Citizens from the southwest
section of town gathered at
Oakview Baptist Church on
Thursday, Jan. 11, to discuss
their opposition to a proposed
housing development on 30.02
acres in the southwest section
of the city between Southwest
Sixth and Second Streets.
The development is being
proposed by Royal Concrete
Construction. The company
currently has a concrete con-
struction facility in West Palm
Beach but is planning on put-
ting another facility in Okee-
chobee. The proposed develop-

ment is aimed at providing
affordable housing for employ-
ees of the plant.
Royal Concrete anticipates
bringing approximately 300
workers from its West Palm-
Beach plant to Okeechobee,
then hiring an estimated 1,500
more employees from the Okee-
chobee area.
According to prior planning-
board and City council meetings
the developer, Royal Professional
Builders (Royal Concrete Con-
struction), is planning to create a
development consisting of three
phases with a total of 168 units.
Eric Engstrom, the chief finan-
cial officer for Royal Professional

Builders, said the development
would be completed in three
phases.
According to a site plan by
Royal Architecture and Design,
Inc. dated July, 27, 2006, entitled
the "Okeechobee work force
housing site plan" there are 40
two-story single family units, 54
one-story single family units and
74 townhouses proposed to be
built.
Keith Walpole and Al Hug-
gins, citizens of the southwest
section of the city, have retained
Thomas J. Baird, P.A., to repre-
sent them by filing a petition to

Hunting is and was good

By MaryAnn Morris
There is still enough open
land around Lake Okeechobee
to have good hunting. And it
looks as if that won't be chang-
ing any time soon. Where the
early settlers hunted to live,
people today hunt for sport or
to enjoy the taste of game
meats. Today, there are "hunt-
ing buggies" yesterday, there
were "hunting buggies." Yes-
terdays were a bit different,
though. Few people who drive
past the Okeechobee County
Courthouse with the new Judi-
cial Center know that people
used to hunt there as recently
as 1920.
Jesse Motes, now 84 years
old, born in Belle Glade in
1922, remembers the hunting
there:
"My father earned a living
trapping and farming in Flori-
da. Back then, nothing was
drained and the only farming
was close in to town, you see,

pioneers and history

not way out like now. That's
why trapping was so good. The
saw grass was full of game.
There was a good market for
raccoon pelts. When the price
was good we could get $3 to $4
apiece for them. We used to get
bobcats too. There were a lot
of them back then.
"When you were out in the
Glades on foot trapping, in the
dry weather, you had to watch
for the big cracks. The black
dirt would dry up and shrink
and make cracks big enough

that you could go almost up to
your knee inside the crack if
you weren't careful.
Up north of Basinger on the
Kissimmee Prairie or "Viking"
as it is also called, people have
hunted as long as people have
lived here. The late Thelma
Walker, who was 87 years old
when Twila Valentine inter-
viewed her for the Okeechobee
News in 1989, remembered her
husband, John Henry Walker,
Jr., going out on hunting par-
ties:
"A crowd of men used to get
together and go our in the
woods and camp and deer
hunt. There was Don and Carl
Walker and Hardy Walker and
Jinx Linden. I can't remember
all of them. They went our and
they would get a cook to go
with them and do the cooking
so they could hunt. They killed
a lot of deer up there on the

Attorney Thomas Baird, P.A., is representing Keith Walpole OKeechobee News/Chauna Agullar
and Al Huggins in a petition to reverse the decision made by Citizens gathered at Oakview Baptist Church to hear infor-
the Okeechobee City Council on Tuesday, Nov. 7, 2006 that mation about the status of a petition filed concerning the
changed the future land use from single family to multi-fam- Royal Professional Builders (Royal Concrete Construc-
ily and PUD for a 20-acre parcel in the southwest section of tion) development proposed for the southwest section of

the city.

