RESIDENCE IN ST. VINCENT FOR
BRITISH SUBJECTS FROM ABROAD
HAVING A RIGHT OR INTEREST
IN PROPERTY.
The Administrator regrets that the
circular issued by his Office on the sub-
ject of permanent residence for British
Subjects having an interest in land or
property in St. Vincent did not make
it clear that it represented no new
policy or decision but merely set out the
legal position as it has stood for several
years.
Some confusion has also arisen over
the words "belong to St. Vincent".
Under Section 2(2) (b) of the Immi-
gration (Restriction) Ordinance, 1939,
a person is deemed to belong to St. Vin-
cent if he is a British subject and:
(i) Was born in St. Vincent or of
parents who at the time of his
birth were ordinarily resident
in St. Vincent.
(ii) Has been ordinarily resident
in St. Vincent continuously for
a period of seven years or more.
(iii) Obtained the status of a Brit-
ish Subject by reason of the
grant by the Governor of a
Certificate of Naturalization
under the British Nationality
and Status of Aliens Act, 1914.
(iv) Is the wife of a person to
whom any of. the foregoing
categories applies not living
apart from such person under
a decree of a competent court
or a deed of separation.
(v) Is a child, -stpchild or adopted
child having been adopted in
a manner recognized by law,
under the age of 16 years, of
a person to whom any of the
foregoing categories applies.
Persons in these categories have un-
disputed right of entry into St. Vincent.

AWARD OF A SCHOLARSHIP TENABLE
AT THE EASTERN CARIBBEAN FARM
INSTITUTE TRINIDAD
Applications are invited for suitably
qualified candidates for the award of
a scholarship to the Eastern Caribbean
Farm Institute Forestry School in
Trinidad, opening in September, 1967.
Applicants should have at least Chem-
istry, Botany or Biology, Mathematics
and English at ordinary level and
preferably at advanced level of G.C.E.
The successful candidate will be re-
quired to enter into a bond with the
Government of St. Vincent to serve for
a stated period on his return.
Further information may be obtained
from the Chief Technical Officer, Min-
istry for Trade, Production, Labour and
Tourism, Murray Road, Kingstown.

paragraph 2 has been amended to per-
mit candidates who will be over the age
of 13 years 6 months on 30th Septem-
ber, 1967 to sit the examination for
entrance to the St. Vincent Grammar
School and Girls' High School. Candi-
dates should not be less than 10 years

This is an appeal from the decision of the Magistrate in which he entered
judgement for the respondent in a claim for damages arising out of a motor
accident. The Magistrate held thal the accident resulted from defects in the
car which were unknown to the respondent and thaL the appellant had not
discharged the burden of proof placed upon him after the respondent gave a
reasonable explanation of the accident.
The facts show that the respondent was driving his taxi from Questelles
to Kingstown. The appellant was a passenger in the car and on reaching a
steep hill known as Gibson's Corner the respondent was driving fast and at-
tempted to change the gear. He was unable to do this effectively and he lost
control. The car mounted a bank and the appellant was injured. The
respondent said, "The accident was at Gibson's Corner down hill. I applied
my brakes, no brakes. I did my best by banking the car as I was going down
a steep hill. I did not think I could have stopped without banking." That is
all the evidence he gave in regard to the accident. On this evidence the Magis-
trate found the accident was caused by latent defects in the car and the defend-
ant was not liable.
Counsel for the appellant contended that there was insufficient evidence
for the Magistrate to come to this conclusion and that the respondent had not
discharged the burden cast on him of the presumption of negligence on his part.
Counsel for the respondent, on the other hand, submitted that there were suffi-
cient facts for the Magistrate to come to the conclusion that the cause of the
accident was latent defects in the car.
In our view the mere statement "I had no brakes" is a neutral event con-
sistent, and equally consistent, with negligence or due diligence on the part of
the defendant. To displace the presumption of negligence the defendant must
go further and prove, or it must emerge from the evidence, the specific cause
of the failure of the brakes. If the statement, "I applied brakes, no brakes"
were a defence, then all a motorist would have to do to escape damages for his
negligence would be to say, "I had no brakes." He must go further and prove
that he exercised due diligence in the driving of his car and equal diligence in
the maintenance and use of his vehicle and that negligence was not a probable
cause of the accident.
In Moore V R Fox (1956) 1 ALL E.R. 182 the Court of Appeal approved
the dictum of Asquith L.J., as follows, in Barkway V South Wales Transport
(1948) 2 ALL E.R. 460:
(i) If the defendant's omnibus leaves the road and falls down an embark-
ment, and this without more is proved, then res ipsa loquitur, there
is a presumption that the event is caused by negligence on the part
of defendants, and plaintiff succeeds unless defendants can rebut this
presumption;
(ii) it is no rebuttal for defendants to show, again without more, that the
immediate cause of the the omnibus leaving the road is a tyre burst,
since a tyre burst per se is a neutral event consistent, and equally
consistent, with negligence or due diligence on the part of defendants.

When a balance has been tilted one way, you cannot redress it by
adding an equal weight to each scale.
(ii) To displace the presumption, defendants must go further and prove
(or it must emerge from the evidence as a whole) either
(a) that the burst itself was due to a specific cause which does not
connote negligence on their part but points to its absence as.
more probable, or
(b) if they can point to no such cause, that they used all reason-
able care in and about the management of their tyres:"
Applying the principle laid down in the Barkway case, we have come to the
conclusion that the mere statement, "I applied my brakes, no brakes" is not
sufficient to displace the presumption of negligence on the part of the respond-
ent in this case. The statement, "I had no brakes" is equal to saying, "My
tyre burst" or "I had a skid". These statements are not defences in actions
for negligence and do not, in our view, rebut the presumption of negligence.
For these reasons the appeal must be allowed and judgment entered for the
plaintiff. The order of the Court is that the case be remitted to the Magistrate
with the direction that judgment be entered for the plaintiff and that the,
damages be assessed.

Kingdom coins in the near future in
all the territories served by the East
Caribbean Currency Authority (viz.,
Antigua, Barbados, Dominica, Mont-
serrat, St. Christopher-Nevis-Anguilla,
St. Lucia and St. Vincent) and such
coins will then no longer be legal tender
in these territories.
Banks have been informed of the in-
tention to demonetise United Kingdom
coins. Free exchange of such coins will
not be undertaken after demonetisation.

BANK OF ENGLAND NOTES
Five Pound Notes of the B Series,
bearing a Portrait of Brittania and pre-
dominately blue in colour, issued during
the years 1957 to 1963 will not be Legal
Tender after 26th June, 1967.
They will still be exchangeable after-
that date at the Head Office of the Bank
of England, but the Bank cannot under-
take to exchange Notes through the
medium of the Post.
The Public are advised to make-
arran gments for any of these Notes in
their possession to be paid into a Bank
Account without delay.
