The body of a "hard core hiker"
was found in about 4 feet of water
and a scant 100 yards from U.S. 98
North.
"You could literally see him
from the highway," said Detective
Ted Van Deman, of the Okeecho-
bee County Sheriff's Office
(OCSO).
The body of Keith R. Galaise,
53, Sheffield, Mass., was recov-
ered Monday, Jan. 11, after being
found by members of the Florida
Trail Hiking Association.
Detective Van Deman said late

Tuesday afternoon that District
19 Medical Examiner Dr. Roger
Mittleman has preliminarily ruled
the cause of death as "accidental
hypothermia." The official find-
ings won't be available until lab
results are returned in nine weeks,
he added.
According to Detective Van De-
man, Mr. Galaise was a "hard core
hiker" who came to Florida every
year on vacation to hike. He appar-
ently arrived here via Amtrak on
Thursday, Jan. 7, and it is believed
he immediately started his hike at
Okee-Tantie. He was planning on
hiking to Orlando.

The detective said the body of
the 5-foot-5-inch, 200-pound, man
was found entangled in a barbed
wire fence. As of Tuesday after-
noon, it was not known how long
the man had been dead.
Detective Van Deman said ac-
cording to the man's cell phone,
he was alive as of 1 p.m. Saturday,
Jan. 9.
"He had tried to call a local per-
son," the detective explained. "If
he was calling for help or not, we
don't know."
The local person was not a
family member, but was an ac-
quaintance of Mr. Galaise's.

swamp
Detective Van Deman said Mr.
Galaise was not dressed to with-
stand the 30-degree temperatures
and rain that hit the area on Sat-
urday, nor the nighttime tempera-
tures that dipped below the freez-
ing mark.
"He was dressed in a T-shirt,
shorts and windbreaker. He was
not dressed appropriately for the
weather and he didn't have any
other clothes in his backpack,"
the detective said. "I think he mis-
judged the Florida weather."
The man's body was found by

OCSO divers search

for evidence

By Eric Kopp
Okeechobee News
Two members of the Okeecho-
bee County Sheriff's Office
(OCSO) dive team spent over an
hour Tuesday morning in a cold
and murky canal looking for evi-
dence in an assault case.
They were looking for a 12-
inch pipe wrench that is believed
to be the weapon used in an argu-
ment Sunday night, Jan. 10, that
ended with three people being
injured.
According to OCSO Detec-
tive Bill Maerki one man is being
sought for hitting two other men
in the head with the wrench, and
for throwing his girlfriend down a
ramp for the handicapped.
Detective Maerki said the wom-
an was taken to Raulerson Hospi-
tal then transported to the trauma
center at Lawnwood Regional
Medical Center in Fort Pierce. He
said she has since been released.

The four people were barbe-
cuing a wild hog at a home on
S.E. 27th St. Sunday night when
the fight broke out around 11:45
p.m. The suspect in the case was
intoxicated and became argu-
mentative and as the two male
victims were trying to escort him
from the property he reportedly
picked up the pipe wrench and
"commenced to beat on them
with it," said Detective Maerki.
It took 14 staples to close
wounds in one man's scalp, while
the second man reportedly had a
small laceration to the top of his
head. The second victim had also
been hit in the face but, added the
detective, his wounds were not
serious.
OCSO Deputy Sergeant Shan-
non Peterson, along with Deputy
Corporal Randy Thomas, were
called to the home Tuesday morn-
ing to search for the wrench after

an 11-year-old girl tossed it into the canal.
"She threw the wrench into the canal
under the instruction of one of the victims,"
said Detective Maerki.
The man, whose name has not been
released, was arrested Monday on a felony
charge of tampering with physical evidence.
He was booked into the Okeechobee Coun-
ty Jail on $250 bond, but has since been re-
leased on bond.
Cpl. Thomas began his dive at 9:47 a.m.
when the air temperature was in the low
40s. The water temperature, he estimated,
was around 50 degrees.
"It's cold," he said when he finished his
dive about 30 minutes later. But, he added,
the water wasn't as cold as he thought it
would be.
Sgt. Peterson entered the water at 10:22
a.m. and searched for about 30 minutes.
Neither diver was successful.
Detective Maerki said he would meet
with the girl at the scene in hopes she can
help him narrow down the area where she
threw the wrench. If so, he said OCSO divers
may resume their search Wednesday.

By Eric Kopp
Okeechobee News
An Okeechobee woman was pronounced
dead at the scene of a two vehicle accident
on S.R. 710 at 9:24 a.m. Monday, Jan. 11.
According to a Florida Highway Patrol
(FHP) release, Stephanie J. Bruner, 30, was
killed after her 1999 Ford vehicle collided
with a fully-loaded 2007 Peterbilt cement
truck.
The FHP report states that Ms. Bruner
was traveling eastbound on S.R. 710 when
she apparently pulled out to pass a west-

bound vehicle and drove directly in front of
the oncoming cement truck.
The truck was driven by Dale Michael
King, 44, of Port St. Lucie. Mr. King was not
injured.
FHP Lieutenant Tim Frith said a witness
stated that Ms. Bruner had successfully
passed one vehicle then apparently pulled
out to pass a second vehicle when the ac-
cident occurred.
Ms. Bruner's vehicle was declared a total
loss, while the crash did an estimated $6,000
in damages to the truck.

OYDC client accused of strangling staffer

By Eric Kopp
Okeechobee News
A client at the Okeechobee Youth Deten-
tion Center (OYDC), 7200 U.S. 441 N., has
been arrested and charged
with allegedly strangling a
female staff member.
Willie Coleman, 17,i
Texas Court, Fort Pierce,
was arrested Saturday, Jan.
9, on one felony count of
battery on detention staff.
After being booked into
the Okeechobee County
Jail, Coleman was taken to Willie
the Department of Juvenile
Justice Detention Center in Coleman
Fort Pierce.

