BY THE GOVERNOR OF THE
LEEWARD ISLANDS.

A PROCLAMATION.

Kk. W. BLACKBURNE,
Governor.

WHEREAS by section 50 of the
Interpretation and General Clauses
Act, 1955 (No. 12/1955) it is provided
that the said Act shall come into
operation on a day to be appointed
by the Governor by proclamation
published in the Gazette.

NOW, THEREFORE, I, KeNNETH
WiLtliamM BLACKBURNE, a Knight
Commander of the Most Distinguished

Order of Saint Michael and Saint
George, an Officer of the Most
Excellent Order of the British

Empire, Governor and Commander in
Chief in and over the Colony of the
Leeward Islands and Vice Admiral
of the same, do by this my procla-
mation declare that the said Act shall
come into operation on the 28th day
of February, 1955. :

AND all Her Majesty’s officers and
loving subjects in the said Colony
and all others whom it may concern
are hereby required to take due
notice hereof and to give their ready
ebedience accordingly.

GIVEN at the Government House,
Antigua, this 18th day of Febru-
ary, 1955, and in the fourth year
of Her Majesty’s reign.

March, 1955.

AND all Her Majesty’s loving sub-
jects in the Presidency of the Virgin
Islands and all others whom it may
concern are hereby required to take
due notice hereof and give their
ready obedience accordingly.

Declaration dated February 8,
1955, made under Section 8
of the Land Acquisition Act,
1944 (No. 11/1944), for the
acquisition of certain land in
the Presidency of Saint Chris-
topher Nevis and Anguilla
required for public purposes.

IT IS HEREBY DECLARED that
the Governor in Council with the
approval of the Legislative Council of
the Presidency of Saint Christopher
Nevis and Anguilla considers that
the land described in the Schedule
hereto, situate in the island of
Anguilla in the said Presidency,
should be acquired for public pur-
poses, namely, for the erection of a
health outpost, in the said Presidency.

SCHEDULE.

An area of approximately + of an
acre situate at South Hill in the
island of Anguilla in the Presidency
of Saint Christopher Nevis and
Anguilla, and bounded as_ follows,
that is to say, on the North and West
by lands of FRANCES ANN CARTY;
on the South by the public main
road; and on the East by a private
road.

THE REGISTRATION OF UNITED
KINGDOM -PAaTENTS ACT, 1925,

NOTICE IS* HEREBY GIVEN
that ERNST JOHAN JENS HENRIKSEN,
have applied for registration in the
Leeward Islands of United Kingdom



Patent No. 669,973 dated the 6th day

of January, 1947 and issued 6n the
30th day of July 1952 and have filed
in the Registrar’s Office at the Court
House St. John’s, Antigua, a complete
copy of the specifications and the
Certificate of the Comptroller General
of the United Kingdom Patent Office
giving full particulars of this patent
which will be open to public inspec-
tion at the said office at any time
between the hours of 9.30 a.m. and
3.30 p.m. on working days except on
Saturdays when the hours will be
from 9.30 a.m. to 12 noon,

Any person may within two
months from the date of this adver-
tisement give notice to the Registrar
of opposition to the issne of a certifi-
cate of registration upon any of the
grounds prescribed in section 10 of
the Patents Act, 1906, for opposition
to grant of Letters Patent.

An Ordinance to control the importation of
animals, birds, reptiles and insects, and to
regulate the treatment and disposal of animals
which are suffering or are suspected to be
suffering from any disease, and for other
matters related thereto or connected there-
with.

ENACTED by the Legislature of Montserrat

as follows:—

PART. I.

PRELIMINARY.

1. This Ordinance may be cited as the
Animals (Diseases and Importation) Ordinance,
1954, and shall come into operation on a date to
be appointed by the Governor by proclamation
published in the Gazette.

2. In this Ordinance, unless the context
otherwise requires—

“animals” includes cattle, buffalo, horses,
mules, asses, sheep, swine, goats, dogs,
eats, and all animals of whatsoever kind,
whether similar to the foregoing or not;

“bird” does not include poultry ;

“‘ carcass’? means the careass of any animal,
and includes any part of the carcass or of
the meat, bones, hide, skin, hoofs, horns,
offal or other part of an animal;

‘cattle’? includes bulls, cows, oxen, steers,
heifers and calves;

‘defined port’ means a port as defined by
any regulations made under section 14
of this Ordinance;

“disease” means anthrax, brucellosis, conta-
gious bovine pleuro-pneumonia, equine
encephalo-myelitis, equine infectious
anemia, epizootic abortions, epizootic
lymphangitis, foot and mouth disease,
glanders and farey, hemorrhagic septica-
mia, infectious laryngotracheitia, mange
ovine (commonly called sheep scab),
melitensis infection (commonly called
Malta fever), Newcastle disease (com-
monly called fowl pest or fowl plague),

. paralytic rabies (bat transmitted),
psittacosis, rabies, rinderpest, sarcoptic
mange in horses, swine erysipelas, swine
fever (commonly called hog cholera),
tuberculosis, trypanosomiasis (including
dourine, mal de caderas, surra and try-
panosoma vivax infection), variola ovina,
variola vaccinia, and such other diseases
as the Governor in Council may from
time to time by order made under
section 11 of this Ordinance declare to
be a disease within the meaning of this
Ordinance;

‘ diseased” means affected with disease;

‘“‘fodder”’ means grass, hay or any other
substances commonly used for the food
of animals;

“infected area’? means an area declared as
such under section 5 or 6 of this
Ordinance;

‘“‘infeeted place’ means a place declared as
such under section 5 of this Ordinance;

“insect ’’ includes members of the class
Insects and of the class Arachnida;

‘inspector ”” means an inspector appointed by
the Governor under section 38 of this
Ordinance;

“litter” means straw or any other substance
commonly used as the bedding for, or
otherwise used for or about animals;

‘‘owner ” includes the person in possession or
charge of any animal;

“poultry” means domestic fowls, turkeys,
geese, ducks, guinea fowls and pigeons;

“suspected” meuns suspected of being
diseased.

