Whereas section cightecn of the Emergency Laws (Transitional Provisions) Act, 1946 (hereinafter called “the
Act of 1946”), as amended by section eight of the Emergency Laws (Miscellaneous Previsions) Act, 1947 (hereinafter
called “the Act of 1947”), enabled provision to be made by Order in Council for the continuation in force until the
tenth day of December, 1950, of Defence Regulations having effect in Colonies and other territories, and provision
was so made by the Emergency Laws (Transitional Provisions) (Colonies, ete.) Order in Council, 1946 (hereinafter
called “the Order of 1946”), and the Emergency Laws (Miscellaneous Provisions) (Colonies, ete.) Order in Council,
1947:

And Whereas Article 3 of the Emergency Laws (Continuance) Order, 1954, (hereinafter called “ihe Order of
1954”), made on the twenty-fourth day of November, 1954, in pursuance of the Act of 1947 provides that the powers
exercisable under section eighteen of the Act of 1946 shall be exercisable, in relation to any Defence Regulations
remaining in force by virtue of the said section eighteen and Article 3 of the Emergency Laws (Continuance) Order,
1953, when the Order of 1954 was made, ag if, in the said settion-eighteen as amended by section eight of the Act of
1947 tor the reference to the tenth day of December, 1950, there were substituted a reference to the 10th day of

December, 1955:

Now, Therefore, Her Majesty, in pursuance of section eighteen ef the Act of 1946 and Article 3 of the
Order of 1954 and of all other powers enabling Her in that behalf, is pleased, by and with the advice of Her Privy
Council, to order, and it is hereby ordered as follows:— -

1. This Order may be cited as the Emergency Laws (Miscellaneous Provisions) (Colonies, etc.) Order in
Council, 1954.

2. The Governor of any territory mentioned in the Schedule to this Order may by order provide:—

(a) for the continuation in force until the tenth day of December, 1955, of any Defence Regula-
tions, being Defence Regulations in force in the territory at the date of the making of the Order of
1954 by virtue of section eighteen of the Act of 1946 and Article 3 of the Emergency Laws (Con-
tinuance) Order, 1953;

(b) that any Defence Regulations so continued in force shall have effect subject to such
exceptions, limitations and modifications as the Governor thinks necessary or expedient.

3. The provisions of section two, subsection (2) of section three, section four and section five of the Order
of 1946 shall have effect in relation to this Order, and to Defence Regulations continued in force under this Order,
as they have effect in relation to the Order of 1946, and to Defence Regulations continued in force under that Order.

Whereas by section eight of the Supplies and Services (Transitional Powers) Act, 1945, the said Act was
limited to expire on the tenth day of December, nineteen hundred and fifty, five years after the passing thereof,
unless continued in force under that section:

And Whereas by Orders in Council, made under that section the said Act was continued in force until the
tenth day of December, nineteen hundred and fifty-four:

: And Whereas it is provided by that section that if an Address is presented to Her Majesty by each House of
Parliament praying that the said Act should be continued in force for a further period of one year from the time at
which it would otherwise expire, Her Majesty may by Order in Council direct that it shall continue in foree for that
further period:

And Whereas such an Address has been presented to Her Majesty by each House of Parliament as aforesaid:

Now, Therefore, Her Majesty, in pursuance of the said section eight and of all other powers enabling Her in
that behalf, is pleased, by and with the advice of Her Privy Council, to order, and it ig hereby ordered, as follows:—

/ 1. ‘The Supplies and Services (Transitional Powers) Act, 1945, which would otherwise expire on the tenth
day of December, nineteen hundred and fifty-four, shall continue in force for a further period of one year until the

2. This Order may be cited as the Supplies and Services (Continuance) Order, 1954, and shall come into
operation on the seventh day of December, nineteen hundred and fifty-four.

