(1) Where a woman by any wilful act or omission Infanticide. causes the death of her child being a child under the age of twelve months, but at the time of the act or omission the balance of her mind was disturbed by reason of her not having fully recovered from the effect of giving birth to the child or by reason of the effect of lactation consequent upon the birth of the child, then, notwithstanding that the circumstances were such that but for this Ordinance the offence would have amounted to murder, she shall be guilty of felony, to wit of infanticide, and may for such offence be dealt with and punished as if she had been guilty of the offence of manslaughter of the child. (2) Where upon the trial of a woman for the murder of her child, being a child under the age of twelve months, the Court before whom such woman is tried or, in the case of a trial by jury, the jury, is or are of opinion that she by any wilful act or omission caused its death, but that at the time of the act or omission the balance of her mind was disturbed by reason of her not having fully recovered from the effect of giving birth to the child or by reason of the effect of lactation consequent upon the birth of the child, then the Court or jury as the case may be may, notwithstanding that the circumstances were such that but for the provisions of this Ordinance it or they might have returned a verdict of murder, return in lieu thereof a verdict of infanticide. (3) Nothing in this Ordinance shall affect the power of the Court or the jury upon an information for the murder of a child to return a verdict of; manslaughter, or a verdict of guilty but insane, or a verdict of concealment of birth, in 24 & 25 Vict. pursuance of section sixty of the Offences against the Person c. 100. Act, 1861, except that for the purposes of the proviso to that section a child shall be deemed to have recently been born if it had been born within twelve months before its death. (4) The said section sixty shall apply in the case of the acquittal of a woman upon an information for infanticide as it applies upon the acquittal of a woman upon an information for murder. (2) In determining for the purposes of this Rule the pension for which an officer woull have been eligible if his service had been wholly in Sierra Leone; (a) the final pensionable emoluments taken shall be those of his last period of service in the Group; (b) no regard shall be had to regulations 4, 5, 6, 7, 8, 16 and 17 of the regulations in the Schedule to the Pensions Ordinance, 1901; (c) regard shall be had to the condition that pension may not exceed two-thirds of the highest pensionable emoluments; (d) no period of other public service under any scheduled Government which.does not grant a pension or gratuity to the officer shall be taken into account: Provided that the pension of any such officer in respect of his service in Sierra Leone may be calculated as though any Scheduled Government under which he has served had not been a Scheduled Government if this should be to his advantage. (3) For the purpose of this rule the aggregate amount of his pensionable emoluments shall be taken as the total amount of salary which the officer would have drawn, and the total amount of the other pensionable emoluments which he would have enjoyed had he been on duty on full pay in his substantive office or offices throughout his period of service in the Group subsequent to the attainment of the age of twenty years: Provided that in calculating the aggregate amount of his pensionable emoluments no account shall be taken of any service under any Scheduled Government which does not grant the officer a pension or gratuity: Provided further that where under Regulation 11 of the regulations in the Schedule to the Pensions Ordinance, 1901, only a part of a period of service in a civil capacity is taken into account, there shall be taken into account for the calculation aforesaid only such part of the officer's aggregate emoluments during that period as bears to such aggregate the same proportion as the service in civil capacity which is so taken into account bears to his total service in a civil capacity during the said period. 3. Where a part only of the other public service of an Pension officer has been under one or more of the Scheduled when other Governments, the provisions of rule 2 of these Rules shall service both apply; but in calculating the amount of pension, regard nowithiitn shall be had only to service in the Group. the Group. 14. Import includes:- (a) to bring into the Colony, and (b) to bring within the inland waters of the Colony whether or not the publication is brought ashore, and whether or not there is an intention to bring the same ashore. Colony includes Protectorate. Seditious 3. (1) A seditious intention is an intention:- intention. (i) to bring into hatred or contempt or to excite disaffection against the person of His Majesty, His Heirs or successors, or the Government of the Colony as by law established; or (ii) to excite His Majesty's subjects or inhabitants of the Colony to attempt to procure the altera- tion, otherwise than by lawful means, of any other matter in the Colony as by law established; or (iii) to bring into hatred or contempt or to excite disaffection against the administration of justice in the Colony; or (iv) to raise