A PROCLAMATION.

WHEREAS by section 4 of the
Transfer of Sombrero Act, 1956 (No.
1/1955) it is provided that the said
- Act shall come into operation ona
day to be appointed by the Governor
by proclamation published in the
Gazette.
NOW, THEREFORE, I, KENNETH
WILLIAM BLACKBURNE, a Knight
Commander of the Most Distinguish-
ed Order of Saint Michael and Saint
George, an Officer of the Most Excel-
lent Order of the British Empire,
Governor and Commander in Chief
in and over the Colony of the Leeward
Islands and Vice Admiral of the same,
do by this my proclamation declare
that the said Act shall come into opera-
tion on the first day of May, 1956.
AND all Her Majesty’s officers and
loving subjects in the said Colony and
all others whom it may concern are
hereby required to take due notice
hereof and to give their ready obedi-
ence accordingly.
GIVEN at the Government House,
Antigua, this 21st day of March,
1956, and in the fifth year of
Her Majesty’s reign.

PRISONS DEPARTMENT.
Vacancy for an _ Assistant
Superintendent of Prisons,
British Guiana. .
Applications are invited from suit-
ably qualified persons for appoint-
ment to a vacant post of Assistant
Superintendent of Prisons in the
Prisons Department. The post is on
the permanent and pensionable estab-
lishment of the Colony and is on the
salary scale A 9: $3,120x$144—
$3,984]] x $144-$4,560. Free quar-
ters are provided or a house allowance
is paid in lieu thereof.
2. The duties of the post are as
follows: --
(i) to be in charge of the admin-
istration of a Prison and of
the training of subordinate
officers;
(ii) checking warrants of com-
mitment, their daily entry
in the registers and the
accuracy of entries record-
ing the dates of discharge of
prisoners;
(iii) inspecting daily every part of
the Prison at which he may
be station ond. as) fre-
quently as ‘sible gangs

quests of prisoners and
charges against them; and
dealing with the charges in
accordance with the rules
and regulations governing
the Prisons of the Colony;
(v) interviewing all prisoners on
admission and on discharge.
(vi) paying night visits to the
Prison at which he may be
stationed to ensure proper

(vii) observing strictly and carry-
out Prison Rules and Orders
and instructions of the
Superintendent, and ensur-
ing compliance therewith by
all concerned; and
(vili) such other duties as may be
assigned to him by the
Superintendent of Prisons.
3. Candidates should be under 35
years of age, of good physique and
personality, and have ability to com-
mand respect. Previous Prison, Police
or Military Service would be an asset
but is not essential. The educational
qualifications shall be a First Class
Army Certificate of Hducation: or
the Cambridge School Certificate
with credits in at least four subjects
of which one must be English Lan-
guage, or the General Certificate of
Education at Ordinary Level with
passes in at least five subjects of
which one mnst be English Language;
in either case, three of the subjects
must be obtained at one examination,
but the supplementary credits or sub-
jects need not be from the same
examining body eg., a School Certi-
ficate with 3 credits may be supple-
mented by a G.C.E. Certificate at
Ordinary Level. Tixperience of agri-
culture and mixed farming would be
an advantage.
4. The conditions in paragaaph 3
in respect of the age and educational
qualification requirements do not
apply to applicants who are already
in the Service or are in a Prison
Service.
5. The successful candidate, if
not already in the Service, will be
required to pass a medical examina-
tion for admission thereto.
6. Vacation leave is earned at the
rate of five days for each completed
month of resident service up to a
maximum of six months, subject to
the completion of a minimum tour of
service of two years. ‘lhe candidate
selected will be eligible for the grant
of assisted leave passages. in accord-
ance with the Public Officers Leave
(Passages) Regulations No. 34 of 1952.

