Local man accused of theft of checks
By Eric Kopp
Okeechobee News
An Okeechobee man has been arrested
on several felony charges
for his alleged connection
in the theft of checks from
two different people for
whom he was working.
Adam Lee Minix, 34,
S.E. 25th St., was arrested
Wednesday, Jan. 6, and
charged with a total of
three counts of uttering a Adam Lee
forged instrument, three Minix
counts of grand theft and
three counts of criminal use of personal in-
formation.
Minix is being held in the Okeechobee
County Jail without bond.
According to an arrest report by Detec-
tive Augustin Saucedo, of the Okeechobee
County Sheriff's Office (OCSO), Minix
cashed two checks on the account of one
victim and cashed one check on the ac-
count of a second victim.
Detective Saucedo stated that the checks
were cashed for a total of $850.
The detective's report states that Minix
had two friends cash the checks for him.
He reportedly told the friends he didn't
have a Florida identification card. One of
the man's friends apparently told the detec-
tive that the checks were already filled out,
except for the name of the person cashing
the instrument.
Both victims told the detective that they
paid Minix in cash, and never by check.
Detective Saucedo went on to say in his
report that fingerprints matching those of
Minix were found on one of the victim's
checkbook.

(two items). Those simply renewing may do
so by a convenience method, via the Inter-
net or mail, one time between office renew-
als. The renewal following a convenience
option must be in a state driver license office
(or participating tax collector office) where
new requirements will be in effect.
Floridians are encouraged to visit Gath-
erGoGet.com to find out how and when
to gather your documents, go to a driver li-
cense office and get your new card. This on-
line hub allows residents to obtain contact
information showing where to get required
documents, create personalized checklists
and browse a list of local driver license of-
fices in their area.
"These new requirements support the
most secure identification credential possi-
ble," said Division of Driver License Director,
Sandra Lambert. "We are pleased to have
a convenient online tool in place that takes
Floridians through a step-by-step process,
helping to identify and obtain all required
documents to prepare for their next visit to
an office."
Florida law was enacted to ensure the
state's compliance with the provisions of
the Federal Real ID Act. Despite the recent
extension of deadlines by the Department of
Homeland Security, Florida will continue its
efforts to provide the most secure credentials
and issuance processes possible, benefitting
both our citizens as well as law enforcement
agencies. The decision by the DHS will have
no impact on Florida's planned improve-
ments.
While the new documentation require-
ments begin Jan. 1, 2010, Florida residents
are not required to visit a driver license or tax
collector office on or before this date. Resi-
dents may verify when they need to visit an
office with the required documents by visit-
ing GatherGoGet.com.
As the changes may require some prepa-
ration, the Department encourages residents
to visit the website to speed through the pro-
cess so they can make their transactions in
one trip. For more information about the

Woman accused of meth possession
By Eric Kopp
Okeechobee News
An Okeechobee woman has been
booked into the county jail following her
arrest for allegedly having
a 'meth pipe' in her posses-
sion.
Daphney Gail Padgett,
32, N.E. 356th Court, was
arrested Tuesday, Jan. 5, on
a felony charge of posses-
sion of methamphetamine
and a misdemeanor charge
of possession of drug para-
phernalia. She was booked Daphney
into the Okeechobee Gail Padgett
County Jail under a bond
of $6,000.
Padgett was also arrested on an Okeecho-
bee County writ of bodily attachment/child
support warrant. Her bond on that charge
is $1,000, which is a cash purge-meaning,
that is apparently what she owes in child
support and it must be paid before she can
be released.
An arrest report by a detective with the
Okeechobee Narcotics Task Force states that
a car was stopped for speeding on U.S. 441
N. The driver of the car, who was not arrest-
ed on criminal charges, gave the detective
permission to search the white four-door
Ford.
Prior to searching the car, the detective
said Padgett, who was the passenger, "...
appeared to be attempting to conceal some-
thing from me." The detective said when a
black purse on the floor of the car next to
Padgett's feet was moved a rolled up piece
of white cloth was found. Inside the cloth
was a glass pipe that is allegedly used to
smoke meth.
The detective's report goes on to state that
there was a white residue in the pipe that,
when field tested, indicated a positive result
for the presence of methamphetamine.
The report does not indicate if the driver
of the car was issued a traffic citation for do-
ing 70 mph in a 60-mph zone.

