Fourth and Fifth Electoral Distriets
of the Presidency in respect of the
first general election to be held wnder
the said Ordinance.

as amended, the Honourable the Act-
ing Chief Juslice selected for the
sitting of the Court in the Antigua
Cirenit has appointed the undermen-
tioned day on which the ensuing
Circuit shall sit in the Presidency,

on me in Section 2 of the Vehicles &
Road Traffic Ordinance 1946 (No. 5
of 1946) I hereby fix the period
hereunder for the lighting of vehicles.

Until further notice, the lizhting
of vehicles shall be from 6.30 p.m.
to 5.30 a.m.

chase of the Main X-Ray Diagnostic
equipment which was installed at the
Barbados General Hospital in 1941,
consisting of—

shockproof system, tubes, etc.

2. This equipment, which may
be inspected on application to the
Specialist Radiologist, General Hospi-
tal, will shortly be dismantled, and
the purchaser will be responsible for
its removal from the Hospital.

3. Tenders should be in sealed
envelopes marked “ Tender for X-Ray
Equipment’ and addressed to the
Chief Secretary, Public Buildings,
Bridgetown, Barbados, to reach him
not later than the 15th September,
1954.

4. The Government does not bind
itself to accept the highest or any
tender.

Tenders are invited for the supply of 15,000 half bags of 100 lb each ““E” grade flour from
Local Commission Agents of Canadian Flour Mills. (Quotations should be C.I.F. Antigua and should
include agents commission. Tenders should indicate whether they would be prepared to accept any pro-
portion of the 15,000 bags say 5,000 bags and if so at what price.

2. The “E” grade flour must be milled sclely from Canadian Hard Spring Wheat not lower
in grade than No. 3 northern and must be of the following minimum standard:—

for samples to be drawn and analysed on his behalf.

Shipping documents must include date of shipment of all flourand must indicate that it is en-
riched and ‘ Vitamin Enriched Flour” must be stencilled on cach bag.

3. Flour to be loaded at Montreal, Halifax or St. John and shipped at rate of 5,000 half
bags of 100 lb each month commencing early November 1954 and ending in January 1955. A. notice
of the award will be made and the price accepted by Government.

4. Tenders should be in a sealed envelope marked ‘ Tenders for flour” and should be addressed
to His Honour the Administrator and should reach the Administrator’s Office not later than 12 noon on.
the 30th September, 1954.

ENACTED by the Legislature of Mont-
serrat as follows: —

e 1. This Ordinance may be cited as _ short title

Iter Majesty, by virtue and in exercise of Her powers under
the Dominica Act, 1938(a), and of all other powers enabling
Her in that behalf, is pleased, by and with the advice of Her
Privy Council, to order, and it is hereby ordered as
follows: —

1.--(1) This Order may be cited as the Leeward Islands
and Windward Islands (Courts) (Amendment) Order in
Couneil, 1954, and shall be constrned as one with the
Leeward Islands and Windward Islands (Courts) Orders in
Council, 1989 and 1949(0).

(2) The Leeward Islands and Windward Islands
(Courts) Orders in Council, 1939 and 1949, and this Order
may be cited together as the Leeward [slands and Windward
Islands (Courts) Orders in Council, 1959 to 1954.

2. Section 4 of the Lee vard Islands and Windward
Islands (Courts) Order in Council, 1939, is hereby amended
by the insertion immediately after subsection (1) thereof of
the following new subsections:-—

““(ta) When a holder of the office of Chief Justice
is on leave of absence pending relinquishment of his
office it shall bo lawful for another person to be
appointed substantively to the otice of Chief Justice.

(1B) When two or more persons are holding the
office of Chiet Justice by reason of an appointment
made pursuant to subsection (14) of this Section then,

5 of this Order, the person last appointed thereto shall
be deemed to be the sole substantive holder of the
oftice.”

This Order amends the Leeward Islands and Windward
Tslands (Courts) Order in Council, 1939, by providing that

Court of the Windward Islands and Leeward Islands is on
leave of absence pending relinquishment of his office it shall
be lawful for another person to be appointed substantively

WHEREAS by section 2 of the Watercourses and Water
Works Ordinance, 1945, as amended, it is provided that the
Governor in Council may by Order define any area to be a
distribution area for the purposes of the Ordinance;

NOW, THEREFORE, the Governor in Council doth

hereby order as follows:—

1. Citation. This Order may be cited ay the Water
Distribution Area Order, 1954.

2. Distribution Area. For the purposes of the
Watercourses and Water Works Ordinance, 1945, as amended,
the following area is defined as a distribution area: —

General Distribution Area. The island of Antigua.