discontent or disaffection amongst His Majesty's subjects or inhabitants of the Colony; or (v) to promote feelings of ill-will and hostility between different (ci. -:s of the population of the Colony. But an act, speech or publication is not seditious by reason only that it intends:- (a) to show that His Majesty has been misled or mistaken in any of his measures; or (b) to point out errors or defects in the government or constitution of the Colony as by law established or in legislation or in the administration of justice with a view to the remedying of such errors or defects; or (c) to persuade His Majesty's subjects or inhabitants of the Colony to attempt to procure by lawful means the alteration of any matter in the Colony as by law established; or (d) to point out, with a view to their removal, any matters which are producing or have a tendency to produce feelings of ill will and enmity between different classes of the population of the Colony.. (2) In determining whether the intention with which any act was done, any words were spoken or any document was published, was or was not seditious, every person shall be Sedition. deemed to intend the consequences which would naturally follow from his conduct at the time and under the circum- stances in which he so conducted himself. 4. (1) Any person who- Offences. (a) does or attempts to do, or makes any prepara- tion to do, or conspires with any person to do, any act with a seditious intention; (b) utters any seditious words; (c) prints, publishes, sells, offers for sale, distri- butes or reproduces any seditious publication; (d) imports any seditious publication, unless he has no reason to believe that it is seditious shall be guilty of an offence and liable for a first offence to imprisonment for a term not exceeding two years, without hard labour, or to a fine not exceeding 100 or to both such imprisonment and fine, and for a subsequent offence to imprisonment for a term not exceeding seven years, with or without hard labour; and any seditious publication slall be forfeited to His Majesty. (2) Any person who without lawful excuse has in his possession any seditious publication shall be guilty of an offence and liable for a first offence to imprisonment for a term not exceeding one year, with or without hard labour, or to a fine not exceeding 50 or to both such imprisonment and fine and for a subsequent offence to imprisonment for a term rot exceeding three years, with or without hard labour; and any such publication shall be forfeited to His Majesty. 5. (2) A person who complies with the provisions of sub-section (1) of this section or is convicted of an offence under that sub-section shall not be liable to be convicted for having imported or having in his possession the same publication or extract therefrom. (a) The Postmaster-General; (b) any officer of the Customs Department not below the rank of Collector; (c) any Police Officer not below the rank of Assistant Superintendent; (d) any other official authorized in that behalf by the Governor may detain, open and examine any package or article which he suspects to contain any publication or extract therefrom which it is an offence under the provisions of section 4 to import, publish, sell, offer for sale, distribute, reproduce, or possess, and during such examination may detain any person importing, distributing, or posting such package or article or in whose possession such package or article is found. (2) If any such publication or extract therefrom is found in such package or article, the whole package or article may be impounded and retained by the officer and the person importing, distributing, or posting it, or in whose possession it is found, may forthwith be arrested and proceeded against for the commission of an offence under section 4 or section 5 as the case may be. (2) If a magistrate is satisfied by information on oath that there is reasonable ground for suspecting that an offence under this Ordinance has been committed, and that evidence of the commission thereof is to be found at any premises or place specified in the information, he may, on an application made by a police officer of or above the rank of Assistant Superintendent or by a court messenger of or above the rank of Assistant Commissioner, grant a search warrant authorising any such police officer or court messen- ger as aforesaid named in the warrant together with any other persons named in the warrant and any other police officers or court messengers to enter the premises or place at any time within one month from the date of the warrant, if necessary by force, and to search the premises or place and every person found therein, and to seize anything found on the premises or place or on any such person which the police officer or court messenger has reasonable ground for suspecting to be evidence of the commission of such an offence as aforesaid: Provided that- (a) A search warrant shall only be issued in respect .of an offence suspected to have been committed within three months prior to the laying of the information thereof; and (b) If a search warrant under this Ordinance has been executed on any premises, it shall be the duty of the police officer or court messenger who has conducted or directed the search to notify the occupier that the search has taken place, and to supply