3. (1) The Governor may appoint an
inspector and such assistant inspectors as muy be
necessary for the purposes of this Ordinance;

(2) It shall be the duty of the inspector and
assistant inspector to carry out the provisions of
this Ordinance and of any regulations made there-
under and for such purpose every assistant
inspector shall have, subject to the directions
either general or particular of the inspector, all
rights, powers, and duties given to the inspector
under this Ordinance.

4. (1) Every person having in his posses-
sion or under his charge any diseased animal

shall—

(a) as far as practicable keep such
animals separate from animals not so diseased;
and

(6) with all practicable speed give
notice of the fact of the animal being so
diseased to the inspector, or to the person in
charge of the nearest police station.

(2) The person to whom notice under sub-
section (1) of this section is given, if not the
inspector, shall forthwith give information thereof
to the inspector.

5. (1) Where there is evidence that any
disease exists in any stable, shed, pen, field,
pasture, or other similar place, the inspector shall
forthwith sign a notice to that effect and such
notice shall contain a declaration that such place,
the limits whereof shall be therein specified, is an
infected place. A copy of such notice shall be
served upon the occupier of such place.

(2) Upon the service of such notice the place
therein specified shall be an infected place subject
to confirmation or otherwise by the Governor
in Council under the provisions of sub-section (4)
of this section:

Provided that the inspector may, at any time
within seven days of such service and before
such confirmation or otherwise, withdraw such
notice and thereupon such place shall cease to be
an infected place.

(3) The inspector shall with all practicable
speed send copies of such notice to the Commis-
sioner of the Presidency, and where any such
notice has been withdrawn the inspector shall
forthwith inform the Commissioner of the Presi-
dency to that effect.

(4) Upon receipt by the Commissioner of
the copies of such notice the Governor in Council
shall, unless such notice has been withdrawn,
forthwith consider the matter and—

(a) if satisfied that such course is
expedient or necessary, shall by order declare
the place specified in such notice to be an
infected place, and may also by order deciare
that any area containing, adjoining or sur-
rounding, such place is an area infected
with disease and such order shall specify the
limits of such infected aren; or

(b) if not so satisfied, shall by order
revoke the notice of the inspector, and there-
upon as from the time specified in that behalf
by such order such place shall cease to be an
infected place.

6. (1) The Governor in Council, whenever
it appears necessary or expedient so to do by
reason of the existence of any disease, may by
order declare any area in the Presidency ‘ Oo be
infected with disease, and such order shall
specify the limits of any such infected area.

(2) The Governor in Council wm y, in his
absolute discretion, by order prohibit, during such
time as may be specified in such order—

(a) the use in any manner whatever of
any public road through an infected area or
of any part of such public road; «

(6) the use, except in compliance with
such conditions as may be specified in such
order, or any such public road or of any part
of such public road.

7. No defined port, or part thereof, shall
be declared to be an infected place or an infected
area.

8. (1) The inspector may cause any diseased
or suspected animal, or any animal which had been
in the same stable, shed, pen field, pasture, or
other similar place, or in the same herd or flock
as, Or in contact with, any diseased or suspected
animal, whether or no any such place has been
declared to be an infected place or is within an
infected area, to be slaughtered in order to prevent
the spread of the disease, and for such purpose
the inspector may give all such directions as he
may consider necessary.

(2) The inspector may, for the purpose of
observation and treatment, take possession of and
retain any animal liable to be slaughtered under
this section, but subject to payment of compensa-
tion as in the case of actual slaughter.

9. Any animal slaughtered under the pro-
visions of this Ordinance, or which dies as the
result of disease, shall be destroyed, buried, or
otherwise disposed of as soon as possible in
accordance with the regulations made under this
Ordinance and ‘in accordance with the orders,

either general or particular, of the inspector; and
for such purposes the inspector may use any
suitable ground in the possession or occupation of
the owner of the animal.

10. (1) The Governor may in his discretion
award, for the compulsory slaughter of any animal
under the provisions of fuis Ordinance, compensa-
tion which shall be payable out of the general
revenue of the Presidency. The amount of any
such compensation shall not exceed the value of
the animal immediately before slaughter, and
compensation may be reduced or refused where
the owner has, in the opinion of the Governor,
been guilty in relation to the animal, of an offence
against this Ordinance.

(2) No compensation shall be payable in
respect of any animal compulsorily slaughtered
when in a quarantine depot, if, in the opinion of
the inspector, such animal was diseased at the
time of importation.

11. The Governor in Council may from
time to time by order add any particular disease,
or remove any particular disease from the defini-
tion of disease contained in section 2 of this
Ordinance, and as from the date of any such order
such particular disease shall be, or shall cease to
be (as the case may be), a disease within the
meaning of this Ordinance.

12. (1) The Governor in Council may make
regulations generally for the control and treatment
of diseased or suspected animals and for the pre-
vention and spread of disease.

(2) Regulations made under sub-section (1)
of this section may, without prejudice to the
generality of such power, make provision with
regard to—

eation of the provisions of this Ordinance in
relation to any animals suffering from any
particular disease.

(6) the notices to be given by persons
in possession or in charge of diseased animals
in the case of any particular disease, or in the
case of illness of any such animal, and the
persons to whom such notices are to he given;

(c) the notification to the public of
infected places or infected area: and the
removal of anything into, within or out of
such places or areas, and the cleansing or
disinfecting of such places or areas;

(d@) the movement of persons into,
within or out of infected places or infected
areas, and the prevention of the spread of
disease by persons in contact with diseased or
suspected animals;

(e) the treatment, disinfecting, destruc-
tion, burial, disposal, and digging up, of
anything in or removed from an infected

place or infected area;

(/) tbe movement, isolation, segregation,
treatment. slaughter, destruction, disposal,
burial, seizure, detention, and exposure for
sale, of diseased or suspected animals;

(g) the removal, transport, treatment,
isolation, examination, testing, cleansing,
disinfecting, protection from suffering, ex-
posure for sale, exhibition, or marking, of
animals;

(h) the removal, transport, treatment,
examination, cleansing and disinfecting, of
carcasses, fodder, dung and other things
likely to spread disease;

(7) the cleansing, disinfecting, and
examination, of places used by, and vehicles
used for the transport of animals;

(7) the fees and expenses incurred for
any purpose for which regulations may be
made under this section, and the persons by
whom they are to be paid, and the manner
in which they may be recovered;

IMPORTATION.

