AN ORDINANCE to amend, the Promissory Oaths Act, Cap. 135.

Enacted by the Legislature of Saint Vincent.
1. This Ordinance may be cited as the Promissory Oaths
(Amendment) Ordinance, 1956, and shall be read as one with
the Promissory Oaths Act (hereinafter referred to as the princi-
pal Ordinance) and all .amendments thereto.
2. Section 6 of the principal Ordinance is hereby amended
(a) by re-numbering the said section as "6 (1)"; and
(b) by adding the following new subsection:
"(2) Every person appointed or called upon to exercise
the functions of Clerk of the Executive Council shall before
entering upon the duties of his office take the oath set out
as Form 5 in Schedule A to this Ordinance."
3. Schedule A to the principal Ordinance is hereby amend-
ed as follows:-
(a) by deleting Form 4 appearing therein and substi-
tuting therefore the following:-
"FORM OF OATH OF EXECUTIVE COUNCILLOR.

The objects of this Bill are-
(a) to enlarge the wording of the Oaths of a Member of the Executive
Council;
(b) to provide an oath to be taken by the Clerk of the Executive Council; and
(c) to provide that Ministers of the Government should take an oath of

AN ORDINANCE further to amend the Interpretation Ordinance
(Cap. 72).
Enacted by the Legislature of Saint Vincent.
1. This Ordinance may be cited as the Interpretation
(Amendment) Ordinance, 1956, and shall be read as one with the
Interpretation Ordinance (hereinafter referred to as the prin-
cipal Ordinance) and all amendments thereto.
2. Paragraph (e) of Section 2 of the principal Ordinance
is hereby repealed and replaced by the following:-
"(e) "Governor in Council" means, save as otherwise
provided by Letters Patent under the Great Seal of the
United Kingdom, by any Order of Her Majesty in Council
or by Instructions under the Royal Sign Manual and Signet,
the Governor acting with the advice of the Executive Coun-
cil, and, to such extent as may be provided by any such
Letters Patent, Order of Her Majesty in Council or Instruc-
tions, in accordance with that advice, but not necessarily in
such Council assembled." 4

Ordinance, 1956, and shall be read as one with the Police Ordin-
ance, 1947, (hereinafter referred to as the principal Ordinance)
and ,all amendments thereto.
2. (1) Subsection (2) of section 46 of the principal Ordin-
ance as amended by section 10 of the Police (Amendment)
Ordinance, 1951, is hereby further amended by deleting the
words "subsection (4) of this section" appearing in lines one
and two thereof and substituting therefore the following words
"the following section".
(2) Subsection (4) of section 46 of the principal Ordin-
ance is hereby repealed.
3. After section 46 of the principal Ordinance as amended,
there shall be added the following new section:-

(c) on account of circumstances specifically attri-
buted to the nature of his duty, while in the
service of the Government of the Colony, it
shall be lawful for the Governor in Council to
grant, in addition to the grant, if any, made to
his legal personal representative under section
46 (2) of this Ordinance-
(i) if the deceased non-commissioned officer
or constable leaves a widow, a pension to
her, while unmarried and of good charac-
ter at a rate not exceeding ten-sixtieths
of his annual rate of pay at the date of
the injury, or seventy-two dollars a year,
whichever is the greater;
(ii) if the deceased non-commisioned officer
or constable leaves a widow to whom a
pension is granted under the preceding
paragraph and a child or children, a pen-
sion in respect of each child, until such
child attains the age of 18 years, of an
amount not exceeding one-eighth of the
, pension prescribed under the preceding
paragraph;
(iii) if the deceased non-commissioned officer
or constable leaves a child or children,
but does not leave a widow, or no pension
is granted to the widow, a pension in
respect of each child, until such child
attains the age of 18 years, of double the
amount prescribed by the preceding para-
graph;
(iv) if the deceased non-commissioned officer
or constable leaves a child or children
and a widow to whom a pension is granted
under paragraph (ii of this subsection,
and the widow subsequently dies, a pen-
sion in respect of each child as from the
date of the death of the widow until such
child attains the age of 18 years, of double
the amount prescribed in paragraph (ii)
of this subsection;
(v> if the deceased non-commissioned officer
or constable does not leave a widow, or if
no pension is granted to his widow, and
if his mother was wholly or mainly de-
pendent on him for her support, a pen-
sion to the mother while of good charac-
ter and without adequate means of
support, of an amount not exceeding the

