information that the Secretary of State
has appointed Mr. Justice FImLp to
the office of Chief Justice, Wind ward
and Leeward Islands, in accordance
with Section 4 (1) of the Windward
Islands and Leeward Islands (Courts)
Order in Council, 1959, as umended
by the West Indies (Dissolution and

Interim Commissioner) Order in
Council, 1962.
2. The appointment was made

with effect from 2nd December, 1963.

1927 (No. 11 of 1927)
Statutory Rules and
Orders 1951 No. 18.

The imposition of duties of Cus-
toms in respect of the educational
scientific and cultural materials listed
in Schedules A, B,C, and D of the
Resolution of the Legislative Council
of Antigua dated October 25th 1951,
S.R. & O. 1951 No. 18, was abolished
by the terms of the said Resolution
made under section 15 of the Customs
Dutics Ordinance, 1927 No. 11 of
1927, provided such materials are the
product of such States as are designa-
ted by the Administrator by notice
published in the Gazette us being
Contracting States to the UNESCO
Agreement on the Importation of
Educational, Scientific and Cultural
Materials approved by the General
Conference of UNESCO during the
fifth session at Florence in June, 1950;
and subject to the conditions laid
down in tho said Schedules: Pro-
vided that the importation of any
such material is accompanied by a
certificate that such material is of an
educational, scientific or cultural
character signed by or on behalf of
the Minister of Education of the Uni-
ted Kingdom or by such other body
or person aj may be designated for
such purpose by the Administrator
by notice published in the Gazette.

For the purposes of the said exemp-
tion the Administrator has designated
the following States asbeing Contract-

tion of Laws Ordinance, 1959.

Notice is hereby given that the
Government of Montserrat has ap-
pointed Messrs. Waterlow and Sons
Limited, of Worship Street. London,
H.C.4, England, to be the Govern-
ment Printer within the meaning of
the Evidence (Colonial Statutes) Act,
1907, of the Revised Edition of the
Laws of the Colony of Antigua pre-
pared under the authority of the
Revised Edition of the Laws Ordi-
nance, 1959 (No. 15 of 1959) the said
Edition to contain the Acts and Ordi-
nances in force on the ist day of
January, 1962, being the day appoint-
ed by notice made the 10th day of
November, 1961, by the Administrator
under section 8 (2) of the said Revised

Be it enacted by the Queen’s Most Excellent
Majesty, by and with the advice and consent of
the Legislative Council of Antigua, and by the
authority of the same as follows:—

1. This Ordinance may be cited as the Short title.
Supplementary Appropriation (No. 2) Ordinance,
1963.

2. The various sums of money set forth in Legalisation
the Schedule to this Ordinance amounting in all to of expendi
the sum of One hundred and nine thousand eight ,
hundred and ten dollars and eight cents in addition
to the sums granted by the Appropriation Ordi-
nance, 1963, shall be and the sume are hereby 2/1963.
declared to be charged upon and made payable from
and out of the public funds of the Colony and the

An Ordinance to authorise a further increase of
pensions payable in respect of public service.

[1st January, 1963.]

Be it enacted by the Queen’s Most Excellent
Majesty, by and with the advice, and consent of
the Legislative Council of Antigua, and by the
authority of the same as follows:—

‘1. This Ordinance may be cited as the short title.
Pensions (Increase) Ordinance, 1963.

2. (1) In this Ordinance, the expression Interpreta-
“pension”? means any pension or any proportion “™
of a pension payable by way of periodical payments
under the provisions of any law mentioned in the
Schedule to this Ordinance but does not include any
sum payable otherwise than by way of periodical

- payments out of the revenues of Antigua; and
accordingly the provisions of this Ordinance shall
not have effect with respect to any pension which
has been commuted or where part but not the whole
of a pension has been commuted with respect to
that part thereof.

2 Pensions (Increase). —- No. 22 of 1963.

(2) In this Ordinance, unless the context
otherwise requires, the following expressions have
the following meanings respectively, that is to say—

“the Act of” any specified year menns the
Pensions (Increase) Act of that year;

“enactment” includes any: enactment in any
law which is in force in the Colony;

“relevant increase’? means wn increase by
virture of, or by reference to, increases
under any of the following enactments,
that is to say, the Act of 1947; the Act
of 1953 and the Act of 1957.

‘Scheduled Government” shall have the same
meaning as in the Pensions Regulations,
1947.