18. (1) Nobird, reptile or insect may be
imported into the Presidency save under and in
accordance with a licence granted by the
inspector under the provisions of section 15 of
this Ordinance,

(2) Any person who—

(a) imports into the Presidency any
bird, reptile, or insect, otherwise than
under a licence in that behalf granted
under section 15 of this Ordinance; or

(b) contravenes or fails to comply with

any of the provisions of any such licence,
shall be guilty of on offence against this Ordi-
nance; and any bird, reptile or insect in respect
of which any such offence is alleged to have
been committed may be seized and on conviction
of the offender shall be forfeited to the Crown.

14. (1) The Governor in Council may,
for the purposes of preventing the introduction
or spread of any disease into the Presidency,
make regulations prohibiting, restricting, con-
trolling or regulating the importation of animals
or poultry, or any specific kind thereof, or of
carcasses, fodder, litter, dung or other thing
likely to spread disease.

(2) Regulations made under sub-section
(1) of this section may, without prejudice to the
generality of such power, make provision with
regard to—

(a) specifying and defining the ports

(4) controlling, prohibiting or regula-

or out of, any defined port;

(c) controlling the examination, clean-
sing, destruction, disposal, seizure and deten-
tion of any animal cr poultry, or of carcasses,
fodder, litter, dung or other thing likeiy to
spread disease, in a port;

(d) the fees and expenses incurred for
any purposes for which regulations may be
made under this section, and the persons to
whom they are to be paid and the manner
in which they may be recovered;

(e) the penalties for the breach of any
such regulations.

15. (1) The inspector may grant to any
person a licence to import any bird, reptile or
insect into the Presidency, and may, notwith-
standing anything contained in the regulations
made under section 14 of this Ordinance, for
the purposes of any exhibition, performance, or
circus, grant a licence to import any particular
animal into the Presidency.

(2) Any licence granted under this section
may contain such terms and conditions as the
inspector may think necessary.

(3) Every person desirous of applying for
a licence shall make application in such form as
the inspector may require.

16. The Governor may appoint quarantine
depots in such places as he may deem necessary,
and all animals, birds, reptiles or insects,
required to be quarantined under this Ordinance
or any regulations made, or licence granted,
thereunder, shall be placed within such depots
in accordance with the orders of the inspector.

any regulations made under this Ordinance or to

depot for such time and under such conditions
as may be specified in such regulations or in any

such licence.
PART IV.

GENERAL,

18. (1) Where any person is found com-
mitting, or is reasonably suspected of being
engaged in committing, an offence against this
Ordinance or against any regulation made there-
under, any police officer may without warrant
stop and detain him, and if his name and
address are not known to the police officer and he
fails to give them to the police officer such
police officer may without warrant arrest him
and may, whether he has so stopped, detained
or arrested such person or not, stop, detain and
examine any animal, bird, reptile, insect, vehicle,
boat or other thing to which the offence or
suspected offence relates and require it to be
forthwith taken back to or into any place or
district wherefrom or whereout it was unlawfully
removed, and execute and enforce that requisi-
tion.

(2) If any person obstructs or impedes a
police officer in the execution of this Ordinance
or of any regulations made thereunder, or assists
in any such obstructing or impeding, the police
officer may without warrant arrest the offender.

(3) A person arrested under this section
shall not be detained without warrant longer
than is necessary for the purpose of being taken
before a Magis strate, and the provisions of the
Police Act, 1951, in relation to the granting of
bail shall apply to any such person.

19. The inspeetor shall have all the
powers given to a police officer under section 18
of this Ordinance and may at any time enter-—

(a) any pen, building, land, or place,
where he has reasonable erounds for
supposing—

(i) that disease exists, or has, within
fifty-six days, existed; or

(ii) that the carcass of any . diseased
or suspected animal is or bas been
kept or has been buried, destroyed
or otherwise disposed of; or

(iii) that there is to be found therein
anything or any place in respect
whereof any person has on any
occasion failed to comply with the
provisions of this Ordinance or of
any regulations made thereunder;
or

(iv) that this Ordinance or any regula-
tions made thereunder have not
been or are not being complied
with;

(b) any vehicle, vessel, or boat, in
which or in respect whereof he has reason-
able grounds for believing that this Ordi-
nance or any regulations made thereunder
have not been or are not been complied
with.

20. Any person who, without lawful Offences.
suthority or excuse, the proof whereof shall lie
ea him,—

(a) when required by this Ordinance,
or by any regulations or order made there-
under, to keep any animal separate as far
as practicable, or to give any notice of
disease with all practicable speed, fails so to
do; or

(6) contravenes or fails to comply with
any of the provisions of this Ordinance, or
of any regulations or order made thereunder;
or

(¢) contravenes or fails to comply with
any directions given by (he inspector under
sectiou 8 of this Ordinance; or

(d) refuses to the inspector, acting in
execution of this Ordinance or of any regula-
tions made thereunder, admission to any pen,
building, land, place, vehicle, vessel or boat,
which such inspector is entitled to enter or
examine, or obstructs or impedes him from
so entering or examining, or otherwise in
any respect obstructs or impedes the inspector
or any police officer in the execution of his
duty, or assists in any such obstructing or
impeding; or

(e) throws or places or causes to be
thrown or placed into or in any river,
stream, creek, gut, pond, well, drain, or
other water or watercourse, or into or in the
sea within three miles of the shore, the car-
cass of an animal which has died of disease or
has been slaughtered as diseased or suspected ;
or

(7) takes, or allows to be taken, unless
other wise required by this Ordinance or by
any regulations or order made thereunder, or
allows to stray, any diseased animal in or
upon any common, public road, or publie
place; or

(g) digs up, or causes or allows to be
dug up, the buried carcass of any animal
which has been slaughtered under this Ordi-
nance as diseased or suspected, or which has
died or is suspected of having died from any
disease; or

(Ah) takes or moves, or allows to be
taken or moved, any animal, careass, fodder,
litter, dung or other thing, into or out of any
infected place or infected area otherwise than
in accordance with this Ordinance or with
any regulations or order made thereunder; or

(z) allows any animal to stray into or
out of any infected place or infected area,

shall be guilty of an offence against this Ordinance.