the Department of Community
Affairs (DCA) to revoke the com-
prehensive plan map amendment
that changed the future land use
designation from single family to
multi-family for the two 9.89
parcels of land located between
Southwest Sixth and Second
Streets.
The third 10.24-acre parcel of
land had been previously
approved by the city council to be
changed to multi-family approxi-
mately a year ago for a different
developer who sold the land to
Royal Professional Builders.
Mr. Baird said Thursday that
the prime objectives for the citi-
zens who are opposed to this
change in land use are: traffic
concurrency; sufficient water and
sewer supply; school concurren-
cy; and, compatibility with the
character of the community.
He told the citizens attending
that they should "in no uncertain
terms, let your council members
know that you are against this."
He also went on to say they "...
are to be respectful, non-argu-
mentative and speak in a normal
tone of voice."
Mr. Baird also told the citizens
that ".. we are not dealing with
any other issue other than density.
You may disagree with other
issues within your own home, but
we are dealing with the legal
issues."
These other issues alluded to
were most likely derived from the
Tuesday, Nov. 7, city council
meeting where Elizabeth Maxwell
stated: "I have heard Mr. Sanger
(owner of Royal Concrete) say at
the Kiwanis meetings that the
bulk of their laborers are
Guatemalan laborers. I don't
know if you have been to
Indiantown lately, but he is right
about the side walk, it is going to
need to go straight up to that thing
(el Amigo de todos) which trans-
lates to friends to everyone or

everyone's friends.. That site
where they are building their
plant is over by the livestock mar-
ket. It is also by Playland Park,
which would be a perfect site for
them to put this housing in, not in
the middle of our city in the
southwest section."
"This isn't a normal developer
that is coming in here to establish
affordable housing for our com-
munity; he is here to establish
housing for his workers," said Mr.
Walpole at the Nov. 7 council
meeting. "(City Police) Chief
(Denny) Davis needs to think of
the type of labor that is coming in
here and how they will get along
with the community."
Mr. Huggins also spoke at the
Nov. 7 meeting and said that "...
multi-family housing can never
have the character of a single fam-
ily neighborhood."
According to Ken Treadwell,
general counsel for Royal Profes-
sional Builders, they have
retained the counsel of John Jor-
gensen, P.A., in response to the
petition by Mr. Walpole and Mr.
Huggins.
The action that is being peti-
tioned is that of the city Planning
Board/Board of Adjustment and
Appeals who passed the rezoning
unanimously on Oct. 19.
According to the minutes,
board member Devin Maxwell,
the husband of Elizabeth
Maxwell, voted in favor of this
action.
Mr. Maxwell later stated that he
feels the minutes reflecting his
yea vote are inaccurate because
he was approximately seven min-
utes late for the meeting and did
not think that he was an active
voter.
But Betty Clements, City Gen-
eral Services coordinator, said in a
telephone interview that "The dis-
cussion on the land use change
was heard by Mr. Maxwell, as he
was only seven minutes late."
When Mr. Maxwell came into
the chambers, the alternate got
up out of Mr. Maxwell's seat and
returned to the alternate position

the city.
to allow Mr. Maxwell to take his
proper position on the board.
Mr. Maxwell did not say
whether he would have voted
against or for the future land use
change.
"I think that a lot of times these
decisions that have impact over
many, many years are made with-
in a few minutes. I know a lot
about the whole project now," he
said Friday, Jan. 12, in a telephone
interview.
Mr. Treadwell said Royal Pro-
fessional Builders has always stat-
ed that they are willing to do
whatever they have to do as far as
concurrency, and for the better-
ment of the community. They
have been actively involved in the
Okeechobee Utility Authority
(OUA) meetings concerning the
wastewater treatment plant and
have committed and signed an
agreement with them to reserve
capacity in that plant.
According to Mr. Treadwell,
they have made an initial pay-
ment of approximately $38,000,
and have a schedule of payments
that will end up totaling about
$380,000.
"It is under my impression that
Okeechobee County School sys-
tem has not completed the
requirements of their school con-
currency plan, but we are fully
willing to comply with all of the
needs that extend from this devel-
opment including impact fees,"
he continued.
Mr. Treadwell also spoke on
traffic concurrency as a traffic
study had been commissioned
before the city council meeting on
Nov. 7. According to Mr. Tread-
well, the traffic study was com-
pleted and, to his knowledge, the
only issues were the normal
issues with the main. intersections
in town..
Engineer Jeff Sumner of the
engineering firm LBFH Inc. did
not return phone calls prior to
newspaper deadline for more
specific information.
Mr. Baird said Thursday they
were going to attempt a media-