WHEREAS it ig enacted by section
12° of the Leeward Islands Acts, 1871
to 1950. as amended, that the General
Legislative Council may from time to
time be convoked, prorogued, and
dissolved by Proclamation:

AND WHEREAS by proclamation
under the hand of the Governor
dated the 4th day of January, 1954,
the General Legislative Council was
convoked for the 6th day of January,
1954:

AND WHEREAS the said Council
met on the 6th and Tin days of
January, 1954 and on the 24th day
of August, 1954, and after despatch
of the business thereof at the meeting
of the 24th day of August, 1954 was
on the said date adjourned sine die:

AND WHEREAS it is expedient
that the said Council should be pro-
rogued:

NOW, THEREFORE, I do by
this my proclamation prorogue the
General Legislative Council until the
3rd day of January, 1955.

AND the members of the said
Council and all other Her Majesty’s
officers and loving subjects in the
Colony of the Leeward Islands and
al! others whom it may concern are
hereby required to take due notice
hereof and to give their ready
abedience accordingly.

provided that the said Ordinance
shall come into operation on such
day as the Governor may appoint by
proclamation published in the Gazette.

NOW, THEREFORE, I, HENRY
ANTHONY CAMILLO HOWARD, the
Officer for the time being administer-
ing the Government of the Presidency
of the Virgin Islands, do by this my
proclamation declare that the said
Ordinance shall come into operation
on the 6th day of December, 1954.

Judge selected for the sitting of the

Ordinance, 1946.

By virtue of the powers conferred
on me in Section 2 of the Vehicles
and Road Traffic Ordinance, 1946
(No. 5 of 1946), I hereby fix the
period hereun-ler for the lighting of
vehicles.

Until further notice, the lighting
of vehicles shall be from 5.45 p.m. to
5.45 a.m.

Control of Imports and Exports

Notice No. 5 of 1954
TENDER FOR FLOUR

Tenders are invited for the supply of 15,000 half bags of 100 lb each “EE” grade flour from
Local Commission Agents of Canadian Flour Mills. (Quotations should be C.LF. Antigua and should
include agents commission. Tenders should indicate whether they would be prepared to accept any pro-
portion of the 15,000 bags say 5,000 bags and if so at what price.

2. The “EB” grade flour must be miJled solely from Canadian Hard Spring Wheat not lower
in grade than No. 3 northern and must be of the following minimum standard:—

Maximum moisture a 14,00%
Maximum ash i 52%
Minimum protein wee 12.00%

All flour to be enriched in accordance with the following:—

The name of the miller, analysis of the flour, the enrichment standard and brand name should
be stated in the tender. Chemist’s certificate showing analysis of the flour, enrichment standard and
duly notarised must accompany documents. The Supply Officer however, exercises the right to arrange
for samples to be drawn and analysed on his behalf.

Shipping documents must include date of shipment of all flour and must indicate that it is en-
riched and “ Vitamin Enriched Flour” must be stencilled on each bag.

3. Flour to be loaded at Montreal, Halifax or St. John and shipped to arrive in Antigua
during February, March and April, 1955 at a monthly rate of 5,000 half-bags of 100 lbs. each.

4. Tenders should be in a sealed envelope marked ‘ Tenders for flour” and should be addressed
to His Honour the Administrator and should reach the Administrator’s Office not later than 12 noon on
the 31st December, 1954.

5. Government does not bind itself to accept the lowest or any tender.

1. Citation. These Regulations may be cited as the
Curreney (Notes) (Amendment) Regulations, 1954, and
i be read as one with the Currency (Notes) Reeulations,

2, Amendment to Principal Regulations.
The following paragraph is hereby substituted for paragraph
(3) of regulution 20 of the Principal Regulations:—

(3) Ordinary surveys shall be held at least
quarterly, andin addition at least one surprise survey shall be
held every year, The Governor may order a surprise survey
at any time, ’

1954, parep DecremMBer 8, 1954, MADE BY THE Gov-
ERNOR BY VIRTUE OF THRE POWERS VESTED IN IIIM_ IN
THAT BEHALE.