21. Any person guilty of an offence against
this Ordinance shall, save where otherwise
expressly provided be liable for each such offence
. On summary conviction to a fine not exceeding
two hundred and forty dollars or to imprisonment
for any term not exceeding three months, or to
both such fine and imprisonment.

22. (1) Where the owner is charged with
an offence against this Ordinance, or against any
regulations or order made thereunder, relative to
disease or to any illness of the animal, he shall be
presumed to have known of the existence of the
disease or illness unless and until he shows to the
satisfaction of the court that he has not knowledge
thereof and could not with reasonable diligence
have obtained the knowledge.

(2) Where a person is charged with an
offence against this Ordinance, or against any
regulations or order made thereunder, in not
having duly cleansed or disinfected any place,
vessel, or thing, belonging to him or in his charge
and a presumption against him on the part of the
prosecution is raised it shall lie on him to prove
the due cleansing and disinfection thereof.

(3) The certificate of the inspector to the
effect that any animals is or was affected with a
disease specified in the certificate shall for the
purposes of this Ordinance or of any regulations
or order made thereunder be conclusive evidence
in all courts of justice of the matter certified.

23. Exceptas specifically provided in any
regulations or order under this Ordinance,
nothing in this Ordinance, or in any regulations
made thereunder, shall restrict or prohibit the
transport of any person, animal, or thing, by
public road through an infected place or an
infected area if such person, animal or thing is not
detained within such place or area.

24. The Governor in Council may by order
apply, subject to such exceptions, adaptations and
modifications as may be therein set out, the pro-
visions of this Ordinance, and of any regulations
made thereunder, to poultry.

An Ordinance to authorise the raising of a loan for
an amount of sixty-nine thousand and _ six
hundred dollars for the purpose of. financing
the electricity scheme and _ public jetty
improvements in the Presidency.

WHEREAS it is expedient to raise a loan of
sixty-nine thousand and six hundred dollars for
the purposes specified in the Schedule to this
Ordinance:

ENACTED by the Legislature of Montserrat
as follows:—

1. This Ordinance may be cited as the
Development (Electricity and Public Jetty) Loan
Ordinance, 1954.

2. The Governor or the Crown Agents
acting on his behalf may raise by loan an amount
sufficient to produce as nearly as may be the sum
of sixty-nine thousand and six hundred dollars and
such further sum as may be necessary to defray
the expenses of issue.

8. The principal monies and interest repre-
sented by the loan issued under the provisions of
this Ordinance are hereby charged upon and shall
be payable out of the general revenues and assets
of the Presidency.

4. (1) Any sum raised to defray the
expenses of issue shall be applied only to that
purpose.

(2) Save as aforesaid, the money borrowed
under this Ordinance shall be appr »priated and
applied to the purposes specified in the Schedule
to this Ordinance:

Provided that the Governor may with the
prior sanction of the Secretary of State utilise any
saving in respect of any of the items in that
Schedule to cover any excess of expenditure in
respect of any other or others of those items.

5. The loan hereby authorised, or any part
thereof, may be raised either—-

(a) in the Presidency under the pro-
visions of the General Local Loan Ordinance,
1954, or

(6) in the United Kingdom by the
Crown Agents.

6. If the loan hereby authorised or any part
thereof shall be raised in the United Kingdom
then the following provisions shall apply:—

(a) So long as any portion of such loan
remains outstanding the Governor shall in
each half-year ending with the day on which
the interest on such loan falls due appropriate
out of the general revenues and assets of the
Presidency a sum equal to one half-year’s
interest on the whole of such loan outstanding
and shall remit that sum to the Crown
Agents at such time as will enable them to
pay thereout the then current half-year’s
interest on the day on which it falls due.

(6) The Governor shall also in each half-
year ending as aforesaid appropriate out of
the said revenues and assets of the Presidency
for the formation of a sinking fund for the
repayment of the loan at par an additional
sum in respect of the total nominal amount of
such loan outstanding equal to one-half of the
annual contribution to be decided upon by the
Governor on the issue o the loan and shall
remit that sum to the Crown Agents with the
remittance hereinbefore mentioned:

Provided that the said contribution shall
commence not later than three years after the
date from which the interest on such loan
shall commence to run.

(c) The aforesaid annual contribution
shall be not less than such amount as may be
determined wi h the approval of the Secretary
of State to be sufficient to redeem such loan
at its due date,

(d) The Crown Agents shal!, for the
purpose of forming a sinking fund for the
final extinction of the debt, from time to time
place at interest or invest in the purchase of
such securities as may from time to time be
approved by the Secretary of State so much
of the money so remitted to them as aforesaid
as shall not be required for the payment of
interest for the current half-year and shall
also place at interest or invest in the purchase
of like securities the accumulations of interest
or the dividends, interest or produce of such
investments, and may from time to time with
the approval of the Secretary of State change
any such investments, and shall hold such
fund in trust for the repayment of the
principal monies for the time being repre-
sented by such loan.

(e) If at any time the trustees of the
sinking funds are satisfied that the value of
any sinking fund provided by this Ordinance
will be sufficient, with further accumulations,
of interest but without further payment of
contributions, to enable the loan to be
redeemed out of the proceeds of the sinking
fund when the same shall fall due to be
redeemed, the Governor may, with the
approval of the Secretary of State, suspend
further payment of contributions to the said
sinking fund:

Provided that contributions to the sink-
ing fund shall be recommenced if the trustees
‘ebull at any time inform the Governor that
this is necessary.

