An Ordinance to Provide for the Imposition of
Customs Duties, and for purposes connected
therewith.

B]j IT ENACTED by the Governor l' Sierra Leone, with the
advice and consent of the Legislative Council thereof, as
follows :--
1. This Ordinance may be cited as the Customs Tariff short title
Ordinance, 1932, and slall apply to the Colony and Protec- and applica-

within the meaning of the Statute of Westminister,
1931, and any territory in respect of which a
mandate of the Lengue of Nations is being cxer-
aof cised by the Government of the United Kingdom

Import duties 3. There shall be raised, levied, collected, and paid into
of Customs the general revenue of Sierra Leone upon all goods specified
to be levied, in the first schedule which shall be imported into Sierra Leone
or taken out of bond for consumption in Sierra Leone, the
several duties appearing in that schedule and set opposite to
each item respectively in the column of the tariff applicable
to such goods, subject to the following conditions :-
(a) The rates of duties set forth in the column headed
"British Preferential Tariff" of the first schedule
shall apply to goods the growth, produce or
manufacture of the British Empire. Provided that
such goods are shown to the satisfaction of the
Comptroller of Customs to have been
(1) consigned from, and
(2) grown, produced or manufactured m the
British Empire.

(b) The rates of duties set forth in the column headed
General Tariff of the first schedule shall apply
to all goods not entitled to admission under the
column headed "British Preferential Tariff" of that
schedule. Provided that the rates of duties pre
scribed by an Order in Council made under
paragraph (b) or paragraph (c) of section 16 (1)
and approved by the Legislative Council under
section 16 (2) or (3) shall, on the coming into force
of such Order and during its operation, be
substituted for the rates of duties set out in the
column headed General Tarift in respect of
the goods specified in such Order being the
growth, produce or manufacture of the foreign

payment of duty-

5. (1) The value of goods, for the purpose of ascertaining
the amount of the ad valorem duty payable thereon, shall be
the price paid or to be paid by the owner thereof, after the
deduction of any allowance made by the seller to the owner

by way of recognized trade or cash discounts, and of any
charges incidental to the delivery of the goods in Sierra
Leone. Provided that-
(a) there shall be no deduction of contingent discounts Provisoes.
or rebates, or buying and selling commissions and
sample discounts; and
(b) where goods are consigned by the person or firm by
whom they were manufactured, or by an agent on
his or their behalf, to an agent of such person or
firm in Sierra Leone for the purpose of sale in
Sierra Leone, the value of the goods shall be deemed
to be the current domestic value in finished condi-
tion in the country of consignment at the time of
delivery of the goods for exportation, and shall
include the value of packages, if any, in which the
goods would be sold for ldonestic consumption,
together with any royalties and selling commissions
which would be payable, the deduction of recognized
trade and cash discounts being allowed, but not
contingent discounts or rebates; and
S(C) in the case of goods whtic' have substantially
depreciated from their original value, the value of
' s such goods shall be deemed to be their value at the
time of impifration.

(2) No dFcounts or deductions from the purchase price Discounts

ad valorem duty shall be allowed unless such discounts or tions allowed
in certain
deductions be clearly shown to the satisfaction of the cases.

discounts or deductions have been or purport to have been
actually allowed or, in any case coming within the preceding
proviso, by the signature of the manufacturer.

(3) In this section the word owner means the owner"
importer in Sierra Leone, except in cases of a principal con- and "seller "
signing goods to his agent in Sierra Leone, where it means defined.

to Sierra Leone, except in cases of a principal consigning
goods to an agent in Sierra Leone, where it means the person
from whom the goods were purchased by the principal.

6. All invoices of goods shall be made out in the currency Invoices to

7. (1) If any goods subject to tile Iayment of specific duty
are imported in any bag, box, tin, jar, bottle or any other
package intended for sale and marked or labelled or commonly
sold as con(lailning or ('ollllonlly related to contain a specific

(2) In all cases where such bag, box, tin, jar, bottle or
other package is not so mai ked or labelled, or commonly so
sold or reputed, tlie duty, if payable on weight, shall ie
calhclated on lthe gross weight of such bag, box, tin, jar.