3. Revocation. The Water Distribution Areas Order,
1951, (8. R. & O. 1951, No. 15) is hereby revoked.

1. Water Service Rates. The water service rates
pryable on premises within the General Distribution Area as
defined in the Water Distribution Area Order, 1954 shall with
effect from the first day of October, 1954 in respect of a
domestic supply or a non-domestic supply as respectively
defined in the Watercourses and Water Works Regulations,
1954, be as Follows:—

(1) Domestic Suppty.
(a) Where a water meter has been installed.

(i) a minimum charge of $1.20 per quarter for
the first 3,000 gallons of water or part
thereof consumed;

(ii) an additional charge of 50 cents for each
further 1,009 gallons or part thereof
consumed.

(6) Where no water meter has been installed.

5 per cent of the annual rental value of the
premises payable in equal quarterly instalments
or $1.00 per quarter, whichever amount is the
higher.

(2) Non-Domestic SuPPLy.
(a) Where a water meter has been mstalled.

(i) a minimum charge of $3.00 per quarter for
the first 3,000 gallons of water or part
thereof consumed irrespective of the size of
meter installed;

(ii) an additional charge of 80 cents for each
further 1,000 gallons or part thereof
consumed,

(6) Where no water meter has been installed.

7% per cent of the annual rental value of the
premises payable in equal quarterly instalments
or $10.00 per quarter, whichever amount is the

higher.

2. Exemption from Water Services Rate. The
premises of all Government institutions and of all churches and °
schools approved by the Governor in Council shall be exempt
from water service rate.

3. Cancellation. The Water Service Rates, 1951
(S. R. & O, 1951, No. 16) are hereby cancelled.

1. Crration. These Regulations may be cited as the
Watercourses and Water Works Regulations, 1954.

2. [xrerpreratton, In these Regulations unless the
context otherwise reyuires—

“domestic supply”? means water supplied for use for
domestic purposes only to any dwelling house, school-
house, church, office, store shop or other building;

‘non-domestic supply’? means water supplied to any
hotel, factory, drugstore, laundry, garage used for
public service vehicles or for repairing motor vehicles,
trough for watering animals, or to any place where
water is used wholly or partly for other than domestic
purposes;

‘* Ordinance’? means the Watercourses and Water Works
Ordinance, 1945, as amended ;

“owner” includes lessee or occupier, where the owner is
not resident in the Presidency «and has no lawful
attorney therein;

‘“stand-pipe” means any pipe, tap, cock, valve, cistern or
tank situated in any public place or in any place to
which the public have access, from, through or by
means of which water is supplied to the public;

“water service” means uny pipe, cock, valve, fitting or
other appliance used for conducting a supply of water
from the waterworks into any premises for use
thereon.

3. APPLICATION FOR A SUPPLY OF WaTER. (1) Every
application for water to be supplied to any premises shall be
made by the owner of the premises in the form set ont in the
Schedule hereto.

(2) The Colonial Engineer shall notify the applicant of
the result of his application.

4. Connecting Water Service. (1) On the applica-
tion being approved the Public Works Department shall
connect the water service to the premises or permit the same to
be connected under its supervision.

(2) The water service shall not be connected to any urinal,
water closet, or other similar sanitary apparatus except through
wgistern and in accordance with such directions as may be given
by the Public Works Department.

(3) Every water service discharging water into any bath,
sink or other similar receptacle shall be so placed as to discharge
above the top water level.

(4) Every cistern or tank which is connected to a water
service and is used for storing a supply of water from the
waterworks shall be maintained clean and water-tight and fitted
with an inspection plate and with an overtlow pipe of not less
than one size larger diameter than the inlet pipe and led to
discharge away from any exterior wall. The inlet pipe shall be
provide a with a suitable and effective ball valve.

(5) No new water service shall be turned on on any
premises until the cost of making the water service connection
under regulation 5 of these Regulations shall have been first
paid into the Treasury.

5. Cosr or connectina Warer Service. (1) Where
a water service is connected by the Public Works Department,
the cost of making the connection shall include the following:—

(a) the cost of all materials used, except the initial
cost of any water meter installed, increased by 25 per cent;

(6) the cost of labour and transport;

(c) any expenses incurred in carrying out the work,
including the cost of repairing any part of any street or
road broken open for the purpose.

(2) The cost of connecting a water service to any premises
shall be recovered from the owner of the premises.

(3) The owner shall, on being notified of the amount due,
pay the same into the Treasury.

(4) The Colorial Engineer shall have power to fix a time
for the payment of the amount due by any person und to
extend such time or to permit of payment being by instalments.