Applications are invited for ap-
pointment to the post of Senior
Draughtsman, Windward Islands,
particulars of which are as follows:—
Appointment: The post is non-
pensionable, and appointment thereto
will be on a temporary contractual
basis for a period of 2 years in the
first instance. The officer will be
subject to the Colonial Regulations
aud the local General Orders for the
time being in force, so far as they are
applicable. The officer will be a
member of the staff of the Executive
Architect, Windward Islands, and
will be stationed in St. Lucia.
Salary: The salary will be at the
rate of $3,360 (£700) per annum in
the scale $3,360 x 120-3,600 (£700 x
25-750) per annum.
Qualifications: Applicants should
have had at least 5 years experience
of work usually undertaken by an
Architect's Office und be thoroughly
conversant with the preparation of
working drawings and specifications,
Quarters: Quarters are not pro-
vided.
Passages: Free passages to St.
Lucia will be provided for the officer,
his wife, and children, not exceeding
5 persons in all; children to be under
18 years of age, unmarried and de-
pendent on the officer. Free return
passages will also be provided on the
satisfactory termination of the period
of engagement.
Leave: Vacation leave on full sal-
ary will be granted ut the rate of one
week for each completed period of 12
months service. Such leave to be
taken on the satisfactory termination
of the officer’s contract,
Medical Attention: Free medical
attention and medicines are not pro-
vided.
Taxation: All Government offi-
cers are liable to taxation imposed by
local legislation.
Applications, giving full particulars’
of applicants’ qualifications and ex-
perience, and accompanied by two
testimonials, which will not be
returned, should be addressed to the
Chief Secretary, Windward Islands,
at Grenada, and should reach him not
later than the 30th April, 1956.

ENACTED by the Legislature of Antigua
as follows:—
1. This Ordinance may be cited as the
Antigua Constitution and Elections (Amendment)
Ordinance, 1956, and shall be read as one with the
Antigua Constitution and Elections Ordinance,
1951, as amended hereinafter called the Principal
Ordinance.
2. Section 12 of the Principal Ordinance is
hereby amended as follows: —
(i) by substituting in subsection (1) the
words “every official member appointed by

as follows —
1. This Ordinance may be cited as the
Development (Telephone) Loan (Amendment)
Ordinance, 1956, and shall be read as one with the
Development (Telephone) Loan Ordinance, 1954,
hereinafter culled the Principal Ordinance.
2. The Long Title of the Principal Ordi-
nance shall have effect as if for the words ‘‘ two
hundred and sixteen thousand dollars ’’ there were
substituted the words “three hundred thousand

OBJECTS AND REASONS.
{
The object of this Bill is to increase the amount authorised
by the Principal Ordinance to be raised by way of loan for the
purpose of financing the re-organisation of the telephone
system in Antigua from $216,000 to $300,638.40 consequent
on the revision of the estimates for this project.

An Ordinance to amend the Aid to Pionear Industries
Industries Ordinance, 1950.

ENACTED by the Legislature of Autigua as follows:
1. This Ordinance may be cited as the Aid to Pioneer
Industries (Amendment) Ordinance 1956, and shall be
read as one with the Aid to Pioneer Industries Ordinance,
‘1950, hereinafter referred to as the Principal Ordinance.
2. Subsection (1) of section 4 of the Principal
Ordinance is hereby amended by adding at the end thereof
the following proviso:—
“ Provided that the Governor in Council may in
any such order impose continuing conditions to
be observed by the’pioneer manufacturer and
subject to which the statug of pioneer manufac-
ture may be retained.
In this section the expression “continuing
conditions� means conditions which may con-
tinue for a period of not more than five yours,â€