pension which might have been granted
to his widow;
(vi) if the deceased non-commissioned officer
or constable does not leave a widow or
mother, or if no pension is granted to his
widow or mother, and if his father was
wholly or mainly dependent on him for
his support, a pension to the father, while
of good character, of an amount not
exceeding the pension which might have
been granted to his widow;
(vii) if the deceased non-commissioned officer
or constable does not leave a child or
children who is or are eligible for a pen-
sion under the provisions of this section,
and, if .any brother or sister was wholly or
mainly dependent on him, for support, a
pension in respect of any such brother or
sister of the same amount and subject
to the same conditions as the pension
which might have been granted in respect
of a child under paragraphs (ii), (iii) and
(iv) of this subsection:
Provided that-
(a) pension shall not be payable under
this subsection at any time in re-
spect of more than six children or
in respect of a legitimate child born
later than nine months after the
date of the injury;
(b) in the case of -a pension granted
under paragraph (v) of this sub-
section, if the mother is a widow at
the time of the grant of the pension
and subsequently remarries such
pension shall cease as from the
date of remarriage;
(c) a pension granted to a female child
under this section shall cease upon
marriage of such child under the
-ge of 18 years;
(d) in the case of a pension granted
under paragraph (v), (vi) or (vii)
of this sub-section, if it appears to
the Secretary of State at any time
that .the mother or father, or any
brother or sister is adequately pro-
vided with other means of support,

such pension shall cease as from
such date as the Secretary of State
may determine.
(2) For the purposes of this section, the fol-
lowing words have in relation to a deceased non-com-
missioned officer or constable the meanings respec-
tively assigned to them:-
(a) "brother" includes every male child
of his father or of his mother;
(b) "child" includes-
(i) a posthumus child;
(ii) a step-child or illegitimate child
born before the date of the
injury and wholly or mainly de-
pendent upon him for support;
and
(iii) an adopted child, adopted in a
manner recognized by law, be-
fore the date of the injury, and
dependent as aforesaid;
(c) fatherk includes his step-father and
person by whom he has been adopted;
(d) "mother" includes his step-mother
and a female person by whom
he has been adopted;
(e) "sister" includes every female child
of his father or of his mother.
(3) If a non-commissioned officer or constable
proceeding by a route approved by the Governor to
or from the Colony at the commencement or termin-
ation of his service therein, or of .a period of leave
therefrom, dies as the result of damage to the vessel,
aircraft or vehicle in which he is travelling, or of any
act of violence directed against such vessel, aircraft
or vehicle, and the Governor is satisfied that such
damage or act is attributable to circumstances arising
out of any war in which Her Majesty may be engaged,
such non-commissioned officer or constable shall be
deemed, for the purpose of this section, to have died
in the circumstances described in subsection (1) of
this section:
Provided that this subsection shall not
apply in the case of a non-commissioned officer or
constable who is eligible to receive an award under
subsection (4) of this section.
(4) A non-commissioned officer or constable
who dies as a result of injuries received while travel-

ling by air in pursuance of official instructions shall
be deemed to have died in the actual discharge of his
duty and on account of circumstances specifically
attributable to the nature of his injuries; and if his
injuries were not also due to his own default the rates
of pension prescribed in paragraphs (i) and (ii) of
subsection (1) of this section shall be fifteen sixtieths
and one-sixth respectively.
4. This Ordinance shall be deemed to have come into force Commence-
on the 1st day of December, 1954. ment.

AN ORDINANCE to further and protect the activities and
interests of the Girl Guides Association in the Colony.
Enacted by the Legislature of Saint Vincent.
1. This Ordinance may be cited as the Girl Guides Associa-
tion Ordinance, 1956.
2. In this Ordinance-
"Association" means the Girl Guides Association incor-
porated under the Royal Charter on the 14th day
of December, 1922.
"Girl Guide" means a Girl Guide- recognized as such
under the constitution, byelaws, or rules of the
Association, and includes also all officers of the
Association.
3. It shall not be lawful for any person, not being by the
byelaws or rules of the Association duly authorised and entitled
so to do, publicly to wear, carry or bear any uniform, badge, token
or emblem (which under the said byelaws or rules is specially
adopted for use under the authority of the Association) in such
style or manner as to convey an impression that such person
is, under the said byelaws or rules, entitled so to wear, carry or
bear such uniform, badge, token or emblem.