6. Urkeer and Revatk or Warrer Service Connec-
TION. (1) Where a water service connection has been made
and the cost thereof paid for by the owner of the premises, the
upkeep and repair of the connection shall be the responsibility
of the Public Works Departinent to that point on the connection
where the water meter is attixed, or where no such meter is
wtixed to the point where the connection enters the premises of
the owner, or where the connection is made on the owner's
premises to the potut of such connection.

(2) ‘The owner of any premises to which a water service
connection has been made shall at all reasonable times afford to
any officer of the Public Works Department access to any part
of the premises through which the water serviee counection
passes and to the water meter, and permit him to carry out
such cxaminations, Hispecuon, repairs or replacement of any
water service connection as nay be necessary pursuant to para-
graph (1) of this regulation,

(3) No such officer shall be liable tor any damage, Husance

conveying a domestic supply of water, unless the Colomial
Engineer otherwise directs, shall be of half ineh internal
diameter.

Ss. Warrer Mees. (1) The Public Works Department
shall have the right to instal a meter im any premises with a
domestic or non-domestic supply and the water services rate
pavable shall as from the commencement of the eustine quarter
be based on the volume of water constuned on such premises,
in accordance with the water service rites levied under the
Ordinance.

(2) The nieter shall remam the property et the Govern-
ment and shall be fitted to a separate and distinct inlet leading
dircet from: the distribution miu tate the premises,

(3) Whenever any question shall arise as to the accuracy
of any meter the person compl: uning may, on depositing the
sum of three dollars and sixty cents into the Treasury, require
the meter to be tested; and subsequent charges shall be bused
on the result of the test.

(4) A meter shall be deemed to be correct if its error docs
not exceed three per cent.

(5) In the event of the meter being found incorrect the
amount of the deposit shall be returned.

(6) Any officer or employee of the Public Works Depart-
ment or any other person authorised by the Colonial Eneineer
shall be at liberty to enter any premises where a meter is
installed at all reasonable times for the purpose of reading,
checking or inspecting the meter.

(7) In addition to the water se rvice rate payable
respect of any premises the Colonial Engincer may charge an
annual rental in uccordance with the provisions of paragraph (S)
of this regulation in respect of any meter installed by the Public
Works Department on such premises, which rental shall be
payable in equal quarterly instalments together with the water
service rate under regulation 13 () of these Reeulations.

(8) The apnual rental of meters shall not exceed the
following rates: —

(a) for } inch meter, three dollars and sixty cenis,
(>) for } inch meter, four dollars:

(¢) fora meter exceeding * inch but not exceeding
13 inches, seven dollars and twenty cents:

(d) for a meter exceeding 1) inches, a rental not
exceeding twenty per cent of the cost of the meter to
be fixed by the Colonial lagineer: Provided that only
in exee ptional ciretuustances will a larger meter than a
1$ inch meter be affixed in any service connection

9. Marertans, Frrrincs, ere. All pipes, tabes, cocks,
valves, fittings and other materials to be used in connecting
or extending a water service shall be provided by the Pulhe
Works Department or shall be approved by the Colonial
Engineer.

10. PERSONS AUTHORISED TO CONNECT, REPAIR, ETC.
Warer Services, No person other than the Public Works
Department, its employees ond persons licensed by the
Colonial Engineer shall undertake to connect, alter, repair
or extend any water service.

11. LIckNSING OF PERSONS TO UNDERTAKE CONNECTING,
REPATRING, EVC. (1) The Colonial Engineer may grant
licences to such persons as he considers competent to under-
take the work of connecting, altering, repairing or extending
water services.

(2) Every person to whom a licence is to be granted
shall, before the eraut of such licence, enter into a bond
with the Colonial Engineer in a form to be approved by him.

() The bond shall be for the sum of two hundred and
forty dollars with one surety to be approved by the Colonial
ingineer against all damages for injury fo persons or to
public ov private property arising out of any act done by
the licensee in the execution of any work in connection with
any water service.

(4) Every licence snall be annual and shall expire ou
the Sist day of December of the year in which it is issued
and may be renewed aunually by endorsement of the period
of renewal thereon:

Provided that on every such renewal the bond given
under paragraphs (2) and (3) of this regulation shall, with
the consent of the surety in writing, be deemed to extend to
such period of renewal.