WHEREAS section 18 of the Emergency Laws (Transi-
tional Provisions) Act, 1946 (hereinafter called “the Act of
1946), as amended by section 8 of the Nmergency Laws
(Miscellaneous Provisions) Act, 1947 (hereinafter called “ the
Act of 1947"), enabled provision to be made by Order in
Council for the continuation in force until the tenth day of
December, 1950, of Defence Regulations having effect in Colo-
nies and other territories, and provision was so made by the
Emergency Laws (Transitional Provisions) (Colonies, ctc.),
Order in Council, 1946 (hereinafter called ‘the Order of
1946’), and the Emergency Laws (Miscellaneous Provisions)
(Colonies, etc.) Order in Council, 1947:

AND WHEREAS Article 3 of the Emergency Laws
(Continuance) Order, 1954 (hereinafter called “the Order of
1954’), made on the 24th day of November, 1954, in pursu-
ance of the Act of 1947, provides that the powers exercisable,
in relation to any Defence Regulations remaining in force by
virtue of the said section 18 and Article 3 of the Hmergency
Laws (Continuance) Order, 1953, when the Order of 1954 was
made, as if, in the said section 18 as amended by section 8 of
the Act of 1947 for the reference to the tenth day of December,
1950, there were substituted a reference to the tenth day of
December, 1955:

AND WHEREAS the Emergency Laws (Miscellaneous
Provisions) (Colonies, ete.) Order in Council, 1954 (hereinafter
called “the Order in Council of 1954’) made by Her Majesty
the Queen on the 24th day of November, 1954, under the provi-
sions of the above recited Acts and Orders, enables the
Governor by Order to provide—

() for the continuation in force until the 10th day
of December, 1955, of any Defence Regulations, being

Defence Regulations in force in the Colony at the date of
the making of the Order of i954 by virtue of section 18
of the Act of 1946 and Article 3 of the Emergency Laws
(Continuance) Order, 1953;

(6) that any Defence Regulations so continued in
force shall have effect subject to such exceptions, limita-
tions and modifications as the Governor thinks necessary
or expedient:

NOW, THEREFORE, the Governor in pursuance of
section 18 of the Act of 1946 and Article 5 of the Order of
1954 and Article 2 of the Order in Council of 1954-and of all
other powers enabling him in that behalf is pleased to order
aud it is hereby ordered as tfollows:-—

1. Citation. This Order may be cited as the Emer-
gency Laws (Miscellaneous Provisions) Order, 1954.

2. Continuation. (1) The Defence Regulations
mentioned in the Schedule to this Order, being Defence Regu-
lations in force in the Colony at the date of the making of the
Ovder of 1954 by virtue of section 18 of the Act of 1946 and
Avticle 3 of the Emergency Laws (Continuance) Order, 1953
shall continue in force until the tenth dey of December, 1955:

Provided that such Defence Regulations may he revoked
either in whole or in part at any time by Order.

(2) Subsection (4) of section 5 of the Interpretation of
Laws Act (Cap. 193) shall apply, as it applies to the
interpretation of an Act, upon the expiry of any Defence
Regulation continued in force by this Order, as if such Regu-
lation had been revoked.

An Act to repeal the Crown Suits Act.
ENACTED by the Legislature of the

Leeward Islands.

1. This Act may be cited as the Crown Suits Short title.
(Repeal) Act, 1954.

2. The Crown Suits Act is hereby repealed: Repeal and
Saving.

Cap. 6.

Provided that notwithstanding the repeal
of the said Act where in any Federal or Local
Act or subsidiary legislation it is provided
that any suit shall be governed by the
provisions of the Crown Suits Act or that the
provisions of the Crown Suits Act shall be
applicable to any proceedings brought under
such Federal or Local Act or subsidiary
legislation, then for any reference to the
Crown Suits Act in such Federal or Local
Act or subsidiary legislation there shall be
substituted a reference to the Crown Proceed-
ings Ordinance of the Presidency in which
such suit or proceedings may be instituted.

8. This Act shall come into operation on a Commence-
day to be appointed by the Governor by Proclaina- “
tion published in the Gazette.

LEEWARD 2 Crown Suits (Repeal) No. — of 1954.

OBJECTS AND REASONS.

On the coming into force of the Crown Proceedings
Ordinance in the various Presidencies by virtue of which suits
may be brought against the Crown, the Crown Suits Act will
become otiose.