tion process before having a hear-
ing which would not occur until
mid-April.
"His company is definitely
always willing to talk to try to
resolve issues," said Mr. Baird.
He went on to add, however,
that he had not received that call
for mediation as of Jan. 11.
Other questions by the citizens
at the town meeting were raised
concerning tax issues and the tax
base of the homes within the
development.
According to the Okeechobee
County Property Appraiser's
office property taxes are accessed
by using the property value and
multiplying it by the current mill-
age rate. A trailer valued at the
same value as a house would pay
the same amount of taxes.
For example, any land -
including all improvements -
that is valued at 100,000 would be
taxed the same amount of prop-
erty taxes.
These concrete module town-
houses and homes are not vehi-
cles and will be required to pay
the normal taxes for a home.
According to the city council
agenda for Tuesday, Jan. 16, the
Royal Professional Builders failed
to meet the deadline to be consid-
ered at the January Technical
Review Committee (TRC) meet-
ing. Therefore, the ordinance will
not go before the council at their
Tuesday, Feb. 6, meeting.
A Plan Unit Development
(PUD) zoning requires the TRC to
approve the conceptual site plan
prior to final adoption of the
rezoning of the property.
At their next meeting the coun-
cil will vote to rescind the previ-
ous action from the Nov. 7, 2006,
meeting to change the public
hearing date to Feb. 6, 2007, to
give sufficient time for the TRC
meeting as required by code book
section 90-401.

Note: the paved road that runs

Preserve State Park is the old

People still hunt up on "The
Prairie" in Viking and in the
marshes around Belle Glade,
Clewiston and Moore Haven,

but with modern guns, air boats
and hunting buggies. South
Florida Water Management Dis-
trict, when it sets aside land for
collecting water, filtering water
or such, usually opens it to the
public for various kinds of hunt-
ing. More and more land is
being set aside and opened all
the time, so the tradition of
hunting in the 'Glades and on
the Prairie, it seems will contin-
ue. At least one pioneer tradi-
tion won't be bulldozed under.

George May and his daughter Bev-
erly May. She went on to play at
Osceola Middle School for three
years before taking her talent to the
high school level.
"I've always loved volleyball. I
set a goal and dreamed that I could
be good enough to continue to
play volleyball in college," said Ms.
Brown. "I knew a long time ago
that volleyball could help pay for
my college education."
"It's fitting that she receives this
scholarship," said coach May.
"Between club and high school
volleyball, she's already used to
playing a fast-paced style of volley-
ball. I'm extremely proud of her
accomplishments."

Ms. Brown, indeed, has accom-
plished quite a deal in her high
school career. In addition to being
an honor roll student with a 3.0
grade point average, she holds
many school records. In 2006, she
had 55 match assists in a game
against Glades Day. She had 653
season assists, 248 career aces (a
school record), 692 career service
points (a school record) and 1,400
career assists (a school record).
Ms. Brown's advice for younger
players is "Do your 100 percent
best in everything you do. It will
pay off in the end and get you
where you want to be."
Ms. Brown's mother, Patricia
Garcia, said her daughter has
worked very hard to reach her
goals.
"I'm so proud of Shaunaye.
She's worked so hard all these

years. And she's done it she has
achieved her goal to play college
volleyball," said Ms. Garcia.
Her new coaches at PCC were
impressed with Ms. Brown's dedi-
cation.
"She is really dedicated," said
PCC coach Jason Lynch. "It's in her
heart. She has been willing to give
her best effort even before she was
signed by our school."
Fellow PCC coach Amanda
Wommack said "She has determi-
nation and a willingness to learn.
She listens to what she is told."
OHS principal Toni Wiersma,
who was also at the signing cere-
mony, also had high praise for Ms.
Brown.
"Shaunaye is a wonderful
young lady. We at Okeechobee
High School are proud of her
achievements and I know that she

will continue to do her best at
Polk," said Ms. Wiersma.
Ms. Brown has joined the elite
club of OHS volleyball players who
have gone on to play in college.

