Doctors at Emory Hospital in Atlanta placed a stent
in her trachea earlier this year, which did not correct
the problem. She was then transferred,to Beth Israel
Deaconess Hospital in Boston, where she will have an-
other surgery in a few weeks.
Howell's parents, Wayne and Shirley Smith of Jasper
are-Lzrre ntly.staying in Boston with her.

Trauma One, the helicopter ambulance service operated by Shands
Jacksonville, was in Jasper on May 26 as part of a public relations campaign.

plorer's Club, said that on
his last trip to the Alapaha
River, he spent around
$175 in the county on gas
and groceries. He also not-
ed that some of his friends
from Jacksonville had
spent approximately "i

the closing of the Alapaha
has affected sales.
"During the summer, the
store would be packed with
off-roaders buying gas,
food and ice, but since the
river was closed, business
has slowed down," the em-
ployee said.
Pat Taylor, manager at
the BP/Burger King, also
located at SR 6 and 1-75,
said she could not tell a
difference in sales at the
gas station or the restau-
rant.
Gonynor feels that the
SRWMD has enacted the
rule with "complete disre-
gard to the public interest
and right to land use" and
would like to see the Ala-
paha riverbed re-opened
for ATV and ORV use. He
has offered some sugges-
tions to safeguard the rights
of the landowners while
still allowing off-roaders to
enjoy the area. These in-
clude constructing a park-
ing lot. and boat ramp, post-
ing the rules on signs and
requiring permits to use the
riverbed.
Gonynor thinks that a
real entrance and parking
lot would instill a feeling of
official use and responsibil-
ity more so than driving
under the overpass through
the trash. A boat ramp at
SR 6 and US 41 would not
only allow safe access for
ATVs and ORVs to the
riverbed when it is dry but
would also provide boaters
access to the river when the
water level is up. Large

should be no littering and a
dumpster should be placed
at the entrance.
Gonynor noted that al-
though Big Cypress Swamp
in South Florida has re-
duced ORV trails from
thousands of miles to a few
hundred miles, people can
still use the trails with an
ORV permit. Those who
are serious about off-road
riding would not object to
paying a small fee for a per-
mit. Stickers would allow
law enforcement to identify
those who have permits to
be in the riverbed.
Simpson points to the
Outer Banks in North Car-
olina as a good example of
state control of ORV areas.
Through proper resource
management, the state has
made it possible for off-
roaders to have fun safely
without damaging the local
eco-systems. The trails are
clearly marked and sand
dunes and banks are strict-

Dear to the Editor:
Over the past five years my wife and I have invested
our time and money to move to White Springs this year
and enjoy the environment that northern Florida offers,
taking advantage of the great parks, rivers and springs
and work to improve the quality of life within Hamil-
ton County. Over that time we have seen first-hand,
others who have purchased property within Hamilton
County and provided their passion, time and money to
develop and improve the area, such as the most beauti-
ful Bed and Breakfast on the Suwannee, the Sophia.
Jane Adams House, the Telford Hotel, the colorful cab-
ins on the north side of White Springs on 41, the Spring
Street Antique, Janet Moses' Art Shoppe, the new ap-
praiser's office and yoga studio, the Dollar Store, the
new house built on Bridge Street, and all the private
citizens who have adorned their homes and this is in
White Springs only, and not taking into consideration
the Fronton and Welcoming Center and other new de-
velopments in Hamilton County.
The article in the Orlando Weekly on June 8 was em-
barrassing. The people of Hamilton County need to
take pride in their home and take care of their own
backyard. An ethanol production plant would be good
for Hamilton County. It is the placement of the plant
that the County Commissioners have allowed to pro-
ceed, that should be reconsidered. It is inappropriate to
place an ethanol production plant within five miles of a
well-established eco-tourism area that the State has fi-
nancially invested in with a Heritage and Nature Cen-
ter, a hub of the Wilderness Trail and of course, the
Stephen Foster State Park. Also, there are two develop-
ment companies, the Silver Companies, who have de-
signs to build new homes, and Bienville, who plans to
expand on the existing retreat. However, both are
neighboring the proposed plant site. Are they still will-
ing to invest their money in those plans?
Industry is needed in Hamilton County to increase
jobs and tax revenue. The County Commissioners
should welcome them in with open arms, but they
should take charge and not allow the industries to dic-
tate where they want to be because it would be more
convenient and economical to them.
Hamilton County is, as their website says, the Jewell
of the Suwannee .... a diamond in the rough ... just a lit-
tle polish, common sense, recognizing, appreciating
and protecting the outstanding areas that already exist,
pride in what they have accomplished in the past few
years and an overall enlightened vision of the future of
Hamilton as a whole, the Commission will create a
county that all will be financially successful, environ-
mentally appreciated, and a community that all people
will be proud of.

