Boaters facing heightened penalties for drinking

Boaters might want to think before they take that
extra drink.
A revision to an existing state law for boating under
the influence (BUI) increases the odds for operators to
receive additional fines and jail time.
Boaters can now receive enhanced penalties if they
exceed the breath/blood alcohol content (BAC) by .15 or
higher. The new rate replaces the old limit of .20 or more,
said Brian Rehwinkel, management analyst with the
boating and waterways section of the Florida Fish and
Wildlife Conservation Commission's Division of Law
Enforcement.
The ruling took effect July 1. It's basically a house-
keeping measure by state legislators to correct changes
made to the law in 1994, when alcohol content limits for
both boaters and motorists was lowered from .10 to .08,
Rehwinkel said.
When the BAC was lowered 15 years ago, a provi-
sion for enhanced penalties was placed in the statue but
did not take into account the revised limit. Until last sum-
mer, additional penalties could be applied only if viola-
tors were .20 or more, in accordance with the .10 rate.
The recent measure affects boaters. Legislators
already lowered the threshold for motorists to .15 or
greater, said Lt. Scott Olson, a state BUI instructor with
the Florida Fish and Wildlife Commission law enforce-
ment division.
BUI violators can face hefty fines, jail and having
their vessel towed. They can also lose their boating privi-
leges and can be required to attend mandatory safety edu-
cation classes.
First time offenders with a BAC under .15 face fines
of $250 to $500, and up to six months jail time. Penalties
for a BAC of. 15 or higher increase the fines to $1,000 and
jail time up to nine months.

A second time offender faces fines of $500 to $1,000
and up to nine months in jail. With enhanced penalties, it's
$1,000 to $2,000 in fines and up to 12 months in jail,
Olson said.
Statewide, there were 657 reported boating accidents.
Of that number, 54 were fatalities. Drowning is the cause
for 70 percent of the deaths. Drug and alcohol-related
fatalities made up 29 percent of those fatalities.
"It's still 29 percent too high," Rehwinkel said.
Unlike driving in a car where open containers are not


permitted, no similar law exists for vessels. Law enforce-
ment officials advise it's best to leave the booze on shore.
Taking too many sips and getting impaired on the
waterways also increases the chances of getting into an
accident on land.
"Often times, when people are boating, they're driv-
ing because they are trailering their boat," Rehwinkel said.

Gamefish designation could be a hard sell for permit

Hush. Keep still. Don't rock the boat so much as a
centimeter. No scratching allowed; it's too loud. No itch-
ing, no hitching, no switching, no twitching.
No pitching either, until one of those bonefish or per-
mit swims within your casting range. Until then, if there's
a bug on the boat and it burps, the fish will pick up the
vibration like a volcanic eruption and flee for their lives.
Now, without moving anything from the soles of your
feet up to your throwing arm, make your cast. If it's as
close to perfect as the space between two words, you
might hook a bonefish.
Permit are supposed to be a little easier than that to
catch on live bait, but even harder on fly.
If those aren't gamefish, what is? Strangely, the bone-
fish never was, not legally, until December when the
Florida Fish and Wildlife Conservation (FWC) commission
declared it so and ordered rule writers to draft the details.
Those will include spreading the one-only daily bag
limit for bonefish to adjacent federal waters. Where the
U.S. government doesn't regulate a species and the near-
est state does, the state can do that.
The permit that's a fish, not a fishing license is
technically an overgrown pompano. Its devotees rate it as
hard to catch as the Holy Grail, the stone-gripped sword
Excalibur or (at least) the lost empress Anastasia who,
strictly speaking, probably is extinct.
Permit supporters wanted gamefish designation for
them too, but the FWC didn't grant it during the
December session and probably won't any time soon.
That's partly because the FWC has very little biological
data about the species, which appears to be abundant
although that isn't well documented either.
There's a small commercial fishery for permit in the
lower Keys, where the fish can be found on some restau-
rant menus.
One of the difficulties of compiling reliable data is
that free-swimming small permit are practically indistin-
guishable from large pompano but it is easy if you
catch either fish.