Your fish can clean its own tank

COLLEGE STATION If that
slimy fish tank you have needs a
good scrubbing, think twice before
you get out the brushes and the Mr.
Clean. It's best not to try any house-
hold slime-stoppers in fact, it may
be best to let your fish do all the
work.
What we might call slime is
actually mucous secreted from the
fish in order to create a pleasing
environment and combat high
alkaline pH levels in tap water. Most
fish work on a cleaning cycle that
lasts about two to three weeks,
says Dr. Donald Lewis, professor in
the Department of Pathobiology at
the College of Veterinary Medicine
& Biomedical Sciences at Texas
A&M University.
The cycle begins when fish are
first introduced into a new aquari-
um. Most owners purchase a tank
and fish at the same time, placing
fish into the water as soon as the
tank is filled. This instant plunge
causes the fish to secrete mucous
as a way of protecting itself from
the high level of ammonia found in
tap water resulting from the break-
down of organic matter, Lewis
said.
The mucous secretion is a pop-
ulation of bacteria, and the first step
a fish takes to deal with the excess
ammonia. The bacteria that are
produced from the mucous con-
vert the ammonia to nitrites, which
in turn covert the nitrites to nitrates.
By the end of the cycle, all three
compounds exist and balance out
the system. Plants can also be used
to help stabilize the environment
by- absorbing the ammonia,
nitrites, and nitrates from the water.
The cycle begins again when
the current system is disturbed by:
fish excrements, excess food rest-
ing on the aquarium floor, adverse
environmental conditions, or para-
sites, Lewis said.

Instead of spending so much
time cleaning out your fish tank, or
buying new fish, Lewis suggests
some preliminary techniques:
Install an underwater gravel
filter. It is driven by the air filtration
system and functions as a water
cycle to prevent the water from lay-
ering when debris and mucous
arise.
Place gravel, rocks, and acces-
sories into the aquarium or tank
Pour the water into the tank.
Wait at least two to three
weeks before introducing the fish
to tap water. Unless the fish you
purchase is very resilient.
Consider placing plants, oys-
ters, or seashells in the aquarium.
Plants are very beneficial in
absorbing the excess ammonia
and nitrates present and oysters
and seashells can act as a buffer
keeping the water only slightly
alkaline.
One thing to remember is that
the amount of slime produced is
always dependent on the type of
fish and environmental conditions.
For instance, most tropical fish orig-
inating in South America prefer
slightly acidic water and are very
sensitive to high ammonia levels,
while others like cichlids prefer
slightly basic water and can tolerate
ammonia.
All fish have their own unique
pH preference and even the most
properly maintained aquariums
have a little mucous sitting on the
surface, Lewis adds. The next time
you see the characteristic mucous
and feel the slick surface of your
tank, it might be your fish just doing
a little tidying up.

Fairways and
Highways
by Daniel Shube
My annual trek to the PGA Mer-
chandise Show is coming up later
this month. Having made this trip
for a dozen years, finding what
products are going to answer your
(and my) prayers out on the course
is always a challenge.
Will the best in show be a new
driver that will add 20 yards (prefer-
ably in the fairway, not further out-
of-bounds)? Or perhaps a hybrid
that is much easier to hit than a 1-
iron?
In years gone by, I've sought out
solutions to my yip;, I 'still have'
them.
I provided my colleague James
with the idea of playing our tradi-
tional Sunday match following the
show wearing and playing with
only the samples received at the
show. He ended up playing in a
rain suit (on a sunny day)!
It is always fun to see the latest
technology for accessories, like the
machine that showed me how
badly the sun has damaged my
sun. That was almost more
depressing than my yips.
The winner for the most unique
product found at the show still has
to be the cow bed. What is a cow
bed doing at a golf show? Good
question. It-was made from a floor-
ing material being peddled to club-
houses. I've often wondered what
number the cow sets his bed to?
So, I'll try on some new hats. Hit
dozens of drivers. Attempt to win a
prize sinking putts with the latest
putter designs (I won' win). And
realize I still can't hit a blade iron.
I won't count the dimples on
the latest golf ball design either.
Even though I'm sure it will fly fur-
ther, straighter and land softer.
I do like the new colors that
balls come in these days. However,
have you ever tried to find a green
golf ball?
The fashion show is always a
high point. I never do see women
playing that look quite as good as
the models.
Speaking of models, one of my