(7) In case the sinking fund provided
for by this Ordinance shall be insufficient for
the payment of all the principal monies so
borrowed under the authority of this Ordi-
nance at the time the same shall have become
due the Governor shall make good the
deficiencies out of the general revennes and
assets of the Presidency.

nance, 1958, hereinafter called the Principal
Ordinance.

2. The following paragraph is hereby
substituted for paragraph () of subsection (1)
of section 8 of the Principal Ordinance:—

of the Land Acquisition Act,
1944 (No. 11/1944), for the
acquisition of certain land in
the Presidency of Saint Chris-
topher Nevis and Anguilla
required for public purposes.

IT IS HEREBY DECLARED that
the Governor in Council with the
approval of the Legislative Council of
the Presidency of Saint Christopher
Nevis and Anguilla considers that
the land described in the Schedule
hereto, situate in the island of
Anguilla in the said Presidency,
should be acquired for public pur-
poses, namely, for the erection of a
health outpost, in the said Presidency.

SCHEDULE.

An area of approximately + of an
acre situate at South Hill in the
island of Anguilla in the Presidency
of Saint Christopher Nevis and
Anguilla, and bounded as_ follows,
that is to say, on the North and West
by lands of FRANCES ANN CARTY;
on the South by the public main
road; and on the East by a private
road.

NOTICE IS* HEREBY GIVEN
that ERNST JOHAN JENS HENRIKSEN,
have applied for registration in the
Leeward Islands of United Kingdom



Patent No. 669,973 dated the 6th day

of January, 1947 and issued 6n the
30th day of July 1952 and have filed
in the Registrar’s Office at the Court
House St. John’s, Antigua, a complete
copy of the specifications and the
Certificate of the Comptroller General
of the United Kingdom Patent Office
giving full particulars of this patent
which will be open to public inspec-
tion at the said office at any time
between the hours of 9.30 a.m. and
3.30 p.m. on working days except on
Saturdays when the hours will be
from 9.30 a.m. to 12 noon,

Any person may within two
months from the date of this adver-
tisement give notice to the Registrar
of opposition to the issne of a certifi-
cate of registration upon any of the
grounds prescribed in section 10 of
the Patents Act, 1906, for opposition

An Ordinance to control the importation of
animals, birds, reptiles and insects, and to
regulate the treatment and disposal of animals
which are suffering or are suspected to be
suffering from any disease, and for other
matters related thereto or connected there-
with.

ENACTED by the Legislature of Montserrat

as follows:—

PART. I.

PRELIMINARY.

1. This Ordinance may be cited as the
Animals (Diseases and Importation) Ordinance,
1954, and shall come into operation on a date to
be appointed by the Governor by proclamation
published in the Gazette.

2. In this Ordinance, unless the context
otherwise requires—

“animals” includes cattle, buffalo, horses,
mules, asses, sheep, swine, goats, dogs,
eats, and all animals of whatsoever kind,
whether similar to the foregoing or not;

“bird” does not include poultry ;

“‘ carcass’? means the careass of any animal,
and includes any part of the carcass or of
the meat, bones, hide, skin, hoofs, horns,
offal or other part of an animal;

‘cattle’? includes bulls, cows, oxen, steers,
heifers and calves;

‘defined port’ means a port as defined by
any regulations made under section 14
of this Ordinance;

“disease” means anthrax, brucellosis, conta-
gious bovine pleuro-pneumonia, equine
encephalo-myelitis, equine infectious
anemia, epizootic abortions, epizootic
lymphangitis, foot and mouth disease,
glanders and farey, hemorrhagic septica-
mia, infectious laryngotracheitia, mange
ovine (commonly called sheep scab),
melitensis infection (commonly called
Malta fever), Newcastle disease (com-
monly called fowl pest or fowl plague),

. paralytic rabies (bat transmitted),
psittacosis, rabies, rinderpest, sarcoptic
mange in horses, swine erysipelas, swine
fever (commonly called hog cholera),
tuberculosis, trypanosomiasis (including
dourine, mal de caderas, surra and try-
panosoma vivax infection), variola ovina,
variola vaccinia, and such other diseases
as the Governor in Council may from
time to time by order made under
section 11 of this Ordinance declare to
be a disease within the meaning of this
Ordinance;

‘ diseased” means affected with disease;

‘“‘fodder”’ means grass, hay or any other
substances commonly used for the food
of animals;

“infected area’? means an area declared as
such under section 5 or 6 of this
Ordinance;

‘“‘infeeted place’ means a place declared as
such under section 5 of this Ordinance;

“insect ’’ includes members of the class
Insects and of the class Arachnida;

‘inspector ”” means an inspector appointed by
the Governor under section 38 of this
Ordinance;

“litter” means straw or any other substance
commonly used as the bedding for, or
otherwise used for or about animals;

‘‘owner ” includes the person in possession or
charge of any animal;

“poultry” means domestic fowls, turkeys,
geese, ducks, guinea fowls and pigeons;

“suspected” meuns suspected of being
diseased.

3. (1) The Governor may appoint an
inspector and such assistant inspectors as muy be
necessary for the purposes of this Ordinance;

(2) It shall be the duty of the inspector and
assistant inspector to carry out the provisions of
this Ordinance and of any regulations made there-
under and for such purpose every assistant
inspector shall have, subject to the directions
either general or particular of the inspector, all
rights, powers, and duties given to the inspector
under this Ordinance.

4. (1) Every person having in his posses-
sion or under his charge any diseased animal

shall—

(a) as far as practicable keep such
animals separate from animals not so diseased;
and

(6) with all practicable speed give
notice of the fact of the animal being so
diseased to the inspector, or to the person in
charge of the nearest police station.

(2) The person to whom notice under sub-
section (1) of this section is given, if not the
inspector, shall forthwith give information thereof
to the inspector.