In an e-mail circulating among fishing clubs,
University of Miami fish scientist Michael Larkin cites a
1986 study reporting that there are 17 to 21 rays in the
dorsal fin of a permit, compared to 22 to 27 rays in a pom-
pano's dorsal.
"If you count, then you can tell the difference," Larkin
wrote.


The FWC commission added only a little protection
for permit, extending state regulations to previously
unregulated federal waters.
The downside, from a rod-and-reel angler's view-
point, is that the rules will let spear fishers stick permit
longer than 20 inches from lip to tail fork out there.
Larkin and sportsmen carrying his message are
against that:
"These offshore areas are the spawning grounds for
permit as defined by the FWC's Marine Research
Institute," he wrote. "Permit need to be protected during
their spawning event to ensure a sustainable population."
He cited a 2002 study by the same institute, which
said moderate fishing mortality could cause a fast
decrease in the spawning stock.
"This could cause devastating problems to the south
Florida economy that hosts a large catch-and-release per-
mit fishery," Larkin concluded. "The near-shore catch
and release fishery for bonefish generates $1 billion per
annum to Florida's economy. Therefore the near-shore
permit fishery also has a significant contribution."
Common intermingling of bonefish and permit
anglers, often the same people, makes it unrealistic to try
separating their spending on sport fishing. That may com-
bine with the lack of scientific data on permit to make
gamefish designation harder to sell.
Until there's a comprehensive scientific study of per-
mit, sufficiently detailed and compiled over a time span
long enough to be credible, nobody can say for sure what
the regulations ought to be. There will continue to be dis-
agreement thus far short of outright conflict -
between the interests of commercial fishing, sport spear-
ing and rod-and-reelers.

Famed golfer emerges as fishing's Wildcat Forrest

It wasn't a bad disguise -
long black poncho, tall black
pointy-top hat, black eye mask, all
that but the man wearing it was
betrayed by his shoes with tassels
on top and spikes in the soles.
More than that, the way he
S gripped his broom, with head
down and right hand overlapping
left thumb, totally gave him away.
"Good morning, Wildcat," I said as soon as he
walked into my office.
"You recognize me?" said he, clearly startled.
"Of course," said I. "You're Lionel (Wildcat) Forrest,
famous well-known golf player. The shoes don't match
your outfit and anyway, Wicked Witch costumes are too
conspicuous in January. The trick to being unrecognized is
not being noticed in the first place. That's your free con-
sultation. Now we're on the clock. What brings you to a
fishing consultant?"
It took him a while to get to the point. He told me he's
trying to straighten things out with his wife, who's very
angry with him. To prove his sincerity he swore off golf
indefinitely and even gave away his clubs, but his wife
kept one.
When the atmosphere gets tense and she starts twitch-
ing that iron, he needs to get out for a while.
It's not easy. You or I can drive an Escalade with dents
and broken windows wherever we want without being
accosted by anyone except maybe a shade tree mechanic.
Wildcat Forrest can't do that. He's too well known.
"No\\ that I'm out of golf, where can I go and what
can I do without being spotted by everybody and hounded
by the media?" he asked. "How can I keep floozies and
bimbos from finding me?"
I almost said they don't find him, he finds them, but I
reminded myself that Wildcat is my client, not my patient.
"Someone told me fishing is safer that way than golf,
and referred me to you," he said. "I can't say who it is out
of respect for his secrecy I mean privacy."
His informant is right about fishing, I told Wildcat,

but only if he avoids big-money tournaments where blend-
ing in is almost impossible for someone like him, espe-
cially if he wins. Blending in is one key. Simplicity is
another.
That means staying away not only from tournaments
but also from yacht clubs, which are little different from
the country clubs where he hangs out now. He'd have to lie
about who he is and a lot more. It would be complicated.

When I finished laughing,
I gave him a 'yes' to the
first question and a 'no' to
the second. Leave the
shopping to me, I said.

