No. 491.
GENERAL DIRECTIONS ON PROCEDURE UNDER THE MINISTERIAL
SYSTEM.
The following General Directions on Procedure under the Ministerial System,
which were made on the direction of the Secretary of State for the Colonies, and
have been in operation since 8th March, 1956, when the Ministerial System was
instituted, are published for information of the general public:-
The directions which are issued under the authority of the Governor will
be subject to review in the light of experience.
1. MINISTERS:
(1) Functions
Each Minister will be responsible for:-
(a) the general direction of the Departments under his Ministry;
(b) the submission to the Executive Council of policy proposals or any
other important proposals affecting his Ministry;
(c) the execution of decisions reached by the Executive Council in so
far as they affect his Ministry;
(d) ensuring that no expenditure is incurred by Departments under
his Ministry which has not been sanctioned by the Legislature and,
where his prior assent is required, by the Secretary of State;
(e) dealing with matters affecting his Ministry in the Legislative Coun-
cil;
(f) dealing with individuals and public bodies on matters affecting his
Ministry.
(2) Relations between the Governor and the Ministers
(a) Ministers have the right of direct access to the Governor, and the
Governor will be glad to have discussions with them at any time
by appointment arranged through the Private Secretary.
(b) Written communications made to the Governor by or on behalf
of Ministers should be addressed to His Excellency and forwarded
to the Chief Secretary for transmission to the Governor.

(3) Relations between the Ministers and the Administrator
The Administraotr will continue to preside over the Executive Coun-
cil in the absence of the Governor; he will be responsible to the Governor,
inter alia, for internal security, labour relations, information and the
Public Service. In all these capacities the exercise of his functions will
necessitate the closest consultation and co-ordination with the Ministers.
(4) Relations between the Ministers and their Principal Assistant Secretaries.
The Principal Assistant Secretary will be responsible for seeing that
all matters requiring the attention of the Minister are submitted to him
promptly, with all relevant documentation and technical advice. He will
be responsible for conveying the Minister's decisions to the proper quar-
ters and will keep the Minister informed of the progress made in carrying
out his policy.
The Principal Assistant Secretary will be responsible for conducting
the Minister's correspondence with Government Departments and the
public, and for drafting Ministerial submissions to the Executive Council
or the Governor.
It will be the duty of the Principal Assistant Secretary to ensure
that all proposals involving establishment or financial considerations are
seen by the Administrator or the Financial Secretary before submission
to the Executive Council.
In official letters the Principal Assistant Secretary will use the
expression "I am directed by the Minister" and will sign: "Principal
Assistant Secretary to the Ministry for . ".
(The Principal Assistant Secretary and other members of the Minis-
ter's official staff will not be called upon to deal with purely political
or party matters arising from the Minister's representative capacity
in his constituency.)
(5) Relations between the Ministers and the Heads of Departments.
(a) The Head of Department will be responsible to the Minister for the
administration of his Department and will act as adviser to the
Minister on professional or technical matters falling within the
scope of his Department. It will be the duty of the Head of Depart-
ment to keep the Minister fully informed, either directly or through
the Principal Assistant Secretary, of all the important activities
of the Department, and to execute such decisions of. policy as come
within the scope of the Department.
(b) The Head of Department will not take any action involving a change
of policy or the likelihood of public controversy without reference
to the Minister.
(c) The Head of Department will have the right of access to the Minister.
(d) If a Head of Department considers that the compliance with a
direction or decision of his Minister will have a seriously adverse
effect upon the work of his Department, he may request that a
statement of his views be referred by the Minister to the Executive
Council.
(e) It is not possible to lay down precisely what departmental matters
should or should not be the concern of the Minister; but in general
the Minister's business is to formulate departmental policy with
the advice of the Head of Department and the concurrence of the
Executive Council, and to assure himself that it is being carried out;
while leaving to the Head of Department the day-to-day administra-
tive responsibility for executing the policy.
(f) The normal channel of communication between the Minister and the
Head of Department will be through the Principal Assistant Secretary
to the Ministry. In correspondence with their Ministers, Heads of
Departments will follow the same procedure as has been previously
in force in regard to correspondence with the Administrator. Cor-
respondence should ordinarily be by typed memorandum, saving
telegram or minute, of which a copy will be retained in the appro-
priate file.
(g) Departments should continue to correspond direct with each other
on routine matters.
(6) Relations between Ministers
(a) General
Meetings of the Executive Council will provide a regular opportunity
for discussions between Ministers on matters of general policy, but
frequent consultations between the Ministers, the Administrator, the
Crown Attorney and the Financial Secretary will also be necessary
on matters of mutual concern. Ministers, Principal Assistant Secre-

