The Customs Act, 1962 (Act 1962-18)

THE CUSTOMS (CARIBBEAN FREE TRADE ASSO-
CIATION) ORDER, 1969
The Minister in exercise of the powers conferred
on him by section 25 of the Customs Act, 1962 hereby
makes the following Order:-
1.. This Order may be cited as the Customs (Carib-
bean Free Trade Association) Order, 1969.
2.(1) Subject to paragraph 5 and notwithstanding
the provisions of Part I of the First Schedule to the
:Customs Act, 1962, the rate of duties of customs on
any item set out in the First Schedule shall, where
the goods to be charged are eligible for an Agreement
rate of duty pursuant to the Caribbean Free Trade
Act 1967-33. Association Act, 1967, be a fraction of the basic rate
applicable to the item, the appropriate fraction being
determined in accordance with the Second Schedule
having regard to the period within which the goods
were imported.
(2) For the purposes of this paragraph the basic
rate applicable to an item, shall be the rate at which
customs duty was chargeable immediately before 1st
May, 1968 on the importation of such item into the
Island under the British Preferential Tariff.
3.(1) Notwithstanding the provision of Part I of
Act 1962-18. the First Schedule to the Customs Act, 1962, the rate
of duties of customs on any item set out in the first
column of Parts I and II of the Third Schedule shall,
where the goods to be charged are eligible for an
Agreement rate of duty pursuant to"the Caribbean Free
Act 1967-33. Trade Association Act, 1967, be the rate set out oppo-

site such item in the third column of the said Sche-
dule, and in addition, in the case of any item set out
in Part I of the said Schedule, such fraction of the
basic surcharge applicable to the item as is deter-
mined having regard to the provisions of sub-paragraph
(2).
(2) For the purposes of this paragraph the basic
surcharge on any item of goods set out in the first
column of Part I of the Third Schedule shall be de-
termined in accordance with the provisions of the
appropriate Part of the Fourth Schedule applicable to
that item and the appropriate fraction of such sur-
charge to be charged in respect of any item of goods
shall be as set out in the Fifth Schedule regard being
had to the period within which the goods were im-
ported.
4. No additional duty under the Revenue in aid Act 1941-5.
Act, 1941, and no package tax under the Package Act 1941-6.
Tax Act, 1941, shall be charged on the importation of
any items set out in Part I of the Third Schedule,
where the goods to be charged are eligible for an
agreement rate of duty pursuant to the Caribbean Free
Trade Association Act, 1967.
5. The Minister may, if it appears expedient so to
do by reason of any decision taken by the Council of
the Caribbean Free Trade Association, by notice pub-
lished in the Official Gazette, direct that paragraphs
2, 3 and 4, or any of those paragraphs, shall not apply
to such of the items set out in the First and Third
Schedules as may be specified in the notice.