him with a list of any documents or other objects which have been removed from the pre- mises, and where any documents have been removed from any other person to supply that person with a list of such documents. (3) No woman shall, in pursuance of a warrant issued under the last foregoing subsection, be searched except by a woman. (4) Anything seized under this section may be retained for a period not exceeding one month, or if within that period proceedings are commenced for an offence under this Ordinance until the conclusion of those proceedings, and subject as aforesaid and to the provisions of any enactment, including this Ordinance, conferring powers on Courts deal- ing with offences, any property which has come into the possession of the police or court messengers under this section Incitement to Disaffection. shall be returned to the owner, or, if the owner cannot be ascertained, shall be disposed of in such manner as the Governor, on application being made to him, may direct. 4. (2) No prosecution under this Ordinance shall take place without the consent of the Attorney General. (3) Where a prosecution under this Ordinance is be- ing carried on by the Attorney General, a Court of Summary Jurisdiction shall not deal with the case summarily without the consent of the Attorney General. (4) Where any person is convicted of an offence under this Ordinance, the Court dealing with the case may order any documents connected with the offence to be destroyed or dealt with in such other manner as may be specified in the order, but no documents shall be destroyed before the expira- tion of the period within which an appeal may be lodged, and if an appeal is lodged 'no document shall be destroyed until after the appeal has been heard and decided. (1) It shall be lawful for the Governor to make an Expulsion of Order (hereinafter called an Expulsion Order) requiring any aliens. alien to leave the Colony and/or Protectorate within a time fixed by such Order, and thereafter to remain out of the Colony and/or Protectorate- (a) if he deems it conducive to the public good to make an Expulsion Order against the alien, or (b) if it is certified to him by a Judge or Magistrate that the alien has been convicted by the Court of any felony, misdemeanor, or other offence for which the Court has power to impose imprisonment without the option of a fine, and that the Court recommends that an Expulsion Order should be made in his case either in addition to or in lieu of the sentence. Provided that nothing contained in paragraph (b) above shall prejudice the power of the Governor in his absolute discretion to make an Expulsion Order under the provisions of paragraph (a) of this sub-section. (2) An Expulsion Order may be made subject to any condition which the Governor may think proper. 4. (4) The Board may act notwithstanding any vacancy in their number. Reports of 9. (1) A Board of Inquiry may, if it thinks fit, make the Board interim reports. and publi- cation. (2) Any report of the Board, and any minority report, shall be submitted to the Governor. (3) In this section the expression telegram shall have the same meaning as in the Telegraphs Ordinance, 1924, and the expression wireless telegraphy shall have the same meaning as in the Wireless Telegraphy Ordinance, 1924. Bonus means a share of the profits of a registered society divided among its members in proportion to the volume of business done with the society by them from which the profits of the society were derived. Bye-laws means the registered bye-laws made by a society in the exercise of any power confei'red by this Ordinance, and includes a registered amendment of the bye-laws. No6. 20 1939 Central Society means a registered society estab- lished to facilitate the operations of registered societies in accordance with co-operative principles and includes a central financing society. Central Financing Society" means a registered society of which the principal object is to make loans to other registered societies. Committee means the governing body of a registered society to whom the management of its affairs is entrusted. Dividend means a share of the profits of a registered society divided among its members in proportion to the share capital held by them. Member" includes a person or registered society joining in the application for the registration of a society, and a person or registered society duly admitted to membership after registration. Officer includes a President, Chairman, Secretary, Treasurer, Member of Committee, or other person empowered under the Rules or bye-laws to give directions in regard to the business of a registered society. Registered Society means a co-operative society registered under this Ordinance. Registrar means a person appointed to perform the duties of a Registrar of Co-operative Societies under this Ordinance and includes an Assistant Registrar. Rules mean rules made by the Governor in Council under this Ordinance. Registration of Go-operative Societies. Power of 3. (b) The word limited or its vernacular equiva- lent shall be the last word in the name of every society with limited liability registered under this Ordinance. (e) Save in the case of a central financing society the word bank or banking shall not form part of the name of any society registered under this Ordinance. 7.