(5) Every licensee under this regulation shall betore
the Sth day after the commencement of each quarter
submit a veturn signed by him to the Colonial Kngineer
setting forth the work conducted by him during the previous
quarter, including the premises on which work was done
and the charges made therefor,

(6) Every lieenee granted under this regulation shail
he revocable by the Colonial Bbneineer in the event of its
being shown to his satisfaction that the licensee has
comunited any fagrant or persistent breach of any of the
provisions of the Ordinance or of any regulation made
thereunder; or in the event of the Colonial Engineer being
satistod of serious negleet ar incompetence on the part ef
the licensee in the esceution of any work performed by lam
pursuant toa Heenee granted wider this regulation,

(7) Inthis regulation the term “licensee ” shall include
any employees of the person to whom the licence is granted
under this regulation.

12. APiOINrTMENT OF AssrssorsS. Where the water
service rate payable in respect of any premises is based on
the rental value of such premises, the Colonial Kngineer
may appoint such persons as he thinks fit to assess the
rental value thereof for the purpose of fixing the water
service rate payable as a percentage of the annual rental
value of such premises;

Provided that, where the rental value of any such
premises has been assessed for the purposes of city rate, the
water service vate shall be based on such assessment.

13. PaymMest or Waren Service Rares. Water
service rate shall be paid into the Treasury by the person
requiring, receiving or using the water supplied hy the
Public Works Department as follows:—

(a) in yespect of premises on which no meter is
installed the rate shall be paid in advance by equal
quarterly payments before the 7th January, the 7th
April, the 7th July, and the 7th October of each year;

(>) in respect of premises on which a meter is
installed the rate shall be paid before the 15th January,
the Loth April, the 5th July and the 14th October of
each year.

14. Discontinuance or Warer Surety. (1) Wathout
prejudice to the payment of water rates the Public Works
Department may regitlate or sttspend the supply of water
to any premises in the event of drought or to enable an
examination of any water serviec or of any part of the water
works to be made or any repairs or alterations to any water
service or waterworks or any other work necessary Tor the
maintenance of the water supply to be effected,

(2) The Public Works Department may in any ot the
eircumstances mentioned hereunder discontinue the supply
of water to any prenitses—

(7) where the cost of making #& water services
eonunection has not after demand been paid into the
Treastury by the owner, lessee ar other persaii to whoni
the account for the charges therefor has been rendered ;



(4) where the water rate in respect of the premises
has remained unpaid for seven days after the date fixed
for the payment, thereof;

(c) where there has been undue waste or improper
use of the water.

(3) When the supply of water to any premises is
discontinued under subparagraph (7) or subparagraph (6) of
paragraph (2) of this regulation such service may be
reconnected on payment by or on behalf of the defaulting
party of the charges or arrears of water rate due and in
addition, at the discretion of the Colonial Engineer, of an
additional fee of one dollar and twenty cents.

15. Conrron or Sraxp-prers. Any person who—
(a) allows water from any stand pipe to flow—

(1) into any vessel which is at the time over-
flowing, or

(ii) into any vessel which, at the time, is
unable to retain its contents;

(6) turns on the tap or cock of any stand-pipe and
allows the water flowing therefrom to go to waste;

(c) bathes, or washes any clothes or washes any
child, animal or vehicle at or near any stand-pipe,

shall be guilty of an offence and shall on summary convic-
tion be liable to a penalty not exceeding forty-cight dollars.

16.) Prorecrion or Water Courses. The Colonial
Engineer may—

(a) authorise any officer or employee of the Public
Works Department to cut, fell, or burn any tree or
underwood whatever growing or that shall grow within
a distance of thirty fect of any watercourse;

(6) prohibit within the distance aforesaid . the
cultivation of any land or the depasturing or grazing of
any livestock.

17.) Revocation. The Watercourses and Water Works
Regulations 1946 (3. R. & O. 1946, No. 14) and the Water-
courses aud Water Works (Amendment) Regulations, 1951
(3. K. & O. 1951, No. 17) are hereby revoked.

1. Citation. These Regulations may be cited as the Legisla-
tive Council (Remuneration of Election Officers) Regulations, 1954.

2. Interpretation. In these Kegulations “the Ordinance”
means the Virgin Islands Constitution and Hlections Ordinance, 1954.

%. Rates of Pay. The following amounts shall be paid to
election officers for their services in the performance of such duties
as may be assigned to thein under the Ordinance: —

(a) To the Supervisor of Elections— ninety-four dollars
and twenty-nine
cents

(6) To every registering officer for each
name entered on a preliminary list—- nine cents

Provided that where a registering officer has been
assisted in his duties by one or more assistant registering
officers the total amount payable shali be divided between
them in such manner as the Supervisor of Elections may
direct.

