Acting Commissioner.

WHEREAS pur:uant to the provi-
sions of subsection (1) of section 25
of the Montserrat Constitution and
Elections Ordinance, 1952 (No. 1/1952)
the Governor by proclamation dated
the 13th day of December, 1954,
prorogued the Legislative Council of
the Presidency of Montserrat until
such further date as may be appointed,
by proclamation of the Commissioner
under the provisions of section 18 of
the said Ordinance, for the first sitting
in the next session of the said Council:

AND WHEREAS it is provided by
section 18 of the said Ordinance that
the s-ssions of the said Council shall
be held at such times and places as the
Commissioner shall from time to time
by proclamation appoint:

AND WHEREAS it is expedient
that a session of the said Council
should now be held:

NOW, THEREFORE, I do by this
my proclamation hereby appoint that
a session of the Legislative Council of
the Presidency of Monts-rrat shall be
held and that the first meeting thereof
shall commence with a sitting of the
Council at the Council Chamber in the
town of Plymouth in the island of
Montserrat at 11 o’clock in the fore-

INCOME TAX NOTICE.

The Income Tax Ordinance No. 7 of



1945 (As amendea).



Public Officers and Pensioners.

Any public officer or pensioner
liable to pay income tax whose income
including that of his wife consists
solely of his and/or her emoluments
as a public ofticer or pensioner or
other allowance: from public fands,
shall deliver a trne and correct return
of his whole income to the Commis-
sioners not later than the dist day ot
January, 1955. (Section 67 and
S. R. & O. 1946, No. 19).

Other Persons.

Every person (including 2 com-
pany) liable to pay income tax shal]
deliver a true and correct return of
his whole income not later than the
31st day of March, 1955 (Section 67
and 8. R. & O. 1946, Ne. 13).

Agents, Trustees, etc.

Any person having the direction,
control or management of any prop-
erty or concern, or being in receipt
of income; on behalf of any person,
whether resident or non-resident, as
attorney, factor, agent, trustee, cura-
tor or committee should make and
deliver to the Commissioners a return
in respect of such property, concern
or income not later than the 3lst day
of Mareh, 1955. (Sections 28 and
29).

General.

Any person may be considered to
be “ liable to pay income tax” if his
income from all sources exceeds one
hundred and twelve pounds ($537.60).

All claims for deduction from in-
come tax must be substantiated by
the production of receipts or other
bona fide evidence.

Penalties.

Any person liable to pay income
tax who fails to make or delivera
return within the prescribed period
shall be guilty of au offence against
this Ordinance and shall be Hable on
conviction to a penalty not exceeding
one hundred pounds, andl in default
of payment to imprisonment with or
without hard labour for a term not
exceeding six months. (Section 6%.)

Any person who makes or delivers
a.falge return or keeps or prepares
any false accounts or particulars con-
cerning any income on which tax is
payable shall be guilty of an offence
and shall be liable on conviction to
a fine not exceeding five hundred
pounds. or to imprisonment with or
without hard labour for a term not
exceeding six monts (Section 64).

Masters and Local Agents of all
Ships, Sailing Vessels and

Aircraft.

All goods of any kind which are
not manifested, arriving in this presi-
dency from abroad must be pre-
sented to a Customs Officer at
the Airport or Port of Entry.

Officers, hostesses and other mem-
bers of the crews of ships and aircraft,
Agents’ clerks, stevedores, ships’
labourers and visitors to ships are
advised to take care to submit to the
Customs Ollicers on duiy packages
and goods of all descriptions, which
they may bring ashore from any ship,
vessel or aircraft.

Failure to present such packages or
goods to a Customs Officer may
result in arrest of the person con-
cerned and seizure and confiscation
of the packages or goods.

The Collector of Customs. Customs
Officers and any meinber of the Police
Force, upon reasonable suspicion may
stop and examine any person carrying
any package to ascertain whether any
smuggled goods are contained therein.
(Section 44 of the Trade and Revenue
Ordinance No. 8 of 1900).

