elected Member, Mr. Japheth Hazell, a
Bye-Election has become necessary, and
under the provisions of Section 6 (1) of
the Local Government Ordinance, 1951,
Mr. SILVANUS BURKE, who has been
appointed Returning Officer, will be in

Elizabeth. Beqnia, on Tuesday, 24th

AN ORDINANCE further to amend the Currency Ordinance, 1950.
[ 17th January, 1956. ]
Enacted by the Legislature of Saint Vincent.
1. (1) This Ordinance may be cited as the Currency
(Amendment No. 2) Ordinance, 1955, and shall be read as one
with the Currency Ordinance, 1950, (hereinafter referred to as
the principal Ordinance) and all amendments thereto.
(2) This Ordinance shall be deemed to have come into opera-
tion on the first day of October, 1955.
2. The proviso to subsection (1) of section 6 of the prin-
cipal Ordinance as amended is hereby repealed and replaced
as follows:-
"Provided that for the purposes of this Ordinance the
value of Jamaica notes shall be calculated at the rate of
one pound for four dollars and eighty cents."

1. PRAYERS.
The President opened the meeting with the reading of prayers.
2. MINUTES.
The minutes of the meeting held on 3rd November 1955, copies of which
were circulated were taken as read and were confirmed.
3. ANNOUNCEMENTS.
The President read a letter received from the Governor of Barbados express-
ing his appreciation for the message of sympathy which was sent by the Council
after the hurricane. The President also drew Members' attention to the announce-
ment which was made in the Press regarding the Federation Conference due to
be held in London during February. He stated that this Colony's delegate will
be elected by the Legislative Council at a future date either at a normal meeting
or at a special meeting called for that purpose. He further stated that as the
delegate should be plenipotentiary it was thought that he should be a member
of Executive Council, preferably an elected Member.
4. NOTICES OF MOTIONS.

5. NOTICES Or QUESTIONS.
The Member for South Windward gave notice of the following questions:
1. Could the Administration inform this House whether the circtilating
Tumour that the payment of a sum of $2,496 made to the Assistant Admin-
istratos for leave passages is correct?
2. Having regard to the fact that leave passage had been paid to the
Assistant Administrator two years ago; will the Administration now. state
whether the Assistant Administrator has again become eligible for leave
passages?
3. Will the Administration please state Colonial Regulation which en-
ables .an officer of the Civil Service to get eight months vacation leave with
pay after a period of two years service?
4. Could the Administration inform this House whether Government
has agreed to supply certain pieces of furniture to Government owned
houses occupied by certain members of the Civil Service?
5. If the answer to 4 is in the affirmative
Will the Administration state the houses which contain a supply
of Government Furniture and the list of furniture in each of these houses?
6. Will Government please state under whose control do these furni-
tures fall; and whether an inventory is done when one officer gives up
the House he occupies?