8. If ainy goods are or can he classed tinder two or nmore
names, lheadings, or descriptions, with a resulting difference
as to duty, duty shall be charged when it is a difference
between liability to or freedom from duty, and the higher or
highest of tlie duiites applicable shall be charged when it is a
difference as to Iwo or more duties.

10. (1) If goods imported are composed of two or more
materials, one only of widich is dutiable, duty shall be charged
on lie whole of the goods at the rate applicable to the dutiable
material. Provided that if the Comptroller of Customs is
satisfied tlha tlie goods contain only a very .small proportion
of the material on which duty is clhargeable. duty shall be

(2) If goods imported are composed of two or more
materials, iwo or more of which are dutiable, duty shall be
charged on lihe whole of the goods at thle ra e applicable to
that material on which duty is chargeable at the highest

that the goods contain only a very small proportion of
the material on wlicth duty is chargeable at rite highest rate.

Drawbacks 11. A drawback amounting to ninety-five per cent. of
allowed. the duties paid on imported goods shall be refunded on the
exportation thereof, with such exceptions and subject to such
conditions as may le prescribed by rules made under
section 17.

12. (1) Every sum of money which shall be due for Repayment

The Governor in Council may, by Order-
(a) add to, vary or revoke the whole or any part of
the first, second and third schedules;
(b) direct that all goods specified in the Order,
which are shown to the satisfaction of tlie
Comptroller of Customs to have been con
signed from, and grown, produced or
manufactured in the foreign country men
tioned therein, shall be admitted at such
lesser rates of duties than those chargeable
under the General Tariff as shall be specified
in the Order, and where any such Order is
made and approved by the Legislative Council
the provisions of this Ordinance shall have
effect accordingly;


(c) direct that special duties shall le levied on the
goods (to be specified therein) of any foreign
country (to be mentioned therein) which, in
the opinion of the Governor in Council,
discriminates against any goods produced or
manufactured in Sierra Leone, whether by way
of the imposition of duties, or the prohibition
or restriction of importation, or otherwise,
and where any such Order is made and
approved by the Legislative Council the
provisions of this Ordinance shall have effect
accordingly. *
(2) No Order in Council made under this section shall
come into force before the same shall have been approved by
a resolution of thet Legislative Council.
(3) The Legislative Council may amniul ainy Order in
Council made under this section. An ()Order in Coulnil so
amended shall be deemed to have been made by thlie Governor
in Council and to have been approved by the Legislative
Council.

17. (1) The Governor in Council may make rules carrying
into effect any of the provisions or purposes of this Ordinance.

(2) In particular, and without prejudice to the
generality of the foregoing power, the Governor in Council
may make rules with respect to the following matters:-
(a) The proportion of value which must be the result
of labour within the British Empire to entitle goods
to admission as having heen produced or manufac-
tured in tile British Empire.
(b) The evidence which may be required by the
Comptroller of Customs and the conditions which
must be fulfilled before lie admits goods as
having been (1) consigned from. and (2I grown,
produced or manufactured in the British Empire.

(c) The evidence which may be required by the Comp-
troller of customss and the conditions which must
be fulfilled before he admits goods as having been
(1) consigned from, and (2) grown, produced or
manufactured in a foreign country to which an
Order in Council made under section 16 (1) (b)
and approved by the Legislative Council applies.

(d) The evidence which may be required by the
Comptroller of Customs to satisfy him that goods
are not the growth, produce or manufacture of a
foreign country to which an Order in Council made
under section 16 (1) (c) and approved by the
Legislative Council applies.

(c) Goods on which drawback shall be allowed.

(f) The conditions under whicl drawback shall be
allowed, and the amount thereof.

(y) the exportation of goods for repair or alteration.

(h) The conditions under which goods imported for
temporary use only may be exempted from duty.
(i) The prescription of forms to be used for any purpose
under this Ordinance.

