An Ordinance to amend further the Customs Duties
Ordinance, 1927..
[31st May, 1963] Commence-
ment.
ENACTED by the Legislature of the Colony
of the Virgin Islands.
1. This Ordinance may be cited as the Cus- Short title.
toms Duties (Amendment) Ordinance, 1963 and
shall be read as one with the Customs Duties Ordi- 9/1927
nance, 1927, as amended, hereinafter called the
Principal Ordinance.

2. Section 2 of the Principal Ordinance is Amendment
hereby amended as follows: of Section 2
of the Princi.
pal Ordinance.
(a) by inserting before the definition of Col-
lector of Customs the following defini-
tion:-

"Aircraft" includes balloons, kites,
gliders, airships and flying machines,",
(b) by inserting between the, definitions of
Collector of Customs and Duty the
following definition:-
" Drawback means a refund of all or
part of any duty of customs or exoise
authorised by law in respect of goods
exported or used in any particular
manner,",

(c) by substituting the following definition for
the definition of Duty ":-

SCHEDULE.


REGULATIONS COVERING LANDING AND
PARKING FEES.
1. In this Schedule unless the context otherwise requires-
aircraft weight means that maximum permissible
weight authorized by the aircraft's certificate of air-
worthiness;
normal hours means the hours from 6.00 a.m to
6.00 p.m. on each day of the week.
(U. S.) means in the currency:of the United States
of America.
2. (1) (a) The fees to be charged for the landing of an
aircraft at Beef Island Airport or Airfield during normal hours
shall be assessed on the aircraft weight and shall be at the rate
of 60o. (U. S.) for each 1,000 lbs. or part thereof of the aircraft's
weight:
Provided that there shall be paid in addition to the fees
specified above, a special fee equivalent to twenty-five per centum
of such fee in respect of any aircraft landing otherwise than in
an emergency outside the normal hours.
(b) The fees to be charged for the landing of an air-
craft at Road Harbour or Soper's Hole shall be 50c. (U. S.)
for each landing.
(c) No parking fee will be charged for the day on
which the aircraft lands at Beef Island Airfield or Airport.
Thereafter parking fees will be charged at the following
rates:-
Aircraft Weight For each 24 hours
or part thereof
Up to 10,000 lbs, $1.00 (U. S.)
Over 10,000 lbs. $2.00 (U. S.)
(2) In lieu of a fee for each landing as provided in para-
graphs (1) (a) and (b) of this Regulation, the Administrator
may, from time to time, fix a commuted fee to be paid by any
person in respect of an air,"raft owned or operated by him and
landing at the arodromes during such period, ,is the Administra-
tor may determine.

THE WATER AREAS ORDER, 1963, DATED 12TH FEBRUARY
1963, MADE BY THE ADMINISTRATOR IN COUNCIL UNDER
SECTION 3 OF THE PROTECTION OF TREFS AND CONSERt
VATION OF SOIL AND WATER ORDINANCE, 1954 (No. 8 OF
1954).


1. CITATION. This Order may be cited as the Water
Areas Order, 1963.
2. WATER AREAS. It is hereby declared that the areas
described in the Schedule hereto shall be water areas for purposes
of the Proctection of Trees and Conservation of Soil and Water
Ordinance, 1954 (No. 8 of 1954).
3. COMMENCEMENT. This Order shall come into opera-
tion on the 12th day of February. 1963.

SCHEDULE


(i) All that area of land situate at Belle Vue in
island of Tortola and bounded as follows:-
On the North by an imaginary line running from
a concrete pillar hereinafter referred to as the
Northern Concrete Pillar at the eastern side in
a westerly direction to a gut known as Belle Vue
gut ", thence to a mango tree hereinafter referred
to as the North-Western Mango Tree" near to
which a steel stake has been fixed in the ground;
on the West by a public road leading to Belle
Yue and demarcated as follows, that is to say, by
an imaginary line running from the North-

" Duty includes any tax or surtax
imposed by the customs or excise laws,"
(d) by inserting between the definitions of
Duty and "Goods the following
definition:-
"Export with its grammatical varia-
tions and cognate expressions, means to
take or cause to be taken out of the
Colony or the waters thereof,", and
(e) by inserting between the definition., of
Goods and Proof of Spirit the
following definitions:-
Import with its grammatical varia-
tions and cognate expressions, menns to
bring or cause to be brought within the
Colony or the waters thereof,",
" owner when used in relation to
goods includes any person who is for the
time being entitled, either as owner or
agent for the owner, to the possession of
any goods,".
3. Section 12 of the Principal Ordinance is

Peralty for 12G. If any goods for which
not exporting. bond is required under section 12E of
this Ordinance after being entered and
put on board an aircraft or ship shall
be used otherwise than as stores (if so
entered) or shall not be duly exported
to and discharged at the declared desti-
nation (such goods not having been
discharged in the Colony with the
permission of the Collector of Customs)
or otherwise accounted for to the
satisfaction of the Collector of Customs,
the same shall be forfeited: and the
Master of the aircraft or ship in which
such goods shall have been put, shall
incur a penalty of three hundred dol-
lars in the currency of the United
States of America, or treble the value
of such goods at the election of the
Collector of Customs.

