According to jail records
at the Glades County Jail Rod-
ney King, Lukner Blanc and
Romuald Claude are all being
held without bond. King is
charged with criminal mischief
with property damage, larceny,
burglary and high speed fleeing
and eluding a law enforcement
officer. The other two men are
charged with fleeing and elud-
ing a law enforcement officer,
vehicle theft, robbery, burglary,
larceny and criminal mischief
with property damage.

Detective Ted Van Deman of
the Okeechobee County Sher-
iff's Office (OCSO) said a 17-
year-old Loxahatchee teen was
injured when the shot was fired
into a black Jeep Cherokee in
which he was a passenger. He
said the .22 caliber bullet shat-
tered the driver's side window
and struck the teen a grazing
blow. The teen was riding in the
passenger seat.
The detective said the.vehicle
was driven by James Preston
Cole, 19, of Canal Point. Mr.
Cole, added the detective, was
injured when shards of glass
struck him in his left armr

the increase was not so signifi-
cant," she said,
"Under the new amend-
ment, you will not see the
huge property tax increases
you have seen in the past," she
said. "Because taxing authori-
ties cannot increase taxes any
more than the actual percent-
age of growth in the County,"
she said.

Migrant housing on

A migrant housing facility is on
the agenda for City of Okeechobee
Planning Board (OPB)/Board of
Adjustment and Appeals (BOA)
meeting to be held Thursday, Jan
17 at 6 p.m. in City Hall, 55 South-
east Third Avenue, Room 101.
For 720 Northwest Ninth Drive,
Application No. 08-002-SE is Rafa-
el Ayala's request to allow a spe-
cial exception to allow a residen-
tial migrant housing facility within
RMF zoning district at the south-
east corner of Northwest 9t" Drive
and Northwest 81t Street on the
south side of the railroad. Mr. Ayla
wishes to buy this property from
the current owner. There are two
existing buildings each with three
two-bedroom apartments. There
is also another building being
used as a storage shed. The apart-
ment buildings have been used
to house migrants for some time,
but have only been licensed by
the state and county this past year.
Staff is recommending denial of
this request because the current
owner of the property has not met
significant code requirements and
this facility is closer to an existing
migrant housing facility than the
250 feet the Code allows.

been operating out of this one-
story building since 2003. Now
the owner wants to add a dwell-
ing unit above the business to be
used "by the owners at their dis-


cretion." Staff is recommending
approval since nothing in the City
Comprehensive Plan prohibits it;
such use is specifically authorized
as a Special Exception in that zon-
ing district and the use is appro-
priate for the locations and poses
no adverse effects to the neigh-
borhood.-
At the northeast corner of 108
Northeast Seventh Avenue and
SR 70 along the east side of Tay-
lor Creek, David and Anita Nunez
request a variance to reduce the
front setbacks .from twenty to zero
feet and the north side setbacks
from eight to zero feet within a
CHV zoning district. Staff is recom-
mending denial of this since no
hardship has been shown and the
extent of the variance requested
was not the minimum that would
work. Staff feels that reasonable
use of the property can be made
without such a large variance.
Southeast Milk, owner of 1005
Southwest Park Street has request-
ed permission to create a five-foot
offset "visibility triangle." A "vis-
ibility triangle" is an area without
any building or other which could
block the view of the driver of a
motor vehicle attempting to (in
this case) pull out of the property
on to Southwest Park Street. Staff'
recommends denial because the
property owner added to an exist-

lem. This could be reduced. No
irrefutable justification has been
presented. Reasonable use of the
property can be made without the
variance.
Finally, the Board of County
Commissioners of Okeechobee
County is requesting to reduce
the required front setback at
304 Northwest Fourth Street
(Okeechobee County Jail and
Sherrif's Office to allow place-
ment of an emergency genera-
tor and fuel storage, to replace
the existing 20-year-old genera-
tor. The requirements of today's
generators make this kind of
location necessary. The location
of the proposed new generator
and fuel tank is along the unim-
proved Northwest Fourth Street
as it extends west toward the
ballpark from the Sheriffs facility.
It will be a 40 foot by 40 foot build-
ing. Depending on input from the
Fire Chief, staff is recommending
approval of the request to allow
as little as a zero setback for' the
storage building for the new gen-
erator and its fuel.