"We'll get you some middle-class rods and reels," I
said. "We'll buy a plain second-hand boat that you can tow
with a second-hand pickup truck to public launching ramps
where you'll meet the kind of people who wonder what
you've got in your fish box, not your pocket. You'll order
a fishing license online as Lionel, your formal name."
Wildcat frowned.
"It sounds awfully down-scale for someone of my
stature," he grumped.
I reminded him that my job is to transform him into
someone who won't attract the kind of attention that got
him into the trouble that brought him to me. He'll still

enjoy being outdoors. He'll still compete, but against fish
instead of golfers.
"If you really want to be let alone, you'll do as I
advise," I said. I assured him he'll hardly ever see flashy
young women wagging their tails at public launching
ramps or in tackle stores.
I told him how rare it's been, all my life, to even
notice attractive human females in such places, let alone
meet them. Whenever I do, they're with someone else.
They never offer me their phone numbers or ask for mine.
"Does that mean I have to look like you?" Wildcat
asked, a bit nervously.
Not exactly, but he must grow whiskers because he
hasn't any now. If he did, I'd tell him to shave. He doesn't
wear glasses, so we'll get him some with window glass
and no designer label. If he did wear glasses, I'd tell him
to switch to contact lenses.
No more golf caps and (even more important), no
swoosh logos, I insisted, except for the shoes. Shoes with-
out logos would look peculiar. Anyway they'll be deck
shoes, not golf shoes.
Caps with logos, even if they're merely beer or bait
logos, draw attention to a man's face. I ordered Wildcat to
switch to wide-brimmed hats that will shade his face,
making it less noticeable and less identifiable without
looking furtive.
"Is there such a thing as a fishing suit that I can buy?"

Along with consuming black-eyed
peas and collard greens for good luck (it's
a southern thing), another New Year's tra-
dition is watching old films and TV shows.
"Saturday Night Live" is a party favorite.
One of the best episodes was when
Dan Akroyd and Gilda Radner argued
over whether a can of foam called ''Nc
Shimmer" was a floor wax or a desert
topping. As their fight heated up, Chevy
Chase appeared and demonstrated that
the product is (of course) both a floor
wax and a desert topping.
This was a really funny skit and it
satirically demonstrates many a con-
sumer's absurdist quest to find a single
product that serves multiple needs.
Sometimes this occurs in legal situations.
For example, I've often been asked
if it's preferable to pursue the expense of
a good insurance policy or a well-written
contract. The underlying premise pre-
supposes that one of these documents
can serve all business needs. Confusion
is understandable considering there's a
certain amount of overlap on what insur-
ance policies and business contracts
actually cover.
First, let's review the essence of an
insurance policy:
When it comes to maritime insur-
ance, any policy is actually better
described as a contract anyway. This is
because, unlike most homeowner or auto
insurance policies, the clauses included
or not included are generally neither
mandated nor scrutinized by any govern-
ment entity. Instead, in maritime insur-
ance the agreed clauses between the par-
ties (i.e. the underwriters, and the
insured) can be as inclusive or exclusive
as these parties are willing to accept.
Maritime insurance can be viewed as


a contract where, for a price, an under-
writer agrees to pay the policy owner
should that person incur a specified loss
from a specified occurrence detailed in
the contract. Ideally, the expectations of
the parties are that such losses will prove
rare, and therefore result in continued
renewal at a low premium price.

business contract and
a proper insurance
policy offering broad
coverage should
work together...

By contrast, non-insurance business
contracts are generally agreements
between two or more parties that, for
some form of compensation, set up specif-
ic guidelines for performance and actions
between those parties. Simply put: "You
pay me, and I do something you want at a
certain time and place." Or, "I pay you and
you give me something I want at a specif-
ic time and place."
Now, here is where the confusion
generally arises over the differences
between contracts and insurance:
In business contracts, acceptance of
certain risks by one party or another
regarding performance can be included
in the agreement e.g., "I pay you to
paint a room, and I agree in the contract
not to sue you or stop payment if you
drop paint on the floor."
In comparison, insurance policies
can offer protection from losses due to
lawsuits initiated by other parties e.g.,
"Regardless of any previous agreement, I
still sue you for spilling paint on my floor