taries and Heads of Departments will ensure that all officers for
whose supervision and direction they are responsible are mindful
of the importance of inter-Ministerial consultation and co-operation
at all levels.
(b) Financial Matters
Ministers and their Principal Assistant Secretaries will ensure that
no proposals involving expenditure from public funds for which
authority has not been given, are put to the Executive Council until
the comments of the Financial Secretary have been obtained and
recorded.
(7) Ministers and Executive Council
(a) The Executive Council is the Government's principal instrument
of policy. In addition to the large number of matters which must
be referred to it by law, the Executive Council will deal with:-
(a) all matters requiring policy decisions and all other matters of
importance;
(b) all proposals for new expenditure for which the sanction of the
Legislature has not yet been obtained;
(c) all matters involving the drafting of new legislation.
Under (a) the Ministers will submit to Executive Council all new
policy proposals. Ministers will also be expected to bring to the
Executive Council all proposals which may give rise to public oppo-
sition or controversy even though such proposals are within lines
of policy previously agreed.
(b) Responsibility of Ministers for Executive Council decisions
The Ministers will accept collective responsibility for the majority
decisions of the Executive Council and will be under an obligation
to support all Executive Council decisions both in the Legislative
Council and otherwise in public.
(8) Executive Council Business
(a) Submission of Memoranda
(i) All matters of importance submitted to the Executive Council
should normally be presented in the form of a memorandum
which should be as short and as clear as possible. The memo-
randum should conclude with a summary of the points referred
to the Council for decision. When the Minister is of the opinion
that a matter should be referred to the Executive Council, and
has satisfied himself that all the other authorities concerned
(e.g. the Financial Secretary, Crown Attorney, another Minister
or Head of Department) have been consulted, he will cause a
memorandum to be drafted by his Principal Assistant Secretary
which will include the advice of those consulted. If the Minister
is unable to accept the advice of the Head of Department con-
cerned on any matter requiring reference to the Executive
Council the views of the Head of Department should be included
in the memorandum.
(ii) When the memorandum has been approved by the Minister
it should be forwarded with the file to the Clerk to Executive
Council who, unless it is a formal or unimportant matter, will
submit it to the Governor or Administrator for approval of its
inclusion in the Agenda for the next meeting.
(iii) After approval of inclusion in the Agenda, the Clerk to Execu-
tive Council will cause sufficient copies of the memorandum to
be made to permit of circulation to all Members. Memoranda
should be circulated to Members two days before the meeting
and the files should reach the Administrator at least one day
before the meeting.
(b) Decisions
If the decision is one requiring immediate action, the Clerk to the
Executive Council will be responsible for preparing an advance record
of the Executive Council decision and will send it to the Principal
Assistant Secretary of the Ministry concerned for action.
(c) Minutes
The record will be limited to a statement of the decision of the
Executive Council with such summary of the discussion only as is
essential for the guidance of those responsible for taking action on
the decision. Copies of the unconfirmed minutes should be sent to
each Member of the Executive Council as expeditiously as possible.