5. (1) Where there is evidence that any
disease exists in any stable, shed, pen, field,
pasture, or other similar place, the inspector shall
forthwith sign a notice to that effect and such
notice shall contain a declaration that such place,
the limits whereof shall be therein specified, is an
infected place. A copy of such notice shall be
served upon the occupier of such place.

(2) Upon the service of such notice the place
therein specified shall be an infected place subject
to confirmation or otherwise by the Governor
in Council under the provisions of sub-section (4)
of this section:

Provided that the inspector may, at any time
within seven days of such service and before
such confirmation or otherwise, withdraw such
notice and thereupon such place shall cease to be
an infected place.

(3) The inspector shall with all practicable
speed send copies of such notice to the Commis-
sioner of the Presidency, and where any such
notice has been withdrawn the inspector shall
forthwith inform the Commissioner of the Presi-
dency to that effect.

(4) Upon receipt by the Commissioner of
the copies of such notice the Governor in Council
shall, unless such notice has been withdrawn,
forthwith consider the matter and—

(a) if satisfied that such course is
expedient or necessary, shall by order declare
the place specified in such notice to be an
infected place, and may also by order deciare
that any area containing, adjoining or sur-
rounding, such place is an area infected
with disease and such order shall specify the
limits of such infected aren; or

(b) if not so satisfied, shall by order
revoke the notice of the inspector, and there-
upon as from the time specified in that behalf
by such order such place shall cease to be an
infected place.

6. (1) The Governor in Council, whenever
it appears necessary or expedient so to do by
reason of the existence of any disease, may by
order declare any area in the Presidency ‘ Oo be
infected with disease, and such order shall
specify the limits of any such infected area.

(2) The Governor in Council wm y, in his
absolute discretion, by order prohibit, during such
time as may be specified in such order—

(a) the use in any manner whatever of
any public road through an infected area or
of any part of such public road; «

(6) the use, except in compliance with
such conditions as may be specified in such
order, or any such public road or of any part
of such public road.

7. No defined port, or part thereof, shall
be declared to be an infected place or an infected
area.

8. (1) The inspector may cause any diseased
or suspected animal, or any animal which had been
in the same stable, shed, pen field, pasture, or
other similar place, or in the same herd or flock
as, Or in contact with, any diseased or suspected
animal, whether or no any such place has been
declared to be an infected place or is within an
infected area, to be slaughtered in order to prevent
the spread of the disease, and for such purpose
the inspector may give all such directions as he
may consider necessary.

(2) The inspector may, for the purpose of
observation and treatment, take possession of and
retain any animal liable to be slaughtered under
this section, but subject to payment of compensa-
tion as in the case of actual slaughter.

9. Any animal slaughtered under the pro-
visions of this Ordinance, or which dies as the
result of disease, shall be destroyed, buried, or
otherwise disposed of as soon as possible in
accordance with the regulations made under this
Ordinance and ‘in accordance with the orders,

either general or particular, of the inspector; and
for such purposes the inspector may use any
suitable ground in the possession or occupation of
the owner of the animal.

10. (1) The Governor may in his discretion
award, for the compulsory slaughter of any animal
under the provisions of fuis Ordinance, compensa-
tion which shall be payable out of the general
revenue of the Presidency. The amount of any
such compensation shall not exceed the value of
the animal immediately before slaughter, and
compensation may be reduced or refused where
the owner has, in the opinion of the Governor,
been guilty in relation to the animal, of an offence
against this Ordinance.

(2) No compensation shall be payable in
respect of any animal compulsorily slaughtered
when in a quarantine depot, if, in the opinion of
the inspector, such animal was diseased at the
time of importation.

11. The Governor in Council may from
time to time by order add any particular disease,
or remove any particular disease from the defini-
tion of disease contained in section 2 of this
Ordinance, and as from the date of any such order
such particular disease shall be, or shall cease to
be (as the case may be), a disease within the
meaning of this Ordinance.

12. (1) The Governor in Council may make
regulations generally for the control and treatment
of diseased or suspected animals and for the pre-
vention and spread of disease.

(2) Regulations made under sub-section (1)
of this section may, without prejudice to the
generality of such power, make provision with
regard to—

relation to any animals suffering from any
particular disease.

(6) the notices to be given by persons
in possession or in charge of diseased animals
in the case of any particular disease, or in the
case of illness of any such animal, and the
persons to whom such notices are to he given;

(c) the notification to the public of
infected places or infected area: and the
removal of anything into, within or out of
such places or areas, and the cleansing or
disinfecting of such places or areas;

(d@) the movement of persons into,
within or out of infected places or infected
areas, and the prevention of the spread of
disease by persons in contact with diseased or
suspected animals;

(e) the treatment, disinfecting, destruc-
tion, burial, disposal, and digging up, of
anything in or removed from an infected

place or infected area;

(/) tbe movement, isolation, segregation,
treatment. slaughter, destruction, disposal,
burial, seizure, detention, and exposure for
sale, of diseased or suspected animals;

(g) the removal, transport, treatment,
isolation, examination, testing, cleansing,
disinfecting, protection from suffering, ex-
posure for sale, exhibition, or marking, of
animals;

(h) the removal, transport, treatment,
examination, cleansing and disinfecting, of
carcasses, fodder, dung and other things
likely to spread disease;

(7) the cleansing, disinfecting, and
examination, of places used by, and vehicles
used for the transport of animals;

(7) the fees and expenses incurred for
any purpose for which regulations may be
made under this section, and the persons by
whom they are to be paid, and the manner
in which they may be recovered;

PART? Il.

IMPORTATION.

18. (1) Nobird, reptile or insect may be
imported into the Presidency save under and in
accordance with a licence granted by the
inspector under the provisions of section 15 of
this Ordinance,

(2) Any person who—

(a) imports into the Presidency any
bird, reptile, or insect, otherwise than
under a licence in that behalf granted
under section 15 of this Ordinance; or

(b) contravenes or fails to comply with

any of the provisions of any such licence,
shall be guilty of on offence against this Ordi-
nance; and any bird, reptile or insect in respect
of which any such offence is alleged to have
been committed may be seized and on conviction
of the offender shall be forfeited to the Crown.