The purpose of this Bill is to repeal this Act.

An Act to amend further the Summary Jurisdic-

tion Act.

ENACTED by the Legislature of the

Leeward Islands.

1. This Act may be cited as the Summary
Jurisdiction (Amendment) Act, 1954, and shall be
read as one with the Summary Jurisdiction Act, as
amended, hereinafter called the Principal Act.

2. Section 8 of the Principal Act is hereby
ainended by the deletion of paragraph “(a)” thereof
and by re-lettering paragraphs “‘(b)”’ and “(¢)”
as paragraphs “(a)” and ‘ (6) ” respectively.

3. This Act shall come into operation on
a day to be appointed by the Governor by Procla-
mation published in the (razette.

OBJECTS AND REASONS.

Paragraph (a) of section 8 of the Summary Jurisdiction
Act (Cap. 21) precluded the Court of Summary Jurisdiction
trom taking cognizance of any “suits in which the matter in

question” related “to the taking of any duty payable to Her
Majesty, or to any fee of office, or other matier where rig hits in
future may be bound, or to any general right or duty ”’

2. By the Crown Proceedings Bill it is proposed to
confer jurisdiction not only on the Court of Summar y Jurisdic-
tion, but ulso on Magistrates’ Courts to deal with proceedings
brought by or against the Crown, and consequently section 8
(a) of Cap. 21 will have to be repealed.

An Act to amend further the Stamp Act.

ENACTED by the Legislature of the Leeward
Islands.

1. This Act may be cited as the Stamp
(Amendment) Act, 1954, and shall be read as one
with the Stamp Act, ns amended, hereinafter called
the Principal Act.

2. Section 2 of the Principal Act shall have
effect and shall be deemed always to have had
effect as if—

(a) the words “ Provisions of Act with
certain exceptions’ were substituted for the
word “ Act” appearing at the beginning of
the marginal note to the said section; and .

(6) the words and figures ‘‘ Subsection
(1) of section 9 and section 10 of Part I, and
Parts II and III, of this Act,” were substituted
for the words “This Act”? appearing at the
beginning of the first line of the said section.

The object of this Bill is to remove doubts as to whether
sections 4 to 8 and section 9 (2) of the Stamp Act (Cap. 135)
ceased to apply to the Virgin Islands (by reason of the provi-
sions of section 2 of the said Act) when the 1927 Revised
Kidition of the Laws came into effect on 17th February, 1930.

An Act to amend the Local Constables Act.

ENACTED by the Legislature of the Lee-

ward Islands.

1. This Act may be cited as the Local
Constables (Amendment) Act, 1955, and shall be
read as one with the Local Constables Act, here-
inafter called the Principal «Act.

2. Section 2 of the Principal Act is hereby
amended by the insertion therein, immediately after
the interpretation of the word ‘ District’, of the
following—

“¢ “ Division’ means a police division of the
Colony as provided in section 3 of the
Police Act, 1951;

“ Divisional Officer”? means the Gazetted
Police officer or the senior police officer
in charge of the Division in the Presi-
dency for which a iocal constable is
appointed ;

“Governor” includes the officer for the time
being administering the Government of a
Presidency ;”’.

amended by the substitution of the words “ the

umended by the substitution of the word “ Gover-
nor’ for the word ‘ Magistrate”? in the second

at the time of bis appointment shall report his
intended departure to the Divisional Officer.

(3) A local constable who ceases to reside
in the Presidency for which he was appointed
shall be deemed to have resigned his appoint-
ment.”’.