Nolan Richard Lee
Nolan Richard Lee, age
74, of Jasper, Florida,
passed away Wednesday,
June 28, 2006, at North
Florida Regional Medical
Center in Gainesville, Flori-
da, following an extended
illness. He was born in
Echols County, Georgia, on
September 20, 1931, to the
late Milledge and Pearlie
Hunter Lee. Mr. Lee was a
deputy with the Hamilton
County Sheriff's Office for
several years. He retired
from Energy Savings Prod-
ucts in Jasper in 1988 and
enjoyed filling his days
with hunting, fishing and,
gardening. Mr. Lee was a
member of Suwannee Sta-
tion Baptist Church in
Suwannee County. He was
preceded in death by his
parents and two sons,
Richard K. Lee and Allen K.
Survivors include his
wife of 56 years, Ethel Met-

Eleanor Mason Lawson,
age 85,: of Jennings, Florida,

25, 2006, at Suwannee Val-
ley Nursing Center in
Jasper, Florida. She was
born February 14, 1921, in
Hancock, Maryland, to the
late William E. and Carrie
Mason. Mrs. Lawson re-
tired as an administrative
assistant from the Social Se-
curity Administration and
was a member of Oak
Grove Church of Christ.
She was preceded in death
by her husband, Stonewall
Jackson Lawson.
Survivors include two
sisters: Ruth Larkin of Jen-,
nings, and Virginia Keefer
of Mercersburg, Pennsylva-
nia; and several nieces and
nephews, including: Carol
Hill of Princeton, West Vir-
ginia; Donna Davis of Jen-
nings; and Robin Whiddon
of Jasper. Several cousins
also survive.

Willie Cleon Nichols, age
81, of Jasper, Florida,
passed away Tuesday, June
27, 2006, at the Veterans
Administration Medical
Center in Lake City, Flori-
da, following an extended
illness. He was born in
Dade City, Florida, on June
23, 1925. Mr. Nichols was a
retired ranger with the
Florida Department of
Forestry and was a farmer.
He was a Veteran of For-
eign Wars having and in
the United States Army
during World War II.
Survivors include his
wife, Gracie Colita Stone
Nichols of Jasper; two sons
and daughters-in-law!

week as much as I missed
writing to you. This week
will be short also as we are
having to get our news in on Friday this
week, so our faithful staff can get their
work done. They are so patient with us,
and believe me, I remember how it is
trying to get everything together on
time. The clock really rules in the news-
paper business, and I do appreciate their
efforts.
We want to get some political informa-
tion to you that has been given to us.
The Political Forum, sponsored by the
Hamilton County Republican Party, will
take place on Sunday afternoon, August
20, at 3 p.m. at the Courtoy Civic Center,
Jasper. All candidates are invited, and
urged to attend; speaking will be limited
to three minutes. Hope to see you there.

lerri and Wayne Mitchell are proud to
announce the birth of a new grand-
daughter, Aurora Dannen Sanders,
daughter of Julie and Daniel Sanders.
Aurora was born June 19, at 12:15 at
North Florida Regional Hospital,
Gainesville. She weighed 7 pounds, 15'
ounces; was 20 1/2" long. Paternal
grandparents are Leroy and Frances
Sanders of Old Town. Aurora joins a
brother, Brennan, who is 22 months old.
They have been visiting Wayne and Jerri
.for a few days.-We got a-first-hand look
at her and she is beautiful.