(3) Unless and until amended, varied or revoked by the
Governor in (Council under this section, the rules set out in the
fJ fourth schedule shall have effect as if they had been duly
made under this section and shall come into force simul-
taneously with this Ordinance. Provided that the Governor
in Council may also, in exercise of his powers under this
section, add to the rules in the said schedule and may, for
any rules therein, substitute some other rules.


18. The Customs Tariff Ordinance, 1924, is hereby Repeal of
repealed. Cap. 50.

1. Air craft and accessories.

2. All goods imported in special circumstances for obj ~ts
of a general public character, or for an enterprise deeminy to
be beneficial to the Colony or Protectorate, with the approval
of the Governor in Council but subject to such terms and
conditions, if any, as he may think fit to impose.

3. All goods imported by :-
(a) The Inspector-General of the Royal West African
Frontier Force and his staff Oflicers for their
private use when on inspection duty within the
Colony or the Protectorate.
(b) Boundary and other special commissioners and
their assistants, and offices specially appointed for
service generally in Brilish West Africa, and whose
duties require them to travel between the various
British West African/Possessions, for their private
use when on duty within the Colony or Protec
torate.
4. All goods imported fo/the sole use of any mess or officer
or member of the crew of/any of the ships of Ilis Majesty's
Navy on the Coast of Africa, upon proof being made to the
satisfaction of lie Comptroller of Customs that the same are
bona fide imported for the sole use of any such mes.s, officer or
member.
5. All goods officially imported by, or for the use of:--
(a) His Majesty's troops.
(b) His Majesty's ships, or for any officer or member
of the crew serving on one of His Majesty's ships.
(c) The Colonial Government.

6. All goods imported by officers of any body of Boy
Scouts or Girl Guides recognized by the Colonial Government,
which are required solely for the use of such scouts, guides
or their officers.
7. All goods imported for the official use of any foreign
Consulate, and the luggage and personal effects of the
Consular representative of any foreign country, or his
fami or suite, if such Consular representative is not
engaged in any other business or profession in the Colony
or /Irotectorate, provided that a similar privilege is
ac orded by such foreign country to the British Consulate

8. All non-consumable goods such as furniture, plate, glass
or cutlery, and any other goods whatsoever approved by the
Governor in Council, when such non-consumable goods or

imported with the sanction of the Governor ly the secretary
of any rifle club, the constitution and objects of which have
been approved by the Governor.
29. Firearms for sporting purposes re-imported, provided
that-
(i) they have been previously licensed;

(iii) they have remained in the possession of the person
re-importing the same since such licensing and

Rules relating to entry of goods under the British
Preferenlial Tariff.
7. (1) All goods for which admission under the British Certificates
Preferential Tariff is claimed shall be accompanied by a of rigin

14. Goods certified for entry under the British Preferential
Tariff shall be packed separately from other goods. The
packages, however, may be enclosed with other goods, provided
that the certificate of origin is endorsed accordingly.


15. Goods entitled to be admitted under the British
Preferential Tariff shall not be entered on entries along with
goods not so entitled.


16. Goods, the produce or manufacture of one part of the
British Empire, when imported into Sierra Leone trom
another part of the British Empire. may lie admitted to
h preference provided that they are accompanied lby a certificate
declared before the Customs authorities of the last port of
shipment certifying that such goods were entered at such
r port as British Empire goods, and were supported iby certiti-
cates of origin at the time of admission. Provided also
that when the country from which such gools i re

State, the person by whom the goods are finally exported or

to the Pension of Ulric Arthur William Coker.

BE IT ENACTED by the Governor of Sierra Leone, with the
advice and consent of the Legislative Council thereof, as
follows :-

1. This Ordinance may be cited as the Ulric Arthur William Short title,
Coker Pension Ordinance, 1932, and shall apply to the Colony and application
Protectorate. It shall be deemed to have come into operation on and
the 1st day of January, 1932. ment.

