Any person who contravenes any of the provisions of
subsection (1) of this section shall be guilty of an offence and
shall be liable on summary conviction to a fine not exceeding
two hundred dollars.
9. (1) Upon application to the Authority by any grower
whose holding qualifies in the prescribed respects or by any
dealer, the authority may grant a licence to such grower or
dealer to operate a private wrapping shed on such holding.
(2) Any licence granted under the provisions of this section
may be revoked by the Authority if the grower's holding ceases
to be qualified in the prescribed manner.
(3) During the cutting period, and within twenty-four
hours before the commencement thereof, the Authority or the
Local Authority shall have the right to enter upon any private
wrapping shed for the purpose of examining the condition of
such shed or for the purpose of examining and rejecting any
bananas received threat.
10. (1) It shall be the duty of every member of the Police
Force which expression shall include Rural Constables to assist
the Authority, the Local Authority and their servants and agents
in the enforcement of the provisions of this Act.
(2) Any person who obstructs, hinders molests or assaults
any member of the Police Force or the servant or agent of the
Authority or Local Authority engaged in the performance of any
duty or. the exercise of any power imposed or conferred on him
by or under any provision of this Act shall be guilty of an offence
and shall be liable on summary conviction to a fine not exceeding
two hundred dollars or to imprisonment with or without hard
labour for a term not exceeding four months.
(3) No action, suit prosecution or other proceedings shall
be brought or instituted against the Authority or the Local

(2) Regulations made by the Authority shall have no effect
until approved by the Governor and when so approved, shall
come into force on such date as may be specified in such Regu-
lations, and as from such date, such Regulations shall have
the same force and effect as if they were contained in and formed
part of this Act:
Provided that until varied or revoked by any such Regula-
tions, the Regulations contained in the Schedule to this Act
shall be in force.
SCHEDULE
(Section 12 (2)).
BANANA (PROTECTION AND QUALITY CONTROL) REGULATIONS.
1. Short title. These Regulations may be cited as the Banana (Protection
and Quality Control) Regulations, 1969.
2. Interpretation. In these Regulations, unless the context otherwise re-

"the Act" means the Banana (Protection and Quality Control) Act, 1969;
"bunch" means a bunch of bananas;
"bruise" in relation to a banana means a permanent mark or indent more
than one quarter of a square inch in area and which has been caused
by the banana coming into contact with an object;
"damaged" in relation to a bunch means having a finger which is broken,
bruised, sun-scorched or ruptured;
"scar" means a cured bruise.
3. Wrapping, stacking and handling of bananas before acceptance thereof
at a private wrapping shed or buying point, (1) Every bunch shall. at or imme-

diately after the harvesting thereof be wrapped in a half-inch foam rubber sheet
or protected by any other means approved of by the Authority.
(2) The harvested bunch wrapped or protected as aforesaid shall be carried
on padded trays designed by the Authority to a private wrapping shed or a buying
point operated by the Local Authority or a boxing plant.
(3) If it is necessary to stack any bananas on the ground before loading
the same unto a vehicle, such banana shall be stacked wrapped in a half-inch
foam rubber sheet on a one-inch foam rubber sheed placed on the ground or
in such other method as may be approved by the Authority.
(4) Stacked bananas shall be protected from the sun by methods approved
of by the Authority.
(5) No banana shall be loaded unto any vehicle unless such banana shall
have been wrapped and stacked as hereinbefore provided.
(6) If it is necessary to stack bananas outside a wrapping shed or buying
point before such bananas have been accepted for wrapping and sleeping, then
unless otherwise approved by the Authority-
(i) the bananas shall be stacked in the shade and protected from the sun
and shall be stacked in foam rubber wrappers on one-inch foam rubber
sheets;
(ii) after the removal of the foam rubber wrappers, the bananas shall be
stacked on one-inch foam rubber sheets, and a half-inch foam rubber
sheet shall be placed between each layer of bananas.
(7) Bananas shall not be stacked as aforesaid to a height in excess of
four layers.
4. Private wrapping sheds. (1)The qualifications for a licence to operate
a private wrapping shed are as follows:-
(a) in the case of a grower, his holding must be productive of not less
than an average of one hundred bunches per week;
(b) in the case of a dealer, he must have delivered to the Local Authority
an average of not less than one hundred bunches per cutting.
(2) The site for the erection of a private wrapping shed must be accessible
to vehicles.
(3) Every private wrapping shed shall be covered with water-proof roofing
material and must be large enough to accommodate the wrapping and stacking
of bananas.
(4) Every private wrapping shed shall be maintained in a sanitary con-
dition and after each shipment, all trash, stalks, rejected bunches and hands,
shall be removed from the shed and tne vicinity thereof.
(5) The sides of a private wrapping shed which come or may come into
contact with wrapped bunches shall be padded with half-inch thick foam rubber
or other material approved of by the Authority.
5. Handling of bananas in wrapping sheds. (1) While being wrapped, every
bunch shall be suspended by a stout cord attached to the stalk with a slip noose
which can be easily drawn tight.