(c) To every returning officer of an
electoral district in which the elec-
tion was contested— seventeen dollars and
fourteen cents

(d) To every returning officer of an
electora! district in which the elec-
tion was uncontested— eight dollars and
fifty-seven cents

(«) To every presiding officer— seventeen dollars and
fourteen cents

(7) To every poll clerk— eight dollars and
fifty-seven cents
(yg) To every poll clerk and every witness
tallying at the count of the votes— six dollars and
eighty-six cents

(h) To every messenger appointed to
collect’ a ballot box and election
documents



three dollars and
forty-three cents.

4, Travelling. For travelling in connection with an election,
election officers shall be paid at the rate prescribed for public officers
by any Travelling Allowance Regulations in force.

TENDER FOR FLOUR

Tenders are invited for the supply of 15,000 half bags of 100 lb each ““E” grade flour from
Local Commission Agents of Canadian Flour Mills. (Quotations should be C.I.F. Antigua and should
include agents commission. Tenders should indicate whether they would be prepared to accept any pro-
portion of the 15,000 bags say 5,000 bags and if so at what price.

2. The “E” grade flour must be milled sclely from Canadian Hard Spring Wheat not lower
in grade than No. 3 northern and must be of the following minimum standard:—

Minimum protein vee 12.00%

duly notarised must accompany documents. The Supply Officer however, exercises the right to arrange
for samples to be drawn and analysed on his behalf.

Shipping documents must include date of shipment of all flourand must indicate that it is en-
riched and ‘ Vitamin Enriched Flour” must be stencilled on cach bag.

3. Flour to be loaded at Montreal, Halifax or St. John and shipped at rate of 5,000 half
bags of 100 lb each month commencing early November 1954 and ending in January 1955. A. notice
of the award will be made and the price accepted by Government.

4. Tenders should be in a sealed envelope marked ‘ Tenders for flour” and should be addressed
to His Honour the Administrator and should reach the Administrator’s Office not later than 12 noon on.
the 30th September, 1954.

5. Government does not bind itself to accept the lowest or any tender.

An Ordinance to amend further the Cotton
Export Duty Amendment Ordinance, 1919.

ENACTED by the Legislature of Mont-
serrat as follows: —

e 1. This Ordinance may be cited as _ short title
: the Cotton Export Duty (Amendment) Ordi-
~ nance, 1954.

The Cotton Hxport Duty Amendment 1/1919. 6/1931.
Ordinance, 1919, as amended, is hereinafter 7153) ee
called the Principal Ordinance.

2. Schedule A of the Principal Ordinance amendment
is hereby amended by the deletion of item 1 of Schedule *.

Iter Majesty, by virtue and in exercise of Her powers under
the Dominica Act, 1938(a), and of all other powers enabling
Her in that behalf, is pleased, by and with the advice of Her
Privy Council, to order, and it is hereby ordered as
follows: —

1.--(1) This Order may be cited as the Leeward Islands
and Windward Islands (Courts) (Amendment) Order in
Couneil, 1954, and shall be constrned as one with the
Leeward Islands and Windward Islands (Courts) Orders in
Council, 1989 and 1949(0).

(2) The Leeward Islands and Windward Islands
(Courts) Orders in Council, 1939 and 1949, and this Order
may be cited together as the Leeward [slands and Windward
Islands (Courts) Orders in Council, 1959 to 1954.

2. Section 4 of the Lee vard Islands and Windward
Islands (Courts) Order in Council, 1939, is hereby amended
by the insertion immediately after subsection (1) thereof of
the following new subsections:-—

““(ta) When a holder of the office of Chief Justice
is on leave of absence pending relinquishment of his
office it shall bo lawful for another person to be
appointed substantively to the otice of Chief Justice.

office of Chiet Justice by reason of an appointment

5 of this Order, the person last appointed thereto shall
be deemed to be the sole substantive holder of the
oftice.”

to indicate its general purport.)

This Order amends the Leeward Islands and Windward
Tslands (Courts) Order in Council, 1939, by providing that
when a holder of the office of Chief Justice of the Supreme
Court of the Windward Islands and Leeward Islands is on
leave of absence pending relinquishment of his office it shall
be lawful for another person to be appointed substantively
to the office of Chief Justice.

WHEREAS by section 2 of the Watercourses and Water
Works Ordinance, 1945, as amended, it is provided that the
Governor in Council may by Order define any area to be a
distribution area for the purposes of the Ordinance;

NOW, THEREFORE, the Governor in Council doth

hereby order as follows:—

1. Citation. This Order may be cited ay the Water
Distribution Area Order, 1954.

2. Distribution Area. For the purposes of the
Watercourses and Water Works Ordinance, 1945, as amended,
the following area is defined as a distribution area: —

General Distribution Area. The island of Antigua.