Brief

Glades County bans outdoor burning
The Glades County Board of County Commissioners has deter-
mined that emergency conditions exist as a result of extreme
drought and other existing weather conditions. The Board imple-
mented a burn ban, starting Jan. 8, 2008. The ban will continue
in effect, without interruption, until the Board of County Commis-
sioners appropriate. The ban suspends any and all outdoor burning
except where outdoor burning is being performed pursuant to an
outdoor burning permit issued by the Division of Forestry or pursu-
ant to other State authorization. The suspended/banned outdoor
burning includes: outdoor burning of yard waste, recreational fires,
the private use and discharge of fireworks and sparklers and the use
of any other outdoor ignition source.
Water restrictions still in effect
Residents in the Lake Okeechobee Service Area (LOSA) of the
South Florida Water Management District are reminded that Phase
III Water Restrictions remain in effect. Under Phase III, most residen-
tial water users in the LOSA are required to limit outdoor irrigation
times to one day per week and four hours per day. Residents with
odd home addresses are allowed to water between the hours of 4
a.m. and 8 a.m. EST on Saturdays, while residents with even home
addresses are allowed to water between the hours of 4 a.m. and 8
a.m. EST on Sundays. Residents may also hand-water (no sprinklers,
automated or manual) on their designated day between 5 and 7
p.m. No domestic water'use for outdoor irrigation will be allowed
Monday through Friday,
In addition, residential users.may wash their cars, boats and other
equipment from 5-7 p.m. and within the specific times and days
where irrigation is allowed. Residents also are expected to observe
normal water conservation practices within the home. The use of
water for firefighting, safety, sanitation, health, medical and other
essential purposes is not restricted. Organizers of charity car wash-
es and outdoor water-based recreational activities are required to
obtain a variance. Application forms and instructions are available
on the District website at www.sfwmd.gov. For more informa-
tion, please phone the South Florida Water Management District

Corrections
The Jan. 13 edition story headlined "Officials watch for home-
stead fraud" contained an error. The story stated, "On Tuesday, Jan.
29, voters in Florida will have the opportunity to vote on how home-
stead exemptions are assessed. They can choose to keep their cur-
rent exemption and their current Save Our 'Homes cap, or choose the
Super Homestead Exemption and give up Save Our Homes." This
statement is incorrect as the proposed change has been updated.
The proposed amendment includes Save Our Homes Portability.
The Jan. 14 edition story headlined, "Proposed tax cut a mixed
blessing" also contained an error. The story stated, "Under the pro-
posal to be voted on later this month, the first $25,000 of assessed
value would be exempt. The second $25,000 value of the home, that
portion of the value between $25,001 and $50,000, would be taxed.
Then the third $25,000 of value between $50,001 and $75,000 would
be taxed." It should have stated the' firsts $25,000 would be exempt,
tlfe second $25,000 would be taxed and the third $25,000, the portion
of the value between $50,001 and $75,000 would be exempt.