8. Section 5 of the Principal Ordjnance is hereby
repealed and replaced by the following section:—
“5. (1) Every pioneer manufacturer shall be
entitled upon the issue to him of a licence by the
Governor in Council and subject to such terms and
conditions as may be imposed by such licence, to
import into the Presidency free of customs duty, or
to purchase in the Presidency subject to refund of
customs duty, during a period of five years commenc-
ing on the date on which he became a pioneer mann-
facturer by virtue of an order made under section 4
of this Ordinance, such of the articles included in the
Schedule to this Ordinance, as may be specified in
such licence, if he satisfies the Chief Accountant that
such articles are or were required for the construction,
alteration, re-construction or extension of the pioneer
manufacturer, or for equipping such pioneer factory
or extension thereof for the purpose of manufacturing
the relevant pioneer product or products, so however,
that relief from customs duty shall not be granted
under this section in respect of articles which in the
opinion of the Chief Accountant are or were intended
for the purpose of effecting repairs to such pioneer
factory or extensidn thereof, or to any apparatus,
machinery, appliances or equipment in any pioneer
factory or extension thereof.
(2) Every holder of a licence issued under the
authority of the lust preceding’ subsection who
satisfics the Chief Accountant—
(a) that any article specified in the
licence has been purchased by him in the
Presidency subject to the terms and condi-
tions imposed by the licence and that
customs duty was paid upon the importation
into the Presidency of such article;
(6) as to the amount of the customs
duty so paid,
shall be entitled to be refunded by the Chief
Accountant the amount of the customs duty so paid:
Provided that where the holder of the licence satisfies
the Chief Accountant that he is unable to ascertain
the amount of the customs duty paid, he shall be
entitled to be paid by the Chief Accountant by way of
refund of customs duty such sum as is, in the opinion
of the Chief Accountant, reasonable: Provided further
that no refund of customs duty shall be made under
this subsection where the amount of customs duty so
paid, or the sum which the Chief Accountant assesses
as a reasonable sum to be paid by way of refund of
customs duty, as the case may be, is less than ten
dollars.â€

(1) thereof,

otherwise disposed of by such pioneer manufacturer
except—

neer factory for the purpose of which such article
was acquired, to the assignee of such factory; or
(6) upon the pioneer manufacturer paying,
or giving security to the satisfaction of the
Chicf Accountant for the payment of,
(i) an amount equivalent to the amount
of customs duty which, but for
the provisions of this Ordinance,
would have been payable upon the
importation into the Presidency
of such article, where such article
was so imported by such pioneer
manufacturer, or
: Gi) an amount equivalent to the amount
refunded to such pioneer manu-
facturer by way of relief from
customs duty nnder the provisions
of subsection (2) of section 5 of this
Ordinance, where such article was
purchased in the Presidency by
such pioneer manufacturer; or
(c) after the expiration of five years from
the date of the acquisition of such article.â€

6. Section 10 of the Principal Ordinance is heraby
amended—
(a) by adding thereto the following subsection
immediately after subsection (4) thereof:—
“ (4A) Where the Governor in Council
Council is satisfied that any pioneer manu-
facturer has broken any of the conditions
contained in the order declaring him to be
a pioneer manufacturer and subject to which
he was so declared to be a pioneer manufac-
turer and that having regard to all the
circumstances of the case it is expedient so
to do, he may revoke the order made under
section 4 of this Ordinance declaring such
person to be a pioneer manufacturer in
relation to the pioneer factory and pioneer
industry in respect of which such order was
made.â€
(6) by adding the words “or any refund of
customs duty he has received in respect of the pur-
chase of articles in the Presidency †immediately after
the word “articles†in line eight of paragraph (5)
thereof. ,
(c) by adding thereto the following subsection
immediately after subsection (5) thereof :—
“ (5A) When any order made under
section 4 of this Ordinance is revoked under
the provisions of subsection (4A) of this
section the provisions of section 5 and sec-
tion 8 of this Ordinance shall be deemed
never to have applied to the person declared
to be a pioneer manufacturer under such
order in respect of the pioneer factory and
pioneer industry specified in such order;
and such person shall, notwithstanding
anything contained in the Customs Duties
Ordinance or the Income Tax Ordinance, be
liable to pay to the Chief Accountant all sums
which but for the provisions of section 5 of
the Ordinance would have been payable as
customs duty on articles acauired for the
construction, alteration, re-construction or
extension of the pioneer factory, or for
equipping such factory or any extension
thereof for the purpose of manufacturing
the relevant pioneer product or products,
and all sums refunded to him by the
Chief Accountant under the authority of sub-
section (2) of section 5 of this Ordinance, and
to the Commissioners of Income Tax such
income tax as would but for the provisions of
.

section & of this Ordinunce have been payable
in respect of the pioneer enterprise:
Provided that if in the opinion of the Governor in
Council liability to the payment in full of any such sums
or any such tax would canse undue hardship or if for
any other reason the Governor in Council deems it
expedient so to do, the Governor in Council may remit
the whole or any part of such sums or tax.â€
7. Subsection (3) of section 11 of the Principal
Ordinance is hereby amended by substituting for the
expression “under the provisions of subsection (5)†the
expression ‘and to the Commissioners of Income Tax
under the provisions of subsection (5) or subsection (5.4),
as the case may be,â€.

