VIRGIN ISLANDS.
The — Court of the Windward Islands and Leeward Is-
lands (Remuneration and conditions of Office) (Courts)
Order 1964.
_ An Order, a draft of which hag been approved by
resolution of the legislative ehamber of each of the Colo-
nies to which the Windward Islands and Leeward Islands
(Courts) Order in Council, 1959 as amended applies, made
by the Secretary of State for the Colonies in exercise of
powers conferred on him by section 21 of that Order as .
amended by the West Indies (Dissolution and Interim
Commissioner) Order in Council 1962, and of other powers
enabling him in that behalf:—
1. This Order may be cited as the Supreme Court
of the Windward Islands and Leeward Islands (Remunera-
tion and Conditions of Office) (Courts) Order 1964.
2. (1) In this Order, “island of residence’? means—
(a) in the case of a person holding the office of
Judge, the island designated as the residence
of such person under the provisions of sec-
tion 4 of this Order;
(b) in the case of any other person, the island or
country in which such person is ordinarily
resident.
colony of residence†means the Colony in which
the island of residence is situated.
(2) References in this Order to the Chief Justice, a
Puisne Judge or a Judge shall be references to the Chief
Justice, a Puisne Judge ora Judge, respectively, of the
Supreme Court of the Windward Islands and Leeward
Islands, and shall include references to a person acting in
the office of Chief Justice, a Puisne Judge or a Judge,
respectively, of that Court.
8. There shall be paid to the Chief Justice a salary
at the rate of $12,000.00 a year and to each Puisne Judge
a salary at the rate of $9,600.00 a year.

5. (1) Each Judge is entitled to furnished quarters
in his island of residence and if he is temporarily posted ©
for duty to any other island for a period exceeding 3
months, he will be entitled to furnished quarters in that -
other island if he surrenders any furnished quarters that —

- may have been provided for him in his island of residence.
(2) In respect of the quarters provided, a Judge shall <
pay rent at the annual rate of $720.00 and in respect of
the furniture supplied he-shall pay rent at the annual rate
of 10% of the value of such furniture. -

(3) The scale of furniture allotted to the Judge's
furnished quarters shall be subject to the approval of the
Administrator of the territory concerned.
6. (1) A Judge is entitled to reimbursement by
Government in respect of the actual cost of travelling on
duty between his island of residence and any place out-
side the island (including the cost. of travelling, within
any island, between his place of residence and the place
of embarkation and disembarkation, as the case may be)
by such means as may be approved by the Chief Justice
of the Supreme Oourt of the Windward Islands and
Leeward Islands.
(2) A Judge shall be paid a travelling allowance at -
the rate of $40.00 a month in respect of travelling and
transport on duty within the island in which he is for the
time being performing his functions.
7. A Judge shall be reimbursed in respect of the
actual cost of board and lodging while out of his island of
residence on duty.
8. (1) A Judge resident in St. Kitts shall be
entitled to a subsistence allowance of $5.00 for each day.
or part of a day spent on duty in Nevis or Anguilla.
(2) Subject to the provisions of paragraphs 3 and 4
of this section a Judge shall be entitled to a subsistence
allowance of $10.00 for each day or part of a day spent
on duty outside his Colony of residence.
(3) Where a Judge is assigned for duty to an island
other than his island of residence for a period exceeding
3 months, he shall not be entitled to the subsistence
allowance under the last foregoing paragraph unless—
(a) he ig maintaining living accomodation for
himself or his family in his Colony of residence;
(}) he ig not provided with free furnished quarters
in the Colony to which he is temporarily posted,

(4) Where a Judge is assigned for duty to an island
other than his island of residence for a period exceeding
6 months and is entitled to subsistence allowance under
the provisions of paragraphs (2) and (3) of this section,
the subsistence allowance payable to him from the
beginning of the seventh month shall be at the reduced
rate of $5,00 for each day or part of a day.
9, (1) A Judge is not entitled as of right to leave
or leave passages.
(2) Leave is granted subject to the exigencies of the
public service and the sums payable in respect of leave
passages may be modified from time to time according to
‘the availability of public funds.
(3) A Judge is eligible for forty-five days vacation
leave annually and such leave may be accumulated up
- to a maximum of one hundred and eighty days.
. (4) A Judge is eligible for leave passages once in
every two years if leave is to be spent in the territories
covered by the jurisdiction of the Court or in Barbados,
Jamaica or Trinidad, and once in every three years if
leave is to be spent elsewhere than in those territories.
(5) A Judge is also eligible for passages on first
appointment to the island to which he is assigned for
duty and for passages on retirement to his country of
origin or to another place of retirement provided that the
cost involved does not exceed the cost of passages to his
country of origin. Passages on retirement are normally
only granted where a Judge has completed three years
of service since his last overseas leave.
(6) Leave passages as prescribed by subsections (4)
and (5) of this section are provided for the judge, his
wife and children who are under the age of 18 years,
unmarried, and dependent upon him, provided that:
(i) the cost of passages is limited to the
equivalent of first Class air travel; and
(ii) the amount to be granted shall not exceed
the cost of three adult return passages, at
the rates prescribed in sub-paragraph (1)
above,
(a) to the place where the leave is to be
taken if the leave is taken within the
territories covered by the jurisdiction
of’ the Court, Barbados, Jamaica and
Trinidad