2. Notwithstanding the Pensions (Non-European Officers) Authority
Ordinance, 1924, a gratuity of 37 and an annual pension at the for payment
rate of 151 ls. Sd. shall be charged on and payable out of the "f special
grat,,ity aud
general revenue of Sierra Leone to the said Ulric Arthur William pensionn to
Coker, formerly an African Assistant Treasurer employed by the Ulric Arthur
Government of Sierra Leone, and such pension shall take effect William

one of such appointed members to be deputy chairman
of the committee, if he thinks fit. The acts of the
committee shall not require the approval of the
Council, but the committee shall render to the Council
full and accurate accounts of the moneys distributed
by them in relief of the poor in such manner and
at such intervals as the Council shall direct."

BE IT ENACTED by the Governor of Sierra Leone, with the
advice and consent of the Legislative Council thereof, as
follows :-

1. This Ordinance may be cited as the Pensions (Widows and Short title.
Orphans) Amendment Ordinance, 1932.
Repeal and
2. Section 11 (2) of the Pensions (Widows and Orphans) replacement
Ordinance, 1924, is hereby repealed and replaced by the of section 11
following sub-section :- (2) of
Cap. 148.
"(2) If a contributor or widow of a contributor shall at "-Penalty for

respecting any of the particulars required by this ment."

BE IT ENACTED by the Governor of Sierra Leone, with the
advice and consent of the Legislative Council thereof, as
follows :-
1. This Ordinance may be cited as the Registration of Short title.
Instruments (Amendment) Ordinance, 1932.

2. Section 12 of the Registration of Instruments Ordinance, Amendment
of section 12
1924, is hereby amended- of Cap. 182.
(a) by inserting the words "signed by the person who
made it immediately after the word land in the
third line, and

(b) by adding thereto the following further proviso :-
Provided further that the Registrar-General may
admit an exclusive prospecting licence granted
under section 18A of the Minerals Ordinance,
1927, to be registered although it has no plan as

aforesaid drawn on the margin or back thereof or
annexed thereto in any case where, by reason of
the size of the area over which such exclusive
prospecting licence is granted or otherwis-e. it

Government Official temporarily in charge of the
headquarters of a district.

In other parts (b) If executed in any other part of His Majesty's

instrument to be registered, in the same way as
directed with respect to any instrument acknowledged
or proved before himself.
(4) Any instrument presented for registration, and Registration

Protection of the City of Freetown from Fire.

advice and consent of the Legislative Council thereof, as
follows :-
1. This Ordinance may be cited as the Freetown Fire Short title.
Prevention Measures Ordinance, 1932.
2. In this Ordinance, unless the contest otherwise Interpreta-

Council means the City Council of Freetown as
constituted by the same Ordinance.
Fire Brigade includes all such persons as are,

appurtenances, fire escapes and implements as are,
from time to time, provided by the Council for

controllers similarly appointed subject to such
limitations as to jurisdiction or otherwise as may
be specified in the notice of their appointment.

Power of 3. Whenever it shall appear to the Governor in Council that

stuffs under such part thereof, the Governor in Council may, by Order. declare

reference to some specified part of Sierra Leone only.

Power of 4. It shall be lawful for the Governor in Council. by any
Governor in such Order as aforesaid-

make Orders (i) to fix the maximum price for which any article thereby

(ii) to prohibit the purchase or barter of any article thereby
declared to be a controlled article for the purpose of
resale in or export from the area to which the Order
applies without the written permission of the food

Order applies without the written permission of the
food controller ;
(iv) to prohibit the concealment or destruction of any
article thereby declared to be a controlled article:
(v) to restrict the sale of any article thereby declared to be
a controlled article, either by any individual or
generally by all persons dealing in such article, to
such quantity as the food controller, by notice
published in the Gazette or written order under his
hand, may from time to time direct.

Penalty for 5. Any person who shall act in contravention of any such

supply of any controlled article.

(2) The food controller may, by written notice, require any
merchant, shopkeeper, storekeeper or baker to produce for
inspection all or any books or documents relating to any
controlled article in his possession or under his control.