HERITAGE OR HATE: For all of those of you that fly the confeder-
ate flag, wear it on your clothes, and put the stickers on your vehicles,
and offer that it's "heritage not hate," you really need to check yourself
and your history. I'm really disappointed that a confederate license
plate is even being-considered by the state legislature. Despite the argu-
ment that the north fought for oppression and aggression (a rant listed
at http://www.southern-style.us/alesson in history.htm), the bottom
line is that the south succeeded from the Union because Lincoln was
elected and continued slavery was at risk. The southern states pushed
for the annexation of Texas to become a slave state as well as trying
to annex Cuba and several Central American countries. Adding to the
issue was the Dred Scott v. Sanford case in which Lincoln asserted
that the next Dred Scott case could hurt the north, and this caused
the abolitionist's to ramp up their efforts. Another seminal event was
John Brown's raid on the Harper Ferry Amory and these combined
events as well as others caused South Carolina announcing in its state
legislature that it was succeeding from the union, 'followed by Missis-
sippi, Florida, Alabama, Georgia, Louisiana, and Texas. Thht's the real
history, backed by both Union and Confederate archives. There has
been enough of the argument that your ancestor's didn't own slaves.
I assure you; if your ancestors identified themselves as "rebels," you
can count on them supporting the Jim Crow laws that were just as
influential in continuing the rampant racism that existed in the south.
The confederacy was created out of a need to continue slavery and
free labor on.the plantation. The confederate flag is a continued identi-
'fication with the atrocities that occurred. Trust me, freedom of speech
is an important American right, but to continue to claim that this is not
an offensive symbol is ridiculous. I guess that we should fly the Nazi
flag since Hitler did some good things in Germany too.
SANITATION WORKERS: This morning as I lay in the comfort of
my bed and I heard you working in the cold and dark, God laid it on
my heart as to what a witness for Jesus you all are by doing what you
do. Like Jesus you make our world a better place to live. On recycle
days, like Jesus, you take the used and discarded and enable it to be-
come new and needed. On garbage trash days, your work is like that
of Jesus' second coming to cleanse the earth. You collect, remove and
send the bad and un-recyclable to be destroyed by fire. What most
people consider a lowly and un-desirable profession turns out to be
.very much like Jesus' life when here on earth and in His second com-
ing. Thank you for doing what you do, and know God honors your
,work and is well pleased in your reflection of his son.
ABSENTEE BALLOTS: They are talking on TV about Florida's ab-
sentee balloting picking up, how about the 2000 election where they
didn't count the ballots because the election was too close to call. Are
you going to count the absentee ballots this year?
RUDE: I would like to speak out about the rude customers who
won't even try to put the buggies where they belong, and also the driv-
ers who are in such a big hurry they won't give anyone the chance to
back out who is trying to back out.
NEW AMENDMENT: I don't understand with this new tax amend-
ment, what it means When they talk about when you move, you can
take the value up to 500,000. If I got'a house appraised at $75,000 and
moved into a house appraised at $200,000 I don't know what that
means, but they don't mean that I am going to pay tax on the $75,000
surely. And they don't say that I can take .$75,000 more off my tax.
What in the world does that mean? They never explain it, can you
please?
Editor's note: A recent commentary by Sarasota County Property
Appraiser Jim Toradora explained it this way: Currently, a property
- receiving the Homestead Exemption has its annual Assessed Value
increases limited to no more than 3 percent or the change in the'
Consumer Price Index, whichever is less. Any interruption in the ex-
emption, such as the property being sold, results in a reassessment
to the property's current Market Value. The difference between the
homestead property's Assessed Value and its Market Value is referred
to as a Cap. The proposed law would permit the owner to relinquish
the homestead on one property and within 2 years move, or port,
the Cap to a newly established homestead property. The maximum
amount that could be ported is $500,000. If downsizing to a home
of lower market value the ratio of Assessed Value to Market Value
would remain the same as the ratio from the previous residence. In
no event would portability permit a property to become completely
tax exempt. For example if the owners have a homestead property
with a Market Value of $300,000 and an Assessed Value of $200,000
the Cap would be $100,000 ($300,000 $200,000). If the owner upside
to a property with a Market Value of say $450,000 and establish a
new homestead, the Assessed Value of this property would be re-
duced to $350,000 ($450,000- $100,000).
GET IN THE NOW: Jan. 14, 2008, I1 am listening to the news to-
night on the different candidates, stop bragging about the past presi-
dents. Wake up! It isn't the color or the past president, which they all
did good in someway; however, it is the NOW, THE NOW! What are
they going to do for the people? This is about the presidential elec-
tion.
HOMESTEAD AMENDMENT: The more I read about the Home-
stead increase proposal, the more I think it is a really bad idea.'It is
a plant to' benefit the wealthy at the cost of services to the public.
Maybe they can afford to live in gated communities with their own
security'forces, but most of us need the local fire departments, police
and EMTs. This amendment will cut property taxes and because of
that will cut funding for services that are vital to the community. The
rich never want to pay their own way. That is how they stay rich.