14. (1) The Governor in Council may,
for the purposes of preventing the introduction
or spread of any disease into the Presidency,
make regulations prohibiting, restricting, con-
trolling or regulating the importation of animals
or poultry, or any specific kind thereof, or of
carcasses, fodder, litter, dung or other thing
likely to spread disease.

(2) Regulations made under sub-section
(1) of this section may, without prejudice to the
generality of such power, make provision with
regard to—

(a) specifying and defining the ports
at which animals or poultry or carcasses,
fodder, litter, dung or other thing likely to
spread disease may he landed;

(4) controlling, prohibiting or regula-
ting the movement of animals or poultry,

or of carcasses, fodder, litter, dung or other
thing likely to spread disease, into, within,
or out of, any defined port;

(c) controlling the examination, clean-
sing, destruction, disposal, seizure and deten-
tion of any animal cr poultry, or of carcasses,
fodder, litter, dung or other thing likeiy to
spread disease, in a port;

(d) the fees and expenses incurred for
any purposes for which regulations may be
made under this section, and the persons to
whom they are to be paid and the manner
in which they may be recovered;

(e) the penalties for the breach of any
such regulations.

15. (1) The inspector may grant to any
person a licence to import any bird, reptile or
insect into the Presidency, and may, notwith-
standing anything contained in the regulations
made under section 14 of this Ordinance, for
the purposes of any exhibition, performance, or
circus, grant a licence to import any particular
animal into the Presidency.

(2) Any licence granted under this section
may contain such terms and conditions as the
inspector may think necessary.

(3) Every person desirous of applying for
a licence shall make application in such form as
the inspector may require.

16. The Governor may appoint quarantine
depots in such places as he may deem necessary,
and all animals, birds, reptiles or insects,
required to be quarantined under this Ordinance
or any regulations made, or licence granted,
thereunder, shall be placed within such depots
in accordance with the orders of the inspector.

under this Ordinance, be placed in a quarantine
depot for such time and under such conditions
as may be specified in such regulations or in any

such licence.
PART IV.

GENERAL,

18. (1) Where any person is found com-
mitting, or is reasonably suspected of being
engaged in committing, an offence against this
Ordinance or against any regulation made there-
under, any police officer may without warrant
stop and detain him, and if his name and
address are not known to the police officer and he
fails to give them to the police officer such
police officer may without warrant arrest him
and may, whether he has so stopped, detained
or arrested such person or not, stop, detain and
examine any animal, bird, reptile, insect, vehicle,
boat or other thing to which the offence or
suspected offence relates and require it to be
forthwith taken back to or into any place or
district wherefrom or whereout it was unlawfully
removed, and execute and enforce that requisi-
tion.

(2) If any person obstructs or impedes a
police officer in the execution of this Ordinance
or of any regulations made thereunder, or assists
in any such obstructing or impeding, the police
officer may without warrant arrest the offender.

(3) A person arrested under this section
shall not be detained without warrant longer
than is necessary for the purpose of being taken
before a Magis strate, and the provisions of the
Police Act, 1951, in relation to the granting of
bail shall apply to any such person.

19. The inspeetor shall have all the
powers given to a police officer under section 18
of this Ordinance and may at any time enter-—

(a) any pen, building, land, or place,
where he has reasonable erounds for
supposing—

(i) that disease exists, or has, within
fifty-six days, existed; or

(ii) that the carcass of any . diseased
or suspected animal is or bas been
kept or has been buried, destroyed
or otherwise disposed of; or

(iii) that there is to be found therein
anything or any place in respect
whereof any person has on any
occasion failed to comply with the
provisions of this Ordinance or of
any regulations made thereunder;
or

(iv) that this Ordinance or any regula-
tions made thereunder have not
been or are not being complied
with;

(b) any vehicle, vessel, or boat, in
which or in respect whereof he has reason-
able grounds for believing that this Ordi-
nance or any regulations made thereunder
have not been or are not been complied
with.

20. Any person who, without lawful Offences.

(a) when required by this Ordinance,
or by any regulations or order made there-
under, to keep any animal separate as far
as practicable, or to give any notice of
disease with all practicable speed, fails so to
do; or

(6) contravenes or fails to comply with
any of the provisions of this Ordinance, or
of any regulations or order made thereunder;
or

(¢) contravenes or fails to comply with
any directions given by (he inspector under

(d) refuses to the inspector, acting in
execution of this Ordinance or of any regula-
tions made thereunder, admission to any pen,
building, land, place, vehicle, vessel or boat,
which such inspector is entitled to enter or
examine, or obstructs or impedes him from
so entering or examining, or otherwise in
any respect obstructs or impedes the inspector
or any police officer in the execution of his
duty, or assists in any such obstructing or
impeding; or

(e) throws or places or causes to be
thrown or placed into or in any river,
stream, creek, gut, pond, well, drain, or
other water or watercourse, or into or in the
sea within three miles of the shore, the car-
cass of an animal which has died of disease or
has been slaughtered as diseased or suspected ;
or

(7) takes, or allows to be taken, unless
other wise required by this Ordinance or by
any regulations or order made thereunder, or
allows to stray, any diseased animal in or
upon any common, public road, or publie
place; or

(g) digs up, or causes or allows to be
dug up, the buried carcass of any animal
which has been slaughtered under this Ordi-
nance as diseased or suspected, or which has
died or is suspected of having died from any
disease; or

(Ah) takes or moves, or allows to be
taken or moved, any animal, careass, fodder,
litter, dung or other thing, into or out of any
infected place or infected area otherwise than
in accordance with this Ordinance or with
any regulations or order made thereunder; or

(z) allows any animal to stray into or
out of any infected place or infected area,

shall be guilty of an offence against this Ordinance.

21. Any person guilty of an offence against
this Ordinance shall, save where otherwise
expressly provided be liable for each such offence
. On summary conviction to a fine not exceeding
two hundred and forty dollars or to imprisonment
for any term not exceeding three months, or to
both such fine and imprisonment.