Another tough work day for
Show!
favorite pastimes at the show has
been to have my picture taken with
the models. I must be a better
salesman than I thought. I'm not
buying their product. I'm not going
to win the Honda Classic. And they
still let me take a photo with them.

me at the PGA Merchandise

Going to the show might be one
of the few guilty pleasures a golfer
can indulge in that is not on the
course. Tough job!
Stay tuned and I'll fill you in on
what's hot and what's not in the"
coming weeks!

Bronson touts alternative fuels

TALLAHASSEE Florida has
the capability of producing more
alternative fuels than anywhere
else in the country, Florida Agricul-
ture and Consumer Services Com-
missioner Charles H. Bronson told
state legislators.
Appearing before a joint meet-
ing of the House Agribusiness and
House Energy Committees, Bron-
son said the state's abundant sun-
shine, ample rainfall and year-
round growing season puts Florida
ahead of every state in the country
in its potential to produce ethanol
and bio-diesel crops.
"You today are in a position of
putting Florida ahead of the pack,"
Bronson said. "It will be a Florida
that looks much different than it
does today."
What are needed are tax incen-
tives or some form of financial
assistance that the state can pro-
vide to encourage growers to pro-

duce alternative energy crops and
processors to locate facilities in
Florida to convert the crops to fuel,
Bronson said.
Bronson is a member of the
steering committee of "25x25" -
a national bipartisan organization
whose goal is to see U.S. agricul-
ture produce 25 percent of the
nation's energy needs by the year
2025. He has launched the state's
"Farm to Fuel" program, which
encompasses efforts under way in
Florida to see that goal realized.
In his presentation to legislators
today, Bronson pointed out that if
the "Farm to Fuel" initiative is suc-
cessful in Florida, it would not only
lessen the state and nation's
dependency on foreign oil but
would keep green space in Florida
by giving farmers yet another crop
to produce and a way to make a
profit.
In recent years, urban

encroachment on rural areas has
triggered large losses of farm land
and in the process contributed to
congestion and the lack of green or
open space.
"If you want to keep green
space in Florida without the state
having to buy every single acre and
taking it off the tax rolls, give farm-
ers another crop to make a profit
on," Bronson said.
The Commissioner told legisla-
tors that unlike the Midwest, where
corn is the primary alternative ener-
gy crop, research done at the Uni-
versity of Florida has concluded that
by using certain bacteria, virtually
any type of bio-mass can be broken
down to fuel. That would include
wood, forestry debris, plant stalks
and even livestock waste in addi-
tion to conventional crops.
"The opportunities in Florida
are going to shock you," Bronson
said.

IRS to start processing extender claims Feb. 3

WASHINGTON The Inter-
nal Revenue Service plans a Feb.
3 start date for processing tax
returns that claim key tax provi-
sions enacted in December.
The IRS announced today
that it will begin processing both
e-file and paper tax returns on
Feb. 3 that include claims for the
major "extender" provisions,
including deductions for state
and local sales taxes, higher
education tuition and fees, and
educator expenses. Any other
tax returns for individuals that
do not claim the extender provi-
sion can be filed as normal this
month.
The Feb. 3 date allows the IRS
enough time to update its sys-
tems to accommodate the tax
law changes without disrupting
other operations tied to the tax
filing season.
"The vast majority of taxpay-
ers will not be affected by these
changes, and they will not notice
any difference as they start filing
tax returns this month," IRS
Commissioner Mark W. Everson
said. "The IRS urges people
claiming the extender deduc-
tions to file electronically to
reduce the chance of making an
error."
Based on filings last year,
about 930,000 tax returns
claimed any of the three main
extender provisions by Feb. 1.
Overall, the IRS expects to
process about 136 million indi-
vidual tax returns this year.
The IRS is taking a number of
steps to help taxpayers get the
information they need to take