According to an arrest affidavit by Deputy
Sarah Green, of the Okeechobee County
Sheriff's Office (OCSO), Coleman grabbed
the female staff member by the throat. Cole-
man reportedly held the 5-foot-2-inch, 110-
pound, woman against the wall and contin-
ued to strangle her despite orders to release
her.
The 6-foot-2, 160-pound, Coleman was
finally pulled off the woman by other staff
members.
Deputy Green's report said the female
victim was going to be taken to the hospital
because she was having difficulty speaking
and swallowing.
The deputy's report does not give a spe-
cific reason for the attack other than Cole-
man was "... not happy at the facility..." and
did not think he was treated fairly.

munity name and your local or state

new topics or comment on existing
topics. What follows is a sampling of
some of the discussions currently tak-
ing place. Thanks for participating!

Traffic cameras
Since the cameras would only enforce
existing laws, I have no problem with this
idea. Obviously, the county is already short
on deputies due to the budget issues. I don't
think traffic cameras will generate a lot of
money, but if they help reduce the speeding
problem and thus help reduce the number
of accidents, that would be worthwhile. It
won't take long before those who regularly
drive those roads will know where the cam-
eras are and will slow down. So if they put
the traffic cameras in the problem areas-
such as 70 West and State Road 710, then
that could be a help.
SThe traffic cameras are for revenue.
They may have some residual effect on
traffic, however, I would wager their main
focus is revenue and have very little to do
with our safety. Collecting the fines would
primarily target land owners; people that
Code Enforcement can attach onto to by
way of lien. Those that have nothing and
refuse to pay their fines will go scott-free.
These are civil infractions and would have
to be handled through code enforcement as
the law stands now. Don't get lulled into this
"to help law enforcement" ideology.

Turn signals
Now that our winter residents have re-
turned and there is quite a bit of traffic on
the road, it would be a big help if drivers
would use their turn signals to indicate their
intention to change lanes or turn. Give the
other drivers a little warning. We all have to
share the road.
This is a problem year round. Even
the cops don't signal. When these people
meet you from across the street I swear
they don't know what they are supposed
to do about signaling. They don't appear to
know whether straight across guy gets to go
first or wait. If they have driver's licenses,
their score must have been barely 75. But
I strongly suspect it's more a matter of not
caring than not knowing, same attitude as
applies to many other aspects of their life.
Throwing trash out the window comes to
mind.

Of course all drivers should be using
their turn signals year round, but this time of
year when there is a lot of traffic, it becomes
more important. I know some don't think
they need to bother with turn signals if there
is no other traffic around. If you signal and
there is no one there to see it, does it mat-
ter? But I think it is just a good idea to be
in the habit of always using the turn signals
so it becomes something you do automati-
cally.

Single member districts
I see in the news that Lee County is
considering going to a single member dis-
trict voting plan, so that only those who
live within a county commission or school
board district could vote in that race. This
makes the elected official more accountable
to his or her district. Proponents point out
that in that county, in half of the past con-
tested races, the person who won the seat
did not carry the majority in their home dis-
trict. So the district has no way to get rid of
representatives they don't think are doing a
good job. I know Okeechobee County often
has the same problem-the person who
wins the district might not win the county-
wide election. Should Okeechobee go to
single member districts? I think it's worth a
discussion.
I think Okeechobee County should
make a change. The way things are now,
to run for county commission or school
board, you have to live in that district, but
everyone in the county gets to vote in the
election. The way the districts are drawn is
like a pie. So someone might live in the city
limits but represent a district whose popula-
tion center is 20 miles away. So living in 'that
district' does not mean they necessarily live
near most of the voters in that district. The
current system means we don't always have
good choices in candidates because unless
you happen to live in that district you can't
run for that office. Sometimes we have two
really qualified candidates in one district and
two poor candidates in another. I think they
should either open it up so that anyone in
the county can run for a district seat which
would mean we would have more qualified
candidates to choose from-or else make it
single member where only those who live
in the district can vote, which would make
them more accountable to their voters.

Funeral home in bankruptcy
Since August of 1980, Buxton Funeral
Home has serviced the death care needs of
Okeechobee and surrounding areas.
On Wednesday, Dec. 30, 2009 the United
States Federal Bankruptcy Court ordered
Buxton Funeral Home into Chapter 7.
The business that has proudly serviced
this community for three decades is no lon-
ger able to operate at this time.
Our family felt we owed it to the com-
munity for an explanation of the events that
unfolded.
In 2004 hurricanes Francis and Jean rav-
aged South Florida and the previous build-
ing was destroyed. The building's damage
was beyond repair and the structure was
demolished. Following the hurricanes, the
business operated out of three modular
trailers. Despite our diminished capacity the
community remained steadfast in their sup-
port during our time of transition.
Contractors broke ground on our new
building and worked tirelessly for over a
year until its completion. As it was under-
stood the construction loan was supposed
to be converted to a full term mortgage by
the banking institution.
The building was finished near the time
of economic decline, and commercial lend-
ing had virtually ceased. The bank then told
us that we were to find financing from a
new lender. After bad dealings with an indi-
vidual who claimed to be a mortgage broker
we missed valuable opportunities for new
financing. Because he did not have our best
interest at heart we were forced into Chap-
ter 11 Reorganization to keep the bank from
foreclosing on the new building.
We submitted a plan for reorganization.
The bank agreed to finance the building for
three years to provide us time to acquire
permanent financing from another lender.
The largest of the funeral home's unsecured

