the setting up of a British Caribbean
Pre-Federation Judicial Commission
under the Chairmanship of Sir ALLAN
CHALMERS SMITH, M.C.
The terms of reference for the Coin-
mission are :-
(1) To consider in tHie light of pro-
posails ii the Plan for a British Carib-
bean Federation (CMD. 8895), particn-
larly chapter VII thereof,
(i) the Constitution of the Fed-
eral Supreme Court ;
(3) To consider whether the Federal
Supreme Court should have jurisdiction
to have appeals front) the Courts of
British Guiana, British Honduras and
the R ammas (or of any of those terri-
lories) if those territories (or any of
them) so desire: and to make recom-
mendiatiolls.
(4) If it is recommended that the
Federal Supreme Court should have
jurisdiction to hear appeals from the
Court of ainy of the territories referred
to in Head (3) above, to consider-
(i) what that Appellate Jurisdic-
tion should be. i n c 1 u d i n g
extent if any to which the

FBNTH MEETING REGIONAL
ECONOMIC COMMITTEE.
The Tenth Meeting of the Regional
Economic Committee, held in George-
town, British Guiana, under the Chair-
manship of Sir FRANK .MCDAVID,
K.C.M.G., C.B.E., concluded its sessions
on Tuesday, the 31st May, 1955. The
meeting was formerly opened by His
Excellency the Governor. Sir ALFRED
SAVAGE, K.C.M.G., in the L'egislative
Council Chamber on Friday, the 26th
May, in the presence of a large gather-
ing. Delegates and their Advisers in-
cluded distinguished leaders in the
political, commercial and official life of
the British Caribbean.
The Meeting reached agreement ona
active measures to be taken in the in-
terests of export industries, of rep-
resentation overseas, of intra-regional
shipping and the promotion of co-oper-
ative action in economic matters affec-
ting the whole region. On these
matters recommendations will go to
Government shortly.
A.-rangements were in mle for sending
a Regional Economic Committee Citrus
Delegation to London to pursue negoti-
ations for United Kingdom assistance to
the Citrus Indrustry based on assurance
given by Her Majesty's Government in
June and November. 1954 and on the
Fact Finding Mission's Report. By
unanimous accord the Committee ac-
credited a Regional Economic Com-
mittee Banana Delegation (initiated by
Jamaica) to London. on which the in-
terests of the Windward and L.,eward
Islands will be represented. The Com-
mittee also agreed (on the suggestion
of Trinidad) that Regional Economic
committeee Delegations while in London
confer with the West India Committee
with a' view to supporting the later's
efforts to secure a reduction of the Rum
Duty.
A decline in exports to Canada was
carefully studied and recommendations
made to Governments for sponsoring
special efforts by Exporters and Comn-
modity Organisations to increase sales.
The arrangements would include a
small advisory team of specially ex-
perienced businessmen to work in con-
sultations with the Trade Coinmmissioner
who attended the meeting. A decision
to appoint a separate Assistanti Trade
Commissioner (students) for carrying
out a Liasion Service for hundretis of
British Wist Indies students in Canada,
should increase the Trade Conuni.ision-
er's opportunities for trade promotion
work.
Arrangements were agreed upon for
setting up British West Indies Students
Liaison Services in the United Kingdom
and in the United States (if America.
The offer of the Jamaica Government to
continue to maintain the present Mig-
rant Workers Service in the United
Kingdom which extends to migrants
from other territories as well \\as ac-
cepted. The Governments of Jamaica
and Barbados have in haiid thorough
investigations of the type of agency
most suitable and arrangements were
made to co-ordinate results fir rn gional
action on the problem.
Measures for promoting an expansion
of inter-regional trade in British Hon-
duras and British Guiana timbers wi re
recommended. The Committee discus-
sed with representatives of WINCO
(West Indies Navigation Company) sev-
eral matters affecting the operations of
the SS "West Indian and also approv-
ed small reductions of passenger fares
proposed by the Company for ceritin
sections of the route.
The Committee made reccn11imnld-
ations to the British Caribi ,an Air
Transport Advisory Couneil for ex-
pediting a technical examination- of
factors which have delayed the pro-
visions of adequate air facilities in St.
Vincent, Dominica and other islands.
It was agreed that the Excutive
Secretary should for the time be-ing
serve as Copra Clearance Officer in dilal-
ings with surpluses of copra and with
ancillary products as rpec;ninieud idl by
the recent Oils and Fats Conference.
There was unanimous agreement that
in view of its proven effectiveness as
a centre for co-oper;tivo action in the
region, the Reional Economic Com-
mittee and Trade Commissioner service
whose initial period expires on 21st
December, 1955, he reconstitute,! on the
same basis for a further period of there
years unless sooner determii, ed by ac-
tion taken by a Federal Goveinment.
Consequent financial and administrative
recommendations were decided upon.