McGauley joined the Senior Citizens of
Valdosta on a trip to San Antonio, Te\.,
for a week-long tour. Some of the places
of interest were the Alamo, River Walk,
L. B. Johnson's Ranch, San lose' Mission,
McNay Museum, and Austin. They al-
ways take such interesting trips, some-
thing to look forward to. Linda is now
retired and is enjoying her retirement.
We would like to get more news from
the churches; we understand there have
been Bible Schools going on and success-
ful ones. The Jennings Methodist had a
great time; they have been busy. Some of
the folks from their Church had a dinner
at the Telford House in White Springs
for their pastor and his wife. They will
be leaving for another field.
The County Wide Sisterhood will meet
at Burnham Christian on Tuesday, at 7

automobile accident re-

bell) Black. It was good
sharing a visit with him.
He resides in Jasper and is
an active member of First
Baptist Church, Jasper.
A large contingent of
Hamilton Countians were
at St. Augustine Beach for
the Fourth of July week.

week-long summer camp,
Camp Love. The Jack-
sonville branch of the Mus-
cular Dystrophy Associa-
tion (MDA) held its annual
'summer camp in June at
Camp Weed in Live Oak.
Campers, ages six to 21,
have the chance to make
friends and to participate
in various indoor and out-
door activities. Volunteer
partners accompany and
care for the campers, help-
ing them to enjoy dozens of
activities that were offered.
From carnivals, dances and
daily swimming, to
hayrides, fire truck rides
and a talent show, all activ-
ities were suited to the
campers' special needs to
create an unforgettable
summer experience.
There was no cost to fam-
ilies of campers who attend
summer camp. The $600
per camper fee is covered
'entirely by support from
National and local corpora-
'tions, groups and individu-
als that raise funds to stip-
port MDA's mission.
SFounded in 1950,. the
Muscular Dystrophy Asso-
ciation is a voluntary
health organization dedi-
cated to finding a cure for
more than 40 neuromuscu-
'lar diseases. MDA funds
research worldwide includ-
ing current projects at the
University of Florida and
Jacksonville's Mayo Clinic.
In Jacksonville, clinics are
located at Nemours Chil-
dren's Clinic and Mayo
Clinic, and in Gainesville,
at Shands Hospital. Free
services for those diag-
riosed with one of the neu-
romuscular diseases in-
clude physical, occupation-
al and respiratory therapy,
genetic counseling and
testing, social services con-
sultation and year-round
patient care.

Effective Julu 1, the Florida Fish and Wildlite Con-
,ervation Commission is implementing a series of
rules approved last year to clarify and standardize
how to measure the total length of saltwater fish.
Fish that have "flat" or irregularly shaped tails are
measured by "total length." The newv rules provide
that total length must be measured by determining
the straight-line distance from the most forward point
of the head w ith the mouth closed, to the farthest tip
of the tail with the tail compressed or squeezed to-
gether, while the fish is lying on its side.
This method is sometimes called "squeezing" or
"pinching" the fish tail, which essentially involves
measuring the maximum possible length of the fish.
The total length measurement is used to measure
the snapper and grouper family, red and black drum
s-nook, spotted seatrout, weakfish, tripletail, bonehsh.

Fish that have forked or angled tails are commonly
measured bY "fork length." No change has- been made
to "fork length" fish, which should still be measured

permit, pompano, African pompano and gray trigger-

Ace pitcher Derek Johnson did his

Suwannee Valley team off the bases
and some timely hitting by all of
our All-Stars allowed our team to
take two of three games making us
the tournament champs.
The coaches want to thank all of
our players and parents, our sup-
porters and sponsors for making
this all possible. The team now ad-
vances to the District One Tourna-
ment held in Lake City.

of the City of Jasper
The City of Jasper, Fire Rescue Depart-
ment will be conducting their on-going
quarterly fire hydrant testing/flushing
program starting Monday, July 10. The
purpose of this program is to identify
proper water supply for firefighting oper-
ations and also to help improve the quali-
ty of water throughout the city's water
system over a period of time. This pro-
gram may result in discolored water
when water faucets are initially turned on
the morning after hydrant testing; flush-
ing. Firefighters will be testing/ flushing
these hydrants between the hours of 8
a.m. till 11 a.m. and 2 p.m. till 4 p.m. each
week day until the entire system has been
flushed, an estimated three week period.