creditors disagreed with the submitted plan
and pushed for liquidation of assets to sat-
isfy any debts.
Since the order of Chapter 7 several par-
ties have expressed interest in making it
possible for the Buxton family to continue
servicing the families of Okeechobee and
surrounding areas. We would continue to
provide the same care and ministry that our
families have come to rely on for the last 30
years. Currently we are trying to fulfill the re-
maining obligations to families that trusted
us with the care of their loved ones.
Any money that has been paid toward a
pre-funded funeral is securely located in a
trust account with the State of Florida. Those
families will be contacted by the United
States Trustee to provide them with informa-
tion regarding their pre-arrangements.
Paul and Marilyn would like to express
their deepest appreciation and love for the
support of the Okeechobee community.
When my parents started this business over
30 years ago, they started a ministry. Never
have we let a family go without a funeral
because of the lack of money, even if the
funeral came as a loss to us. We have never
charged for the funeral of a baby, because of
the personal losses of my parents. God has
taken care of us and will continue to pro-
vide. Though things seem bleak now, there
are many opportunities that could still pres-
ent themselves.
Okeechobee is a unique community that
has treated us well over the last 30 years. We
believe in small town ideologies and take
comfort in the values of this town. The fami-
lies we service are our neighbors and our
friends. It is our prayer that God will allow
us to continue servicing the community in
their time of loss the same way they have
supported us in ours.
Sincerely,
Philip Buxton

Letters to the editor

Thanks for the assistance
I want to issue a formal thank you to our
County Administrator Lyndon Bonner and
our County Commissioner and Chairman
Cliff Betts. We recently suffered the tragedy
of losing one of our feline family members
who was with us for six years which wasn't
nearly long enough. We lost him to the at-
tack of three dogs that live in our neighbor-
hood and came into our yard to go after
him. None the less he is gone now and there
is no replacing him but Mr. Bonner and Mr.
Betts jumped immediately to our aid. Mr.
Bonner even called me in the evening after
he had left the office as he had promised
me he would do in an email. Animal con-
trol responded as quickly as they possibly
could and have been working diligently on
this matter. I know I will be hearing from
them again as soon as all the paperwork
is in order and for that I am forever grate-
ful. Unfortunately, my 15 year old daughter
was home alone at the time and had to wit-
ness the whole thing and was forced to go
outside with a stick and run the dogs away
from her already deceased cat. She was
highly upset as you can imagine. I spoke to
a certified dog trainer who informed me that
when dogs exhibit "aggressive pack behav-
ior" they are dangerous and need to be dealt
with accordingly. I just want these dogs and
any more that can't be contained in their

own yards to be removed for good. I don't
want to wait until a child or another animal
is mauled and/or killed. I don't think this is
too much to ask...do you?

Mitigation of impact fees considered

By Pete Gawda
Okeechobee News
While a complete wavier of impact fees
has been turned down by both the county
commission and the city council, a new
idea has been proposed.
Brian Cartland of Okeechobee Main
Street addressed the Jan. 5 meeting of the
Okeechobee City Council and offered a
program to mitigate impact fees.
"It's in the early stages," he said of
his proposal with many details still to be
worked out. Reduction of impact fees
would be on a graduated scale with a
maximum 60 percent reduction. The pro-
gram would be based on companies that
provide high wage jobs and big capital
investments. The more higher paying jobs
offered and the bigger the investment, the
bigger the reduction.

While such a reduction in impact fees
might help persuade a business to locate
here, Mr. Cartland said it would not be the
ultimate deciding factor. He called his pro-
posed mitigation program one of the tools
to be used to attract new businesses to
the area. While the city council has been
unreceptive of past proposals for a com-
plete wavier of impact fees, they expressed
interest in Mr. Cartland's proposal. It was
the consensus of the council to pursue the
matter further only if the county agreed to
participate in the program.
Mr. Cartland has been working with
county staff and his next move will be to
present the idea to the county commission.
If the county commission is interested, Mr.
Cartland would work with city and county
staffs to iron out the details of the pro-
gram.

Avon Park Air Force Range plans discussed

The Avon Park Air Force Range will be the
topic of a series of land use study workshops
in the area. On Jan. 12, the first workshop
was held in Frostproof. On Jan. 14, a work-
shop is scheduled at 6 p.m. at the Sebring
Civic Center. On Jan. 28, a workshop will
be held at the Okeechobee Civic Center at 6
p.m. All workshops are open to the public.
The Joint Land Use Study is a coopera-
tive land use planning effort between the
Air Force Range and the local governments
of the area surrounding the bombing range
facilities. The goal is to develop a frame-

work for the adoption and implementation
of compatible development measures de-
signed to protect the public heath, safety
and welfare and at the same time safeguard
the ability of the range to fulfill its mission in
the training of the nation's military forces.
Public input is welcome in this process.
Since its inception as a training field for
World War II pilots, the Avon Park Air Force
Range has not only trained military person-
nel for various missions but also has been a
model for environmental management.

City to get sidewalks from stimulus program

By Pete Gawda
Okeechobee News
The City of Okeechobee is getting some
benefit from federal stimulus money even
though the money may not be stimulating
the local economy.
The city approved two separate mainte-
nance agreements with the Florida Depart-
ment of Transportation to provide mainte-
nance for a total of 59 blocks of sidewalk to
be built with federal stimulus money. The
contract for the first group of sidewalks,
which the city agreed to maintain on April
21, 2009, was awarded to an out of town
firm and there is no guarantee the second
group of sidewalks will be built by a local
contractor.
"I think it's a misnomer," Mayor Jim Kirk
said at the April 21, 2009 city council meet-
ing. "It stimulates somebody else's econo-
my."
When City Administrator Brain Whitehall
introduced the second maintenance agree-
ment at the Jan. 5, 2010 city council meet-
ing he pointed out that the city does get the
benefit of the sidewalks.
The sidewalks covered in the first main-
tenance agreement include SW Ninth Street
from Fifth Avenue to 11th Avenue, SW 11th
Avenue from Second Street to Ninth Street,
and SW Seventh Avenue from Second Street
to 15th Street.
The second agreement includes SE Sev-
enth Street from Ninth Avenue to 12th Av-
enue, SE Ninth Avenue from Seventh Street
to 23rd Street, NE Sixth Street from Second
Avenue to Sixth Avenue and NW Sixth Street

from Parrott Avenue to 11 th Avenue.
To date no sidewalks have been built.