2. PERSONNEL AND ESTABLISHMENT
(a) The Ministers will not be responsible for the appointment, discipline,
transfer or promotion of members of the Public Service.
All such matters and all other matters relating to establishment
and personnel will be the responsibility of the Administrator under the
Governor.
In regard to these matters, Heads of Departments and Principal
Assistant Secretaries (in cases affecting Ministries) will communicate
direct with the Administrator and have direct access to him.
(b) Questions of establishment (which include the number and grading
of posts, salaries, allowances, and all matters of this kind affecting
the Public Service), will of course, require consultation with the Minis-
tries concerned and with the Financial Secretary. The Administrator
will be responsible for ensuring that such consultation is carried out.
(c) Sole responsibility for the Public Service, including the power to appoint,
promote, transfer, dismiss and exercise other disciplinary control over
public officers is vested in the Governor, and the Administrator who
will seek the advice and assistance of the Public Service Commission
where appropriate.
3. CEREMONIAL; DEFENCE AND INTERNAL SECURITY; POLICE; EXTER-
NAL AFFAIRS INCLUDING INTERNATIONAL TRADE AND AGREEMENTS,
AND IMMIGRATION; LABOUR; PUBLIC INFORMATION; AND ALL
SUBJECTS NOT SPECIFICALLY ALLOCATED TO MINISTERS.
These subjects will be the responsibility of the Administrator and communi-
cations on these subjects will be addressed to him by Principal Assistant
Secretaries and Heads of Departments concerned.
4. JUDICIARY
The Judiciary, Magistracy and Registry will be administered by the Chief
Justice.
5. LAW OFFICER
The Crown Attorney will continue to exercise his traditional and common
law functions with regard to offences, prosecutions and court matters free
of any control, and he and the Police will continue to have direct access
to one another on these matters.
6. AUDIT
The relationship of the Principal Auditor and his department to the other
departments of Government is not affected by these arrangements and their
complete independence of the Executive in the exercise of their functions
will continue.
7. OVERSEAS CORRESPONDENCE AND CORRESPONDENCE FROM THE
GOVERNOR
(a) Incoming
Communications from the Secretary of State, from the Governor of the
Windward Islands, from Governors of other territories and Her Majesty's
diplomatic representatives overseas, and from all external organizations
such as the Caribbean Commission, Development and Welfare, the Crown
Agents for Overseas Governments and Administrations etc. are addressed
to the Administrator. After perusal by the Administrator they will be
sent to the Registry for filing and circulation to the Ministry concerned
for action.
(b) Outgoing
(i) All outward correspondence to the Secretary of State or to the
Governor of the Windward Islands. Governors of other territories,
Her Majesty's diplomatic representatives overseas, and to all external
organizations such as the Caribbean Commission. Development and
Welfare, the Crown Agents for Oversea Governments and Adminis-
trations, etc. is sent by, or in the name of the Administrator. Des-
patches will be drafted by the appropriate Principal Assistant Secre-
tarv. and when the drafts have been approved by the Minister, they
will be forwarded with the files to the Administrator. After approval
they will be signed by the Administrator.
(ii) savinqrams and telegrams will, in the normal course, be drafted
by the appropriate Principal Assistant Secretary; these are sent
out in the name of the Administrator, and, therefore, if they contain
matters of importance, the drafts with the files should be submitted
to the Administrator for approval as in the case of despatches;

(iii) "in compliance with the principle enunciated in the first sentence
of sub-paragraph (i) above, semi-official correspondence should not
be addressed by Ministers or Principal Assistant Secretaries to
Ministers, to officials at the Colonial Office or to the Governor without
the concurrence of the Administrator and should always include
a phrase indicating that such concurrence has been given.
(N.B. In regard to purely formal matters the drafting stage of
this procedure can be omitted.)

the Governor, the Administrator will be responsible for the following:-

IN THE MATTER OF THE ACQUISITION by the Governor in Council of a certain
parcel of land at Georgetown in the Parish of Charlotte for a public purpose.
DECLARATION OF ACQUISITION OF LAND.
(FIRST PUBLICATION.)
WHEREAS it is enacted by Section 3 of the Land Acquisition Ordinance 1946
(No. 22 of 1946) that if the Governor in Council considers that any Land should
be acquired for a public purpose he may cause a declaration to that effect to be
made.
AND WHEREAS it is considered by the Governor in Council that the under-
mentioned parcel of land should be acquired for a public purpose, to wit, the
extension and improvement of the Georgetown Police Station.
Now IT Is HEREBY DECLARED by His Excellency the Governor acting by and
in accordance with the advice of the Executive Council of the Colony of Saint
Vincent that upon the Second Publication of this Notice in the Gazette all that
parcel of land at King Street, Georgetown, in the Parish of Charlotte, the property
of the Heirs of Laura Gray, measuring 3,814 square feet in area and bounded
on the North by the remaining lands of the Heirs of Laura Gray on the South
partly by lands belonging to the Heirs of McLeod Melville and partly by lands
belonging to Charles Grant, on the East by the Crown and on. the West by King
Street, shall vest absolutely in the Crown.
AND IT Is HEREBY FURTHER DECLARED AND NOTIFIED that a plan bearing the
Number C3/1 showing the above mentioned parcel of land has been prepared
by Mr. H. R. Wason, Licensed Land Surveyor, and can be inspected at all reasonable
hours at the Lands and Survey Office of Kingstown in the said Colony.

an approved school for the purposes of the Ordinance aforesaid.