3. Revocation. The Water Distribution Areas Order,
1951, (8. R. & O. 1951, No. 15) is hereby revoked.

1. Water Service Rates. The water service rates
pryable on premises within the General Distribution Area as
defined in the Water Distribution Area Order, 1954 shall with
effect from the first day of October, 1954 in respect of a
domestic supply or a non-domestic supply as respectively
defined in the Watercourses and Water Works Regulations,
1954, be as Follows:—

(1) Domestic Suppty.
(a) Where a water meter has been installed.

(i) a minimum charge of $1.20 per quarter for
the first 3,000 gallons of water or part
thereof consumed;

(ii) an additional charge of 50 cents for each
further 1,009 gallons or part thereof
consumed.

(6) Where no water meter has been installed.

5 per cent of the annual rental value of the
premises payable in equal quarterly instalments
or $1.00 per quarter, whichever amount is the
higher.

(2) Non-Domestic SuPPLy.
(a) Where a water meter has been mstalled.

(i) a minimum charge of $3.00 per quarter for
the first 3,000 gallons of water or part
thereof consumed irrespective of the size of
meter installed;

(ii) an additional charge of 80 cents for each
further 1,000 gallons or part thereof
consumed,

(6) Where no water meter has been installed.

7% per cent of the annual rental value of the
premises payable in equal quarterly instalments
or $10.00 per quarter, whichever amount is the

higher.

2. Exemption from Water Services Rate. The
premises of all Government institutions and of all churches and °
schools approved by the Governor in Council shall be exempt
from water service rate.

3. Cancellation. The Water Service Rates, 1951
(S. R. & O, 1951, No. 16) are hereby cancelled.

1. Crration. These Regulations may be cited as the
Watercourses and Water Works Regulations, 1954.

2. [xrerpreratton, In these Regulations unless the
context otherwise reyuires—

“domestic supply”? means water supplied for use for
domestic purposes only to any dwelling house, school-
house, church, office, store shop or other building;

‘non-domestic supply’? means water supplied to any
hotel, factory, drugstore, laundry, garage used for
public service vehicles or for repairing motor vehicles,
trough for watering animals, or to any place where
water is used wholly or partly for other than domestic
purposes;

‘* Ordinance’? means the Watercourses and Water Works
Ordinance, 1945, as amended ;

“owner” includes lessee or occupier, where the owner is
not resident in the Presidency «and has no lawful
attorney therein;

‘“stand-pipe” means any pipe, tap, cock, valve, cistern or
tank situated in any public place or in any place to
which the public have access, from, through or by
means of which water is supplied to the public;

“water service” means uny pipe, cock, valve, fitting or
other appliance used for conducting a supply of water
from the waterworks into any premises for use
thereon.

3. APPLICATION FOR A SUPPLY OF WaTER. (1) Every
application for water to be supplied to any premises shall be
made by the owner of the premises in the form set ont in the
Schedule hereto.

(2) The Colonial Engineer shall notify the applicant of
the result of his application.

4. Connecting Water Service. (1) On the applica-
tion being approved the Public Works Department shall
connect the water service to the premises or permit the same to
be connected under its supervision.

(2) The water service shall not be connected to any urinal,
water closet, or other similar sanitary apparatus except through
wgistern and in accordance with such directions as may be given
by the Public Works Department.

(3) Every water service discharging water into any bath,
sink or other similar receptacle shall be so placed as to discharge
above the top water level.

(4) Every cistern or tank which is connected to a water
service and is used for storing a supply of water from the
waterworks shall be maintained clean and water-tight and fitted
with an inspection plate and with an overtlow pipe of not less
than one size larger diameter than the inlet pipe and led to
discharge away from any exterior wall. The inlet pipe shall be
provide a with a suitable and effective ball valve.

(5) No new water service shall be turned on on any
premises until the cost of making the water service connection
under regulation 5 of these Regulations shall have been first
paid into the Treasury.

5. Cosr or connectina Warer Service. (1) Where
a water service is connected by the Public Works Department,
the cost of making the connection shall include the following:—

(a) the cost of all materials used, except the initial
cost of any water meter installed, increased by 25 per cent;

(6) the cost of labour and transport;

(c) any expenses incurred in carrying out the work,
including the cost of repairing any part of any street or
road broken open for the purpose.

(2) The cost of connecting a water service to any premises
shall be recovered from the owner of the premises.

(3) The owner shall, on being notified of the amount due,
pay the same into the Treasury.

(4) The Colorial Engineer shall have power to fix a time
for the payment of the amount due by any person und to
extend such time or to permit of payment being by instalments.