I moved to my Hallandale condo in
2001 because it had a marina that
charged only $100 per month for dock-
age. I thought that the fee was reasonable
since it was less than what I was paying
at a municipal marina.
But I soon learned that as cheap as it
seemed, the amount was twice as high as
the association's cost of operation. Based
on an informal survey I conducted of con-
dos from Aventura to Delray Beach, the
fee was also one of the highest in the area.
My condo documents state that the
association can charge a reasonable rate.
And it appears that the board determines
what's "reasonable."
Rates first went up in 2004. Today,
my former $100 slip costs $270. Several
other condos in the area that I've sur-
veyed have also doubled their rates in the
past few years for no apparent reason
other than they can.
Virgil Rizzo, Florida's first condo
ombudsman, agreed that reasonable fees
should be decided by costs incurred.
My condo board would not even speak
with him.
At another prominent Hallandale
condo, documents call for all marina rev-
enue to be used only for the marina. But the
board uses it for all common expenses. A
boat owner I know living at another local
condo requested that some boards be
replaced on the dock. He was told there was
only $2,000 in the budget for repairs, even
though the slip owners paid in over $40,000.
Now before you think that deeded
slips are better, look at the documents
carefully. Slips at the second condo men-
tioned above share a piece of the total
common expenses. If the building needs a
new roof, the boat owners pay. They also
pay the real estate tax on a 20 by 40-foot


parcel of submerged land.
Last year Broward County passed a
manatee fee for all marinas with five or
more slips. Apparently manatees were
surveyed and the Broward County
Commission determined that they do not
frequent single-family homes with only

one dock. I guess I should be thankful I
don't live in California. The manatee's
cousin, the sea lion, not only stinks but
also can climb aboard boats.
The manatee fee for my marina was
$540 last year. The board, for reasons
that are still "classified," decided to bill
the marina tenants for this fee. Based on
our 1,090 units, this would amount to 4
cents per month for all residents.
Naturally, every time I ride the elevator, I
meet a neighbor who thanks me for sav-
ing him the yearly 48 cents.
I contacted several friends at neighbor-
hood marinas and none of them were billed
individually for this fee. Their directors are
missing out on a golden opportunity.
Naively, I then looked to the Florida
Department of Business and Professional
Regulation for assistance. They don't
even think my marina is a common ele-
ment. They don't know what it is. They
only know what it isn't.
Having given up on reasoning with
the board, I am now looking to the

A well-written contract can be used as a tool to help
prevent a situation that creates alleged liability. Insurance
can be used as a tool to pay for losses from the alleged lia-
bility should the best efforts at prevention fail.
Ideally, a well-written business contract and a proper
insurance policy offering broad coverage should work togeth-

Florida Legislature. Barring two exceptions, which I pro-
pose eliminating, Florida statutes say that the fee for
someone's exclusive use of a common element or associ-
ation property should relate to the cost of that person's
exclusive use. After all, most condos are not-for-profit.
This does not only apply to marinas. Our condo
charges $350 to use the social room. They also bought a
gallon of white paint and painted stripes 2 feet apart in a
corer of the garage and rented the spots for $45 a month
for motorcycle parking.
Those who agree with me should call their state rep-
resentatives and ask them to support the Bob E. Sherman
Amendment.
Forget that you paid $1,000 a month for your slip in
New York or that it would cost $100 to park your HOG at
public storage.

Regulations on red snapper, grouper mount this year

Want to catch a New Year meal or two of Atlantic
snapper and grouper? Check the weather and hit the water
before Monday, Jan. 4. You who hesitate are lost.
What's the hurry?
Here's the hurry:
On that day, there begins a boggle of eye-glazing new
federal and Florida regulations that may cause the desired
result of refreshing the fishery not necessarily because
they're good rules, but because compliance may be such a
headache that the fishing won't feel worth the bother.
If you're able to figure out where in the state's
Atlantic waters you can catch a grouper without getting
busted for fishing in the wrong place at the wrong time,
you'll have to obey new bag limits.
Your group is limited to three grouper (all species) per
person. It used to be five. Formerly all of you combined
could keep two gag and/or black grouper, but now you can
keep just one either gag or black but not both.
The first federal hit is nominally temporary, sched-
uled to end on June 2, but that presumes the South Atlantic
Fishery Management Council can have a long-range plan
stock replenishment scheme ready by then.
It means that in the federal depths off Florida,
Georgia and both Carolinas, you'll have let go every red
snapper you catch.
Typically, when the feds impose regulations where
there are no go-together state rules, the states adopt more
or less matching ones for adjacent waters in their own
jurisdictions.
In this case, or maybe another one very like it, the
Florida Fish and Wildlife Conservation Commission joined
the feds in imposing a Jan. 1 to April 30 shutdown on clos-
er-to-shore catches of 11 grouper species until May 1.
If we have it right, you have the first three days of the