hours.
Suwannee Valley Community Co-
ordinated Child Care, Inc. visited the
dental office of Dr. Jerry Smith in
Jasper, to present him with a plaque
of appreciation. Ginney Crews, Oral
Health Specialist, with the Oral
Health Grant of SV4Cs, proudly pre-
sented to Dr. Smith and his staff the
award made by the Headstart and
Early Headstart children he saw dur-
ing the 2005-2006 school year.
Dr. Smith and his staff are an asset
to SV4Cs in assisting with the dental
needs of the children of Headstart
and Early Headstart. The children
get the necessary dental exams to de-
termine what dental needs are to
met.
SV4Cs appreciates Dr. Smith and
all of his office staff for the excellent
attention given to the children, par-
ents and to our staff.
Florida Butterfly Festival photo contest
The 2006 Florida Butterfly Festival photography contest
rules are now available online. The entry fee is $10 per
photo, with cash prizes awarded to the top five winners.
Prizes will be first, $500; second, $400; third, $300; fourth,
$200; and fifth, $100. Top winners, calendar selections and
honorable mentions will be displayed at the Florida Mu-
seum of Natural History during festival. Each of the win-
ners shall be clearly indicated in the exhibit and contact in-
formation for the photographer provided. Entry deadline

Shands at UF Auxilary donates $2 million
The Shands at the Univer-
sity of Florida Auxiliary do-
nated $2 million dollars to-
wards the construction and
development of the Shands
at UF Cancer Hospital. The
group presented the gift re-
cently during its annual
awards luncheon.
The cancer hospital will
house 168 private inpatiernt
beds for a variety of pa-
tients, including those re-
ceiving diagnostic and ther-
apeutic oncology services. It
also will include a critical
care center for emergency-
and trauma-related services.
This latest gift will estab-
lish the Shands at UF Auxil-
iary Conference Center
within the cancer hospital.
The conference center will
provide public space to host
community health fairs,
screenings and educational
workshops on health issues
such as cancer prevention
and treatment.

The Shands at UF Auxil-
iary was formed in 1961.
Commonly referred to as
the pink ladies, the men and
women who make up the
group have volunteered
more than 528,000 hours at
the hospital during the past
four decades. Last year,
they provided more than
$50,000 in grants to supple-
ment patient services at
Shands at UF and $11,500 in
scholarships for UF stu-
dents pursuing medical de-
grees.

AMERICA, our Home Sweet Home

America, our Home Sweet Home! Have you ever
thought about what your life might be like if you
had been born in another country, say in the war-
torn Middle East, or one of the Third World coun-
tries of Central America or Communist China? I am
sure none of our lives would be anything like we
are living today. In the Bible God says in Acts 17:26
"From one man God made every nation of men,
that they should inhabit the whole earth; and He
determined the times set for them and the exact
places where they should live." You see, before you
were ever born God knew you would be blessed to
live in America.
How many times do we take for granted the
blessings we have living in a free country? Every
time we go to a grocery store and see food on the
shelves is a blessing. If we have money to purchase
groceries, that is a miracle. You see, after traveling
to several countries away from home in January,
March and May, I am again reminded of the amaz-
ing country that we call home, America. When we
were in Nassau, Bahamas in January, we decided to
go into one of the grocery stores there to see
where the locals shop. It was truly heartbreaking to
see a country that is so close to ours with so little
available to them. The store had a couple of aisles
in the middle, and then some shelves around the
outer walls. Many shelves were just bare, or had
only one or two of several different kinds of items.
They had very little variety of foods and the prices
on what. they did have would scare you. Meat and
produce were scarce, and the little we saw was
pitiful to see and outrageously priced. I was think-
ing to myself as we walked through this store how'
many people right here in our area go to one of
the stores in our town and fill up a whole cart
every week and probably purchase smaller
amounts other days of the week. In Nassau, we
saw many who try to make a living selling their
handcrafts in the straw market come into the store
and buy only one or two things because that is all
they could afford. This is definitely not the land of
plenty. Imagine a bottle of shampoo that I see so
many times on sale for 78 cents, or at the most 98
cents, selling for $4.89. Once again, I' was remind-
ed of Roatan, Honduras, where milk is over $9 a
gallon if you can get it, and when you do get it, it
is already sour. Yes, we are truly a blessed people!
How many children here in America would be
overjoyed when given a small sandwich-sized Zi-
ploc bag with a few pieces of candy,: either a little
toy car or a tiny doll and maybe,some stickers, hair
barrettes or plastic animals? How many of our
teens would be thrilled to be given that same size
Ziploc'bag with a new toothbrush, toothpaste,
floss, a comb and some candy? Well, in many coun-
tries we have visited, the smiles of the children, the
teens and even some adults have been incredible!'
There was a little boy in the Turks and Caicos that
took his bag and began setting every little thing
out for his mom to see. He was so very thankful
and excited. Then the same thing happened in the
Bahamas where we got a wonderful picture of