3. Subject to the provisions of this Ordi-
nance the annual rate of any pension specified in
the Schedule to this Ordinance which is based on
emoluments pxid in respect of any period ending
not later than the 3lst day of March, 1960, may,
in respect of any period beginning on or after the
Ist day of January, 1963, be increased by the
Administrator by an amount equal to the following
percentage of the adjusted rate of that pension, that
18 to say—

(a) if the pension is based on emoluments

paid in respect of any period ending not
Inter than 31st December, 1955, twenty
five per cent;

(b) if the pension is based on emoluments
paid in respect of a period beginning after
the last mentioned date and ending on a
date not later than the 31st March, 1960,
fifteen per cent.

In this section the expression “adjusted rate”
in relation to any pension, means the aggregate
annual rate of that pension after any relevant
increase thereof apart from this section, including
any increase im the case of mixed pensions

authorised by virtue of any enactment, any gees
of a dollar in that aggregate being treated as
whole dollar.

4. (1) Where a pension is determined by
reference to arate of emoluments paid by a Govern-
ment or authority other than the Government of
the Colony, the Administrator, after paying regard
to the emoluments by reference to which that
pension was computed and to any increase of such
emoluments in consequence of any general revision
of salaries, may after consultation with the Ministry
of Finance, but subject to the provisions of sub-
section (2) of this section authorise thejpayment of
an increase of such pension. ,

(2) Where the payment of an increase of
pension is authorised by virtue of the provisions
of subsection (1) of this section such increase shall
be made on the basis of the increases authorised by
section 3 of this Ordinance in the case of' pensions
to which that section applies.

(3) For the purposes of this section the
expression “the basie”’ means the substitution by
the Administrator of the dates immediately preced-
ing the effective dates of any general revisions of
salaries by the Scheduled Government us he may
determine to be appropriate for the 3lat December,
1955, or the 31st March, 1960, as the case may be.

5. (1) No increase shall be payable under
this Ordinance unless the pensioner—

(a) has attained the age of 55 years; or
(5) has not attained the age of 16 years; or

‘(c) bas retired on account of physical or men-
tal infirmity; or

(d) is to the satisfaction of the Administrator
permanently incapacitated from engaging
in full time employment; or

(e) is a woman with at least one dependant; or

(f) is a woman whose pension is payable in
respect of her deceased husband and has
attained the age of 40 years.

(2) In the preceding subsection the expression
“ dependant” in relation to a pensioner shall have
the meaning assigned thereto by subsection (2)
of section 3 of the Pensions (Increase) Ordinance,
1957.

6. There shall be defrayed out of moneys

provided by the Legislature any expenditure

incurred under or by virtue of this Ordinance.

7. The amount of any increase awarded in
accordance with this Ordinance shall not be taken
into account for the purposes of any provisions
contained in any Ordinance specified in the Sched-
ule to this Ordinance which limits the amount of
pension which may be drawn by an officer.

8. This Ordinance shall be deemed to have
come into force on the lst day of January, 1963.

An Ordinance to amend further the Pensions
Act, 1947.

Be it enacted by the Queens Most Excellent
Majesty, by and with the advice and consent of
the Legislative Council of Antigua, and by the
authority of the same as follows:—

1. This Ordinance may be cited as the Pen-
sions Act (Amendment) Ordinance, 1963, and
shall be read as one with the Pensions Act, 1947,
and all amendments thereto, hereinafter called
the principal Act.

2. Subsection (1) of section 2 of the prin-
cipal Act is amended as follows: —

(i) by the insertion in paragraph (a) of the
definition of ‘‘ pensionable emoluments”
of the words “ inducement allowance, ”

immediately after the word “salary”;

Montserrat Constitution and Elections Ordinance, 1952, as
amended, that the Administrator, acting in accordance with the
advice of the Chief Minister, may at any time by proclamatien
published in the Gazette, prorogue the Legislative Council:

NOW, THEREFORE, in accordance with the advice of the
Chief Minister, I do hereby prorogue the Legislative Council of
the Colony on the 27th day of December, 1968, until such date
as-I may appoint by proclamation for the next session of the said

_ Council:

AND the Members of the said Council and all other Her
Majesty’s officers and loving subjects in the Colony and all those
whom it may concern are hereby required to take notice hereof
and to govern themselves accordingly.

1. Short title. This Order may be cited as the Aid
to Pioneer Industries (Karl Muller) (Meat Processing) Order,
1963. ;

2. Declaration of Pioneer Manufacture.
Kart Mover of Plymouth, Montserrat, is hereby declared to
be a pioneer manufacturer for the purposes of the Aid to
Pioneer Industries Ordinance, 1950, in relation to his pioneer
factory situated at George Street, Plymouth, and in relation to
meat processing and the manufacture of sausages, hams, lard
and bacon declared by the Aid to Pioneer Industries (Meat
Processing) Order, 1963, to be a pioneer industry and pioneer
products respectively; and the production day in respect of the
said factory in relation to the above mentioned pioneer products
is hereby declared to be the day of July 30, 1963.