OBJECTS AND REASONS.
The object of this Bill is to amend the Aid to Pioneer
Industries Ordinance, 1950 to provide for the refund of
customs duty on items in the Schedule purchased locally
in cases where the duty is not less than ten dollars and
also to provide for the issue of a licence for the refund of
such duty by the Governor in Council.

1/1955) it is provided that the said

WILLIAM BLACKBURNE, a Knight
Commander of the Most Distinguish-
ed Order of Saint Michael and Saint
George, an Officer of the Most Excel-
lent Order of the British Empire,
Governor and Commander in Chief
in and over the Colony of the Leeward
Islands and Vice Admiral of the same,
do by this my proclamation declare
that the said Act shall come into opera-
tion on the first day of May, 1956.

Vacancy for an _ Assistant
Superintendent of Prisons,
British Guiana. .
Applications are invited from suit-
ably qualified persons for appoint-
ment to a vacant post of Assistant
Superintendent of Prisons in the
Prisons Department. The post is on
the permanent and pensionable estab-
lishment of the Colony and is on the
salary scale A 9: $3,120x$144—
$3,984]] x $144-$4,560. Free quar-
ters are provided or a house allowance
is paid in lieu thereof.
2. The duties of the post are as
follows: --
(i) to be in charge of the admin-
istration of a Prison and of
the training of subordinate
officers;
(ii) checking warrants of com-
mitment, their daily entry
in the registers and the
accuracy of entries record-
ing the dates of discharge of
prisoners;
(iii) inspecting daily every part of
the Prison at which he may
be station ond. as) fre-
quently as ‘sible gangs

charges against them; and
dealing with the charges in
accordance with the rules
and regulations governing
the Prisons of the Colony;
(v) interviewing all prisoners on
admission and on discharge.

out Prison Rules and Orders
and instructions of the
Superintendent, and ensur-
ing compliance therewith by
all concerned; and
(vili) such other duties as may be
assigned to him by the
Superintendent of Prisons.
3. Candidates should be under 35
years of age, of good physique and
personality, and have ability to com-
mand respect. Previous Prison, Police
or Military Service would be an asset
but is not essential. The educational
qualifications shall be a First Class
Army Certificate of Hducation: or
the Cambridge School Certificate
with credits in at least four subjects
of which one must be English Lan-
guage, or the General Certificate of
Education at Ordinary Level with
passes in at least five subjects of
which one mnst be English Language;
in either case, three of the subjects
must be obtained at one examination,
but the supplementary credits or sub-
jects need not be from the same
examining body eg., a School Certi-
ficate with 3 credits may be supple-
mented by a G.C.E. Certificate at
Ordinary Level. Tixperience of agri-
culture and mixed farming would be
an advantage.
4. The conditions in paragaaph 3
in respect of the age and educational
qualification requirements do not
apply to applicants who are already
in the Service or are in a Prison
Service.
5. The successful candidate, if
not already in the Service, will be
required to pass a medical examina-
tion for admission thereto.
6. Vacation leave is earned at the
rate of five days for each completed
month of resident service up to a
maximum of six months, subject to
the completion of a minimum tour of
service of two years. ‘lhe candidate
selected will be eligible for the grant
of assisted leave passages. in accord-
ance with the Public Officers Leave
(Passages) Regulations No. 34 of 1952.

pensionable, and appointment thereto
will be on a temporary contractual

Architect, Windward Islands, and
will be stationed in St. Lucia.
Salary: The salary will be at the
rate of $3,360 (£700) per annum in
the scale $3,360 x 120-3,600 (£700 x
25-750) per annum.
Qualifications: Applicants should
have had at least 5 years experience
of work usually undertaken by an
Architect's Office und be thoroughly
conversant with the preparation of
working drawings and specifications,
Quarters: Quarters are not pro-
vided.
Passages: Free passages to St.
Lucia will be provided for the officer,
his wife, and children, not exceeding
5 persons in all; children to be under
18 years of age, unmarried and de-
pendent on the officer. Free return
passages will also be provided on the
satisfactory termination of the period
of engagement.
Leave: Vacation leave on full sal-
ary will be granted ut the rate of one
week for each completed period of 12
months service. Such leave to be
taken on the satisfactory termination
of the officer’s contract,
Medical Attention: Free medical
attention and medicines are not pro-
vided.
Taxation: All Government offi-
cers are liable to taxation imposed by
local legislation.