Developers consider taking OUA to court

By Pete Gawda
Okeechobee News
It looks like some developers may go to
court to protest the legality of their develop-
ers' agreements with Okeechobee Utility Au-
thority (OUA).
At their meeting on Tuesday, Jan. 12 the
OUA Board of Directors voted to secure the
services of Harold Melville of Fort Pierce
in connection with the developers' agree-
ments. Mr. Melville has defended OUA in
other actions in the past.
There are presently seven developers
agreements based on the 10/20 plan in
which developers agreed to make a 10 per-
cent down payment on their total waste-
water capital connections charges. That
down payment was to be followed by a 10
percent payment the first year and annual
payments of 20 percent for the next four
years. The annual payments were to be in
the form of assessments on their property
tax bills. Northshore Village has two devel-
opers' agreements. One agreement paid in
full for 155 wastewater capital connection
charges. The second agreement paid for 301
wastewater capital connection charges on
the 10/20 plan. Okeechobee Premier paid
in full for 200 wastewater capital connection
charges. Awesome Ranch and 15th Street

Homes are up to date with their payments
under the 10/20 plan.
Northshore Village, Freshwater Develop-
ment Company, Land Ventures of America,
Royal Professional Builders and Stephen E.
Myers, Sr. did not make the required pay-
ments that were assessed on their 2008 tax
bill. Those five developers owe a total of
$788,228 in assessments, exclusive of any
applicable penalties and interest. The 2008
tax certificates for these properties were pur-
chased by OUA or others.
Okeechobee Premier Property, North-
shore Village, and Stephen E. Meyers, Sr. have
secured attorneys and protested the legality
of their developers' agreements. It is their
position that the developers' agreements are
null and void based upon their failure to pay
guaranteed revenue charges specified in the
developers' agreements. It is OUA's position
that the developers agreements are still valid
even though they did not pursue the guar-
anteed revenue charges. Land Ventures of
America contends, through its attorney, that
the special assessments levied on develop-
ers are invalid for various technical reasons.
The position of OUA is that the developers
voluntarily agreed to the amount, terms and
method of collections of the wastewater
connection fees.

At last month's meeting residents of R Bar
Estates protested the destruction of a veg-
etative buffer at the edge of the wastewater
treatment plant property due to construction
of a Glades Electric Power Company power
line. The treatment plant land is owned by
the state and leased to OUA. The easement
agreement for the powerline was negotiated
between Glades Electric and officials of the
Florida Department of Environmental Pro-
tection (DEP) who hold the deeds to state
owned property. After the meeting, Mr. Hay-
ford went to Tallahassee and discussed the
matter with DEP officials. He reported that
DEP is sticking by the easement they grant-
ed. Mr. Hayford noted that OUA will proba-
bly plant another vegetative buffer, however
it would be between the power line and the
perimeter ditch. The R BAR residents want-
ed the buffer replaced that was between the
powerline easement and Cemetary Road.
The board discussed at length but took
no action on a resolution updating general
policies and procedures. Many of the pro-
posed changes were housekeeping matters
and clarification of language. The proposed
resolution would allow for 36 monthly pay-
ments for paying applicable fees for estab-
lishing a new residential service if the total
bill is $3,000 or more, a charge for returned
checks and adjustment to a customer's bill
for the sewer volumetric charge for water
used to irrigate new plantings or sod on the

customer's property. The board discussed
OUA's billing practices and late fees and
possibly bringing these policies more in line
with the policies of other utilities such as
Florida Power & Light. Carl Leonard, who
was acting in place of absent board chair-
man Frank Irby, suggested that board mem-
bers write down their suggestions for policy
revisions and turn them in to John Hayford,
OUA executive director so they could discuss
the matter further next month.
The board also delayed until next month
taking action on a proposed manual of stan-
dards that would set minimum standards for
design, construction and maintenance of
water and wastewater systems.
In action, the board:
received the finance report for the pe-
riod ending Dec. 31, 2009;
approved payment number 9 to Metzger
& Willard for engineering work done on
Treasure Island Sewer System North in the
amount of $1,266.52:
approved payments totalling $12,128 to
Metzer & Willard for engineering work done
on Treasure Island Sewer System South;
authorized payment of $11,684.42 to
the City of Okeechobee to overlay asphalt on
SE 7th Street and SE 2nd Avenue; and
approved an easement on state owned
land at the site of the Battle of Okeechobee.

Okeechobee KOA receives 'Best of the Best' awards

The Okeechobee KOA Campground, oper-
ated by Manager Wendy Woodman, has been
recognized as being among the "best of the
best" in the Kampgrounds of America system
that includes more than 470 campgrounds in
North America.
The campground received both the 2009
Kampgrounds of America Founder's Award and
the President's Award at a special ceremony re-
cently at KOAs Annual International Convention
in Houston, Texas.
The KOA President's Award is given annu-

ally to campgrounds that receive the highest
customer service scores from their campers on
KOA's Kamper Satisfaction Survey. The Kamper
Satisfaction Survey is sent to nearly 250,000 KOA
campers each year, asking them specific ques-
tions about their stay at a particular KOA camp-
ground. Each campground must also pass an
annual quality inspection, which also factors
into the award.
The KOA Founder's Award gives special rec-
ognition to a select group of President's Award
recipients who receive the very best Kamper Sat-

isfaction Survey scores in the KOA system. The
award is named for KOA founder Dave Drum,
who created the first KOA campground on the
shores of the Yellowstone River in Billings, Mont.
in 1962.
"KOA campground owners who receive
these awards are truly operating the very best
parks in the world," said KOA Chief Operating

Officer Pat Hittmeier. "They take great pride in
providing an excellent camping experience for
their guests, and we take great pride that they are
part of our KOA family."
For more information on this KOA or any of
the more than 470 campgrounds in the KOA sys-
tem, go to www.KOA.com.