Drinking and driving
The problem is that everyone who has been
drinking IS foolish. In fact they were foolish be-
fore, also, when they started. The idea that anyone
can "drink i. .I ...-ii .1 or decide "if you drink,
don't drive" is nonsense. Usually they never be-
lieve they are impaired enough to not be capable
of handling a car. Why anybody thinks they have
to drink alcohol in order to have fun is beyond me.
I can see only one good use for it and that is to
put oneself out of their misery for awhile, (which
the Bible condones), but it should be taken when
you're ready to go to bed and sleep.
Dogs at large
We have an ongoing problem out here in
Crooked Creek Plantation on State Road 70 east
with dogs running at large. Myself and other neigh-
bors have attempted to get this problem rectified
and have had no luck. On Sunday, Jan. 3, we lost a
beloved member of our family "Tobee." He was a
beautiful cat that we rescued five years ago from a
shelter. While in his own yard, he was attacked by
three pitbulls that were running at large. My teen-
age daughter was the only one at home at the time
and was forced to witness this and to get a stick
and beat the dogs off of her already dead cat. I ask
you county officials what is it gonna take? Does
a child have to be bitten and or mauled before
something is done? I sure hope not, that would be
a real tragedy!
Taxes
I see how much they are taxing cigarettes.
Now they need to tax alcohol 10 times as much.
Drunk drivers do not hurt themselves usually, as
they are so relaxed due to being drunk. Guess
what will be next? Fast food or fatty foods.
Pregnant women working
No one should pick up slack work for preg-
nant women. What did they do in the "old I '
Women worked in the field and tended to all the
house work while the men worked. Granted, that
there were more still births and women dying
during birth. Times have changed, suck it up and
work until you give birth or the doctor says stop.
Most women do not a. I lii I ,. are helpless
when they are pregnant and do not use it as an ex-
cuse to get out of work. I am six months pregnant
and work. FMLA does not last the whole preg-
nancy and most women, myself included, must
stay at work because unpaid leave is not an option
if they want to keep their house, car, and food in
our mouths. Truly, lack of policies punish women
who do more physical work than those behind a
desk. Women have come a long way and employ-
ers who insist on not having alternative options for
their pregnant workers floors me. If men were able
to carry a child for nine months, you bet your butt
policies would already be in place everywhere. It
is not special treatment for women, any man that
conceives would obviously be able to benefit from
a pregnancy policy also. As for women who take
advantage of their condition, shame on you.
Terrorist
Fifty-eight percent of those polled say water
boarding and other aggressive ii. r.. ii .... tech-
niques should be used to gain information from
the terrorist who attempted to bomb an airliner
on Christmas Day. The new national telephone
survey finds that just 30 percent oppose the use of
such techniques, and another 12 percent are not
sure. Men and younger voters are more strongly
supportive of the aggressive ii... ..i ii.... tech-
niques than women and those who are older.
Republicans and voters not affiliated with either
major party (read "independents") favor their use
more than Democrats. Seventy-one percent think
i4, ,ii .. 11 i./i the Nigerian Muslim to blow up the
airliner as it landed in Detroit should be investi-
gated by military authorities as a terrorist act. Only
22 percent say it should be handled by civilian au-
thorities as a criminal act, as is currently the case.
It seems totally strange to me that some nurse
has to dress the burns on this demon when only
an hour previously he was willing to blow himself
up in order to eradicate all the other passengers, as
well as the plane.
It shows that we are not murderous savages
like these mass murderers and that it also seems
to be more in line with what Jesus preached. On
whether we should try this guy in a military or ci-
vilian court, I don't remember any of this clamor
when Richard Reid, the would-be shoe bomber,
was tried in civilian court. Ohh, how the winds
change...
We are not murderous savages, but we can
be overcome by those who are. Do you suppose
turning the other cheek only applied to one-on
one relations with your acquaintances, or are we
supposed to adopt the theory as an entire nation?
I wonder if Americans are supposed to give these
demons the other cheek until they completely
eradicate us.
Perhaps it goes to how much faith the coun-
try has in the judicial system. Sort of reinforced af
ter the Judges dropped the charges regarding the
Blackwater case.