(2) The bunch shall be wrapped with cellulose paper and sleeved in dio-
thene tubing.
(3) The cellulose paper shall be placed around the banana and shall be
secured in a manner approved of by the Authority.
(4) An adequate amount of cellulose paper shall be left at the top (small
end) of the banana to ensure that the paper can be well tucked in so as to provide
a good pad for the top hand of the banana.
(5) The diothene tubing shall be gathered around the top (small end) of
the banana and shall be taped.
(6) When the top (small end) of the banana has been secured, the dio-
thene tubing shall be pulled down firmly over the bunch to ensure a firm compact
package and shall be taped.
(7) Immediately after being wrapped and sleeved, the bananas shall be
carried to the reception station, but if it is impossible to do so then, and the
wrapped and sleeved bunches have to be stacked in the wrapping shed, the same
shall be stacked off one-inch foam rubber sheeting.
6. Vehicle requirements. (1) The body and framework of every vehicle shall
be rigid.
(2) There shall be no projections such as uprights, or other unauthorized
fixtures in the body of any vehicle.
(3) Such sides of every vehicle as may come in contact with the foam
rubber padding shall be close boarded.
(4) (a) The sides of every vehicle shall be padded with one and a half-inch
foam rubber sheeting or other material approved of by the Authority.
(b) The floor of the body of every vehicle shall be padded with two-inch
foam rubber sheeting or other material approved of by the Authority.
(c) Tie beams to hold the sides of truck boxes rigid shall be constructed
of solid material such as piping, iron rods or wood. Rope or wire must not be used.
(5) Every vehicle shall be equipped with a removable tail board which shall
be padded on the inner surface in a similar manner to the sides of the vehicle,
shall be of a minimum height two feet six inches from the floor of the box of
the vehicle and shall be rigid when in position.
(6) The floor of the box of every vehicle shall protrude at least eighteen
inches beyond the tail board at the rear of the vehicle so as to serve as a platform
for footman riding on the vehicle.
(7) Every vehicle shall be equipped with a "trouble light" for the safe
loading of bananas at night.
(8) Every vehicle shall carry a serviceable tarpaulin which shall be secured
over the box and at all sides of the vehicle, and which shall be of sufficient size
to cover and protect the bananas in the truck from rain and the sun.
7. Carriage of bananas. (1) No banana shall be carried to the reception
station unless such banana has been duly wrapped and sleeved at a duly licensed

private wrapping shed or at a buying point shed operated by the Local Authority.
(2) Bananas shall be carefully packed in layers in the padded body of the
vehicle with a sheet of half-inch foam rubber between each layer of bunches.
(3) Unless otherwise approved of by the Authority the maximum height
of the packing of bananas in a vehicle shall be eight tiers.
(4) No article (other than those specifically approved of by the Authority
for the protection of bananas) shall be placed on any banana being carried to
private wrapping sheds, buying points and reception stations.
(5) Bananas shall be carried in vehicles with due care and attention having
regard to the conditions of the road, and in no case shall the vehicle be driven
at more than twenty miles per hour.
(6) Only .able-bodied persons of sufficient physique shall be engaged as
footmen to load or unload bananas-unto or from a vehicle.
(7) No more than five persons (including the driver and footmen) shall
ride or be permitted to ride on a vehicle and no more than three such footmen
shall ride or be permitted to ride on the platform reserves for this purpose at
the rear of the body of the vehicle.
8. Handling of bananas at reception stations. (1) Bananas shall be stacked
at reception stations on foam rubber sheets in the same manner as they are by
these regulations required to be stacked at private wrapping sheds.
(2) The heading of bananas to the ship's hold and to conveyor belts shall
be effected by the use of padded trays or by other methods approved of by the
Authority and in such manner as would eliminate any possible damage to the
bananas.
(3) Bananas shall be stacked in ships' holds in such manner as in the
opinion of the Authority would eliminate the possibility of damage to the bananas.
9. Rejectable bananas. A banana is rejectable:-
(i) if the broken, cracked or bruised fingers on the sides of the top or
bottom hands thereof having been removed, the wounds are not
treated with an approved chemical or there remain less than eight
good fully developed fingers therein; or
(ii) if fingers in the centre of a top or bottom hand thereof having been
damaged, the whole hand is not removed and the cut treated with
an approved chemical; or
(iii) if more than two fingers in the sides of a hand between the top
and bottom hands thereof are damaged, or if one or two such fingers
thereof having been removed by cutting, injury is done to the
adjoining hands or the wounds are not treated with an approved
chemical, or if there were damaged fingers in more than two such
centre hands; or
(iv) if two or more fingers in the middle of a centre hand or hands
thereof have been partially eaten by a bird, rat or other creature; or
(v) if the banana has more than three bruises in any part thereof