ENACTED by the Legislature of Antigua
as follows —
1. This Ordinance may be cited as the
Development (Telephone) Loan (Amendment)
Ordinance, 1956, and shall be read as one with the
Development (Telephone) Loan Ordinance, 1954,
hereinafter culled the Principal Ordinance.
2. The Long Title of the Principal Ordi-
nance shall have effect as if for the words ‘‘ two
hundred and sixteen thousand dollars ’’ there were
substituted the words “three hundred thousand
six hundred and thirty eight dollars and forty
centsâ€.
8. The Preamble to the Principal Ordinance
shall have effect as if for the words “ two hundred
and sixteen thousand dollars†there were
substituted the words “ three hundred thousand
six hundred and thirty eight dollars and forty
cents â€â€™.

OBJECTS AND REASONS.
{
The object of this Bill is to increase the amount authorised
by the Principal Ordinance to be raised by way of loan for the
purpose of financing the re-organisation of the telephone
system in Antigua from $216,000 to $300,638.40 consequent
on the revision of the estimates for this project.

An Ordinance to amend the Aid to Pionear Industries
Industries Ordinance, 1950.

ENACTED by the Legislature of Autigua as follows:
1. This Ordinance may be cited as the Aid to Pioneer
Industries (Amendment) Ordinance 1956, and shall be
read as one with the Aid to Pioneer Industries Ordinance,
‘1950, hereinafter referred to as the Principal Ordinance.
2. Subsection (1) of section 4 of the Principal
Ordinance is hereby amended by adding at the end thereof
the following proviso:—
“ Provided that the Governor in Council may in
any such order impose continuing conditions to
be observed by the’pioneer manufacturer and
subject to which the statug of pioneer manufac-
ture may be retained.
In this section the expression “continuing
conditions� means conditions which may con-
tinue for a period of not more than five yours,â€

8. Section 5 of the Principal Ordjnance is hereby
repealed and replaced by the following section:—
“5. (1) Every pioneer manufacturer shall be
entitled upon the issue to him of a licence by the
Governor in Council and subject to such terms and
conditions as may be imposed by such licence, to
import into the Presidency free of customs duty, or
to purchase in the Presidency subject to refund of
customs duty, during a period of five years commenc-
ing on the date on which he became a pioneer mann-
facturer by virtue of an order made under section 4
of this Ordinance, such of the articles included in the
Schedule to this Ordinance, as may be specified in
such licence, if he satisfies the Chief Accountant that
such articles are or were required for the construction,
alteration, re-construction or extension of the pioneer
manufacturer, or for equipping such pioneer factory
or extension thereof for the purpose of manufacturing
the relevant pioneer product or products, so however,
that relief from customs duty shall not be granted
under this section in respect of articles which in the
opinion of the Chief Accountant are or were intended
for the purpose of effecting repairs to such pioneer
factory or extensidn thereof, or to any apparatus,
machinery, appliances or equipment in any pioneer
factory or extension thereof.
(2) Every holder of a licence issued under the
authority of the lust preceding’ subsection who
satisfics the Chief Accountant—
(a) that any article specified in the
licence has been purchased by him in the
Presidency subject to the terms and condi-
tions imposed by the licence and that
customs duty was paid upon the importation
into the Presidency of such article;
(6) as to the amount of the customs
duty so paid,
shall be entitled to be refunded by the Chief
Accountant the amount of the customs duty so paid:
Provided that where the holder of the licence satisfies
the Chief Accountant that he is unable to ascertain
the amount of the customs duty paid, he shall be
entitled to be paid by the Chief Accountant by way of
refund of customs duty such sum as is, in the opinion
of the Chief Accountant, reasonable: Provided further
that no refund of customs duty shall be made under
this subsection where the amount of customs duty so
paid, or the sum which the Chief Accountant assesses
as a reasonable sum to be paid by way of refund of
customs duty, as the case may be, is less than ten
dollars.â€