It's time for mental health parity

For the most part, we live
in a time of medical openness
and acceptance. Katie Couric
can broadcast her colonoscopy
live and celebrities are more
forthcoming than ever about
struggles with cancer, heart
disease and even acne.
The same cannot be. said,
however, about those with a
mental illness. Mental health
issues are not handled in the same
manner-which is understandable
to a point, given many people's
lack of understanding of the
subject.
What is not understandable
- or acceptable is why health
insurers continue to' treat mental
illness differently than physical
illness. For an industry that fully
understands the subject and the
dangers of withholding treatment,
there is no excuse.
Even after all we have learned
about the nature of mental
illness, the devastating financial
and societal cost of ignoring
those who suffer and the amazing
results of proper treatments, it
often remains a struggle to receive
timely and effective care.
The biggest reason? In addition
to the stigma that remains for
some, health insurers discourage
or limit access to mental health
services because they can. Today,
as many as 90 percent of Floridians
with private health insurance
coverage are enrolled in plans


with mental health coverages that
are less than those provided for
physical illnesses.
During the 2007 legislative
session, an attempt was made
to level the playing field as Rep.
Ed Homan and Sen. Dennis
Jones introduced mental health
parity legislation that would have
required employers, commercial
health insurers and health plans
which provide mental health
coverage to ensure that it is no less
restrictive than their coverages for
physical illnesses.
In short, parity prohibits
insurers or health care plans from
discriminating between coverage
offered for mental illness and often
substance abuse from coverage
offered for physical illnesses and
diseases. Under parity, they are
required to use the same visit
limits, deductibles, co-payments,
and annual., and lifetime dollar
benefit limits.
If asked, most people would
probably have assumed such a
lawalready existed. Unfortunately,
such is not the case at least not
one that helps everyone. In 1996,
the federal Mental Health Parity
Act was signed into law, but it
only applies to companies with
50 or .more 'employees, and it
does not prohibit offering mental
health patients fewer services and
requiring higher out-of-pocket
costs.
As a result of this considerable
loophole, 46 states have stepped


up and passed some form of
parity legislation, including Ohio
and New York just last year.
Florida, however, still lack's such
a law.
Those who believe that this
issue, while sounding unfair, does
not directly affect them or many
people they know, are mistaken.
According to the National
Institute of Mental Health, about
one in four adults suffer from
a diagnosable mental disorder
in a given year. And the burden
of. mental illness on health and
productivity in the United States
has long been understated,
with mental disorders being the
leading cause of disability in the
U.S. for individuals aged 15-44.
A surprising 25 percent of all
disability is attributable to mental
illnesses.
The annual economic cost
of mental illness in the U.S. is
estimated at over $275 billion
in lost employment and wages,
reduced productivity, health
care, social welfare, and criminal
justice costs.
That is quite a price to pay in
place of treating mental illness as
any other medical condition.
As our current system
continues to discriminate against
reimbursement for treatment and
discourages those in need from
seeking care, fewer are receiving
it. Incredibly, the percentage of
health insurance premiums spent
on mental health care is actually


declining. And it certainly is not
because fewer people need it.
Ironically, this is occurring
at a time when employers and,
employer groups are increasingly
recognizing the importance of a
mentally healthy workforce..And
many are coming to the realization
that mental health coverages,
represent an investment in their
employees, promote worker
productivity and are essential to
business growth and a company's
bottom line.
It is time for Floridians to
demand a change in the way
coverage for' mental illness is
handled by our insurers. Those
suffering from mental illness
deserve as much help as those
suffering from physical illness,
and discriminating against those
with mental illness .by denying
treatment simply leads to more
illness and high economic and
non-economic costs.
And that is a price we should
no longer have to pay. It is time to
demand parity for mental health
coverages.

Lawsuits
Three such lawsuits were filed
in Okeechobee Circuit Court in
late December. All named the
Phillip Morris Company and the
R.J Reynolds Tobacco Company.
The City of Okeechobee was
named in a civil lawsuit filed by
a local man who suffered several
broken vertebra in his back in an
automobile accident some 15
months ago. Attorneys for Dale
Proudfoot said a fallen or re-
moved stop sign contributed to
the accident on Oct.14, 2006. He
was a passenger in the vehicle
that apparently ran through the


intersection at N.W. 11"' Avenue
and Seventh Court, and collided
with a tractor-trailer. The lawsuit
claims the city was negligent be-
cause it failed to maintain the
stop sign, failed to inspect it and
didn't warn the community that
a dangerous situation existed
there. The lawsuit seeks dam-
ages for pain and suffering, loss
of earnings and other claims.
Two local businesses filed
litigations against Okeechobee
County Property Appraiser Bill
Sherman in the past month
which contests their property tax
assessments for 2007.
Embarq, Florida, Incorporat-
ed contested their assessments
on three properties that are basi-
cally metallic fiber cable, analog,
digital circuits and switch equip-
ment. Embarq was formerly
known as Sprint Telephone.
They have filed several similar
court challenges in recent years.
This year's assessments were set
at nearly $29.53 million.
The second litigation came
from the owner of the Twin Oaks
Pet Cemetery, Thomas Nicholl.
He argued the assessment is ar-
bitrary and capricious. The as-
sessment was $323,942.