8. MOTIONS.
The Colonial Treasurer, seconded! by the Crown Attorney, moved the follow-
ing motions:
That this Council approve the Schedule of Additional Expenditure
required to meet expenditure for the period 1st October to 31st December,
1954.
That this Council approve the Schedule of Additional Expenditure
required to meet expenditure for the period 1st January to 31st March,
1955.
That this Council approve the Schedule of Additional Expenditure
required to meet expenditure for the period 1st April to 30th June, 1955.
The motions were unopposed and passed unanimously.
The Member for North Windward, seconded by the Member for St. George,
moved the first motion standing in his name on the order paper:
WHEREAS by Resolution which passed the Legislative Council by a
majority vote on the 26th June 1953 resolving that a Commission of
Enquiry be appointed in the ,Colony, of Saint Vincent to enquire into the
instrument of justice set up in the said Colony;
AND WHEREAS by an announcement made to the Legislative Council by
His Honour .then the Administrator of the Colony W. F. Coutts, M.B.E.,
on a subsequent meeting declared that the theni Governor and Com-
mander-in-Chief, of the WindwErd Islands His Excellency Betham
Beetham, C.V.O., O.B.E., had used his reserve powers declaring that
such a step was not necessary;
AND WHEREAS it is more than vitally necessary that such a step be now
taken in this Colony if improvements, changes, and revisions; in the mode
and practice in the existing machinery may be effected and. reported upon
by an impartial Commission of Enquiry;
AND WHEREAS the Colonies of Barbados and Trinidad & Tobago have
decided upon such a course of Enquiry-Colonies whose legal scope and
other means of meting out Justice have by far superseded this said Colony
whose very laws are long outmoded .and overdue, even for revision;
AND WHEREAS if the people of this Colony are to survive as a civilized
nation in the self-governing' federal structure proposed and on the verge
to be set up, acts done to the subject in the name of, law should now be
investigated and adjusted to suit "right reason" and what British Justice
in all its forms aims to perfect;
AND WHEREAS within recent months the services of a top, ranking Judge
are sought by the Trinidad & Tobago Government in the United Kingdom
to head a Commission of Enquiry comprising of members of the Trinidad
& Tobago Law Society and other legal personages to inquire into the
instrument of justice set up in that Colony;
BE IT RESOLVED that a Commipsion of Enquiry 'be set up to inquire into
the instrument of Justice set up in the Colony of Saint Vincent and that
the Colonial Office be at once notified so that arrangements be made in
time to acquire for this said Cdoony the services of the Judge to be apm
pointed to lead the Commission to inquire into the instrument of Justice
for Trinidad & Tobago, while such a top ranking Judge would be in the
W.I.;
BE IT FURTHER RESOLVED that a copy of this resolution be sent to the
Secretary of State for Colonial Affairs Mr. Lennox Boyd for his knowledge.
After the debate the motion was lost 4-5 with 3 abstentions.
The Member for North Windward moved the second motion in his name:
WHEREAS the Colony's votes for social welfare and reform .are of such
that social ills and dire reform cannot be tackled by this Government with
any degree of satisfaction;
AND WHnauAS there are in this Colony no reformatories or schools for
delinquents and a vast, population of illegitimate children disowned by
their fathers now being manufactured in the state without paternal sup-
'port;
AND WHEREAs there at present exists the almost unreasonable attitude
in the dispensation of the law relating to affiliation and support of children
and this attitude makes it expedient that the said law be revised, and
made practicable to suit present day problems;
AND WHEREAs this Colony's existence as a civilized state will depend
on the children today who will be the men and women of tomorrow;
BE IT RESOLVED that the law relating to affiliation and maintenance of
children be
(1) tightened, or
(2) be so dispensed with reason coinmonsense and judgment by magis-
trates to cope with the acute bastardy problems threatening our
society.
The motion was seconded by the Member for St. George who moved that
the resolve should be amended to read:
BE IT RESOLVED that the law relating to affiliation and maintenance
of children be first tightened and secondly that the Government seeks the
assistance of our various ministers of religion on the problem to do what
they pan to help in reducing bastardy and that the magistrate dispense
such matter with reason, commonsense and judgement to cope with the
acute bastardy problems threatening our society.
The amendment was seconded by the Member for Central Windward and
accepted by the mover and passed by the House. The motion as amended
was passed 9 votes to nil with three abstentions.
The Member for North Windward moved his third motion which was seconded
ed by the Member for St. George:
BE IT RESOLVED that this Council immediately improve its delaying
action in providing a hansard of the proceedings of the Legislative
Council and that the usual typewritten copies of verbatim minutes for-
merly sent to members of the Council be continued, so that speeches made
in the House be not twisted to suit the whims and fancies of the recorder
of the Council.
The motion was passed unanimously after .a debate.
The meeting adjourned at 12.25 p.m. until 2.15 p.m.
RSiSUMPTION.
Council resumed at -2.15 p.m. Members were present as in the forenoon
except the First Nominated Member, the Member for Kingstown, the Member
for Central Windward, the Secoi, nominated Member and the Third Nominated
Member, who did not return.
The Member for St. Qeorge moved the first motion in his name on the
Order Paper:
WaZmAss it has been the practice here in St. Vincent that whenever an
estate is sold out in parcels that the estate owners merely acquaint the
labourers of that estate that the estate is sold, and that they must find