English up to Cambridge Higher

supe vision and issuing of all medical

drugs issued from the dispensary; for
the engagement of student nurses;
and for the arrangement of systematic
lectures and instructions of the
nursing staff.

of post.
State Registered Nurse (United
Kingdom).
State Certificated Midwife (United
Kingdom).
Post-registration experience in hos-
pital administration is desirable.
(iii) Salary of Post.
$3,744 (780) per annum.
(iv) Allowances and other circum-
stances affecting value of the post
(e.g. transport allowance).
No allowances are payable.
(v) Whether post is pensionable or
not.
The post is pensionable.
(vi) Quarters, housing accommoda-
tion, furniture, china, etc.
Furnished quarters are provided with
necessary crockery, cutlery, etc., for
which a rental of 10% of salary will
be charged.
(vii) (a) Passages.
In the case of an officer on first ap-
pointment who is recruited from out-
side the Colony, free passages, includ-
ing rail fares to the port of embarka-
ti-n will be provided for the officer.
(b) Leave Passages.
Officers receiving salaries of $2,880
per annum and over but less than
$4,320 per annum are eligible for a
leave passage grant in respect of each
completed mo.-th of resident service
during the tour at the rate of $13.50
up to a maximum grant of $960.
(viii) Leave.
Officers in receipt of salaries of
$3,168 per annum and over are eligible

Examination of the University of Lon-
don will be held in St. Vincent in the
month of June, 1958.

duly completed, together with the Trea-

GENERAL CERTIFICATE OF EDUCATION
EXAMINATION.
It is hereby notified for the informa-
tion of interested persons that the
General Certificate of Education Exam-
ination will be held in St. Vincent in
June 1958.
Before applicants will be accepted as
candidates for this examination, they
must be certified by the Education Offi-
cer as fit to take it. For such purpose,
the Education Officer will require evi-
dence that the applicant has been pur-
suing a suitable course of study.
A candidate who does not hold a
General Certificate of Education of the
University of London, or a Cambridge
School Certificate, will be required to
enter in not less than six subjects at the
Ordinary Level.
A candidate entering in six subjects
as stated above, will not be eligible for
the award of a certificate unless he
reaches the pass standard in at least
four subjects.
The following are the fees payable-
(i) An initial entry fee of ten shil-
lings. (This fee has been recently
instituted by the University, to
come into effect in 1958.)
(ii) the examination fee of ten shil-
lings per subject at Ordinary
Level, and one pound per subject
at Advanced Level.
(iii) a local fee of two shillings pay-
able by each candidate.
Candidates should submit to the Local
Correspondent in writing not later than
the 31st January 1958, their full names,
Birth Certificate, subjects offered for the
examination, and the Treasury receipt
for the fees stated above.

from the Local Correspondent.

All licensed dealers in the sale of
intoxicating liquors are hereby reminded
that they should apply to the Chairman
of the Liquor Licences Board for a
renewal of their licences before the
usual annual Liquor Licences Session
which will be held in the various
Parishes during the month of December,
1957.
2. Late applications are subjected
to a late fee. Dealers will therefore
save this fee if they apply for the re-
newal of their licences before the Annual
Licensing Session is held.
3. Applications for new certificates
under the Liquor Licences Ordinance
should reach the Magistrate's Office,
Kingstown not later than 3 p.m. on
Saturday the 23rd day of November,
1957.

Present,
The Queen's Most Excellent Majesty in Council
Her Majesty, by virtue and in exercise of Her powers under
the Saint Vincent and Grenada Constitution Act, 1876(a), and
of all other powers enabling Her in that behalf, is pleased, by
and with the advice of Her Privy Council, to order, and it is
hereby ordered, as follows:-
1.-(1) This Order may be cited as the Saint Vincent
(Legislative Council) (Amendment) Order in Council, 1957,
and shall be construed as one with the Saint Vincent (Legisla-
tive Council) Orders in Council, 1951 to 1956 (b).
(2) The Saint Vincent (Legislative Council) Orders in
Council, 1951 to 1956, and this Order may be cited together as
the Saint Vincent (Legislative Council) Orders in Council, 1951
to 1957.
(3) This Order shall be published in the Gazette and
in such other manner as the Governor shall think fit.
2. Section 24 of the Saint Vincent (Legislative Council)
Order in Council, 1951(c), as amended by the Saint Vincent
(Legislative Council) (Amendment) Order in Council, 1954(d)
is hereby amended by the addition of the following subsection
immediately after subsection (2) :-
(3) If upon any question the votes are equally divided
and the Administrator, the Deputy President or other
Member presiding does not exercise his casting vote, the
motion shall be lost."