these two little boys receiving their bags and they
kept saying thank you over and over again! We
then had the opportunity to share with the mama,
too. She was thanking Jennifer for her son's bag
and joked about where was her bag, and Jennifer
pulled out one with a comb, tooth brush, etc. for
her and she, too, was all smiles!
It is so much fun to bless someone else! It is a
wonderful way to share God's love. 2 Corinthians
9:12 says, "This service you perform not only meets
the needs of God's people, but also produces an
outpouring of gratitude to God." We all can share
God's love with others right where we live. Think
of ways you could be a blessing to someone,
maybe taking food to someone who is sick, writing
a card or note to encourage a person, maybe send-
ing a thinking of you card or e-mail to someone or
helping with a fund-raiser for someone in need.
Look around every day, as someone where you live
could surely use a reminder of the love of God.
A real shock to our family was the tremendous
poverty we saw in Panama. After having been to
Costa Rica and seeing the lush green land with
beautiful pineapple plantations; banana planta-
tions, coffee plantations and many rain forests, we
were unprepared for what Panama had to offer.
Yes, Panama has real cities, and the Panama Canal,
but this is definitely the poorest and dirtiest coun-
try wd have visited. Last year, we thought the.
poverty of Belize and Honduras were bad and they
are, but it is not as bad as Panama. There are some

large buildings in Panama City, yes, you can see the
Pacific Ocean, but most of the people live in filth,
and dire poverty, only a few of the elite rich, or fa-
mous have anything. The children and parents
here in this country seemed as though they could
not believe that the little bags of toys and candy
had been brought from America for them.
As we toured this country on an old worn out,
hot bus we really had time to reflect on our own
home, our own lives and realize how wonderful it
is to live in the good old U.S.A. When we were out
of the bus at one point, we were looking at some
handcrafts the Panamanian people were selling.
Everywhere you went there was a horrible sewage
like smell. We even noticed it in the city area,
which was supposed to be a better part of the
country. When the bus was stopped waiting on traf-
fic, we noticed out the window down in the water
under the bridge we would soon go over, there
was loads of garbage floating in the water, so much
so that it was almost creating a dam in the flow of
water. Soon, we noticed in the yards of the little
houses were places where they seemed to throw
out their garbage in the yard and leave it there.
This was definitely a poor country. Many of the
people in Costa Rica seemed to be hard workers.
Everywhere we travel, God shows us how blessed
we are to live in our country. We realize how much
more we have and how many more opportunities
there are in America than so many other places in
our world. In the beginning of this article, I asked
if you have ever thought about what your life
would be like if you had been born in another
country. Myself, I have, seen many beautiful places
and many terrible places in our travels, but I have
yet to see anywhere I would rather call home than
America, the land of the free. Sure, our country has
many problems, and we have poor and needy peo-
ple. In fact, we could list many faults in our coun-
try if we really wanted to. However, no matter how
you look at it, America is ,still the land of the. free
and the home of the brave. America is a nation
blessed by God.
This year, as we celebrate Independence Day,
our nation's birthday, remember to be thankful to
God for allowing us to live in a nation where we
still have our freedom, where we can still worship
God, go to school, Church, work, play and travel.
We can raise our children and choose 'how many
children you want without the government telling
you otherwise. You can have a holiday picnic or
leave our country to visit other places and return
to our own country without fear. Think, about it,
most of us have food, clothes, a home, family, an
income and the opportunity to go someplace if we
desire.
Do not ever get to the point where you take for
granted the blessings you have in this country. Re-
member to pray for this nation, as America needs
God's blessings:
I love traveling and sharing God's love with oth-
ers in many different ways, but I am always thank-
ful to arrive safely home to America, our Home
Sweet Home. Have a blessed Fourth of July!.

The Fourth of July is a day when we
celebrate the birthday of our country,
America! I am sure most of you proba-
bly look forward to wearing red, white
and blue, waving our flag, having pic-
nics, going to parades or fireworks. It
is for most people a day full of fun!