6. Urkeer and Revatk or Warrer Service Connec-
TION. (1) Where a water service connection has been made
and the cost thereof paid for by the owner of the premises, the
upkeep and repair of the connection shall be the responsibility
of the Public Works Departinent to that point on the connection
where the water meter is attixed, or where no such meter is
wtixed to the point where the connection enters the premises of
the owner, or where the connection is made on the owner's
premises to the potut of such connection.

(2) ‘The owner of any premises to which a water service
connection has been made shall at all reasonable times afford to
any officer of the Public Works Department access to any part
of the premises through which the water serviee counection
passes and to the water meter, and permit him to carry out
such cxaminations, Hispecuon, repairs or replacement of any
water service connection as nay be necessary pursuant to para-
graph (1) of this regulation,

(3) No such officer shall be liable tor any damage, Husance

(3) Whenever any question shall arise as to the accuracy
of any meter the person compl: uning may, on depositing the
sum of three dollars and sixty cents into the Treasury, require
the meter to be tested; and subsequent charges shall be bused
on the result of the test.

(4) A meter shall be deemed to be correct if its error docs
not exceed three per cent.

(5) In the event of the meter being found incorrect the
amount of the deposit shall be returned.

(6) Any officer or employee of the Public Works Depart-
ment or any other person authorised by the Colonial Eneineer
shall be at liberty to enter any premises where a meter is
installed at all reasonable times for the purpose of reading,
checking or inspecting the meter.

(7) In addition to the water se rvice rate payable
respect of any premises the Colonial Engincer may charge an
annual rental in uccordance with the provisions of paragraph (S)
of this regulation in respect of any meter installed by the Public
Works Department on such premises, which rental shall be
payable in equal quarterly instalments together with the water
service rate under regulation 13 () of these Reeulations.

(8) The apnual rental of meters shall not exceed the
following rates: —

(a) for } inch meter, three dollars and sixty cenis,
(>) for } inch meter, four dollars:

(¢) fora meter exceeding * inch but not exceeding
13 inches, seven dollars and twenty cents:

(d) for a meter exceeding 1) inches, a rental not
exceeding twenty per cent of the cost of the meter to
be fixed by the Colonial lagineer: Provided that only
in exee ptional ciretuustances will a larger meter than a
1$ inch meter be affixed in any service connection

9. Marertans, Frrrincs, ere. All pipes, tabes, cocks,
valves, fittings and other materials to be used in connecting
or extending a water service shall be provided by the Pulhe
Works Department or shall be approved by the Colonial
Engineer.

10. PERSONS AUTHORISED TO CONNECT, REPAIR, ETC.
Warer Services, No person other than the Public Works
Department, its employees ond persons licensed by the
Colonial Engineer shall undertake to connect, alter, repair
or extend any water service.

11. LIckNSING OF PERSONS TO UNDERTAKE CONNECTING,
REPATRING, EVC. (1) The Colonial Engineer may grant
licences to such persons as he considers competent to under-
take the work of connecting, altering, repairing or extending
water services.

(2) Every person to whom a licence is to be granted
shall, before the eraut of such licence, enter into a bond
with the Colonial Engineer in a form to be approved by him.

() The bond shall be for the sum of two hundred and
forty dollars with one surety to be approved by the Colonial
ingineer against all damages for injury fo persons or to
public ov private property arising out of any act done by
the licensee in the execution of any work in connection with
any water service.

(4) Every licence snall be annual and shall expire ou
the Sist day of December of the year in which it is issued
and may be renewed aunually by endorsement of the period
of renewal thereon:

Provided that on every such renewal the bond given
under paragraphs (2) and (3) of this regulation shall, with
the consent of the surety in writing, be deemed to extend to
such period of renewal.

(5) Every licensee under this regulation shall betore
the Sth day after the commencement of each quarter
submit a veturn signed by him to the Colonial Kngineer
setting forth the work conducted by him during the previous
quarter, including the premises on which work was done
and the charges made therefor,

(6) Every lieenee granted under this regulation shail
he revocable by the Colonial Bbneineer in the event of its
being shown to his satisfaction that the licensee has
comunited any fagrant or persistent breach of any of the
provisions of the Ordinance or of any regulation made
thereunder; or in the event of the Colonial Engineer being
satistod of serious negleet ar incompetence on the part ef
the licensee in the esceution of any work performed by lam
pursuant toa Heenee granted wider this regulation,

(7) Inthis regulation the term “licensee ” shall include
any employees of the person to whom the licence is granted
under this regulation.