7. The food controller or any public officer authorized by him Power of

acting in exercise of his powers under section 8,
shall be guilty of an offence and liable, on summary conviction,
to a fine not exceeding fifty pounds or to imprisonment, with or
without hard labour, for a period not exceeding six months.

advice and consent of the Legislative Council thereof, as
follows :-
1. This Ordinance may be cited as the Protectorate Iighways Short title
Tolls Ordinance, 1932, and shall come into operation on the and com-

"Highway" means any public road in the Protectorate ton

"Native produce" includes palm oil, paln nuts, palm
kernels, ginger, ground-nuts, benniseed, rubber, gum
co l, piassava, raffia fibre, maize, rice. chillies, cotton and
eery other product of the soil whatsoever, whether raw
or partly or wholly manufactured, of any kind
commonly exported from Sierra Leone.

"' Toll means any money payable under this Ordinance
for the use of any highway.

"Toll collector" means any public officer appointed in
writing by a District Comnissioner to collect tolls
under this Ordinance.

"Toll gate include es toll bar and any other erection and
thing built, set up or made for the purpose of collecting
or checking the collection of tolls.

SToll gate-keeper means any public officer appointed in
writing by a District Co(mmissioner to operate a specified
toll ,gte and check the payment of tolls threat.

"Toll inspector" means any public officer appointed in

BE IT ENACTED by the Governor of Sierra Leone, with the
advice and consent of the Legislative Council thereof, as
follows:-

1. This Ordinance may be cited as the Protectorate Mining Short title,
Benefits Trust Fund Ordinance, 1932, and shall be read and construction

5. (1) In every year the said trustees shall, out of the -aid
fund, pay such proportion or the moneys placed to the credit of
the said fund during that year as they shall, in their absolute
discretion, determine, to the respective owners of the lands. rivers.
streams and watercourses out of or in respect of which such
moneys arise.


(2) If there shall be any question as to the persons entitled
to receive the whole or any art of such payments as last aforesaid,
the decision of the k :sS.T shall be final and binding on all

products for native cultivation.
(v) Irrigation for agricultural purposes.
(vi) The prevention of disease amongst cattle and other
domestic animals in the Protectorate.
(vii) The improvement of such cattle and other domestic
animals.

(viii) The construction, repair and maintenance of roads.
culverts and bridges in the Protectorate.
(ix) Generally such. other purposes as are. in the opinion of

An Ordinance to Amend the Customs Ordinance,
1924. Cap. 49.

BE IT ENACTED by the (Govternor oi' Sirra Leone, with tihe
advice and consent of the Legislatixe Council thereof, as
follows :-

1. This Ordinance may be cited ;s the Customs (Amendment) Short title.

2. The Customs Ordinance, 1924, is hereby amended by of Cap. 49
by insertion
inserting therein, immediately after section 145, the following of new

"145A. (1) The provisions of the last preceding section Special

Authorities of thei port at which any such palm
kernels have been landed shall be produced to the.

produced shall be accepted as a true account or the
quantity of palm kernels so exported and liable
to duty. Provided that for the purposes of calculating
duty thereon an addition of I2 per cent. shall be made
in respect of shrinkage during the voyage.

(3) In the event of the loss from any cause of any
part of a shipment of palm kernels before being
landed, such certificate shall not ih s accepted.

(4) Every exportier or agent who shall neglect or
fail to comply witlh ithi provisions ,of sub-sections (1)
and (2) of this section shall be liable to a penalty n,,t
exceeding one hundred pounds."

of Lunatics from the Colony and Protectorate of
Sierra Leone.

BE IT ENACTED by the Governor of Sierra Leone, with the
advice and consent of the Legislative Council thereof, as
follows :-

1. This Ordinance may be cited as the Lunatics Removal Short title
Ordinance, 1932, and shall apply to the Colony and Protectorate. and applica-
tion.
2. For the purposes of this Ordinance the Lunacy Regulation Limitedappli-
Ordinance, 1924, shall apply to the Protectorate. "in to
Protectorate.
3. In this Ordinance, unless the context otherwise requires Interpre-
tation.
"Native of Sierra Leone" means any person ordinarily
resident in Sierra Leone who is a member of a race,
tribe or community settled in Sierra Leone.

person convicted ought not to have been

International Opium Convention signed at Geneva
on the 13th day of July, 1931, and to make

to Drugs capable of being converted into
Dangerous Drugs.