OKee-Tantie bandstand

By Pete Gawda
Okeechobee News
Things are on track for a spring completion of
the bandstand at Okee Tantie Campground and
Marina that Okeechobee County Commissioners
approved at a special meeting on Dec. 1, 2009.
The bandstand should arrive the week of Jan. 22.
Donnie Oden, capital projects manager for the
county, is waiting on construction drawings and
site work drawings. The site work drawings are
expected next week. When those drawings ar-
rive, site work and concrete work can get started.

The bandstand will be built on a concrete slab
raised 24 inches from ground level.
The bandstand will be paid for entirely from a
Florida Recreation Development Assistance Pro-
gram Grant with no county funds involved. The
cost of the bandstand is $54,927. It is estimated
that assembly will coast an additional $100,000.
The balance of the $200,000 grant will be used for
park amenities at Okee-Tantie.
It is hoped that the bandstand will be com-
pleted in time for the March 3 Okee-Tantie Family
Festival.

Three seniors to be honored at senior night

By Charles M. Murphy
Okeechobee News
Megan Clements, Janna Mullis, and Hailey
Venables will be honored Wednesday night as
the girls soccer team hosts their senior night at
Brahman stadium.
All three seniors were key contributors to
the team this year and have bright futures ac-
cording to soccer coach Julie Bohannon.
"I've worked with the program for the past
couple years and I've seen each of them grow.
Megan has been an incredible player and will
be a big loss for us," Bohannon added.
Clements has been the team goal keeper for
the past three seasons. She has actually played
goalie since she was six years old. She said she
is excited about graduation but has some feel-
ings of sadness as well. "I've always wanted to
be there for my friends, so its kind of sad too."
Clements wants to attend college in North
Carolina and intends to study pre med. She has
played volleyball, soccer, and softball during
her high school career.
"I feel proud that I represented my school
in those three sports. I've tried to be the best at
everything I do and I've done a pretty good job
at that," she added.
Clements said she won't rule out play-
ing college sports in North Carolina. She has
not made a final decision on her college of
choice.

Mullis was praised for her leadership
skills over the years. She said her team really
showed some improvement this year, "I think
the season went well. I was pleased with it and
I thought we achieved a lot. It was a fun year
with my teammates and I'll miss them."
Mullis said senior night will be bitter sweet.
She said she is ready to graduate but added
she will miss her close friends. She hopes to
attend the University of Florida and major in
pharmacy.
"I just wish the girls good luck and hope
they have an awesome future," she added.
Venables was praised for her toughness and
aggressiveness this year, her first on varsity. She
said the losses were frustrating at times but she
was glad she played this year.
"I love to be aggressive, love to slide tackle
and stuff like that. I know this will be the last
time I play soccer for a team, but I'm happy to
complete the year," she said.
Coach Bohannon said all three of the girls
will be sorely missed as they were important
parts of this year's team. "Janna is very well
rounded, academically and in extra curricular
sports. She is an incredible person and people
look up to her. She is a strong leader."
Bohannon said Venables worked very hard
this year and was a good role model for the
other girls. "She has gone through a lot, but
I'm excited that she came out and toughed it
out this year. She showed some strong charac

ter and I was very impressed by that."
Bohannon said Clements was the team
leader for the past few years. She noted Me-
gan doesn't get the credit for what she does
out there. "Her presence definitely shines. Ev
eryone looks up to her. I joke she's the girls'
mother on the field. She communicates very
well. She is a strong player and will be a tough
loss."
Okeechobee takes on Fort Pierce West-
wood tonight at 6 p.m. Senior night festivities
will take place at halftime. Okeechobee also
plays a home match Thursday night against
Martin County. Game time is 6 p.m.

points as Osceola girl's basketball defeated the
Brighton Charter School, 23-9 on Monday.
Osceola didn't play many of their eighth
graders and leading scorers as some of the
younger girls got the chance to play consider-
able minutes.
"For the most part, the girls that don't get to
play often showed a lot of hustle and determi-
nation," Coach Cathy Jones said, "They made
some mistakes but that's expected at this level.
I felt they played better team ball in the second
half."
Osceola took a 5-0 lead after the first quar-
ter and led 11-4 at the break. Osceola led 16-6
after three quarters.
The game was basically a defensive battle
as the young Osceola players and the even
younger Brighton Seminoles are still working
on their skills.
Both teams did show a lot of heart and en-
ergy in the game.
Buck said she felt pretty good but tired after
the game, "I feel good, I knew those girls and
it was hard. The coach said I'm counted on in

the future so that made me feel good. I think
the team will do well because the girls are hus-
tling more and working hard."
Buck had her way underneath against the
smaller opponent. Lauren Hazellief and Mur-
phy also had a lot of rebounds.
Coach Jones praised both Buck and Hazel-
lief for their hard work, "Some of our eighth
graders got to be team leaders for the first time
tonight. They saw what it was like. It was a
good experience."
Hazellief said Brighton never gave up and
made her team work, "I've gotten a lot better
and I've worked and hustled more. I've also
learned more. This helped me learn the game
tonight. I predict we'll do well the rest of the
season. I'll be ready."
Osceola hosted Gifford on Wednesday af
ternoon at 4:30 p.m.