4. Subsection (1) of section 6 of the Principal Section 6 (1)

“Every pioneer manufacturer who
imports into the Presideucy or purchases in
the Presidency any article in respect of
whici he has been granted relief from
customs duty under the provisions of
section 5 of this Ordinance shall—â€
(6) by adding the words ‘or purchased †im-
mediately after the word “imported†in paragraph
(1) thereof,

(1) No article acquired by any pioneer manu-
facturer free of customs duty under the provisions
of this Ordinance shall be sold, given away or
otherwise disposed of by such pioneer manufacturer
except—
ce
(a) in the case of an assignment of the pio-
neer factory for the purpose of which such article
was acquired, to the assignee of such factory; or
(6) upon the pioneer manufacturer paying,
or giving security to the satisfaction of the
Chicf Accountant for the payment of,
(i) an amount equivalent to the amount
of customs duty which, but for
the provisions of this Ordinance,
would have been payable upon the
importation into the Presidency
of such article, where such article
was so imported by such pioneer
manufacturer, or
: Gi) an amount equivalent to the amount
refunded to such pioneer manu-
facturer by way of relief from
customs duty nnder the provisions
of subsection (2) of section 5 of this
Ordinance, where such article was
purchased in the Presidency by
such pioneer manufacturer; or
(c) after the expiration of five years from
the date of the acquisition of such article.â€

6. Section 10 of the Principal Ordinance is heraby
amended—
(a) by adding thereto the following subsection
immediately after subsection (4) thereof:—
“ (4A) Where the Governor in Council
Council is satisfied that any pioneer manu-
facturer has broken any of the conditions
contained in the order declaring him to be
a pioneer manufacturer and subject to which
he was so declared to be a pioneer manufac-
turer and that having regard to all the
circumstances of the case it is expedient so
to do, he may revoke the order made under
section 4 of this Ordinance declaring such
person to be a pioneer manufacturer in
relation to the pioneer factory and pioneer
industry in respect of which such order was
made.â€
(6) by adding the words “or any refund of
customs duty he has received in respect of the pur-
chase of articles in the Presidency †immediately after
the word “articles†in line eight of paragraph (5)
thereof. ,
(c) by adding thereto the following subsection
immediately after subsection (5) thereof :—
“ (5A) When any order made under
section 4 of this Ordinance is revoked under
the provisions of subsection (4A) of this
section the provisions of section 5 and sec-
tion 8 of this Ordinance shall be deemed
never to have applied to the person declared
to be a pioneer manufacturer under such
order in respect of the pioneer factory and
pioneer industry specified in such order;
and such person shall, notwithstanding
anything contained in the Customs Duties
Ordinance or the Income Tax Ordinance, be
liable to pay to the Chief Accountant all sums
which but for the provisions of section 5 of
the Ordinance would have been payable as
customs duty on articles acauired for the
construction, alteration, re-construction or
extension of the pioneer factory, or for
equipping such factory or any extension
thereof for the purpose of manufacturing
the relevant pioneer product or products,
and all sums refunded to him by the
Chief Accountant under the authority of sub-
section (2) of section 5 of this Ordinance, and
to the Commissioners of Income Tax such
income tax as would but for the provisions of

section & of this Ordinunce have been payable
in respect of the pioneer enterprise:
Provided that if in the opinion of the Governor in
Council liability to the payment in full of any such sums
or any such tax would canse undue hardship or if for
any other reason the Governor in Council deems it
expedient so to do, the Governor in Council may remit
the whole or any part of such sums or tax.â€
7. Subsection (3) of section 11 of the Principal
Ordinance is hereby amended by substituting for the
expression “under the provisions of subsection (5)†the
expression ‘and to the Commissioners of Income Tax
under the provisions of subsection (5) or subsection (5.4),
as the case may be,â€.

The object of this Bill is to amend the Aid to Pioneer
Industries Ordinance, 1950 to provide for the refund of
customs duty on items in the Schedule purchased locally
in cases where the duty is not less than ten dollars and
also to provide for the issue of a licence for the refund of
such duty by the Governor in Council.