'Grandma seam'
Seniors vs. Crime has issued a warning to
citizens of a scam which has recently been
used in our area. The "grandma scam" is
not new but has resurfaced during the holi-
day season. An Okeechobee resident was
tricked into sending $1,500 to an address in
Canada. When answering her phone, the
voice sounded just like her grandson; so

Internal Revenue Service offers tax tips
When you prepare to file your tax return,
there are two things that will factor into your
tax situation: dependents and exemptions.
Here are five important facts the IRS wants
you to know about dependents and exemp-
tions before you file your 2009 tax return.
1. If someone else claims you as a depen-
dent, you may still be required to file your
own tax return. Whether or not you must file
a return depends on several factors, includ-
ing the amount of your unearned, earned or
gross income, your marital status, any spe-
cial taxes you owe and, any advance Earned
Income Tax Credit payments you received.
2. Exemptions reduce your taxable in-
come. There are two types of exemptions:
personal exemptions and exemptions for
dependents. For each exemption you can
deduct $3,650 on your 2009 tax return. Ex-
emption amounts are reduced for taxpayers
whose adjusted gross income is above cer-
tain levels, depending on your filing status.
3. If you are a dependent, you may not
claim an exemption. If someone else such
as your parent claims you as a dependent,
you may not claim your personal exemption
on your own tax return.
4. Your spouse is never considered your
dependent. On a joint return, you may claim
one exemption for yourself and one for your
spouse. If you're filing a separate return, you
may claim the exemption for your spouse
only if they had no gross income, are not fil-
ing a joint return, and were not the depen-
dent of another taxpayer.
5. Some people cannot be claimed as
your dependent. Generally, you may not
claim a married person as a dependent
if they file a joint return with their spouse.
Also, to claim someone as a dependent, that
person must be a U.S. citizen, U.S. resident
alien, U.S. national or resident of Canada or
Mexico for some part of the year. There is
an exception to this rule for certain adopted
children. See IRS Publication 501, Exemp-
tions, Standard Deduction, and Filing Infor-
mation for additional tests to determine who
can be claimed as a dependent.
For more information on exemptions,
dependents and whether or not you or your
dependent needs to file a tax return, see IRS
Publication 501. The publication is available
on IRS.gov or can be ordered by calling 800-
TAX-FORM (800-829-3676).
Lipizzaner Stallions to perform
Lagervall to visit Eagles
Rider has local connection
By Pete Gawda
Okeechobee
Sunday afternoon's performance by the
World Famous Lipizzaner Stallions at the
Okeechobee County Agri-Civic Center will
have a local connection.
One of the riders is Holly Johnson,
whose grandparents Vern and Wanetta
Johnson live in Okeechobee.
Ms. Johnson is from For Lauderdale.
The Lipizzaner Stallions that will be per-
forming are based in Orlando. Ms. John-
son saw an advertisement for the group
and auditioned. She had done some jump-
ing and enough dressage exhibition riding
in which the horse is controlled in certain
difficult steps and gaits by very slight move-
ments of the rider, to squeak by the audi-
tion and began training.
The World Famous Lipizzaner Stallions
travel all over the U.S. and Canada. Ms.
Johnson, who has been riding Lipizzan-
ers for about eight months, will be riding
in some the drills and taking part in the fa-
mous "airs above ground."
There will be one performance only at
2 p.m. The 6 p.m. performance was can-
celled due to cold weather. Tickets for the
6 p.m. performance will be honored at 2
p.m.

City council considers waiving impact fees
By Pete Gawda
Okeechobee News
For the third time the topic of waiving im-
pact fees came before the Okeechobee City
Council. However, instead of simply saying
'no' as they have done in the past, the city
council, meeting on Tuesday, Jan. 5 actually
showed some interest.
Brian Cartland, director of economic
development for Okeechobee Main Street
presented a draft proposal whereby targeted
industries, that provide a certain number of