The Collector of Customs and any
persons authorised by him may search
any person on board any vessel within
any port of this presidency, or any
person who has landed from any
vessel, provided he has reason to
suppose that such person is carrying
or bas unenstomed or prohibited
goods about his person. (Section 45
of Ordinance No. 8 of 1900).

licences for plumbers issued by the
former Water Board and City Com-
missioners shall expire on the 31st
December, 1954. Application may
be made to the Public Works
Department for a new licence which
will require the applicant to enter
into a Bond with one Surety for the
sum of ‘wo Hundred and Forty
Dollars ($240.00) in accordance with
Regulation LL (2) (38) of the Water-
courses and Waterworks Regulations,
1954 (S. R. & O. 1954, No. 23).

JAPANESE GOODS

It is hereby notified that quotas
wilt be issued for the importation of
Japanese goods during the year 1955.
All licenges for 1954 will be cancelled
on 31st December, 1954, and goods
arriving after this date will require
new licenses which will be entered
‘against the 1955 quotas. Written

applications for quetas for textiles
and other coods should be forwarded

the 15th Jannary, 1954.

W. I. Liberalization Plan (Token
Iipport Seheme) Ali licens:s under
this plan will be issued for a period
of six months only. The Canadian
part of the plan will funetion as
formerly, vouchers being issued by
the Canadian Department of Trade
and Commerce. Allocations of cur-
reney under the American part of the
plan will be made by the Supply
Officer and applications for licenses
against allocations should be made
by merchants from titae to time as
required. Merchants and Importers
who wish to obtain all-cations should
submit written applications (not appli-
cations fer liceuses) together with
Importers Licences granted by the
Chief Accountant not later than the
10th Jantiary, 1955.

2, The Lunatic Asylums Ordinance, 1899 is Repeal of

hereby repealed. No. 24 of
1399.
3. This Ordinance shall come into operation on Sommenoe

An Ordinance to amend further the Licensing Act,
1879,

ENACT ND) by the Legislature of Antigua as
follows :—

1. This Ordinance may be cited as the Licensing
Act (Amendment) Ordinance, 1954 and. shall be read
as one with the Licensing Act, 1879, as amended, 4/179.
hereinafter called the Principal Ordinance.

2. Section 17 of the Principal Ordinance is
hereby amended by the addition of the following as
subsection (4) thereof :—

* (4) No licence shall be necessary to. sell intoxi-

cating liquors in any police canteen
established in accordance with the pro-
visions of section 62 of the Police Act,
191: 12/1951,

Provided that such canteen be operated by or
solely for the benefit of the Police Welfare Associn-
tion,”

The Executive Council of the Colony having on the Ist day of
November, 1954 advised the amendment of the poe acne
Agreement between the Post Ofhce of Canada and the Post Office of
the Leeward [slands concerning the exchange of parcels by parcel
post which Supplementary Agreoment is speciticd in the Schedule to
Leeward Islands General Government Statutory Rule and Order
1929 No. 56, the Governor, in pursuance of the advice of the said
Couneil, has entered into the Agreement set out in the Schedule
hereto with the Deputy Postmaster General of Canada which said
Agreement shall come into effeet on the L5th day of January, 1955.

AGREEMENT.

THIS AGREEMENT is made the 20th day of December, 1954
BETWEEN His Excelleney Sir Kenneth William Blackburne,
a Knight Commander of the Most Distinguished Order of Saint

Michael and Saint George, an Officer of the Most Excellent Order of
the British Empire, Governor and Commander in Chief in and over
the Colony of the Leeward Islands and Vice Admiral of the same,
acting herein for and on behalf of the said Colony, and W. J.
Turnbull, Deputy Postmaster General of the Dominion of Canada,
acting oa for and on behalf of the said Dominion.