Any person who publicly wears, carries or bears any uni-
form, badge, token or emblem in contravention of the provisions
of this section shall be guilty of an offence against this Ordin-
ance.
4. No Girl Guide shall assume the authority, exercise the
powers or perform the duties of any person employed in the
public service unless she has been lawfully authorized to do so.
Any Girl Guide who contravenes any of the provisions of this
section shall be guilty of an offence against this Ordinance.
5. It shall not be lawful for any person to form, organize
or work in connection with or be concerned in forming or organ-
izing any corps or body which, without due authority granted
under the Royal Charter of the Association, claim or purport to
be Girl Guides or otherwise to be connected with the Association,
or which hold themselves out as, or pass themselves off as, Girl
Guides or as otherwise connected with the Association.
Any person who contravenes any of the provisions of this
section shall be guilty of an offence under this Ordinance.
C. Any person guilty of an offence under this Ordinance
shall be liable on summary conviction to a fine not exceeding
twenty-five dollars or to impnrisonmen,, for a term not exceeding
one month.

is hereby further amended by deleting paragraph (3) thereof
appearing under the head "Exemptions" and substituting there-
for the following new paragraph-
"(3) No succession duty shall be payable in respect of

in any of the circumstances mentioned in section 11 of this

The Member for South Windward asked the following questions standing
in his name:
1. Could the Administration inform this House whether the circulating
rumour that the payment of a sum of $2,496 made to the Assistant Admin-
istrator for leave passages is correct?
2. Having regard to the fact that leave passage had been paid to the
Assistant Administrator two years ago; will the Administration now state
whether the Assistant Administrator has again become eligible for
leave passages?
3. Will the Administration please *state Colonial Regulation which
enables an officer of the Civil Service to get eight months vacation leavp
with pay after a period of two years service?
4. Could the Administration inform this House whether Government
has agreed to supply certain pieces of furniture to Government owned
houses occupied by certain members of the Civil Service?
i. If the answer to 4 is in the affirmative,
Will the Administration state the houses which contain a supply
of' Governme.t Furniture and the list of Iurniture in each of these houses?
6. Will Government please static under whose control do these furni-
ture lall; and whether an inventor%, is done when one officer gives up the

The President replied as follows:
1. Mr. 0. R. Kelsick, Assistant Administrator and Establishment Officer,
was granted Leave Passages for himself .and his wife and was paid the
amount involved in accordance with the then accepted local policy and
regulations in order that he might apply savings towards the passages of
his children.
2. The reply in this case is in the affirmative in accordance with the
reply to the first question.
2. Colonial Regulation No. 82 states That the Leave of Absence of
Officers shall be governed by rules of local application' as directed by
the Secretary of State. In the case of St. Vincent, leave of absence is
governed by General Orders. General Orders dealing with Vacation Leave
to Pensionable Officers are Nos. 157, 164 and 166. No Officer can be
granted 8 months' Vacation Leave for a period of 2 years' service unless
General Orders Nos. 164 and 166 apply to him as they do in the case of
Mr. Kelsick. Mr. Kelsick was due over 7 months' leave in October, 1953,
but, owing to the exigencies of the Service, he was only allowed to take
a three months' holiday.
4. Tte reply is in the affirmative.
5. The Richmond Hill bungalow (recently occupied by the Assistant
Adminisratori, The Pavilion, occupied by the Chief of Police, and the
rented premises not owned by Government, recently occupied by the
Colonial Treasurer. Government owns furniture in each house, as is set
forth in the three lists with which I am supplying the Honourable Mem-
ber in writing.
6. The Public Works Department. Inventories are taken, and will
continue to be taken, once in each year, and also on each occasion when
the premises are vacated by or .allotted to, an officer. In the case of
privately owned, houses, Government furniture will be taken into stock E
by the P.W.D. whenever an Officer vacates, and re-issued as occasion de-
mands. All such furniture has been marked.
BILLS.
The following Bills were introduced and read a first time:
The Excise (Amendment) Bill.
The British Caribbean Shipping (Agreement) Bill.
The Sugar Export Cess (Amendment) Bill.
The Jury (Amendment) Bill.
Second Reading.
The President introduced a certificate of urgency in respect of the Excise
(Amendment) Bill in order to permit the Bill to be taken through all its stages
at the meeting. The Bill was then read a second time.
During the debate of the Bill. the Member for 'North Windward stated that
whenever a Bill was to be accompanied by a certificate of urgency, due notifica-
tion should be given to the Members of Council. The President gave an assurance
that in future, whenever it became known that a certificate of urgency was to
be attached to a Bill, Members would be duly informed. The Bill passed the
committee stage without amendment and was read ,a third time and passed.
The Workmen's Compensation (Amendment) Bill was read a second time.
In committee of the whole House it was agreed that consideration of the
Bill should be deferred for the next meeting of Council.
The Public Service Commission Bill was then read a second time. At the
Committee stage, the following amendments were made:
Clause 1-The date "1955" was changed to "1956".
Clause 2-Inverted commas were placed after "Officer" in the second line.
"Public Officer" in line 4 was corrected to "public officer".
Clause 5 -(1) Line 4: Inverted commas were placed after the word
"Commission".
Sub-clause 3 was amended to read: "No person shall be appointed
as, or shall remain, a member of. the Commission if he is a, member
of the Legislative or Executive Councils of the Colony."
Clause 6-(1) The word "his" in line 7 was corrected to "this".
Clause 7 (b) : A semi-colon was inserted after the word "Committee".
The Bill was then read a third time-and passed.