year to get your grouper and snapper from federal waters.
You're already too late for grouper in state waters, but you
can catch 'em and keep 'em there again starting on May 1.
Other than weeping, wailing, gnashing their teeth and
rending their garments, what are bottom fishing-doers to
do? The Recreational Fishing Alliance decided to sue the
government out of shutting down the red snapper fishery.
The case is in federal court at Jacksonville.
Wait, don't relax yet. While that's going on, the same
management council is asking Secretary of Commerce
Gary Locke to lock down all fishing for snapper and


grouper sub-types that you may have never heard of east of
a 240-foot depth line along the whole South Atlantic coast.
Can you handle more of this? Another pending plan
looks forward to a grouper-snapper catch ban in federal
waters from Cape Canaveral to South Carolina, possibly
around the end of 2010.
Across the state, juggling of size and bag limits and
consideration of spot closures are going on with the Gulf of
Mexico Fishery Management Council. Those issues con-
cern red grouper and gag grouper, aptly named because the
outcome could make fishing-doers turn red and gag.


Wildcat dons new duds for life as a fisherman


Wildcat asked. "If so, can it be tailored?"
When I finished laughing, I gave him a "yes" to the
first question and a "no" to the second. Leave the shop-
ping to me, I said.
That night at the meeting of the Upper Keys Fish or
Cut Bait Society,* I had a quiet word with Hank Skein,
well-known local purveyor of cordage to the boating
trade. Hank's the right size and he was suitably dressed in
low to mid-priced fishing togs.
We walked over to the outdoor sports store where I
spent Wildcat Forrest's money to buy Hank a fancy new
fishing shirt with storage pockets, rod holder and button-
up sleeves, trousers with zip-off legs, the best deck shoes
in the joint and an unembellished but beautifully detailed
shade hat that I wish I could afford to buy myself.
Hank came out of the changing room looking like a
rich millionaire with lots of money.
As we had agreed, he gave me his rumply old outfit
without exactly asking who it was for.
"I know I promised not to make you tell me, and I


shouldn't care, but I find myself wanting very, very much
to know," Hank said.
"You can't, so deal with it," I told him. "And don't for-
get, if some day you happen to see a guy wearing your stuff,
you show not a flicker of recognition. You say nothing."
Hank nodded. As we went our separate ways, he
called back to me:
"If I lose this hat over the side, I'll kill myself."
So that's why you haven't seen much of Wildcat
Forrest on television or billboards lately, and why you
won't for a while. Out of respect for his secrecy I mean
privacy it's all I can tell you just now.

"Not everyone has a lift in their backyard on the
water," he said. "Our message is simple, boating and
drinking don't mix."
How exactly enhanced penalties will affect boating
and drinking is still unknown. But perhaps more people
may have a greater awareness that there are serious con-
sequences for operating a vessel while impaired.
"We hope it does," Rehwinkel said.
Florida Fish and Wildlife has been making an effort to
inform the public about the revision through its web site, mag-
azine and newspaper articles and word of mouth. The agency


is also working on creating a public service radio spot.
"Any way we can get out the message to let people
know about the enhanced penalties," he said.
Since the revision took affect, Olson has noticed a
change in operating and attitudes on the waterways.
"Many of the [boaters] I speak to are cognizant about
the lowered threshold," Olson said.
At .15, a vessel operator is already highly intoxicated.
"I appreciate the legislature lowering the limit," Olson said.