WHEREAS this Agreement is supple oo to the Convention
made between the Post Office of Canada and the Post Office of the
Leeward Islands conecrning the exchanve of closed parcel mail dated
at Ottawa the 27th day of October, 1891 and at Antigua the Sist day
of December, 1891 (hereinafter veferred to as “ the Convention of

AND WHEREAS the Convention of 1891 was amended firstly
in the year 1910 by an amendment referred to hereinafter as “the
first amendment” and sccondly in the vear {924 by a Supplementary
Agreement done in duplicate at Antigua, Leeward ihn Is, on the
27th day of May, 1929 and at Ottawa, Canada, on the Yond day of
June, 1929, referred to hereinafter as ‘‘ the second amendment ”:

AND WHEREAS it is expedient that paragraph (5) of Article
“of the second amendment should be substituted in manner

IT {S HEREBY MUTUALLY AGREED that paragraph (5)
of ies / of the second amendment be deleted and the following
paragraph substituted therefor:—

“(5) The limit of insurance valuc shall be 300 gold franes

1. Crration. These Regulations may be cited as the
Motor Vehicles and Road Traflic (Ainendment No. 2)
Regulations, 1954, and shall be read and construed as one
with the Vehicles and Road Traffic Regulations, 1946
(S.R. & O. 1946, No. 22), as amended, hereinafter called the
Principal Regulations.

2. AMENDMENT OF ReGuiaTion 47. Regulation 47 of
the Principal Regulations by the deletion of paragraph (2) and
the substitution therefor of the following paragraph:—

(2) Notwithstanding the provisions of the preceding
sub-Regulation no. motor omnibus, motor lorry or
motor truck shall under any pretext whatsoever
travel along Corn Alley, or travel either North or
South along that portion of Market. Street: which
lies between Redcliffe Street and Newgate Street
without permission in writing given by the Traffic
Commissioner, ”’

The Income Tax Ordinance No. 7 of



1945 (As amendea).



Public Officers and Pensioners.

Any public officer or pensioner
liable to pay income tax whose income
including that of his wife consists
solely of his and/or her emoluments
as a public ofticer or pensioner or
other allowance: from public fands,
shall deliver a trne and correct return
of his whole income to the Commis-
sioners not later than the dist day ot
January, 1955. (Section 67 and
S. R. & O. 1946, No. 19).

Other Persons.

Every person (including 2 com-
pany) liable to pay income tax shal]
deliver a true and correct return of
his whole income not later than the
31st day of March, 1955 (Section 67
and 8. R. & O. 1946, Ne. 13).

Agents, Trustees, etc.

Any person having the direction,
control or management of any prop-
erty or concern, or being in receipt
of income; on behalf of any person,
whether resident or non-resident, as
attorney, factor, agent, trustee, cura-
tor or committee should make and
deliver to the Commissioners a return
in respect of such property, concern
or income not later than the 3lst day
of Mareh, 1955. (Sections 28 and
29).

General.

Any person may be considered to
be “ liable to pay income tax” if his
income from all sources exceeds one
hundred and twelve pounds ($537.60).

All claims for deduction from in-
come tax must be substantiated by
the production of receipts or other
bona fide evidence.

Penalties.

Any person liable to pay income
tax who fails to make or delivera
return within the prescribed period
shall be guilty of au offence against
this Ordinance and shall be Hable on
conviction to a penalty not exceeding
one hundred pounds, andl in default
of payment to imprisonment with or
without hard labour for a term not
exceeding six months. (Section 6%.)

Any person who makes or delivers
a.falge return or keeps or prepares
any false accounts or particulars con-
cerning any income on which tax is
payable shall be guilty of an offence
and shall be liable on conviction to
a fine not exceeding five hundred
pounds. or to imprisonment with or
without hard labour for a term not
exceeding six monts (Section 64).

All goods of any kind which are
not manifested, arriving in this presi-
dency from abroad must be pre-
sented to a Customs Officer at
the Airport or Port of Entry.

Officers, hostesses and other mem-
bers of the crews of ships and aircraft,
Agents’ clerks, stevedores, ships’
labourers and visitors to ships are
advised to take care to submit to the
Customs Ollicers on duiy packages
and goods of all descriptions, which
they may bring ashore from any ship,
vessel or aircraft.

Failure to present such packages or
goods to a Customs Officer may
result in arrest of the person con-
cerned and seizure and confiscation
of the packages or goods.

The Collector of Customs. Customs
Officers and any meinber of the Police
Force, upon reasonable suspicion may
stop and examine any person carrying
any package to ascertain whether any
smuggled goods are contained therein.
(Section 44 of the Trade and Revenue
Ordinance No. 8 of 1900).