AN ORDINANCE further to amend the Summary Conviction
Offences (Procedure) Ordinance, Chapter 13.

Enacted by the Legislature of Saint Vincent.
1. This Ordinance may be cited as the Summary Convictioa.
Offences (Procedure) (Amendment) Ordinance, 1955, and shall
be read as one with the Summary Conviction Offences (Proce-
dure) Ordinance (hereinafter referred to as the "principal
Ordinance") and all -amendments thereto.
2. Sections 59 and 60 of the Principal Ordinance and the
Schedule thereto are hereby repealed and replaced as follows:--

59. (1) Where a person who is an adult is
charged before the Court with an indictable
offence specified in the. Schedule to this Or-
dinance, the Court, if it thinks it expedient
so to do, having regard to any representation
made in presence of the accused by or on

behalf of the prosecutor, the character and
anticedents of the accused, the nature of the
offence, the absence of circumstances which
would render the offence one of grave or
serious character and all the other circum-
stances of the case (including the adequacy
of the punishment which the Court has power
to inflict), and if the accused, when informed
by the Court of his right to be tried by a jury,
consents to be dealt with summarily, may,
subject to the provisions of this section, deal
summarily with his offence, and if the
accused pleads guilty to, or is found g-uilty of,
the offence charged, may sentence him to be
imprisoned for six months or to a fine not
exceeding two hundred and forty dollars.
(2) If the Court at any time during the
hearing of a charge for such an indictable
offence as aforesaid against a person who is
an adult, becomes satisfied that it is expedi-
ent to deal with the case summarily, the Court
shall thereupon, for the purpose of proceed-
ings under this Section, cause the charge to
be reduced into writing (if this has not al-
ready 'been done) and read to the accused,
and shall then address to him a question to
the following effect:-
Do you desire to be tried by a jury, or do
you consent to the case being dealt with sum-
marily by this Court ?" with a statement, if
the Court thinks such a statement desirable
for the information of the person to whom
the question is addressed, of the meaning
of the case being dealt with summarily, and
the sitting of the. Supreme Court at which he
will be tried if tried by a jury, and if the ac-
cused consents to be dealt with summarily,
shall forthwith ask him, the following ques-
tion:-" Do you plead guilty, or not guilty?".
(3) In this section the expression, adult"
means a person who is, in the opinion of the
Court before which he is charged of the age
of 16 years or upwards."

AN ORDINANCE further to amend the Summary Conviction
Offences Ordinance, Chapter 14.

Enacted by the Legislature of Saint Vincent.
1. This Ordinance may be cited as the Summary Convic.--r Short title.
Offences (Amendment) Ordinance, 1955, and shall be read as
one with the Summary Conviction Offences Ordinance (herein- Cap. 14.
after referred to as "the principal Ordinance") and all amend-
ments thereto.
2. The amendments specified in the second column of the Schedule of
Schedule to this Ordinance shall be made in the provisions of Amendments
the principal Ordinance specified in the first column of that to Principal
Schedule. Ordinance.

52. For the words "five pounds" appearing in the second line, the words

PENSIONS (AMENDMENT) REGULATIONS.
(Gazetted 7th June, 1955).
1. Short title. These Regulations may be cited as the Pensicns (Amend-
ment) Regulations, 1955, and shall be read as one with the Pensions Regulations
1948, contained in the First Schedule to the Pensions Ordinance, 1948, (No. 16 of
1948) hereinafter referred to as the principal Regulations) and all amendments
thereto.
2. Regulation 23 of principal Regulations revoked and
replaced. Regulation 23 of the principal Regulations is hereby revoked and
replaced as follows:-
"Officers 23. (1) This Regulation shall apply to an officer who while
injured or in the service of the Colony either:
contracting (a) is permanently injured in the actual discharge of his
diseases in duty by some injury specifically, attributable to the
the discharge nature of his duty which is not wholly or mainly due
of their to, or seriously aggravated by, his own serious and
duties. culpable negligence or misconduct, or
(b) contracts a disease to which he'is specifically exposed
by the nature of his duty, not being a disease wholly
or mainly due to, or seriously aggravated by,' his own
serious and culpable negligence or misconduct.
(2) In this Regulation, unless the contrary intention ap-
pears, references to an officer being injured and to the date on
which an injury is sustained shall respectively be construed
as including references to him contracting such a disease as is
mentioned in paragraph (1) of this Regulation and to the date
on which such disease is. contracted.
(3) Where an officer to whom this Regulation applies is,
holding a pensionable office in which he has been confirmed:
(a) he may, if his retirement is necessitated or materially
accelerated by his injury tand.. he has been in the pub-
lic service for less than ten years, be granted, in lieu
of any gratuity under Regulation 5 or Regulation 12
of these" Regulations, a pension under Regulation 4,
Sq 1 9, 10 or 11, as the case may be, as if the words "for
S V Iten years or more" were omitted from the said Regu-