Requirements for developers to provide
public works projects to offset the effects of
their developments are now more clearly
defined.
At their meeting on Dec. 17, 2009
Okeechobee County Commissioners ap-
proved an amendment to the county's land
development regulations which replaces the
section on consistency and concurrency de-
terminations.
Concurrency basically means that the de-
velopers of a new residential, commercial or
industrial complex are responsible to ensure
there is sufficient infrastructure capacity to
handle the development. This includes mak-
ing sure there are acceptable levels of service
in such areas as transportation, recreation,
potable water, sewer, and solid waste.
"I'm tickled to death," said Commission-
er Joey Hoover, a long time advocate of con-
currency, adding that this amendment will
solve a lot of problems.
The amendment is more comprehensive
than the section it replaces. It finalizes proce-
dures and methodologies. While the amend-
ment is concerned with recreation, potable
water, sewer, drainage, public schools and
solid waste, the largest section deals with
transportation. It provides for a developer to
furnish additional travel and turn lanes and
intersection improvements under certain
conditions.
Under the new amendment a certificate
of occupancy will not be issued until it is

jobs at a certain pay level, would be given a
partial waiver of impact fees. This would be
an incentive to attract industry to the area.
He presented his rough idea to see if the city
council expressed any interest before he
hammered out the details.
"I like this idea better than just waiving
impact fees," was the opinion of Council-
man Dowling Watford. He suggested that
there be some mechanism to collect impact
fees if the industry did not fulfill its require-
ments.
Mr. Cartland said the waiver could be
determined that the necessary facilities and
services will be in place when the impacts of
the development occur.
A certificate of concurrency will be issued
prior to or concurrent with final approval of
a project.

"It's time to re-evaluate our impact fees,"
said City Administrator Brian Whitehall.
"This warrants some consideration,"
stated Mayor Jim Kirk.
The consensus of the council was to
pursue the matter further only if the county
commission is interested. It was noted that
city impact fees make up only 8 percent of
total impact fees while county impact fees
make up 92 percent.
Turning to other matters, Mr. Whitehall
suggested that property in the City Com-
merce Park be offered for $100,000 an acre.
The council considered a request from
the Chamber of Commerce to sublet a por-
tion of their building for outside office use.
However, Mr. Whitehall pointed out that the
1953 quit claim deed from R. E. Hamrick
that provided the land for the Chamber of
Commerce building stated that the building
should be used for the Chamber of Com-
merce and not for any other purpose.
City Attorney John Cook stated that sub-
leasing the building could involve litigation.
"That's not a battle we need to fight at
this time," said Mr. Watford.

The council took no action on the re-
quest. The mayor suggested that the Cham-
ber of Commerce approach the Hamrick
Trust about subleasing.
The mayor recognized Brain Padgett for
ten years' service to the city as a mainte-
nance operator for the public works depart-
ment.
In other matters, the council:
accepted a warranty deed from G-4
Land and Cattle Company for a turn lane on
SW 22st Street;
approved a maintenance agreement
with the Florida Department of Transporta-
tion dealing with sidewalks to be built with
stimulus money;
approved an interlocal agreement with
Okeechobee County regarding a 2008 Di-

approved the temporary closing of SW

Okeechobee High School defeated West-
wood 55-50 in boy's basketball action Tues-
day night in Okeechobee.
Okeechobee earned revenge from two
last-second losses to the Panthers in 2008-
2009; something that Willard said made
this win that much sweeter. "Energy and
defensive effort were the keys to the game,"
he said. "They beat us two times last year
on buzzer shots but not this year, not this
year!"
Okeechobee and Westwood traded bas-
kets in the first half with Okeechobee getting
a nice run at the end of the first quarter to
take a 17-10 lead. Deforest Shanks hit a 14
foot jumper, Duelle Gore had a three point
play and Aaron Suarez scored on a nice
drive to the hoop as Okeechobee outscored
the Panthers 10-2 to end the quarter.
Westwood returned the favor in the sec-
ond quarter. After Okeechobee built a 22-10
lead on a three pointer by Willard, the Pan-
thers went on a 17-5 run to end the half. The
score was deadlocked at 27 at the break.
Brahman Coach Bryan Van Camp said he
knew Westwood had started slow and the
first half wasn't their best effort. "They made
a great run just before halftime," said the
coach. "We were fortunate to go in even."
Okeechobee scored the first five points
of the third quarter and never trailed in the
second half. Shanks hit another three, Gore
scored on an inside bucket and Willard hit a
16 footer as Okeechobee built an eight point
lead, 44-36, after three quarters.
"It was just a good game. We worked
hard and we forced turnovers on defense.
I'm pretty proud of our defensive effort,"
Willard said.
Okeechobee led by as many as nine
points in the fourth quarter and kept West-
wood from going on any big runs that could
have gotten them back into the camp.
Coach Van Camp said his team did make
some mistakes with the ball down the
stretch but not on the defensive end as they
held the Panthers to one of their lowest scor-
ing outputs of the year.
"We definitely wanted to turn them into
a jump shooting team. We felt they were
strong inside and could run the fast break.
We went zone, hustled back and held them
to outside shots. It seemed to work," he
added.
Troy Harper had nine points for Okeecho-
bee. Andre Robinson had 15 points for Fort
Pierce Westwood. Leon Shorter added 11
points.