OBJECTS AND REASONS

The objects of this Bill are to amend the Local Constables
Act (Cap. 83) by:—

(a) defining the word “Governor” to include the
officer for the time being administering the Government
of a Presidency (clause 2);

(6) imposing on the Divisional Officer, as defined in
the Bill, the duty of the control of equipment to be issued
to Iccal constables, and providing a penalty for the failure
of a local constable to return such equipment on his
ceasing to be « local constable (clauses 2, 5 and 12);

(c) vesting in the Administrator or Commissioner of
a Presidency the power to appoint, call out or dismiss local
constables in case of any riot or emergency (clauses 3, 7
and 11);

(d) subjecting local constables to the control, in
relation to police duty, of a Divisional Officer or the police
officer in charge of any police district or station in the
Presidency (clause 6);

(¢) removing the restriction on the limit of four
shillings per day payable to local constables in relation to
the performance of their duties under the Principal Act
(clauses 8 and 9);

(7) imposing an obligation on local constables to

(g) amending section 19 of the Principal Act
consequent on the passing of the Police Act, 1951
(clause 13); and

(h) saving the appointments of local constables made
before the coming into force of the amending Act.

Council, to order, and it is hereby ordered as follows:— -

1. This Order may be cited as the Emergency Laws (Miscellaneous Provisions) (Colonies, etc.) Order in
Council, 1954.

2. The Governor of any territory mentioned in the Schedule to this Order may by order provide:—

(a) for the continuation in force until the tenth day of December, 1955, of any Defence Regula-
tions, being Defence Regulations in force in the territory at the date of the making of the Order of
1954 by virtue of section eighteen of the Act of 1946 and Article 3 of the Emergency Laws (Con-
tinuance) Order, 1953;

(b) that any Defence Regulations so continued in force shall have effect subject to such
exceptions, limitations and modifications as the Governor thinks necessary or expedient.

3. The provisions of section two, subsection (2) of section three, section four and section five of the Order
of 1946 shall have effect in relation to this Order, and to Defence Regulations continued in force under this Order,
as they have effect in relation to the Order of 1946, and to Defence Regulations continued in force under that Order.

TENDER FOR FLOUR

Tenders are invited for the supply of 15,000 half bags of 100 lb each “EE” grade flour from
Local Commission Agents of Canadian Flour Mills. (Quotations should be C.LF. Antigua and should
include agents commission. Tenders should indicate whether they would be prepared to accept any pro-
portion of the 15,000 bags say 5,000 bags and if so at what price.

2. The “EB” grade flour must be miJled solely from Canadian Hard Spring Wheat not lower
in grade than No. 3 northern and must be of the following minimum standard:—

Minimum protein wee 12.00%

All flour to be enriched in accordance with the following:—

The name of the miller, analysis of the flour, the enrichment standard and brand name should
be stated in the tender. Chemist’s certificate showing analysis of the flour, enrichment standard and
duly notarised must accompany documents. The Supply Officer however, exercises the right to arrange
for samples to be drawn and analysed on his behalf.

Shipping documents must include date of shipment of all flour and must indicate that it is en-
riched and “ Vitamin Enriched Flour” must be stencilled on each bag.

3. Flour to be loaded at Montreal, Halifax or St. John and shipped to arrive in Antigua
during February, March and April, 1955 at a monthly rate of 5,000 half-bags of 100 lbs. each.

4. Tenders should be in a sealed envelope marked ‘ Tenders for flour” and should be addressed
to His Honour the Administrator and should reach the Administrator’s Office not later than 12 noon on
the 31st December, 1954.

5. Government does not bind itself to accept the lowest or any tender.

WHEREAS section 18 of the Emergency Laws (Transi-
tional Provisions) Act, 1946 (hereinafter called “the Act of
1946), as amended by section 8 of the Nmergency Laws
(Miscellaneous Provisions) Act, 1947 (hereinafter called “ the
Act of 1947"), enabled provision to be made by Order in
Council for the continuation in force until the tenth day of
December, 1950, of Defence Regulations having effect in Colo-
nies and other territories, and provision was so made by the
Emergency Laws (Transitional Provisions) (Colonies, ctc.),
Order in Council, 1946 (hereinafter called ‘the Order of
1946’), and the Emergency Laws (Miscellaneous Provisions)
(Colonies, etc.) Order in Council, 1947:

AND WHEREAS Article 3 of the Emergency Laws
(Continuance) Order, 1954 (hereinafter called “the Order of
1954’), made on the 24th day of November, 1954, in pursu-
ance of the Act of 1947, provides that the powers exercisable,
in relation to any Defence Regulations remaining in force by
virtue of the said section 18 and Article 3 of the Hmergency
Laws (Continuance) Order, 1953, when the Order of 1954 was
made, as if, in the said section 18 as amended by section 8 of
the Act of 1947 for the reference to the tenth day of December,
1950, there were substituted a reference to the tenth day of
December, 1955:

AND WHEREAS the Emergency Laws (Miscellaneous
Provisions) (Colonies, ete.) Order in Council, 1954 (hereinafter
called “the Order in Council of 1954’) made by Her Majesty
the Queen on the 24th day of November, 1954, under the provi-
sions of the above recited Acts and Orders, enables the
Governor by Order to provide—

() for the continuation in force until the 10th day
of December, 1955, of any Defence Regulations, being
2 ,

Defence Regulations in force in the Colony at the date of
the making of the Order of i954 by virtue of section 18
of the Act of 1946 and Article 3 of the Emergency Laws
(Continuance) Order, 1953;

(6) that any Defence Regulations so continued in
force shall have effect subject to such exceptions, limita-
tions and modifications as the Governor thinks necessary
or expedient:

NOW, THEREFORE, the Governor in pursuance of
section 18 of the Act of 1946 and Article 5 of the Order of
1954 and Article 2 of the Order in Council of 1954-and of all
other powers enabling him in that behalf is pleased to order
aud it is hereby ordered as tfollows:-—

1. Citation. This Order may be cited as the Emer-
gency Laws (Miscellaneous Provisions) Order, 1954.

2. Continuation. (1) The Defence Regulations
mentioned in the Schedule to this Order, being Defence Regu-
lations in force in the Colony at the date of the making of the
Ovder of 1954 by virtue of section 18 of the Act of 1946 and
Avticle 3 of the Emergency Laws (Continuance) Order, 1953
shall continue in force until the tenth dey of December, 1955:

Provided that such Defence Regulations may he revoked
either in whole or in part at any time by Order.

(2) Subsection (4) of section 5 of the Interpretation of
Laws Act (Cap. 193) shall apply, as it applies to the
interpretation of an Act, upon the expiry of any Defence
Regulation continued in force by this Order, as if such Regu-
lation had been revoked.

An Act to repeal the Crown Suits Act.
ENACTED by the Legislature of the

Leeward Islands.

1. This Act may be cited as the Crown Suits Short title.
(Repeal) Act, 1954.

2. The Crown Suits Act is hereby repealed: Repeal and
Saving.

Cap. 6.

Provided that notwithstanding the repeal
of the said Act where in any Federal or Local
Act or subsidiary legislation it is provided
that any suit shall be governed by the
provisions of the Crown Suits Act or that the
provisions of the Crown Suits Act shall be
applicable to any proceedings brought under
such Federal or Local Act or subsidiary
legislation, then for any reference to the
Crown Suits Act in such Federal or Local
Act or subsidiary legislation there shall be
substituted a reference to the Crown Proceed-
ings Ordinance of the Presidency in which
such suit or proceedings may be instituted.

8. This Act shall come into operation on a Commence-
day to be appointed by the Governor by Proclaina- “
tion published in the Gazette.

Act (Cap. 21) precluded the Court of Summary Jurisdiction
trom taking cognizance of any “suits in which the matter in

future may be bound, or to any general right or duty ”’

2. By the Crown Proceedings Bill it is proposed to
confer jurisdiction not only on the Court of Summar y Jurisdic-
tion, but ulso on Magistrates’ Courts to deal with proceedings
brought by or against the Crown, and consequently section 8
(a) of Cap. 21 will have to be repealed.

An Act to amend further the Stamp Act.

ENACTED by the Legislature of the Leeward
Islands.

1. This Act may be cited as the Stamp
(Amendment) Act, 1954, and shall be read as one
with the Stamp Act, ns amended, hereinafter called
the Principal Act.

2. Section 2 of the Principal Act shall have
effect and shall be deemed always to have had
effect as if—

(a) the words “ Provisions of Act with
certain exceptions’ were substituted for the
word “ Act” appearing at the beginning of
the marginal note to the said section; and .