The Collector of Customs and any
persons authorised by him may search
any person on board any vessel within
any port of this presidency, or any
person who has landed from any
vessel, provided he has reason to
suppose that such person is carrying
or bas unenstomed or prohibited
goods about his person. (Section 45
of Ordinance No. 8 of 1900).

ENACT ND) by the Legislature of Antigua as
follows :—

1. This Ordinance may be cited as the Licensing
Act (Amendment) Ordinance, 1954 and. shall be read
as one with the Licensing Act, 1879, as amended, 4/179.
hereinafter called the Principal Ordinance.

2. Section 17 of the Principal Ordinance is
hereby amended by the addition of the following as
subsection (4) thereof :—

* (4) No licence shall be necessary to. sell intoxi-

cating liquors in any police canteen
established in accordance with the pro-
visions of section 62 of the Police Act,
191: 12/1951,

Provided that such canteen be operated by or
solely for the benefit of the Police Welfare Associn-
tion,”

The Executive Council of the Colony having on the Ist day of
November, 1954 advised the amendment of the poe acne
Agreement between the Post Ofhce of Canada and the Post Office of
the Leeward [slands concerning the exchange of parcels by parcel
post which Supplementary Agreoment is speciticd in the Schedule to
Leeward Islands General Government Statutory Rule and Order
1929 No. 56, the Governor, in pursuance of the advice of the said
Couneil, has entered into the Agreement set out in the Schedule
hereto with the Deputy Postmaster General of Canada which said
Agreement shall come into effeet on the L5th day of January, 1955.

AGREEMENT.

THIS AGREEMENT is made the 20th day of December, 1954
BETWEEN His Excelleney Sir Kenneth William Blackburne,
a Knight Commander of the Most Distinguished Order of Saint

Michael and Saint George, an Officer of the Most Excellent Order of
the British Empire, Governor and Commander in Chief in and over
the Colony of the Leeward Islands and Vice Admiral of the same,
acting herein for and on behalf of the said Colony, and W. J.
Turnbull, Deputy Postmaster General of the Dominion of Canada,
acting oa for and on behalf of the said Dominion.

WHEREAS this Agreement is supple oo to the Convention
made between the Post Office of Canada and the Post Office of the
Leeward Islands conecrning the exchanve of closed parcel mail dated
at Ottawa the 27th day of October, 1891 and at Antigua the Sist day
of December, 1891 (hereinafter veferred to as “ the Convention of

AND WHEREAS the Convention of 1891 was amended firstly
in the year 1910 by an amendment referred to hereinafter as “the
first amendment” and sccondly in the vear {924 by a Supplementary
Agreement done in duplicate at Antigua, Leeward ihn Is, on the
27th day of May, 1929 and at Ottawa, Canada, on the Yond day of
June, 1929, referred to hereinafter as ‘‘ the second amendment ”:

AND WHEREAS it is expedient that paragraph (5) of Article
“of the second amendment should be substituted in manner

IT {S HEREBY MUTUALLY AGREED that paragraph (5)
of ies / of the second amendment be deleted and the following
paragraph substituted therefor:—

“(5) The limit of insurance valuc shall be 300 gold franes

1. Crration. These Regulations may be cited as the
Motor Vehicles and Road Traflic (Ainendment No. 2)
Regulations, 1954, and shall be read and construed as one
with the Vehicles and Road Traffic Regulations, 1946
(S.R. & O. 1946, No. 22), as amended, hereinafter called the
Principal Regulations.

2. AMENDMENT OF ReGuiaTion 47. Regulation 47 of
the Principal Regulations by the deletion of paragraph (2) and
the substitution therefor of the following paragraph:—

(2) Notwithstanding the provisions of the preceding
sub-Regulation no. motor omnibus, motor lorry or
motor truck shall under any pretext whatsoever
travel along Corn Alley, or travel either North or
South along that portion of Market. Street: which
lies between Redcliffe Street and Newgate Street
without permission in writing given by the Traffic
Commissioner, ”’