somewhere to go or to live;
AND WHREAS the practice has been laid for nearly 100 years that the
estate owners prepare houses for their labourers, as an assurance of
having him compelled to work when he needed his services on his estate;
AND WHExmA he is not a tenant at will forhis window or his door is
usually taken off, if he ventures to work outside of the estate for peasant
proprietors;
AND WHE-as the wage paid by these estate owners have not been ade-
quate payment since they were always given lands for kitchen garden to
,Augment the iwges paid;
BE IT RtSOVuD that Government see to it that certain provision be
made for those labourers who have given their entire life on.these estates,
see that certain legal instrument be prepared so that these people be
prevented from becoming public charges.
-The motion was seconded by the Member for North Windward. During the
debate the mover with the consent of the seconder amended the resolve to read:
BE IT RESOLVED that Government see to it that certain provision be made
for those l bourers who had given their entire lives on the estates and
to provide legislation so that these people be prevented from becoming
public charges.
The amendment was passed by Phe House.
The motion as amended was passed nem con.
The Member for St. George moved the second motion standing in, his name:
WH~tAs the first stage of the Customs Warehouse and the Wharf
seems to be more confusing than the former primitive method of landing
consumer goods on the sea-shore;
AND WHEREAs the same spot Used for dropping goods for transfer to
warehouse storage, Is also the spot needed when landing passengers
from ship to shore and vice versa;
AND WHEREAS the first stage of the wharf would not be complete except
Government continues a sea-wall from side of wharf to the spot once
prepared as oil dump site; *
BE IT RESOLVED that Government call on the Banana and Arrowroot
Associations to contribute towards the cost of laying down this sea-wall.
The Member for South Leeward, in seconding, the motion, moved that the
resolve should be amended to read:
BE IT RESOLVED that Government call on the Kingstown Town Board, the
Banana and Arrowroot Associations to contribute towards the cost of
laying down the sea wall.
The amendment was seconded by the Member for North Windward and
accepted by the mover and passed by the House.
The amended motion was then passed 6 to nil with one abstention.
The Member for St. George, seconded by the Member for North Windward,
moved the third motion:
3. WHEREAS the feeder roads of the island are presently in a,very bad
condition, perhaps worse than they ever were for many many years;
AND WHEREAS this condition' is largely due to the constant take over of
roads, which were estate roads of the past, but those estates were within
recent years, cut up and sold out without due regard to the law which
seeks to have roads madesbefore an estate could be divided and sold out;
BE IT RESOLVED that this Government see to it that this law be enforced
in future with an aim to reduce our ever-growing road maintenance cost.
During the debate, the mover, with the consent of the seconder, amended the
motion to read:
BE IT RESOLVED that legislation be drafted to see that roads are first made
before an estate was cut up.
The amendment was passed by the House.
The motion, as amended, was carried 5-nil, with two members abstaining.
9. BILLS.
The following bills were introduced and read a first time:
The Workmen's Compensation (Amendment) Bill.
The Public Service Commission Bill.
The Crown Attorney laid on' the table the report of the Select Committee
of the House on the Summary Conviction (Praedial Larceny) Bill.
In Committee of the whole House, the report and minutes of the Select
Committee were accepted, and the suggested amendments were incorporated in
the bill. The amendments were:
Clause 2: First line-"owned" amended to "owner."
Clause 5 (1) sub paragraph (a): The words "or in or upon any plantation
or land, road or way immediately adjoining such first named planta-
tion or land" in lines 5, 6, 7, were'deleted.
Clause 8 (1) sub paragraph (b): the words "he shall when called upon
so to do by the officer in charge of the Police Station nearest to
hiaresidence present himself at such Police Station," were deleted. Sub
paragraph (c) was amended to read: "he shall not transfer his resi-
dence without a written authority of the officer in charge of such
Police Station, such authority not to be unreasonably withheld."
Sub paragraph (d): "7.30 p.m." and "5 a.m." were substituted for
"sunset" and "sunrise" respectively in line 2.
(2) Line 2: The letter and brackets "(c)" were amended to
read "(b)".
A new subceause (4) was inserted to read: "It shall be! the. duty of
any magistrate placing .a person under special police supervision
in accordance with section 7 (1) to explain to such person at the
time of such conviction, the effects of this section."
Clause 9 (1): The words "or to both such fine and such'imprisonment"
in lines 7 and 8 were deleted.
The Bill was then read a third time and passed.
The Water Distribution Bill was read a second time and in Committee of the
whole House the following amendments were made:
Clause 5: The words "with the approval of the Governor in Council" were
inserted between the words "may" and "purchase" in line 1.
In line 3 the word "likewise" was inserted between "may" and "sell".
After considering Clause 16, Council adjourned at 4.45 p.m. until 2 p.m.
on Friday 9th December.
On the adjournment the Member for North Windward drew attention to
the announcement made in the morning regarding selection of a delegate to
the London Conference on Federation, and the requirement that he should
be a member of Executive Council. The President stated that the final
election of a delegate lay with the Legislative Council, who would select whom
they thought fit whether a member of Executive Council or not, after consid-
ering any arguments put forward.
FRIDAY 9TH DECEMBER, 1955.
Council resumed at 2 p.m. The following were present:

The President announced that he had received a communication from His
Excellency the Governor to the effect that it will not be possible before the 1st
March, 1956, to complete all the necessary arrangements following the making
of the new constitutional instruments to enable the Ministerial System to be
introduced and that the Governor therefore proposed to introduce the new
constitution in all four of the Windward Islands on 1st March, 1956.
Council continued to consider the Water Distribution Bill in Committee:
Clause 18: in line 1 of sup-clause (a), the word "general" was inserted
between "a" and "water", and the word "service" was deleted.
The word "lived"' in line 1 of sub-clause (b) was corrected to read
"levied."
Clause 19 (1): "With the approval of the Governor in Council" was inserted
between "may" and "prescribe" in line 1.
In line 8, "itself" was corrected to read "himself."
Clause 20: Sub-clause (2) paragraph (c) was deleted, and sub-paragraphs
1 and 2 of (c) were deleted.

Sub-clause (3): The words "or in the case referred to in paragraph
2 of subsection 2 of this section from the figures disclosed in the return
on which the current tax rolls are based as provided for in that para-
graph", were deleted.
Clause 23, sub-clause (1) : "for the Governor in Council" wasJ inserted be-
tween "and" and "to" in, line 3. The word "owner" corrected to read
"owners" in line 4.
The word "the" Immediately before the word "metered" in line 4 '
was deleted.
Sub-clause (3): "assessed and" in lines 1 and 2 were deleted.
Clause 26 (1): "in part payment" in line 6 was deleted.
Sub-clause (2) was amended to read: '"Nothing in this section shall
prejudice any of the provisions of section 27 of this ordinance."
Clause 27: was deleted, and the remaining clauses were re-numbered.
Clause 28: "together with the statutory increase (if any)" in lipe 9 was
deleted.
A new sub-clause (3) was inserted to read: "for re-establishing the
supply which has been cut off for non-payment of any rates, charge or
other sum due, the sum of $3 shall be charged."
PART V. MISCELLANEOUS PROVISIONS.
Clauses 29 and 30 were deleted.
Part VI was renumbered "Part V".
Clauses 33 and 34 were deleted.
Clause 38: In line 33 the words "or to both such imprisonment and) fine"
were deleted.
Clause 39: Figure 38 in the 6th line was corrected to read "33".
Clause 40: "38" in the fifth line was corrected to read "33".
The words "or to both such fine and imprisonment" in causes 41, 42
and 44 were deleted.
Clause 45, sub-clause 4: "section 37" was amended to read "section 32".
Clause 46: was deleted.
Part 9 was corrected to read Part 7.
Clause 48: Sub-paragraphs (k) and (1) were deleted, and the other sub-
paragraphs were renumbered.
THE SECOND SCHEDULE.
Heading: (Section 48 (3) ) amended to read (Section 42 (3) ).
Clause 4 (a): The figure "50" was changed to "25".