or their salts in an inert substance whether ii.iui,
or solid, containing any proportion of nmrphine

solution or dilution as aforesaid) containii:f not
less than one-fifth per cent. of morphine or
one-tenth per cent. of cocaine or of ecgonine :

(f) any preparation, admixture, extract or .l z;r
substance containing any proportion ,f
diacetylmorphine;
(g) dihydrohydroxycodeinone, dihydrocodeiione.
dihydromorphinone, acetyldihydrocod, ini ine.
dihydromorphine, their esters and the salts of any
of these substances and of their esters. morpli..'-
N-oxide (commonly known as genomorphiie,.
the morphine-N-oxide derivatives. and any other
pentavalent nitrogen morphine derivatives;
(h) thebaine and its salts, and (with the exception of
methylinorphine, commonly known as codeine,
and ethylmorphine, commonly known as dionin,
and their respective salts) benzylmorphine and
the other ethers of morphine and their respective
salts ;

(i) any preparation, admixture. extract or other
substance containing any proportion of any of
the substances mentioned in paragraph (g) or in
paragraph (h) of this sub-section.

For the purpose of the foregoing provision the expression
"ecgonine" means levo-ecgonine and includes any derivatives of
ecgonine from which it may be recovered industrially, and the
percentage in the case of morphine shall be calculated as in
respect of anhydrous morphine.






Dangerous Drugs (Amendment).


(2) If it appears to the Governor in Council that any new
derivative of morphine or cocaine or of any salts of
morphine or cocaine or any other alkaloid of opium
or any other drug of whatever kind is or is likely
to be productive, if improperly used, or is capable of
being converted into a substance which is, or is likely
to be productive, if improperly used, of ill-effects
substantially of the same character or nature as or
analogous to those produced by morphine or cocaine,
the Governor in Council may by Order declare that
this part of this Ordinance shall apply to that new
derivative or alkaloid or other drug in the same
manner as it applies to the drugs mentioned in
sub-section (1) of this section, and make any
verbal alterations in the list of drugs specified in
sub-section (1) incidental to the declaration contained
in such order.

(3) If the Governor in Council thinks fit, by Order, to
declare that a finding with respect to any preparation
containing any of the. drugs to which this Part applies
has in pursuance of Article 8 of the Internation-l
Opium Convention signed at Geneva on the nineteen i
day of February, nineteen hundred and twenty-fi\ e
been communicated by the Council of the League of
Nations to the parties to the said Convention, tlh
provisions of this part shall as from such date as may
be specified in the Order cease to apply to the
preparation specified therein."


3. The Principal Ordinance is hereby amended by re- le-numbering

(2) If it is made to appear to the Governor in
Council that a decision with respect to any such
product as is mentioned in sub-section (1) of this section
has in pursuance of Article II of the International
Convention signed at Geneva on the thirteenth day
of July, nineteen hundred and thirty-one been
communicated by the Secretary-General of the League
of Nations to the parties to the said Convention. the
Governor in Council may by Order, as the case
requires, either declare that the provisions of this part
of this Ordinance shall apply to the product in the
same manner as they apply to the drugs mentioned in
section 13 (1) of this Ordinance or apply this part
of this Ordinance to that product with such modifica-
tions as may be specified in the Order.

(3) The Governor in Council may by Order apply
this part of this Ordinance, with such modifications

(Protectorate) Ordinance, 1924.

BE IT ENACTED by the Governor of Sierra Leone, with the
advice and consent of the Legislative Council thereof, as
follows :-
1. This Ordinance may be cited as the Public Motor Roads Short title.
(Protectorate) (Amendment) Ordinance, 1932.
2. Section 2 of the Public Motor Roads (Protectorate) Repeal and
Ordinance, 1924 (hereinafter referred to as the Principal replacement
Ordinance), is hereby repealed and replaced by the following of saetio12
section :-
"2. It shall be lawful for the Governor in Council, at the Appoint-
request of any native chief or chiefs concerned, by menit of
Order, to appoint any road in the Protectorate a public public motor