Drawback on 12H. Where it is proved td the
goods lost. satisfaction of the Collector of Customs
that any goods after being duly put on
board an aircraft or ship for exportation
or use as stores have, either before or
after exportation, been destroyed by
accident on board such aircraft or ship,
any drawback or allowance payable on
the goods shall be payable in the same
manner as if the goods had been actu-
ally exported or used as stores.

TENDER.


Tenders are hereby invited for the
transport by motor-car of public
officers travelling on duty for the
year ending 31st December, 1964.

2. Such tenders should be in the
respect of single journey from the
place where the public officer enters
the car to the place at which he leaves
it (i.e. so much a mile for the single
journey) and charge for waiting, if
any, should be stated. Provided
that where the offieoor enters or leaves
the car outside the city limits a
charge may be made for the distance
between the point and St. Johns.

3. Government will not be pre-
cluded from the hiring seats for
public officers in Public service
vehicles which would otherwise be
proceeding to the officer's destination
where htis will result in any economy
e.g. for customs officers going to
Coolidge Airfield on duty in a car
hired or used by the Airline Agents.

4. Government reserves the right
to hire or use cars, or seats in cars,
other than the contractor's cars, for
public officers proceeding on duties
connected with the Customs or
revenue.

5. Government does not bind it-
self to accept the lowest or any tender.
6. The contractor will be expected
to provide prompt and efficient ser-
vice and any agreement entered in to
with a contractor will be subject to
the following conditions:

(i) The Contractor shall when-
ever required furnish a car.

(ii) If due notice of the require-
ment of a car has been given and
failing any satisfactory explana-


tion the Contractor's car arrive
more than five minutes after the
required time, Government shall
have the right to deduct a penalty
not exceeding $2.40 from any of
the sums due and owing to the
Contractor.

(iii) In the event of the Contrac-
tor's car being more than 15 min-
utes later after the required time,
Government may cancel the con-
tract on giving the Contractor one
week's notice in writing.

(iv) Government shall also have
the right to tErminate the contract
on giving one week's notice in
writing if the service is generally
unreliable through repeated un-
punotuality, defective cars or other
cause.


7. The Tender should state the
number of cars to be at the disposal
of Government.


8. All tenders should be addressed

Ordinance, 1963. ISLANDS.
(3) Notwithstanding anything
hereinbefore contained in this section
all drawbacks payable under any former
Act or Ordinance shall be paid or allow-
ed under this Ordinance until cancelled
by direction of the Administrator in
Council under this section.

Certification. 12A. Every sum of money
which shall be due upon any instru-
ment for the payment of money out of
the duties of customs shall be paid by
the Treasurer of the Colony on the said
instrument being certified by the Col-
lector of Customs.

Declaration 12B. The owner of any goods
gooders xport on which drawback is claimed shall
ed on draw- make and subscribe a declaration on the
back. aforesaid instrument that the conditions
under which drawback is allowed have
been fulfilled, and in the case of goods
exported or put on board an aircraft or
ship for use as stores, that such goods
have been actually exported or put on
board for use as stores, as the case may
be, and have not been returned and are
not intended to be returned to the
Colony and that such owner at the time
of entry of such goods was and conti-
nues to be entitled to the drawback
thereon.
Evidence of 12C. The Collector of Customs
disposal of may require the owner to produce satis-
goods. factory evidence of the landing or
disposal of any goods before certifying
any instrument.
Time limit 12D. No instrument for any

tion of one year or such further time

5. AMATEUR LICENCES CHARGED ON POWER. The
licence fee and charges in respect of an Amateur Telecommuni-
cations Station shall be chargeable according to the power
allocated to the tratismitter at such station at the time of the
granting of a licence or of transfer to a higher power.

6. COMMENCEMENT. This Order shall come into force
on the 1st day of February, 1963.

3. (1) Fees chargeable under Regulations shall be paid to
the Treasurer or to any officer authorised by him by the owner,
operator or agent of the aircraft.
(2) All such fees shall be paid into the Treasury in aid of
the general revenue of the Colony.
4. The Administrator may, in his discretion, exempt any
person from the payment either partially or wholly, of any of
the fees set out in Regulation 2 or in any case in which it is
expedient to do so or in which the payment of such fees would
cause undue hardship.

THE TELECOMMUNICATIONS LICENCESS AND FEES) ORDER,
1963, DATED JANUARY 25, 1963, MADE BY THE ADMINIS-
TRATOR IN COUNCIL BY VIRTUE OF SECTION 6 OF THE
TELECOMMUNICATIONS ACT, 1949 (No. 13/1949) AS
AMENDED.