ADJOURNMENT.
On the motion for adjournment, the Member for South Leeward impressed
on the Administration the necessity of setting up a Farm School.
The Member for North Windward spoke on the lack of vital amenities in*
North Windward and the high incidence of soil erosion in the area. He also
spoke on the dispossessing of peasants of rented lands by estate owners for the
purpose of planting bananas. He also criticised Council Paper No. 50 of 1955,
the Report of the Labour Department for the year 1954.
The Member for South Windward spoke on, the replies which were given to
his questions.

The President made the following announcement:
Honourable Members, this Special Meeting of Council has been called
for the sole purpose of electing a Delegate to the Federation Conference
to be held in London next month. I need only repeat what I said before,
that it remains Government's view chat as the Delegate is to be a pleni-
potentiary and must therefore Le able to say yes or no in London, without
referring back to St. Vincent, it would be more suitable if he were a
Member of the Executive Council. It is, however, entirely for Council
to choose whom they think best, and Honourable Members are aware of
the arguments on both sides.
The only other point which I have to add is to say that from all avail-
able information it appears likely that the Delegate will have returned
to St. Vincent before Election takes place for Members of the new Execu-
tive Council under the New Constitution.
The' House will now proceed to the Election.

UNITED KINGDOM, IN FEBRUARY.
Before the election of the Delegate, the Member for Kingstown suggested
that consideration should be given to the sending of three delegates of which
at least one should be chosen from outside the Council. The Member ior North
Windward objected to sending a delegate who is not a Member of the Legislative
Council. The Council then proceeded to elect the delegate by secret ballot. The
votes cast were as follows:
Honourable J. A. Baynes 8 votes
,, E. T. Joshua 1 vote.
There were two blank votes. The Honourable J. A. Baynes was duly elected
this Colony's Delegate.
ELECTION OF AN ADVISER.
The President informed Council that in his opinion the Honourable Keith
Alleyne, with the consent of the Governor, should attend the conference as
Adviser to the St. Vincent Delegate, and possibly acting also as Observer for
the Windward Islands, failing which the Honourable B. F. Dias should attend
as Adviser from St. Vincent. During discussion of the proposal some Members
objected to sending of Mr. Alleyne, as he was not at present employed in the
Colony.
The Member for North Leeward then moved that one Adviser should be sent
with the Delegate from St. Vincent. This motion was seconded by the First
Nominated Member. The Member for South Leeward, seconded by the Member
for Central Windward, moved that two Advisers should be sent with the St.
Vincent Delegate. On the vote, the motions .tied 4:4 and the President gave his
casting vote in favour of the first motion. Council then proceeded to elect an
Adviser by secret ballot.
Result of the voting was:
Honourable G. H. Charles ...... 2 votes
,, B. F. Dias ...... 4 votes
,, E. T. Joshua ...... 2 votes
,, A. C. Cyrus ...... 1 vote
,, H. F. Young ...... 1 vote.
There was one blank vote. The Honourable B. F. Dias was duly elected Adviser
to the St. Vincent Delegate.
The Meeting was then adjourned at 10.45 a.m.