The Osceola Middle School Boys Basket-
ball Team couldn't hold a halftime lead as they
fell to Oslo Middle School 41-31 in boys bas-
ketball action Wednesday in Okeechobee.
Osceola played very well at times but went
through too many dry spells on offense to de-
feat the talented Wildcat squad.
"I think we hung in there. We let them
press us a little bit at the end of the first half.
I think the man to man defense they played
in the third quarter was the difference in the
game," Osceola Coach Mike Wharin said.
Osceola got off to a good start behind solid
play from Sylvester Butler and Datron Smith.
They held a 5-1 lead after a nice scoop shot in
the lane by Butler and held an 8-5 lead at the
end of the first quarter.
A circus shot by Butler gave Osceola a 12-5
lead midway in the second quarter. However,
that was the high water mark for the Warriors.
Oslo took over from there and was able to pull
to within 14-12 just before the half. Smith hit a
shot to give Osceola a 16-12 lead at the half.
Oslo went on an immediate 5-0 run to start
the third quarter as they began to take control.
Eddie Neal, Christian Crews and Butler had
baskets in the third quarter to keep Osceola
close. Oslo led 24-22 after three quarters.
A 7-0 Oslo run in the fourth quarter put the
game away as the Wildcats built a 31-22 lead
and held on. Oslo made their foul shots down
the stretch to keep the lead.
Coach Wharin said as long as his team
plays good defense, they can stay in games
against talented teams. "We show stretches
of good play, that is why we've won three
times," he said. "Some times we aren't that
good on defense and we tend to lose leads.
These guys are learning some valuable les-
sons."

Grove Middle School.
Wharin said his motto is no retreat and no
surrender, even when the team falls behind,
"I think the effort is there. We have the talent.
Now the kids must work within a system. A
lot of them play street ball and the team con-
cept is hard for them to adjust to."
Wharin said his hope is the three eighth
graders on the squad, Neal, Butler and Smith,
will continue to grow and be better prepared
for high school ball.
"We may not win every game but if they
grow and are better for the freshman team
next year, that is what I'm looking for," he
added.

Brahman ready for Outback game
By Charles M. Murphy
Okeechobee News
T.J. Allen said his participation in Satur-
day's Outback Bowl All Star Game in West
Palm Beach will be a showcase for him to
prove he's capable of playing college foot-
ball.
The Brahmans' starting QB at the begin-
ning of last season turned into a solid player
in the secondary and at wide receiver during
the Brahmans winless season in 2009.
He said playing again this Saturday is
something he is really looking forward to.
"I feel good. I'm real glad I was named to
the team," he said. 'All the football players
come together at the end of the season and
most of us know each other."
Allen began practice Monday at Whisper-
ing Pines Park in Port St. Lucie. The team
includes players from the Glades and from
the Treasure Coast. One the opposite side
will be teams from Palm Beach County and
among them Allen's cousin Andre Johnson
of Suncoast.
Allen said he will enjoy competing