1. CITATION. This Order may be cited as the Telecom-
munications (Licences and Fees) Order, 1963.
2. INTERPRETATION. In this Order-
initial charge means the fee chargeable, in addition to
the annual licence fee and the transfer charge, in
respect of a station when licensed for the first time;
"licence means a licence granted under section 6 of the
Telecommunications Act, 1949;
"transfer charge" means the additional fee chargeable
when the power of the transmitter at a station is
increased beyond the maximum of the category
within which it was originally licensed;
(U.S.) means in the currency of the United States of
America.
3. PERIOD AND EXPIRATION OF LICENCES. Applications
for licences and renewals thereof shall be made in the month of
February in each year and every such licence or renewal shall
expire on the 31st day of January in the year next succeeding
that in which it was taken out.
4. FEES FOR LICENCES. (1) There shall be paid to the
Treasurer for every licence and for every renewal thereof, as
the case may be, the fees and charges specified in the Schedule
to this Order.
(2) If a licence is taken out not more than six months
before the 31st day of January next succeeding one-half only
of the appropriate fee specified in the said Schedule shall be
payable.

12E. Before any warehoused
goods, or goods entitled to any draw-
back on being put on board an aircraft
or ship for use as stores or for expor-
tation, or goods exportable only under
particular rules, regulations or restric-
tions, or goods liable to duties of
customs intended for transfer from an
importing to an exporting aircraft or
ship shall be permitted to be entered
for use as stores, or for exportation or
for transfer as aforesaid, the exporter
shall give such security by bond as the
Collector of Customs may require that
such goods shall be duly put on board
the aircraft or ship for which the same
are entered and shall be used as stores
(if so entered) or else exported to and
discharged at the place for which they
are entered within such time as the
Collector of Customs may deem reason-
able, or be otherwise accounted for to
his satisfaction.

12F. If any goods for which
bond is required under section 12E of
this Ordinance shall on examination by
the Collector of Customs be found not
to agree with the entered particulars
thereof, or being goods on which draw-
back shall be claimed or allowed shall
be found to be goods not entitled to
drrwback, all such goods shall be
forfeited; and the exporter of such
goods shall in every such case incur a
penalty of three hundred dollars in the
currency of the United States of
America, or treble the amount of the
value of such goods, at the election of
the Collector of Customs.

(ii) All that area of land situate at Belle Vue in
the island of Tortola known as Morning Rose
Spring" and bounded as follows:-
On the North by an imaginary line running from
a pear tree hereinafter referred to as the Pear
Tree at the western side, near to which a steel
stake has been fixed in ground, in an easterly
direction to a mapoo tree hereinafter referred to
as the Mapoo Tree ", near to which a steel stake
has been fixed in the ground; on the West by
an imaginary line running from the Pear Tree
in a southerly direction to a mastwood tree
hereinafter referred to as the Mastwood Tree ",
near to which a steel stake has been fixed in the
ground: on the South by an imaginary line
running from a fiddle wood tree hereinafter
referred to as the Fiddle Wood Tree" at the
eastern side, near to which a steel stake has been
fixed in the ground, in a westerly direction to
the Mastwood Tree; and on the East by an imagin-
ary line running from the Mapoo Tree in a
southerly direction to the Fiddle Wood Tree.
(iii) All that area of land situate at Purcell in the

THE COLONIAL AIR NAVIGATION (USE OF GOVERNMENT AERO-
DROMES) NOTIFICATION, 1963, DATED 28TH FEBRUARY,
1963 MADE BY THE ADMINISTRATOR IN PURSUANCE OF THE
POWERS CONFERRED UPON HIM BY ARTICLE 60 OF THE
COLONIAL AIR NAVIGATION ORDER, 1961 (IMPERIAL) AND
ALL OTHER POWERS ENABLING HIM IN THAT BEHALF.


1. CITATION. This Notification may be cited as the
Colonial Air Navigation (Use of Government Aerodromes)
Notification, 1963.

2. NOTIFICATION OF AERODROMES. In accordance with
the provisions of Article 60 of the Colonial Air Navigation
Order, 1961 (Imperial), His Honour the Administrator has
been pleased to notify that the Government Aerodromes known
as Beef Island Airfield or Airport, Road Harbour and Soper's
Hole in the Colony are available for use as places for landing or
departure of civil aircraft on payment of the fees set out in the
Regulations in the Schedule hereto and subject to the condition
contained in this Notification.

3. LIABILITY FOR LOSS OR DAMAGE. The said Govern-
ment Aerodromes are made available for use by civil aircraft on
the express condition that such use is entirely at the risk of the
registered owner of the aircraft concerned and that the Govern-
ment shall not be responsible for loss or damage resulting from
the use of the said Government merodromes or their accessory
facilities through act of God, war, civil commotion, riot, looting,
explosion, failure of machinery or plant, negligence, fire or any
other cause whatsoever.

4. REVOCATION. The Colonial Air Navigation (Use of
Government Aerodromes) Notification, 1958 (S. R. & 0. 1958,
No. 1) is hereby revoked.

5. COMMENCEMENT. This Notification shall come into
operation on the 1st day of March, 1963.