(b) he may be granted on retirement an additional pen-
sion at the annual rate of the proportion of h6 actual
pensionable emoluments at the date of his injury
appropriate to his case as shown in the following
table:-
When his capacity to contribute to his own sup-
port is:-
slightly impaired, ...... five sixtieths;
impaired, ...... ten sixtieths;
materially impaired, ...... fifteen sixtieths;
totally destroyed, ...... twenty sixtieths:
Provided that the amount of the additional pen-
sion may be reduced to such an extent as che Governor
in Council shall think reasonable where the injury
is not the cause or the sole cause of retirement.
(4) (a) Where an officer to whom this Regulation applies is
not holding a pensionable office, or is holding a pensionable
office in which he has noi- been confirmed, he may be granted
on retirement a pension oi the same amount*as the additional
pension which might be .,rantpd to him under paragraph (3)
of this Regulation if his office, were a pensionable office and he
had been confirmed therein.
(b) The provisions of Regulation 24 shall not. ppply to a
pension granted under this paragraph.
(5) (a) If, for the purpose of assessing the amount of any
additional pension or pension to be granted under sub-paragraph
(b) of paragraph (3) or under paragraph (4) of this Regulation
to any officer to whom this Regulation applies, the degree of per-
manent impairment of his capacity to contribute to his support
is in doubt, he may be granted a provisional awaid to have
effect until such time as the degree of permanent impairment
can be determined.
(b) The provisions of Regulation 24 shall not apply to an
award made under this paragraph.
(6) If an officer proceeding by'.a route approved by t he
Governor to or from the Colony at the commencement or term-
ination of his service therein, or of a period leave therefrom is
permanently injured as the result of damage to the vessel, air-
craft or vehicle in which he is travelling, or of any act of violence
directed against such vessel, ,aircraft or vehicle, and the Gov-
ernor is satisfied that such damage or act is attributable to
circumstancess arising out of any war in which Her Majesty
may be engaged, such officer shall be deemed for the purposes
of this Regulation to have been injured in the circumstances
described in paragraph (1) of this Regulation.
(7) An officer who is permanently injured wh'le travelling
by air in pursuance of official instructions, and whose injury
is not wholly or mainly due to, or seriously aggravated by, his
own serious and culpable negligence or misconduct, shall be
deemed for the purposes of this Regulation to have been in-
jured in the circumstances described in paragraph (1) of this
Regulation:
Provided that in such a case the rates of pension pre-
.scribed in paragraph (3) of this Regulation shall be seven and
a half sixtieths; fifteen sixtieths; twenty-two and a half
sixtieths and thirty sixtieths respectively.
(8) Neither sub-paragraph (b) of paragraph (J) nor para-
graph (4) of this Regulation shall apply in the case of an
officer selected for appointment to the service of the Colony
on or after the 16th day of May, 1955 who, in consequence of
his injury, is entitled to compensation under the Workmen's
Compensation Ordinance, 1939, or any Ordinance amending
or replacing. that Ordinance.
(9) Neither paragraph (3) nor paragraph (4) of this
Regulation shall apply in the case of an officer who in conse-
quence of his -injury is entitled under the Colonial Superan-
nuation Scheme to benefits corresponding to the benefits
granted under those paragraphs.
(10) (a) Where the Governor is satisfied that damages
have been or will be recovered by an officer in respect of an
injury for which an additional pension or pension may be
granted under sub-paragraph (b) of paragraph (3) or under
paragraph (4) of this Regulation, the Governor may take those
damages into account against such additional pension or pen-
.sion in such manner and to such extent as he may think fit
and may withhold or reduce the additional pension or pension
accordingly.
(b) For the purpose of this paragraph an officer shall be
deemed to recover damages whether they ara paid in pur-
suance of a judgement or order of the court or by way of
.settlement or compromise of his claim and whether or not pro-
ceedings are instituted to -enforce that claim."