OHS Brahman boys hoops get district win

ball team defeated Boynton Beach in im-
pressive fashion Saturday, 70-43.
Okeechobee High School's team had
energy from start to finish as they have bro-
ken the team into two units, with each play-
ing about half the game. It appears to have
worked as Okeechobee ran the visitors into
the ground Saturday.
Ryan Osceola said his team knew this dis-
trict game was important.
"It was a total team effort," he said. "We
all came in for four minutes at a time. If one
team is not doing so well, the other picks up
the slack and we get back into it."
Osceola had several impressive assists
and steals in the game and earned the praise
of his Coach Bryan Van Camp.
"There is no player that I've seen in the
past few games that has been more impor-
tant to us," he noted.
Okeechobee got off to a good start in the
game as Ricky Nieto hit two, three pointers
in the first minute of play. Matt Skipper and
Harper added three pointers before the end
of the quarter as Okeechobee built a 20-13
lead.

Duelle Gore poured in four free throws to
build the lead to 28-16. Austin Willard added
a three point basket and Deforest Shanks
made a couple of strong moves to the hoops
for buckets to help Okeechobee hold a 38-
20 lead at the half.
Osceola said he has tried hard to make
better decisions on the court and handle the
ball better this season.
"The team is trying to go 100 percent all
the time," he said. "If we do that hopefully
we'll come with a win. Tonight we did."
Coach Van Camp said he has been very
impressed with the energy his team has
shown this year. "The kids have bought in.
They are a great group of kids. There is no
selfishness and no attitude problems as ev-
eryone has the same goal," the coach said.
"Right now were on a roll."
Boynton Beach went on an 8-0 run to start
the second half to pull within 12 points but
didn't get any closer. Shanks had two tough
buckets inside, and Osceola hit Willard on a
beautiful pass for a fast break lay up to give
Okeechobee a 49-32 lead. He then stole the
inbounds pass, and tossed it to Harper for
another easy bucket.

Okeechobee led 55-34 after three quar-
ters and built the lead to 27 points in the
fourth quarter.
Van Camp said he sees the team evolv-
ing into a district contender with each pass-
ing game. "We are two completely different
teams. The first team is a more patient half
court team. The second team is strong on
the press and with running the fast break.
The crowd has been phenomenal. At our
home games you can just feel the energy
and the excitement from the crowd. It's
been a blessing for us."

Boys junior varsity playing good ball

By Charles M. Murphy
Okeechobee News
The Okeechobee High School boys bas-
ketball program appears to get better every
day as not only is the varsity enjoying some
success; the junior varsity team is also play-
ing well.
Coach Jason Egli said he sees a bright fu-

ture for many of his players.
"I've preached hard work and motivation
to them." he said. "I feel they are getting into
a groove right now.
Okeechobee has a modest record (4-3),
but they have their share of excellent ath-
letes who could step in to fill spots on the
varsity squad next year.

"Our season has been going pretty well.
We have the talent. A couple of ninth grad-
ers have bounced back and forth and a lot
of our guys in ninth and tenth grade will
most likely be varsity players next year," he
added.
The JV team defeated Westwood and
Boynton Beach last week thanks to work-
manlike effort. Against Boynton Okeecho-
bee trailed at the half and rallied to win.
"That game was about hustle. I told them
at the half to come out and start hustling. We
showed heart and effort in that game," he
added. "The hardest thing on a cold wet and
rainy day is to get motivated. They came out
motivated and got the job done."
Key players on the junior varsity squad
this year include Phillip Jones, Tim Hirst,
Kolby Frank, Alonzo Coleman and Jessie
Thomas.

ceola combined to score 16 points to lead
the Yearling boys to an impressive 45-10 vic-
tory over Pemayetv Emahakv Charter School
Jan. 7.
Yearling played on back-to-back days
against the Seminoles and was able to enjoy
big wins in each game.
Coach Efrain Ochoa said the game was
a good showcase for the younger players
to show what they can do, "Everybody got
to play significant minutes. I got to see our
future players and gave them some experi-
ence."
He praised Imillakiyo Osceola and Tristen
Mavroides for the way he handled the tempo
of the game when they were in there.
"I feel great I guess," Osceola said, "I
practice all the time and show up all the
time. The team is improving a lot. It feels
great."
Mavroides predicted that Yearling will
continue to win games for the remainder
of the year, "I don't always have the most
playing time, but I really stuck it to them and
against Oslo on Monday, I'll do the same."
Yearling scored the first eight points of
the game and led 14-2 after the first quar-
ter. George Tillman had a bucket during the
Yearling run.
Yearling built the lead to 20-2 at the half
and led 32-6 after three quarters.

Taylor Trent scored 10 points to lead a
balanced Yearling Middle School attack to
an impressive 38-1 victory over the Pemay-
etv Emahakv Charter School in girls' basket-
ball action on Jan. 7.
The win was the second in two days for
the Yearling girls over the Seminoles, who
are comprised of sixth graders. The Year-
lings used a suffocating defense, and gave
liberal playing time to all of their reserves in
the big win.
Coach Erin Morrow was pleased that her
team is learning how to win and how to play
defense, "We played hard today. Taylor and
the other girls did a good job handling the
ball. I think we can build on this for the rest
of the season."
Cheyenne Nunez had seven points and
Delaney Osceola and Jaide Micco both had
six points.
Trent said she felt the girls are getting bet-
ter and are more confident than they were
early in the season, "It felt good to win. A
lot of our players know those kids, so it was
good to win."
Neither team looked good on offense
in the first quarter. Yearling led 6-0 after six
minutes.
Keri Dixon and Micco hit jumpers early in
the second to get the Yearlings going. Brigh-