22. (1) Where the owner is charged with
an offence against this Ordinance, or against any
regulations or order made thereunder, relative to
disease or to any illness of the animal, he shall be
presumed to have known of the existence of the
disease or illness unless and until he shows to the
satisfaction of the court that he has not knowledge
thereof and could not with reasonable diligence
have obtained the knowledge.

(2) Where a person is charged with an
offence against this Ordinance, or against any
regulations or order made thereunder, in not
having duly cleansed or disinfected any place,
vessel, or thing, belonging to him or in his charge
and a presumption against him on the part of the
prosecution is raised it shall lie on him to prove
the due cleansing and disinfection thereof.

(3) The certificate of the inspector to the
effect that any animals is or was affected with a
disease specified in the certificate shall for the
purposes of this Ordinance or of any regulations
or order made thereunder be conclusive evidence
in all courts of justice of the matter certified.

23. Exceptas specifically provided in any
regulations or order under this Ordinance,
nothing in this Ordinance, or in any regulations
made thereunder, shall restrict or prohibit the
transport of any person, animal, or thing, by
public road through an infected place or an
infected area if such person, animal or thing is not
detained within such place or area.

24. The Governor in Council may by order
apply, subject to such exceptions, adaptations and
modifications as may be therein set out, the pro-
visions of this Ordinance, and of any regulations
made thereunder, to poultry.

An Ordinance to authorise the raising of a loan for
an amount of sixty-nine thousand and _ six
hundred dollars for the purpose of. financing
the electricity scheme and _ public jetty
improvements in the Presidency.

WHEREAS it is expedient to raise a loan of
sixty-nine thousand and six hundred dollars for
the purposes specified in the Schedule to this
Ordinance:

ENACTED by the Legislature of Montserrat
as follows:—

1. This Ordinance may be cited as the
Development (Electricity and Public Jetty) Loan
Ordinance, 1954.

2. The Governor or the Crown Agents
acting on his behalf may raise by loan an amount
sufficient to produce as nearly as may be the sum
of sixty-nine thousand and six hundred dollars and
such further sum as may be necessary to defray
the expenses of issue.

8. The principal monies and interest repre-
sented by the loan issued under the provisions of
this Ordinance are hereby charged upon and shall
be payable out of the general revenues and assets
of the Presidency.

4. (1) Any sum raised to defray the
expenses of issue shall be applied only to that
purpose.

(2) Save as aforesaid, the money borrowed
under this Ordinance shall be appr »priated and
applied to the purposes specified in the Schedule
to this Ordinance:

Provided that the Governor may with the
prior sanction of the Secretary of State utilise any
saving in respect of any of the items in that
Schedule to cover any excess of expenditure in
respect of any other or others of those items.

5. The loan hereby authorised, or any part
thereof, may be raised either—-

(a) in the Presidency under the pro-
visions of the General Local Loan Ordinance,
1954, or

(6) in the United Kingdom by the
Crown Agents.

6. If the loan hereby authorised or any part
thereof shall be raised in the United Kingdom
then the following provisions shall apply:—

(a) So long as any portion of such loan
remains outstanding the Governor shall in
each half-year ending with the day on which
the interest on such loan falls due appropriate
out of the general revenues and assets of the
Presidency a sum equal to one half-year’s
interest on the whole of such loan outstanding
and shall remit that sum to the Crown
Agents at such time as will enable them to
pay thereout the then current half-year’s
interest on the day on which it falls due.

(6) The Governor shall also in each half-
year ending as aforesaid appropriate out of
the said revenues and assets of the Presidency
for the formation of a sinking fund for the
repayment of the loan at par an additional
sum in respect of the total nominal amount of
such loan outstanding equal to one-half of the
annual contribution to be decided upon by the
Governor on the issue o the loan and shall
remit that sum to the Crown Agents with the
remittance hereinbefore mentioned:

Provided that the said contribution shall
commence not later than three years after the
date from which the interest on such loan
shall commence to run.

(c) The aforesaid annual contribution
shall be not less than such amount as may be
determined wi h the approval of the Secretary
of State to be sufficient to redeem such loan
at its due date,

(d) The Crown Agents shal!, for the
purpose of forming a sinking fund for the
final extinction of the debt, from time to time
place at interest or invest in the purchase of
such securities as may from time to time be
approved by the Secretary of State so much
of the money so remitted to them as aforesaid
as shall not be required for the payment of
interest for the current half-year and shall
also place at interest or invest in the purchase
of like securities the accumulations of interest
or the dividends, interest or produce of such
investments, and may from time to time with
the approval of the Secretary of State change
any such investments, and shall hold such
fund in trust for the repayment of the
principal monies for the time being repre-
sented by such loan.

(e) If at any time the trustees of the
sinking funds are satisfied that the value of
any sinking fund provided by this Ordinance
will be sufficient, with further accumulations,
of interest but without further payment of
contributions, to enable the loan to be
redeemed out of the proceeds of the sinking
fund when the same shall fall due to be
redeemed, the Governor may, with the
approval of the Secretary of State, suspend
further payment of contributions to the said
sinking fund:

Provided that contributions to the sink-
ing fund shall be recommenced if the trustees
‘ebull at any time inform the Governor that
this is necessary.

(7) In case the sinking fund provided
for by this Ordinance shall be insufficient for
the payment of all the principal monies so
borrowed under the authority of this Ordi-
nance at the time the same shall have become
due the Governor shall make good the
deficiencies out of the general revennes and
assets of the Presidency.

Islands as follows:—

1. This Ordinance may be cited as the
Midwifery (Amendment) Ordinance, 1955, and
shall be read as one with the Midwifery Ordi-
nance, 1958, hereinafter called the Principal
Ordinance.

2. The following paragraph is hereby
substituted for paragraph () of subsection (1)
of section 8 of the Principal Ordinance:—

‘“(b) any woman who has _ passed
the first examination of the Central
Midwives Board of England, the Central
Midwives Board for Scotland or the Joint
Nursing and Midwives Board of Northern
[reland under the respective rules of those