4. NOTICES OF MOTIONS.
The Member for Kingstown gave notice of the following Motion and stated
that he would, at a later stage. request the permission of the President and
the House to suspend the Standing Rules and Orders to permit the Motion to
be debated:
WHEREAS the new Development and Welfare Act which has very recent-
ly been introduced and passed by Parliament of Her Majesty's Government .4
has made an allocation to St. Vincent in the sum of 540,000:
AND WHEREAS due to St. Vincent's dire need for development in both
the Economic and Social fields the sum so allocated -could only meet an
approximate 30% of the island's imunediate needs;
BE IT RESOLVED, that in the light of the new proposed,development of
a cross country road in this island that very strong representation be
mad-e to Her Majesty's Government through the Secretary of State for
Overseas Governments and Administrations, and that if possible a d'ae-
gation be briefed to go to the United Kingdom for the purpose.
5. NOTICES OF QUEIieNS.
There were no notices of Questions.
6. PETITIONS.
There were no Petitons presented.
7. PAPERS.

8. MOTIONS.
The Member for North Windward, seconded by the Acting Crown Attorney,
moved the first Motioni standing in his name-
WHEREAS the Laws of this Colony, are behind most, of the sister neigh-
bouring colonies as far as revision is concerned to conform more closely
with the Laws of England; and this makes revision a dire necessity;
AND WHEREAS urgent consideration should be given to the Law relating
to divorce in this Colony for purposes of rectifying a gap and the standard
of morality of living of our people in organized society;

AND WHEREAS dhe grounds for a decree nisi or absolute is based only
on the ground of adultery with no alternative such as desertion or other
forms of cruelty as is the case in the laws of England and most of our
sister neighboring colonies;
BE IT RESOLVED that the law relating to divorce be revised to include
desertion to conform at least with laws that are in conformity in other
colonies and in England;
BE IT FURTHER RESOLVED that this period for desertion be three years.
The Motion was passed unanimously.
The Member for North Windward then moved the second Motion standing
in his name-
WHEREAS on the 24th day of July 1952 a Resolution was brought to
this Legislative Council resolving that the minimum Wage for unskilled
workers and labourers be increased so that the labouring population of
this Colony may have some relief from very lew wages fixed in the Colony;
AND WHEREAS the minimum wage paid in the Colony has not been
revised as yet to suit the condition of work performed by labourers and
unskilled workers both in Government and private concerns;
BE IT RESOLVED that the Minimum Wage at present fixed by the Gov-
ernment be revised and that a wage of $1.80 cents per day be paid to a
male labourer or unskilled worker and that a wage of $1.20 be paid to a
female worker in order that the labouring population be able to exist and
live in the least minimum, normal domestic lives of this Colony.
The Motion was seconded by the Member for the Grenadines.

After the debate the Member for North Windward moved the following
amendment to the resolve of the Motion:-
Be it resolved that the minimum wage at present fixed by the Gov-
ernment be revised and that an increased wage be paid to all workers
in order that the labouring population be able to exist and live normal
domestic lives of this Colony.
The amendment was seconded by the Member for South Windward and
accepted by the House. The Motion as amended was then passed nem con.
The Member for South Leeward, seconded by the Member for Kingstown,
moved the following Motion-
BE IT RESOLVED that Government consider the possibility of utilising
the lands of the Ottley Hall Prison Farm, for the purpose of training juven-
ile cases to become better citizens, after being brought and convicted in
the Magistrate's Court;
AND BE IT FURTHER RESOLVED that Government consider other cases
upon special recommendation, either by the Public Assistance Officer or
by a Oommittee specially appointed for the purpose.
The Motion was debated and passed unanimously.
The Member for Kingstown then sought and obtained the permission of
the President and the House to debate the Motion of which he had previously
given notice:-
WHEREAS the new Development and Welfare Act which has very re-

ADJOURNMENT.
On the Motion for Adjournment, the Member for North Windward request-
ed that investigation should be made with regard to the payment of salary
to Mrs. Smith, former Caretaker of the Canouan Rest House.
The Member for Central Windward drew the Council's attention to the
outbreak of typhoid in the Park Hill-Diamond-Three-Ri-vers-South Rivers
area.
The Meeting adjourned sine die at 12.55 p.m.