Sentencings
Rigoberto Rigo Trujillo, 25,
was adjudicated guilty of sale of
cocaine and possession with the
intent to sell cocaine and was
sentenced to 30 months in prison


on Dec. 18. Trujillo was arrested
on Nov. 27, 2006, after a routine
traffic stop on U.S. 441 north near
N.W. 36th Street.
Prosecutors decided to drop
charges against Cassie Griffin
that included attempted murder,
kidnapping, and aggravated as-
sault. She was a co defendant
with James Owsley, 24, who was
arrested on Jan. 27, 2006, for al-
legedly beating up his stepfather,
pistol whipping him and shoot-
ing at him at more than one oc-
casion. Griffin pleaded no contest
to a charge of criminal mischief
and was sentenced to one year
probation on Dec. 18. Owsley's
case remains in the local court
system.
An Okeechobee man, Richard
Roth, 37, received 10 years in state
prison and 15 years of probation
after he pleaded no contest to
charges that include burglary to
a dwelling or structure with over
$1,000 in property damage. Roth
had originally faced as many as
eight felony counts.
Another local man, Eric Apon-
te, 21, received three years in
state prison after he pleaded no
contest to charges of contribut-
ing to the delinquency of a minor
and lewd and lascivious battery.
Prosecutors dropped a charge of
sexual battery upon the, physical-
ly helpless in the plea deal.

uty. Okeechobee County Sheriff's
Office Detective Sergeant Edwin
Dana reported the hunting camp
was set on fire during the thefts.
A 28-year-old Okeechobee
man, Mario Jaimes, received 14
years in state prison for a charge
of escape when he appeared in
court on Dec. 26. He was found
guilty at a jury trial in late October.


Jaimes had pleaded no contest to
a gun charge and had received 14
years in prison. However, a few
days later while taking out trash
at the county jail he reportedly
made an attempt to escape. He
did not escape the city limits.
Jaimes had earlier convictions
for aggravated battery upon a
pregnant person and was con-
victed in April 2006 of possession
of a firearm by a convicted felon.

OMS girls make it a clean sweep

ries from Yearling despite a par-
tisan home crowd for the Lady

It was a tight defensive battle
throughout and neither team had
a player in double figures.

Assistant Coach Kerri Brantly
said, "We both had some trouble
tonight but both teams managed
to score anyway. We sure wanted

Brantly was standing in for
Head Coach Cathy Jones who
had lost her voice. She still had
enough to encourage her girls
down the stretch.
"It was fun," point guard Ste-
vie Brantley noted, "Yearling, I.
knew they'd bring their A game
because we beat them last time."
Brantley hit her first shot of
the night but didn't score again.
Still she did enough, with tough
defense and ball handling, two
assists and three steals, to propel
her team to victory.
Osceola improved to (6-3)
while Yearling fell to (3-6).

However it was Williams who
made the difference down the
stretch. She hit a breakaway lay
up and a 16 foot jumper to give
Osceola a six point lead.
Coach Bandi said her team just.
couldn't get-the ball rn the basket
down the stretch. "The girls didn't
lose their c6ol. They kept going
for it. I like the way they played."
Brantley, who has played three
years for Osceola, noted this year
there is something different about
the team. In previous years they
might have folded under the pres-
sure, but not this year. "It's a lot
better than the previous years.
I think we have- a really good
team."
Osceola will host Oslo on
Thursday. Yearling travels to Gif-
ford.