STATE OF FLORIDA
DEPARTMENT OF ENVIRONMENTAL PROTECTION
NOTICE OF INTENT TO ISSUE PERMIT
The Department of Environmental Protecbon gives nobce of its intent to issue a permit (File No. 43-0293015-001 to
Florida Gas Transmission Company, LLC, 5444 Westhelmer Road, Houston, Texas 77056, in order to increase their
certificated capacity by 820 million cubic feet per day (MMcf/d) to serve the expanding need for additional natural gas
transportation service in Florida. To accomplish this, FGT shall construct 298.3 miles of 24-inch and 36-inch diameter
mainline loops, 89.8 miles of 30-inch greenfield mainline and 36.1 miles of 20-inch and 24-inch-diameter new green-
field laterals. Additionally, the project includes the removal of approximately 25.9 miles of previously abandoned 24-
inch-diameter pipeline within Loops 3 and 4, and 4.6 miles of 8-inch pipeline from the Inghs lateral. Furthermore, ad-
ditional pipeline facilities to be installed shall include associated mainline valves, pigging facilities (launchers and re-
ceivers), and other appurtenant and auxiliary facilities.
The pipeline and extra workspaces shall traverse 1,156 wetland areas and 247 surface waters, of which 35 surface
waters and wetlands shall be crossed utilizing horizontal directional drilling techniques. In total, the project shall tem-
porarily impact approximately 275-acres of herbaceous wetlands, and impact approximately 427.55-acres of
shrub/scrub and forested wetlands, including the placement of fill in four wetlands for a total of 0.41-acres of perma-
nent wetland impacts. These four wetland locations are: L3-WA-w007, L8-LV-wl02, L9-PA-w009a, and
L11-MD-w005. All herbaceous wetland and surface water impacts shall be temporary in nature, and all contours shall
be restored to pre-construction grades. Additionally, all sediments shall be managed within the construction right-of-
way or extra work spaces so that the nabve seed bank is replaced in its previous horizon.
In efforts to reduce and eliminate wetland and ditch impacts to the maximum extent practicable, the permitted has
utilized the route with the least amount of wetland crossings and has reduced the typical 100-foot wide construction
right-of-way to 75-feet or less in areas where wetlands exist. With current technologies and construction methods,
the 75-feet width is the minimum necessary for maintaining safe working conditions and operation during pipeline in-
stallabon through wetlands. The Applicant has explored numerous alternatives throughout the design phase of the
project, which included minimizing wetland impacts wherever feasible. Given the nature of this long linear project
and the general routing objectve to place the proposed facilities adjacent to other existing infrastructure, FGT has
been able to parallel approximately 99% of the route or approximately 421 of 424 miles in Florida with exisng trans-
mission lines and/or roadways. Where site conditions allow, FGT has located a majority of the temporary staging are-
as or extra temporary work space in upland areas while maintaining a 50-ft vegetative buffer from wetand
boundaries. FGT has further avoided or minimized wetland and surface water impacts at 35 locations throughout the
state utilizing horizontal dreconal drilling techniques.
In order to offset impacts to 427.55-acres of forested wetlands and 4.39- acres of mixed forested and herbaceous
wetlands in conservation easement areas, and for permanently filling 0.41 acres of mixed forested and herbaceous
wetlands, the permitted shall purchase 40.771 mibgation credits at various mitigation banks throughout the State in
accordance with the table in Specific Condition No. 10. Of the 427.55-acres of impacts to forested wetlands within a
75-foot construction corriorr, the permitted is authorized to maintain a 10-foot (5-feet on each side of the pipeline)
wide area as an herbaceous wetland, and is authorized to maintain an additional 10-foot on each side as a
scrub/shrub wetland. All areas outside of the 30-foot wide herbaceous and scrub/shrub wetland shall be left to revert
to natural pre-construction forested conditions, and maintained and monitored in accordance with the "Florida Wet-
land Monitoring and Maintenance Plan", which shall be included as an attachment to the permit.
At the complebon of construction activities the permitted shall restore, to pre-construction elevations, all disturbed
temporary construction areas which were utilized for pipeline installation. With the exception of wetland classification
conversion and four wetlands with a total of less than 0.5 acres of permanent fill, all wetland and surface water im-
pacts shall be temporary in nature.
Following construction completion, the permitted shall work to promote the recruitment of native wetland species
along the entire pipeline route. Monitoring, maintenance and reporting activities shall be conducted within the con-
struction right-of-way easements in accordance with FGT's "Florida Wetland Monitoring and Maintenance Plan", which
requires perpetual maintenance events within the permanent easement and reports to be submitted to the Depart-
ment annually for three years after construction completion. In order to offset any permanent impacts to herbaceous
wetlands as a result of construction activities, the permitted shall provide compensatory wetland mitigation.
The Department issued a "Notice of Intent to Grant Variance" to the applicant on December 24, 2009, for two petb-
tions for variance to exceed turbidity standards (DEP File No. 43-0293015-002) and for an expanded mixing zone
(DEP File No. 43-0293015-003). The granting of this permit does not guarantee the issuance of the variances.
The acbvity is located within Bay, Calhoun, Citrus, Dade, Desoto, Escambia, Gadsden, Gilchrist, Hernando, High-
lands, Hillsborough, Jackson, Jefferson, Lafayette, Leon, Levy, Madison, Manatee, Martin, Okaloosa, Okeechobee,
Pasco, Santa Rosa, Suwannee, Taylor, Walton, and Washington Counties.
The Department's file on this matter is available for public inspection during normal business hours, 8:00 a.m. to
5:00 p.m., Monday through Friday, except legal holidays, at the Department of Environmental Protecton, Attention
Benny Luedlke, 400 North Congress Avenue, Suite 200, West Palm Beach, FL 33401, Telephone: 561-681-6646. Ad-
ditionally, maps that were submitted in the Environmental resource Permit Application are available for review at the
Department's website at http//www dep state fl us/southeastlerplerpmain htm The maps will be available on the
Department's website for a minimum period of ninety days after the date of this nobce.
The Department will issue the permit with attached conditions unless a bmely petition for an administrative hear-
ing is filed under sections 120.569 and 120.57 of the Florida Statutes, before the deadline for filing a petition. The
procedures for petitboning for a hearing are set forth below.
A person whose substantial interests are affected by the Department's proposed permitting decision may pebtion
for an administrative proceeding (hearing) under sections 120.569 and 120.57 of the Florida Statutes. The petition
must contain the information set forth below and must be filed (received by the clerk) in the Office of General Coun-
sel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000.
Petitions by the applicant or any of the parties listed below must be filed within 21 days of receipt of this written
notice. Petitions filed by any persons other than those entitled to written notice under section 120.60 3) of the Flori-
da Statutes must be filed within 21 days of publication of the notice or receipt of the written notice, whichever occurs
first. Under section 120.60(3) of the Florida Statutes, however, any person who has asked the Department for notice
of agency action may file a pebtion within 21 days of receipt of such nobce, regardless of the date of publication.
The petitioner shall mail a copy of the petition to the applicant at the address indicated above at the time of filing.
The failure of any person to file a petition or request for mediabon within the appropriate bime period shall constitute
a waiver of that person's right to request an administrative determination (hearing) under sections 120.569 and
120.57 of the Florida Statutes. Any subsequent intervention (in a proceeding intbated by another party) will be only at
the discretion of the presiding officer upon the filing of a motion in compliance with rule 28-106.205 of the Florida Ad-
ministrative Code.
A petition that disputes the material facts on which the Department's action is based must contain the following
information:
(a) The name and address of each agency affected and each agency's file or identification number, if known;
(b) The name, address, and telephone number of the petitboner; the name, address, and telephone number of the
petitioner's representative, if any, which shall be the address for service purposes during the course of the pro-
ceeding; and an explanabon of how the pebtioner's substantial interests will be affected by the agency determina-
bon;
(c) A statement of how and when each petitioner received nobce of the agency decision;
d) A statement of all disputed issues of material fact. If there are none, the petition must so indicate;
e) A concise statement of the ulbmate facts alleged, as well as the rules or statutes which entitle the petitboner to
relief; and
(f) A demand for relief
A petition that does not dispute the material facts on which the Department's action is based shall state that no
such facts are in dispute and otherwise shall contain the same information as set forth above, as required by rule

