WHEREAS it is enacted by Section 3 of the Land Acquisition Ordinance
(No. 22 of 1946) that if the Governor-in-Council considers that any land should
be acquired for a public purpose he may cause a declaration to that effect to be
made:
AND WHEREAS it is considered by the Governor-in-Council that the under-
mentioned parcel of land should be acquired for a public purpose, to wit, the
protection of the Pipe Line at Golden Grove:
Now THEREFORE IT Is HEREBY DECLARED by His Excellency the Governor acting
by and with the advice and consent of the Executive Council of the Colony of
Saint Vincent that upon the Second Publication of this Notice in the Gazette
all that parcel of land at Golden Grove in the Parish of Charlotte in the Colony
of Saint Vincent belonging to Edwin Williams and measuring 54,497 square feet
and bounded on the North by a Road, on the South by Crown Lands, on the East
by a Road and by a Stream, and on the West by lands of Joseph Arthur, shall
vest absolutely in the Crown:
AND IT Is HEREBY FURTHER DECLARED AND NOTIFIED that a plan bearing the
number C 49 has been prepared by Mr. Lance R. Pierre, Licensed Land Surveyor,
and can be inspected at all reasonable hours at the Survey Office in the town of
Kingstown in the said Colony.

leave after a tour, not exceeding the
cost of normal sea passages to the United
Kingdom for the officer, his wife and
children, subject to the maximum of
three adult fares. Leave passages are
subject to review and are not a per-
manent right of the officer.
Quarters : Quarters are not specifical-
ly provided, but if they become avail-
able and are allocated to the officer, lie
will be required to pay rent at 8O of
salary subject to a maximum of $50 per
month. A house allowance at the pres-
cribed rates may be also payable.

JUDGMENT.
On the 27th August, 1956 the learned
Magistrate of Distrct II Sitting as an
additional Magistrate of District I con-
victed the Appellant of the following
complaint brought by the Respondent: -
"On the 25th day of July, 1956 at
Kingstown . at a Public meeting at
the Market Square, did unlawfully make
use of certain insulting words to wit:-
'George Charles came here two years ago
and thief all you money, he doesn't know
right nor left, who is he, he came here
and fool all of us and now Charles ride
till he reach right up stairs' whereby a
breach of the peace was likely to be
occasioned. Contrary to Sec. 7 of Ord.
27/51."
The Appellant was Bound Over to keep
the peace for 6 months in the sum of
$24.00, and has appealed against this
conviction and the Order.
Mr. Cato in arguing the Appeal urged
that the circumstances related to the
Court by the prosecution witnesses-two
police officers- were not sufficient to
justify the Court in convicting the Ap-
pellant.
He stressed inter alia (i) the fact that
nowhere in the evidence did the prose-
cution indicate whether the charge was
based on an intention of the Appellant
to cause a breach of the peace, or on the
likelihood of a breach of the peace being
caused.
(ii) He adverted to the absence of
positive proof that George Charles was
present at the meeting, and argued that
his presence at the meeting was vital in
order to establish the case as laid.
(iii) The evidence of the prosecution
witnesses established that the behaviour
of those persons attending the meeting
was such that it was not reasonable for
any one in the circumstances to have
apprehended a likely breach of the peace.
(iv) The subject discussed was one of
public interest, and it was open to the
person criticised to take his own action
if he felt so disposed.
(v) In the absence of proof that simi-
lar words used on a previous occasion
had caused a breach of the peace, and
in the absence of evidence of any pas-
sage of words between persons at the
meeting and the speaker, it was not
open to any one to conclude that a
breach of the peace was likely to occur.
The Magistrate therefore erred in
coming to the conclusions which he did
come to, and consequently was wrong in
making the Order which he made.
These proceedings are brought under
Section 7 of Ordinance No. 27 of 1951
(The Public Order Ordinance 1951)
which reads as follows:-
"Any person who in a public place or
at any public meeting uses threatening
abusive or insulting words or behaviour
with intent to provoke a breach of the
peace or whereby a breach of the peace
is likely to be occasioned, shall be guilty
of an offence."
and in the Complaint the words "where-
by a breach of the peace was likely to
be occasioned' are specifically set out.
The evidence before the Court was to
the effect that the two police officers, a
Sergeant and a Constable, were both
present and took notes of the speeches
made by the various speakers. Sergt.
Isaacs in his evidence stated in cross
examination "I assumed that by Charles
the defendant was referring to the Hon-
'ble George Charles, Minister of Social
Services, who was head of a Trade
Union. I did not see him at the meeting.
I do not know if he was in the Colony
on that day. It would appear that the
reference was to certain shortages in
trade union funds. ... P.C. Conroy
Daniel in cross examination stated "... no
one was arrested at that meeting. It
was a fairly large crowd about 80 per-
sons attended the meeting. There was
no disorder. Everything went quietly."
At the close of the case for the prose-
cution a no case submission by Counsel
for the Defendant/Appellant was over-
ruled by the Court whereupon Counsel
elected to rely on his submission, and
the Court convicted.
Cases cited by Counsel for the Appel-
lant were all prior to 1936 the date of
the Public Order Act 1936. (1 Ed. viii and
1 Geo. 6 Cap. 6.) They consequently do
not in the opinion of this Court have
any real bearing on the interpretation
of this comparatively recent statute,
section 5 (our section 7) of which,
created a new offence, one which was
neither known to the Common Law nor
to previous Statute Law.
The Magistrate having heard the evi-
dence was satisfied that a prima facie
case had been made out. He was satis-
fled that the words used were insulting,
and in the circumstances likely to occa-
sion a breach of the peace.
Having regard to the object of the Or-
dinance, viz:--inter alia to make further
provision for the preservation of public
Order on the occasion of meetings in
public places, to the text of the Com-
plaint, and the evidence which was be-
fore the trial Magistrate. This Court is