advantage of the extended
deductions and tax law provi-
sions enacted after IRS forms
went to print.
Taxpayers can visit IRS.gov
for updated information on the
late legislation. Publication 600,
State and Local General Sales
Tax, is posted on IRS.gov. This
month, the IRS is also conduct-
ing a special mailing of Publica-
tion 600, which will include the
state and local sales, tax tables
and instructions for claiming the
sales tax deduction on Schedule
A (Form 1040), to 6 million tax-
payers who have received the
2006 Form 1040 package in the
mail.
The IRS reminded taxpayers
that both paper and electronic
returns will not be processed if
submitted before Feb. 3. Tax
returns filed on paper will be
accepted but will not be
processed until after IRS pro-
cessing systems are updated on
Feb.3.
The IRS emphasized that
using IRS e-file is the most accu-
rate to file any return and the
quickest way for taxpayers to
receive their refunds. Tax soft-
ware will be updated so taxpay-
ers can easily claim the extender
provisions.
"As we always do, we encour-
age taxpayers who think they
may claim these deductions to
file electronically," Everson said.
"They will get their refunds
faster through e-file. Even more
importantly, e-file will greatly
reduce the chances for making
an error compared to claiming

the deductions on the paper
1040."
For people using a paper
1040, several special steps must
be taken. Taxpayers must use
existing lines on the current
Form 1040 and other tax docu-
ments to claim the three major
extenders provisions. The key
forms (Forms 1040, 1040A,
Schedule A&B, and instructions)
went to print in early November
and reflected the law in effect at
that time. The instructions con-
tain a cautionary note to taxpay-
ers that the legislation was pend-
ing at the time of printing.
People using a paper 1040
and claiming the key extender
provisions should follow these
steps:
State and Local General Sales
Tax Deduction:
The deduction for state and
local general sales taxes will be
claimed on Schedule A (Form
1040), line 5, "State and local
income taxes." Enter "ST" on
the dotted line to the left of line 5
to indicate you are claiming the
general sales tax deduction
instead of the deduction for state
and local income tax.
The IRS also issued Publi-
cation 600 for 2006, which
includes the state and local sales
tax tables, a worksheet and
instructions for figuring the
deduction.
This option is available to
all taxpayers regardless of where
they live, though it's primarily
designed to benefit residents of
states with either minimal or no
state and local income taxes.

Higher Education Tuition and
Fees Deduction:
Taxpayers must file Form
1040 to take this deduction for
up to $4,000 of tuition and fees
paid to a post-secondary institu-
tion. It cannot be claimed on
Form 1040A.
The deduction for tuition
and fees will be claimed on
Form 1040, line 35, "Domestic
production activities deduction."
Enter "T" on the blank space to
the left of that line entry if claim-
ing the tuition and fees deduc-
tion, or "B" if claiming both a
deduction for domestic produc-
tion activities and the deduction
for tuition and fees. For those
entering "B," taxpayers must
attach a breakdown showing the
amounts claimed for each
deduction.
Educator Expense Adjust-
ment to Income:
Educators must file Form
1040 in order to take the deduc-
tion for up to $250 of out-of-
pocket classroom expenses. It
cannot be claimed on Form
1040A.
The deduction for educator
expenses will be claimed on
Form 1040, line 23, "Archer MSA
Deduction." Enter "E" on the
dotted line to the left of that line
entry if claiming educator
expenses, or "B" if claiming both
an Archer MSA deduction and
the deduction for educator
expenses on Form 1040. If enter-
ing "B," taxpayers must attach a
breakdown showing the
amounts claimed for each
deduction.