(6) the words and figures ‘‘ Subsection
(1) of section 9 and section 10 of Part I, and
Parts II and III, of this Act,” were substituted
for the words “This Act”? appearing at the
beginning of the first line of the said section.

The object of this Bill is to remove doubts as to whether
sections 4 to 8 and section 9 (2) of the Stamp Act (Cap. 135)

An Act to amend the Local Constables Act.

ENACTED by the Legislature of the Lee-

ward Islands.

1. This Act may be cited as the Local
Constables (Amendment) Act, 1955, and shall be
read as one with the Local Constables Act, here-
inafter called the Principal «Act.

2. Section 2 of the Principal Act is hereby
amended by the insertion therein, immediately after
the interpretation of the word ‘ District’, of the
following—

“¢ “ Division’ means a police division of the
Colony as provided in section 3 of the
Police Act, 1951;

“ Divisional Officer”? means the Gazetted
Police officer or the senior police officer
in charge of the Division in the Presi-
dency for which a iocal constable is
appointed ;

“Governor” includes the officer for the time
being administering the Government of a
Presidency ;”’.

3. Section 4 of the Principal Act is hereby
amended by the substitution of the words “ the
Governor ” for the words “any Magistrate” in the
first and second lines, and the letter “a” for the
word “his” in the third line, thereof.

4. Section 5 of the Principal Act is hereby
umended by the substitution of the word “ Gover-
nor’ for the word ‘ Magistrate”? in the second
line thereof.

5. The following section is hereby substitu-
ted for section 7 of the Principal Act:—

vided by the Divisional Officer with a staff, a
whistle, a note-book, an instruction book and
an armlet bearing the letters “ L.C.” and such
armlet shall be evidence of the office of every
such loeal constable. The cost of these articles
of equipment shall be defrayed at the public
expense.”

7. Section 10 of the Principal Act is hereby
amended by the substitution of the words ‘ The
Governor”? for the words “ Any Magistrate or
Justice of the Peace” in the first line thereof.

8. The following section is hereby substitu-
ted for section 11 of the Principal Act:—

may be authorised in accordance with the

(2) Every such payment shall be made
from such moneys as may be provided for the
purpose by the Legisiative Council of the
Presidency concerned.”

police station which is nearest to the place of

residence of such local constable, and state his

occupation and place of residence; and no local

constable shall change his residence as stated,

unless he has given notice of his intention so

(2) Any local constable who is about to
leave the Presidency wherein he was resident
at the time of bis appointment shall report his
intended departure to the Divisional Officer.

(3) A local constable who ceases to reside
in the Presidency for which he was appointed
shall be deemed to have resigned his appoint-
ment.”’.

11. Section 16 of the Principal Act is hereby Amendment

OBJECTS AND REASONS

The objects of this Bill are to amend the Local Constables
Act (Cap. 83) by:—

(a) defining the word “Governor” to include the
officer for the time being administering the Government
of a Presidency (clause 2);

(6) imposing on the Divisional Officer, as defined in
the Bill, the duty of the control of equipment to be issued
to Iccal constables, and providing a penalty for the failure
of a local constable to return such equipment on his
ceasing to be « local constable (clauses 2, 5 and 12);

(c) vesting in the Administrator or Commissioner of
a Presidency the power to appoint, call out or dismiss local
constables in case of any riot or emergency (clauses 3, 7
and 11);

(d) subjecting local constables to the control, in
relation to police duty, of a Divisional Officer or the police
officer in charge of any police district or station in the
Presidency (clause 6);

(¢) removing the restriction on the limit of four
shillings per day payable to local constables in relation to
the performance of their duties under the Principal Act
(clauses 8 and 9);

(7) imposing an obligation on local constables to
report twice annually and to notify any change of residence
to the appropriate police authorities (clause 10);

(g) amending section 19 of the Principal Act
consequent on the passing of the Police Act, 1951
(clause 13); and

(h) saving the appointments of local constables made
before the coming into force of the amending Act.