Brahman cross country star
Bryan Suarez gave a verbal
commitment to the University of.
South Florida earlier this month
according to Cross Country Coach
NathanOwen.Suarezcanofficially
sign a national letter of intent
starting on the first Wednesday in
February.
Suarez has been among the.
top five runners in cross country at
the 4A level in Florida for the past
three years.
Practices will begin this week'
at Okeechobee High School for
varsity baseball. Girl's softball is a
week ahead of the boys. Coaches
forbothsquadsareoptimisticabout,
the upcoming seasons.
One of the most improved
playersonthevarsitybaseballsquad
figures to be Brice Buckner. The
sophomore has played year round
baseball and has traveled to several
states in an effort' to improve his
game in the past year. He emerged
as the Brahman closer late last
year.
Buckner tossed a one hitter in a
tournament championship game
this sunimer and also played with
a team in Fort Myers that included
several pro and college prospects.
He also increased the velocity on
his fastball by about three miles
per hour.
A new addition to boy's
basketball games this year has
been the pep band under the
direction of Clint LaFlam. The
band performs during time outs
and during halftime. LaFlam said
he is very pleased with the kids
who have joined the.pep band this
year. He even had high school band
members perform at the Yearling
vs. Osceola basketball game in
December.
The Okeechobee High School
band even has a bass guitarist and
a drummer, Ethan TUrbeville, a
senioratOHS. Henotedhehasbeen
a drummer for a long time and that
he got his inspiration for music from
his father, Michael. "I like it. It takes
up a big part of my time. All I like
to do is play drums."
Turbeville said he intends to
pursue a music career and a music
scholarship for college. He would
like to be a band.teacher when he
graduates from college.

Yearling boys handle Warriors again

Yearling used their entire bench
and easily defeated Osceola, 42-
14 in boy's hoops action Monday
afternoon at the Yearling gym.
Yearling coach Kevin Jackson
called off the dogs early as he
used pressure defense in the first
quarter and then rested most of
his starters for the remainder of
the game.
"It was a game where ev-
erybody could get in and get a
chance to show what they can do.
It was good for the entire team,"
Jackson said.
Osceola Coach Marshal Schla-
bach appreciated the gesture from
Jackson not to pressure the ball.
He noted that helped his team at
least work on some things in their
half court offense. "He is a Class
A act, they were trying to improve
and work on things, just like us."
Jackson said he knows how
frustrating it can be for a team
when they can't get the ball up
the court. He noted his team is
in fourth place in the conference,
now and have a chance to make
some noise at the conference
tournament next month.
Steven Geary had 11 points
off the bench for Yearling. He hit
three long jumpers and showed
nice range on his jump shot. Phil-
lip Jones scored eight points, all
in the first quarter for Yearling.
Carlington Jackson had 11 points;
15 rebounds, and three steals for
Osceola, (0-9).
The big man, already over 6'
and 200 pounds, said he is com-
mitted to playing basketball full
time and that bodes well for the
high school over the next four
years.
"We try hard to win. We had
open shots but they wouldn't fall
for us tonight. Next time we'll try
to do better," Jackson stated.
Yearling led 6-0 in the early
going thanks to their pressure
defense at half court. Jones, and
Richard Donegan and others
crowded the passing lanes and
forced several Warrior turnovers.
That turned into several easy
shots and a 14-4 Yearling lead af-
ter the first six minutes.
Jackson went to the bench and

mates some good shots but they
weren't falling. I was more ag-
gressive with my shots and some
of them fell," Jackson noted.
Coach Schlabach likes what
he sees in his big man. He would
like to see his guards continue
to improve, "It's going to come
down to their decisions and their
ball handling. I thought we had
some good looks tonight. The
ball was all around the rim. We
just couldn't get the ball through
the-rim."
Yearling also got six points,
three assists and three steals
from Richard Donegan, and Tim
Hirst added four points. Hunter,
Pritchard had two assists, two
steals .and two,. rebounds,, for
Osceola. John Watts had two
steals and two rebounds off the
bench for the Warriors.
Spivey said Yearling did learn
one lesson from this ganie, don't
take anything for granted. "It
wasn't that easy to win like we
thought it was. We-were goofing
around in the locker room and
thought we'd just come out and
beat them. It didn't work out that

tourney season
BASS BUSTERS 2008 kicks off
in Clewiston, for their 18th year
of holding tournaments every
month on Lake Okeechobee on
Jan. 19 and 20, with the Silver and
Gold Divisions.
The Silver Division will be held
on Saturday Jan. 19, with a team
entry fee of only $60 and includes
the Big Bass Jackpot.
The Gold Division will be held
on Sunday Jan. 20, with a team