against the best in the area and his cousin,
"I've done real well in practice. I feel like I'm
there with most of the players."
Allen expects to see some playing time
at wide receiver and defensive back in the
game. He said the biggest adjustment for
the players has been dealing with the cold
weather.
"A lot of the guys out here are really go-
ing after it. The practices are good. It's hard
to get used to football after so much time
off, we've been away from the game for
awhile," he said.
Allen said recruiters from Cincinnati,
Florida A&M, and Arkansas have all shown
interest in him and he holds out hope he'll
be able to secure a college scholarship.
"I'm pleased to be playing. I think a lot of
people will come to the game. I hope every-
body comes out and sees me," he said.
OHS Boys soccer team on a roll
By Charles M. Murphy
Okeechobee News
The Okeechobee High School Boys Soc-
cer Team continued their mid season run
with a 4-1 victory at a cold Sebring High
School Tuesday night.
Temperatures hovered into the upper 30s
and winds whipped onto the field making
the conditions almost unbearable for the
coaches and the fans, but not the players.
Brahman Coach Lonnie Sears said once
you hit the field, the cold weather isn't a
factor, "The cold don't do anything to you
when you're on the field, you don't even
think about it. On the sidelines you do, but
not out there."
Sears said his team played in even colder
conditions last year in a regional match at
Merritt Island, so he wasn't concerned. He
did have concerns his team would be rusty
after two weeks off.
"We didn't have the rust. We did make a
mistake on defense that cost us a goal as we
didn't mark or guard one of their players and
he scored. Against good teams, you can't af-
ford to do that," he added.
Oscar Garcia, Hunter Pritchard, Ed-
die Guerrero and Diego Rodriquez all had
goals for Okeechobee, (9-4). Sears said he
is pleased that the team has several players
who can score. He noted everyone on the
squad had either a goal or an assist during
the first half of the season.
"We are starting to come together. If we
keep the momentum going into the districts,
I don't see anyone beating us, provided we
bring our best effort," he said.
Okeechobee hosted Clewiston on Thurs-
day night. The boys visit Treasure Coast next
Tuesday.
OHS girls hoops defeat Port St. Lucie
By Charles M. Murphy
Okeechobee News
Monica Koger led three players in dou-
ble figures with 15 points as Okeechobee
High School defeated Port St. Lucie, 61-41,
in girls basketball action Tuesday night.
It was a good return to the court for the
Lady Brahmans who took a few weeks off
for the holidays.
Coach Tony Sherlock said he was afraid
he would see rust in the girls first game
in nearly three weeks, but was pleasantly
surprised, "When we ran our offense we
looked really good. The girls pressed the
ball well and with no practices for awhile,
this was probably a good game for us."
Keighly Stewart had 12 points and Gra-
ciela Varela added 10 points for Okeecho-
bee. Jewel Buck grabbed 12 rebounds and
Markeisha Youmans had 10 rebounds and
six assists.
Sherlock said he is optimistic about his
team's chances in the second half of the
season, "We will work on our defense be-
cause that is our main concern. I'm hoping
we win all of our games this week, we have
the ability."
Okeechobee also will host Sebastian
River on Monday night with the varsity con-
test at 6 p.m.

No child should be forgotten
- GAL needs volunteers
Treasure Coast abused and neglected
children in your communities need Guard-
ians ad Litem. Guardians ad Litem (GALs)
focus exclusively on the child. They advo-
cate for things the law says a child is entitled
to, like a permanent home within a year.
GALs conduct an independent investigation
as to the child's current situation and make
recommendations about what is in a child's
best interests. GALs visit the children regu-
larly to understand their wishes, needs and
explain the dependency system in a way
they can understand.
The 19th Judicial Circuit Guardian ad
Litem Program representing the Treasure
Coast and Okeechobee needs volunteers
to represent Abused, Abandoned and Ne-
glected children. Commenting on her ex-
perience as a Guardian ad Litem volunteer,
Sue Werlin, states, "You look in the mirror
and know you've made a difference in the
life of a child." Pattra Dodd, Volunteer Re-
cruiter, says, "Our volunteers are ordinary
people who accomplish extraordinary
things." Training is Free and will be held
monthly beginning Jan. 5. Florida's Guard-
ian ad Litem Program is a network of pro-
fessional staff and community volunteers
who serve as advocates for neglect ed and
abused children in the court system. There
are local Guardian ad Litem programs in all
20 of Florida's judicial circuits. Guardian ad
Litem volunteers, and the attorneys working
with them, make sure victims of child abuse
and neglect are protected and have a safe
place to live and the necessary services to
overcome their circumstances. For addition-
al information, contact Pattra Farthing-Dodd
at 772-871-7225, or visit our website www.
GuardianadLitem.org.