An Ordinance to authorise a further increase of
pensions payable in respect of public service.

[1st January, 1963.]

Be it enacted by the Queen’s Most Excellent
Majesty, by and with the advice, and consent of
the Legislative Council of Antigua, and by the
authority of the same as follows:—

‘1. This Ordinance may be cited as the short title.
Pensions (Increase) Ordinance, 1963.

2. (1) In this Ordinance, the expression Interpreta-
“pension”? means any pension or any proportion “™
of a pension payable by way of periodical payments
under the provisions of any law mentioned in the
Schedule to this Ordinance but does not include any
sum payable otherwise than by way of periodical

- payments out of the revenues of Antigua; and
accordingly the provisions of this Ordinance shall
not have effect with respect to any pension which
has been commuted or where part but not the whole
of a pension has been commuted with respect to
that part thereof.

2 Pensions (Increase). —- No. 22 of 1963.

(2) In this Ordinance, unless the context
otherwise requires, the following expressions have
the following meanings respectively, that is to say—

“the Act of” any specified year menns the
Pensions (Increase) Act of that year;

“enactment” includes any: enactment in any
law which is in force in the Colony;

“relevant increase’? means wn increase by
virture of, or by reference to, increases
under any of the following enactments,
that is to say, the Act of 1947; the Act
of 1953 and the Act of 1957.

‘Scheduled Government” shall have the same
meaning as in the Pensions Regulations,
1947.

3. Subject to the provisions of this Ordi-
nance the annual rate of any pension specified in
the Schedule to this Ordinance which is based on
emoluments pxid in respect of any period ending
not later than the 3lst day of March, 1960, may,
in respect of any period beginning on or after the
Ist day of January, 1963, be increased by the
Administrator by an amount equal to the following
percentage of the adjusted rate of that pension, that
18 to say—

(a) if the pension is based on emoluments

paid in respect of any period ending not
Inter than 31st December, 1955, twenty
five per cent;

(b) if the pension is based on emoluments
paid in respect of a period beginning after
the last mentioned date and ending on a
date not later than the 31st March, 1960,
fifteen per cent.

In this section the expression “adjusted rate”
in relation to any pension, means the aggregate
annual rate of that pension after any relevant
increase thereof apart from this section, including
any increase im the case of mixed pensions

authorised by virtue of any enactment, any gees
of a dollar in that aggregate being treated as
whole dollar.

4. (1) Where a pension is determined by
reference to arate of emoluments paid by a Govern-
ment or authority other than the Government of
the Colony, the Administrator, after paying regard
to the emoluments by reference to which that
pension was computed and to any increase of such
emoluments in consequence of any general revision
of salaries, may after consultation with the Ministry
of Finance, but subject to the provisions of sub-
section (2) of this section authorise thejpayment of
an increase of such pension. ,

(2) Where the payment of an increase of
pension is authorised by virtue of the provisions
of subsection (1) of this section such increase shall
be made on the basis of the increases authorised by
section 3 of this Ordinance in the case of' pensions
to which that section applies.

(3) For the purposes of this section the
expression “the basie”’ means the substitution by
the Administrator of the dates immediately preced-
ing the effective dates of any general revisions of
salaries by the Scheduled Government us he may
determine to be appropriate for the 3lat December,
1955, or the 31st March, 1960, as the case may be.

5. (1) No increase shall be payable under
this Ordinance unless the pensioner—

(a) has attained the age of 55 years; or
(5) has not attained the age of 16 years; or

‘(c) bas retired on account of physical or men-
tal infirmity; or

(d) is to the satisfaction of the Administrator
permanently incapacitated from engaging
in full time employment; or

(e) is a woman with at least one dependant; or

(f) is a woman whose pension is payable in
respect of her deceased husband and has
attained the age of 40 years.

(2) In the preceding subsection the expression
“ dependant” in relation to a pensioner shall have
the meaning assigned thereto by subsection (2)
of section 3 of the Pensions (Increase) Ordinance,
1957.

6. There shall be defrayed out of moneys

provided by the Legislature any expenditure

incurred under or by virtue of this Ordinance.

7. The amount of any increase awarded in
accordance with this Ordinance shall not be taken
into account for the purposes of any provisions
contained in any Ordinance specified in the Sched-
ule to this Ordinance which limits the amount of
pension which may be drawn by an officer.

8. This Ordinance shall be deemed to have
come into force on the lst day of January, 1963.