12. APiOINrTMENT OF AssrssorsS. Where the water
service rate payable in respect of any premises is based on
the rental value of such premises, the Colonial Kngineer
may appoint such persons as he thinks fit to assess the
rental value thereof for the purpose of fixing the water
service rate payable as a percentage of the annual rental
value of such premises;

Provided that, where the rental value of any such
premises has been assessed for the purposes of city rate, the
water service vate shall be based on such assessment.

13. PaymMest or Waren Service Rares. Water
service rate shall be paid into the Treasury by the person
requiring, receiving or using the water supplied hy the
Public Works Department as follows:—

(a) in yespect of premises on which no meter is
installed the rate shall be paid in advance by equal
quarterly payments before the 7th January, the 7th
April, the 7th July, and the 7th October of each year;

(>) in respect of premises on which a meter is
installed the rate shall be paid before the 15th January,
the Loth April, the 5th July and the 14th October of
each year.

14. Discontinuance or Warer Surety. (1) Wathout
prejudice to the payment of water rates the Public Works
Department may regitlate or sttspend the supply of water
to any premises in the event of drought or to enable an
examination of any water serviec or of any part of the water
works to be made or any repairs or alterations to any water
service or waterworks or any other work necessary Tor the
maintenance of the water supply to be effected,

(2) The Public Works Department may in any ot the
eircumstances mentioned hereunder discontinue the supply
of water to any prenitses—

(7) where the cost of making #& water services
eonunection has not after demand been paid into the
Treastury by the owner, lessee ar other persaii to whoni
the account for the charges therefor has been rendered ;
(4) where the water rate in respect of the premises
has remained unpaid for seven days after the date fixed
for the payment, thereof;

(c) where there has been undue waste or improper
use of the water.

(3) When the supply of water to any premises is
discontinued under subparagraph (7) or subparagraph (6) of
paragraph (2) of this regulation such service may be
reconnected on payment by or on behalf of the defaulting
party of the charges or arrears of water rate due and in
addition, at the discretion of the Colonial Engineer, of an
additional fee of one dollar and twenty cents.

15. Conrron or Sraxp-prers. Any person who—
(a) allows water from any stand pipe to flow—

(1) into any vessel which is at the time over-
flowing, or

(ii) into any vessel which, at the time, is
unable to retain its contents;

(6) turns on the tap or cock of any stand-pipe and
allows the water flowing therefrom to go to waste;

(c) bathes, or washes any clothes or washes any
child, animal or vehicle at or near any stand-pipe,

shall be guilty of an offence and shall on summary convic-
tion be liable to a penalty not exceeding forty-cight dollars.

16.) Prorecrion or Water Courses. The Colonial
Engineer may—

(a) authorise any officer or employee of the Public
Works Department to cut, fell, or burn any tree or
underwood whatever growing or that shall grow within
a distance of thirty fect of any watercourse;

(6) prohibit within the distance aforesaid . the
cultivation of any land or the depasturing or grazing of
any livestock.

17.) Revocation. The Watercourses and Water Works
Regulations 1946 (3. R. & O. 1946, No. 14) and the Water-
courses aud Water Works (Amendment) Regulations, 1951
(3. K. & O. 1951, No. 17) are hereby revoked.

1. Citation. These Regulations may be cited as the Legisla-
tive Council (Remuneration of Election Officers) Regulations, 1954.

2. Interpretation. In these Kegulations “the Ordinance”
means the Virgin Islands Constitution and Hlections Ordinance, 1954.

%. Rates of Pay. The following amounts shall be paid to
election officers for their services in the performance of such duties
as may be assigned to thein under the Ordinance: —

(a) To the Supervisor of Elections— ninety-four dollars
and twenty-nine
cents

(6) To every registering officer for each
name entered on a preliminary list—- nine cents

Provided that where a registering officer has been
assisted in his duties by one or more assistant registering
officers the total amount payable shali be divided between
them in such manner as the Supervisor of Elections may
direct.

(c) To every returning officer of an
electoral district in which the elec-
tion was contested— seventeen dollars and
fourteen cents

(d) To every returning officer of an
electora! district in which the elec-
tion was uncontested— eight dollars and
fifty-seven cents

(«) To every presiding officer— seventeen dollars and
fourteen cents

(7) To every poll clerk— eight dollars and
fifty-seven cents
(yg) To every poll clerk and every witness
tallying at the count of the votes— six dollars and
eighty-six cents

(h) To every messenger appointed to
collect’ a ballot box and election
documents



three dollars and
forty-three cents.

4, Travelling. For travelling in connection with an election,
election officers shall be paid at the rate prescribed for public officers
by any Travelling Allowance Regulations in force.