satisfied that the conclusion arrived at
by the Magistrate having regard to the
circumstances, was reasonable.
He was the sole judge as to whether
the circumstances related to him, were
such as were, or were not, likely to occa-
sion a breach of the peace. In the opin-
ion of this Court it matters not whether
the person named was present or not,
or whether any actual breach of the
peace did result from the use of tie
words, provided the words were found
to be likely to occasion a breach of the
peace.
Further this Court is of the opinion
that the words used at the particular
public meeting, of and concerning
George Charles, a local political figure,
were insulting and that the use of these
words in the circumstances was likely
to occasion a breach of the peace either
by him or his partisans had they been
present.
For these reasons this Court dismisses
the Apeal and confirms the conviction
and Order of the learned Magistrate.

3. At the close of the year under review, the value of Unallocated Stores was
$198,618.11. The following table gives figures of purchases and sales for the

WATER WORKS.
4. No special work was done in connection with the Water
except the re-routing of a section of the Main line near Majorca.

COMMUNICATION.
(ROADS.)
5. A sum of $160,000 was spent in repairing the damage done to the roads
and Bridges, by the rain-storm of October, 1954. In this connection, among thb
major projects was the rebuilding of the Argyle Bridge.
6. The new bridge which is 110 feet in span was designed by Mr. Ronald
Smith, Superintendent of Works. It was built at a cost of $42,270. It was
formally opened by His Honour Mr. A. F. Giles, B.A., M.B.E., on 31st August, 1955.
7. The annual recurrent Maintenance Cost amounted to $72,500, while other
expenditure (recurrent) was as follows:-

8. The Rural Telephone Exchanges are in very bad condition and can be
rightly described as being on their last legs.
The switchboard at Headquarters is heavily overloaded and, in consequence,
applications for new installations cannot be entertained except for very urgent
cases.

A scheme to install a complete new system has been forwarded to the
Secretary of State for consideration.

AIR SERVICE.
The St. Vincent Air Service continued to operate during the year with the
amphibian aircraft chartered from the British Guiana Airways. This links up
the island with Dominica, Barbados, Grenada and Trinidad.
The running cost is met from C.D. & W. funds.
EXTRAORDINARY EXPENDITURE.
(BUILDINGS, ETC.)
9. During the year 1955 the following extraordinary works were started:-
(i) The erection of the Ministerial Building.
(ii) The erection of the new Treasury Building.
(iii) Reconstruction of Post Office and Government Office.
The following were completed:-
6i) A Repeater Station (for the Police).
(ii) Reconstruction of Old Treasury building.
(iii) Reconstruction of Richmond Hill Bungalow.
(iv) Reconstruction of Bequia Jetty.
LOAN WORKS.
10. The new Customs Warehouse was completed during the year and is
now in use. The first stage of the jetty (the Lighter Jetty) is. also finished.
These projects were done at a cost of $183,800.
DEVELOPMENT WORKS.
11. A new school was built at Richland Park at a cost of $21,800. The school
which was opened in January, 1956, accommodates 400 pupils.
The Dorsetshire Hill Government School was extended and at Paget Farm,
Bequia, a new tank was built.
ROADS.
\ 12. The reconstruction and oiling of the Buccament Valley Road was com-
pleted. This is a 31/2 mile stretch and was constructed at a cost of $56,500. Of
this amount $8,500 came from local funds.
13. In the Mesopotamia Area the section of road commonly known as the
Yambou Pass (Vigie/Peruvian Vale Road) was reconditioned and oiled. This
road is just a little under 3 miles and the work was effected at a cost of $57,000.
14. At the end of 1955 there were: Oiled roads, 63 miles; metalled roads,
37 miles; earthen roads, 3101/2 miles. Of these 120 miles are motorable throughout
the year.
15. In September, the heavy seas caused by Hurricane Janet did damage to
the new Customs Warehouse, the Bay Street, jetties at Layou and Barrouallie,
and completely destroyed the Sea-plane ramp. Up to 31st December a little over
$35,000 had been spent in repairing the damage done on the mainland and also
in the Grenadines.
Work would be continued in 1956.

Present,
The Queen's Most Excellent Majesty in Council
Her Majesty, by virtue and in exercise of per powers under the
Saint Vincent and Grenada Constitution Act, 1876(a), and of all
other powers enabling Her in that behalf, is pleased, by and with
the adyice of Her Privy Cduncil, to order, and it is hereby ordered,
as follows:-
1.-(1) This Order may be cited as the Saint Vincent Citations and
(Legislative Council) (Amendment) Order in Council, 1956, and construction.
shall be construed as one with the Saint Vincent (Legislative
Council) Orders in Council, 1951 to 1955 (b).
(2) The Saint Vincent (Legislative Council) Orders in
Council, 1951 to 1955, and (this Order may be cited as the Saint
Vincent (Legislative ,Council) Orders in Council, 1951 to 1956. '
(3) This Order shall be published in the Gazette and in
such other manner as the Governor shall think fit.
2. The Saint Vincent (Legislative Council) Order in Gountil, Amendment of
1951(c), shall have effect, and shall be deemed always to have section 1 of
had effect, as if in subsection (3) of section 1 the existing Saint Vincent
provision were lettered as paragraph (a) and there were added (Legislative