other than on the top or bottom hands which are by these regula-
tions permitted to be removed; or
(vi) if the banana has been scorched by the sun before or after being cut
from the plant; or
(vii) if the banana has a cracked or broken stalk which cannot be
removed by trimming; or
(viii) if on any part thereof (other than on the top or bottom hands
which are by these regulations permitted to be removed) the banana
has scars or marks which may have been caused by insects, lizards,
rubbing branches, leaves or other agents and which render the
banana unsightly; or
(ix) if the banana is marked with multiple spots; or
(x) if any part thereof (other than the top or bottom hands which are
by these regulations permitted to be removed) is stained with latex
or spray material or is dirty with earth or mud; or
(xi) if the banana is scorched by spray material; or
(xii) if the banana has been wet or sprayed by sea water and has not
immediately thereafter been well washed in fresh water;
(xiii) if the banana is diseased;
(xiv) if the banana is not of the approved marketable grade; or
(xv) if the banana weighs less than the approved minimum weight.

AN ACT respecting the imposition or variation of taxation by
statutory instruments for the purpose of the provisional col-
lection of taxes.

Be it enacted by the Queen's Most Excellent Majesty, by and
with the advice and consent of the House of Assembly of Saint
Vincent, and by the authority of the same as follows:-
1. This Act may be cited as the Provisional Collection of
Taxes Act, 1970.
2. (1) In this Act-
"existing tax", means all taxes and all manner of taxes
imposed by any enactment whether in force before or
after the commencement of this Act;
"tax", includes assessments, fees, charges, impositions and
such other levies as form part or are intended to
form part of the general revenue.
(2) In this Act expressions referring to the imposition of a
tax shall be read as referring to the imposition of a new tax.
3. (1) Subject to the provisions of this Act, where proposals
for general or supplementary appropriation of public funds are
made to the House of Assembly and are embodied in an appropri-
ation or supplementary appropriation Bill, as the case may be,
the Governor may, for the purpose of raising revenue to meet

the expenditure specified in any such Bill, by Order, provide for
the imposition of any tax or the variation of any existing tax,
and from the date of the publication of such Order in the Gazette
(hereinafter referred to as "the commencement of the Order")
the tax as imposed or varied by such Order shall be payable.
t2) In the case of the imposition of any tax under subsec-
tion (1) the Order shall, subject to the provisions of this Act, have
effect for a period expiring at the end of four months after the
commencement of the Order.
(3) An Order or any provision of an Order imposing a tax
shall cease to have effect if an Act comes into operation imposing,
with or without modifications, any such tax.
(4) Where any provision in an Order imposing a tax is
omitted from a Bill or if included in a Bill is rejected during the
passage of the Bill through the House, the corresponding provi-
sion of the Order shall cease to have effect.
(5) An Order varying an existing tax shall cease to have
effect if the Order is not confirmed, with or without modifications,
by a resolution agreed to by the House within the next twenty-one
days after the commencement of -the Order, and where any provi-
sion of the Order is deleted by the resolution that provision shall
cease to have effect.
Cases where 4. (1) Where, under subsections (4) and (5), an Order or
tax unauthorised any provision thereof ceases to have effect, or the period limited
and repayable, by subsection (2) of section 3 terminates before the Act comes
into operation imposing the tax, any money paid in pursuance of
the Order or such provision shall be deemed to be an unautho-
rised payment or deduction.
(2) Where the tax as imposed or varied by the Order is
modified by the Act imposing the tax, or by the resolution con-
firming the Order, as the case may be, any money which has been
paid in pursuance of the Order, which would not have been pay-
able under the new conditions affecting the tax, shall be repaid
or made good, and any payment or deduction made in pursuance
of the Order shall, so far as it would not have been authorised
under the new conditions affecting the tax, be deemed to be an
unauthorised payment or deduction.
Content of 5. An Order under section 3 imposing or varying any tax
Order. may contain such conditions affecting the tax as are appropriate
for the purpose of the imposition and collection of the tax as so
imposed or varied.
Construction. 6. Nothing in this Act shall be construed as affecting
powers of the House of Assembly or the Governor under any
enactment to impose or vary any tax.

Ordinance (Cap. 182) is hereby repealed.

WHEREAS by Section 7 of the Bank Holidays Ordinance, Cap. 161, it is enacted
that It shall be lawful for the Governor from time to time by Proclamation in
the Gazette, to appoint a special day to be observed as a Bank Holiday throughout
Saint Vincent.
Now THEREFORE, I Hywel George, Governor of Saint Vincent, do in accordance
with the advice of the Cabinet, and pursuant to the authority vested in me by the
said Ordinance, hereby appoint Tuesday the 10th day of February, 1970, to be
observed as a Bank Holiday throughout Saint Vincent.