Because the administrative hearing process is designed to formulate final agency action, the filing of a petition
means that the Department's final action may be different from the position taken by it in this notice. Persons whose
substanbal interests will be affected by any such final decision of the Department have the right to petition to become
a party to the proceeding, in accordance with the requirements set forth above.
Mediation is not available in this proceeding.
As provided in section 120.573 of the Florida Statutes, the bmely agreement of all parties to mediate will toll the
time limitations imposed by sections 120.569 and 120.57 for holding an administrative hearing and issuing a final or-
der. Unless otherwise agreed by the parties, the mediabon must be concluded within 60 days of the execubon of the
agreement. If mediation results in settlement of the administrative dispute, the Department must enter a final order
incorporating the agreement of the parties. Persons seeking to protect their substantial interests that would be af-
fected by such a modified final decision must file their petitions within 21 days of receipt of this notice, or they shall
be deemed to have waived their right to a proceeding under sections 120.569 and 120.57. If mediation terminates
without settlement of the dispute, the Department shall notify all parties in writing that the administrative hearing
processes under sections 120.569 and 120.57 are resumed.
Any party to this order has the right to seek judicial review of it under section 120.68 of the Florida Statutes, by filing
a notice of appeal under rule 9.110 of the Florida Rules of Appellate Procedure with the clerk of the Department in
the Office of General Counsel, Mail Station 35, 3900 Commonwealth Boulevard, Tallahassee, Florida 32399-3000, and
by filing a copy of the notice of appeal accompanied by the applicable filing fees with the appropriate district court of
-11-1l The notice of appeal must be filed within thirty days after this order is filed with the clerk of the Department

JV girls growing in wins, confidence

By Charles M. Murphy
Okeechobee News

One team on the Okeechobee High
school campus has won 10 games in a row,
and not many people know about it.
Kevin Jackson has led the junior varsity
girls basketball team to a great season in his
first year on the job. "This is my first season
coaching girls so I wasn't sure what to ex-
pect. With hard work I knew we could do as
well as we're doing and I'm very pleased."
Players on this year's squad include Jary-
aca Baker, their point guard who is counted
on for her ball handling skills and defense,
Erena Billie, Cavel Campbell, Amber Cun-
ningham, Ami Edwards, Madison Hanner,
Aaliayh Palmer, Maranda Serrano, Shama-
rah Shanks, and Janet Smith.

Coach Jackson said all of the girls have
played a role in the team's success.
"We like to put a lot of pressure on de-
fense and create easy buckets for ourselves
in transition. We lost our first game, but have
won every since."
The team only had nine players in their
win Monday over Sebastian River but Jack-
son claims they are a very balanced team.
The Coach praised Serrano for her defense
and rebounding, and Ami Edwards, who
has improved dramatically with her offense
and defense at the center position.
"There are a few girls here that I think can

do really well at the next level. Of course
there still is a lot of work left to be done,"
Jackson added. "We are on a roll right now,
let's hope we can keep it that way."

Osceola

boys defeat

Brighton

By Charles M. Murphy
Okeechobee News
Osceola boy's basketball won their fourth
game of the year in impressive fashion, 45-
18, over the Brighton Charter School Pemay-
etv Emahakv on Monday.
The Warriors played without most of their
starters as they used younger players against
the Seminoles.
Coach Mike Wharin said he was glad to
see the reserves get some playing time, "The
third string actually played most of the game
and it was a spirited second half between
the squads."
Expavious Mills, a sixth grader, had 11
points, and Christian Crews and Luis Fon-
seca both had eight points. The team man-
ager, Lance Crum also got to suit up and he
scored six points.
Osceola only led 10-7 after the first quar-
ter but built the lead to 18-7 late in the half
and never trailed in the contest.
Zeke Matthews, Zach Hudson and Rayvan
Smith had nice games for the Seminoles.
Brad Sikorski had six points for Osceola.
Jeff Osgood hit a three point basket and Tad
Norman had two points for Osceola.