Many countries are too poor to have a
picnic. Have you ever thought what
your life would be like if you had

How many times have you been to

dad? I am sure that you saw lot's of

ceries. Just recently, my family and I
were in another country not too far
away from here and went in to one of
the grocery stores. It was so sad, they
had only a few different things on a
few shelves, what they had did not
look good and the prices were way
too high. A bottle of shampoo you can
buy for less than $1 here in America
cost nearly $5 there. The people are
very poor and cannot buy much.
I wonder how excited you kids
would be to receive a little Ziploc bag

drawing someone who is sick or lone-
ly a picture or giving someone a hug.
Everywhere we go we see things that
remind us how blessed we are to live
in America.
I asked you if you ever had thought
what your life would be like if you
had been born in a different country. I
know I am thankful to be living in
America. I know our country has
problems, but thank God, our country
is free! We are free to go to school, to
church, to work, out to play. We have
stores where there is food to buy, and
we are can buy it. We are free to cele-
brate the fourth of July. We, can have a
picnic,. We can travel to other places,.
We truly are blessed to live in Ameri-
ca!
America is still a nation blessed by
God, and this year as we celebrate our
country's birthday, the fourth of July,
remember to be thankful to God for
allowing you to live in a country

Five questions cancer patients may
not know to ask their oncologist
(NAPS)-An estimated 10 million Americans alive today have
faced a cancer diagnosis. Fortunately, advances in cancer care
and treatment have dramatically improved survival rates and
overall quality of life. That improvement is largely due to patients
who are taking an active role in their cancer treatment. The next
step is to find out how to maintain a healthy lifestyle-and properly
care for your entire body.
"Many patients focus on questions about their cancer
treatment, so they often don't think about other facets of their
disease," said Dr. G. David Roodman, Director of Myeloma
Program, University of Pittsburgh Cancer Institute and Director
of Bone Biology Center, University of Pittsburgh Medical Center.
"One important consideration that is often overlooked is the

When faced with cancer, it is important to remember that no
question is inappropriate. Here are five questions cancer
patients may not know to ask their oncologist:
Will cancer and its treatment affect other parts of my body?
Several of the most common types of cancer (e.g., breast,
lung, prostate, kidney) can spread from the original tumor site to
invade .the bone, a process known as bone metastasis. Multiple
myeloma, a cancer of the plasma cell, can also progress to the
bone. It is important that you visit your oncologist to conduct a
e full medical examination to determine if your cancer has
metastasized and learn how you can take action to protect your,
bones.

Preexisting medical conditions put you at higher risk for

Heartless tax law: The premature distributions tax

Beware when you or a
family member must in-
vade a qualified retire-
ment account, because
the 10 percent penalty is
imposed if you make an
"early withdrawal" even
if the withdrawal is due
to a financial hardship.
Section 72(t)(1) of the In-
ternal Revenue Code
generally imposes a 10
percent additional tax on
premature distributions
from "a qualified retire-
ment plan" such as a
401(k). The only excep-
tions to this tax penalty
are certain distributions
that fall within one of
the categories narrowly
specified in Section
72(t)(2).
A recent U.S. tax court
summary opinion said
the hardship must fall
within the definition of a
"qualifying" hardship to
avoid the early distribu-
tion penalty. In the case,
the defendant's former
husband was involved in
a diving accident and be-
came a quadriplegic. She
worked from August
2001 to September 2003
but quit at the end of the
year to care for her two
young children. Due to
financial hardship, the
defendant during 2003
took a lump-sum distrib-
ution from the 401(k) ac-
count maintained by her
former employer. The
defendant at the time
was under age 55, and
used the money to pay
normal, day-to-day liv-
ing expenses. When she
filed her tax return for
2003, she reported the
distribution as income.
The IRS sent her a statu-
tory notice of deficiency
and held her liable for a
10 percent additional tax
on the distribution un-
der Section 72(t) on the
grounds that she re-
ceived the distribution
"prematurely."
Purpose of the.Tax
The legislative pur-
pose underlying the Sec-
tion 72(t) tax is that "pre-
mature distributions
from IRAs frustrate the
intention of saving for
retirement, and Section
72(t) discourages this
from happening."
Courts have many
times declared sympathy
for taxpayers but have
stated that they are
bound by the statutory
exceptions enumerated
in the code. The defen-
dant's argument was
that she did have a qual-
ifying hardship; the
court didn't disagree
that she had a hardship
but held that she didn't
demonstrate that her sit-
uation fell within any of
the exceptions to the 10-
percent additional tax
under section 72(t)(2).
Other cases have had
similar outcomes where
taxpayers took distribu-
tions due to financial
hardship and used the
money to pay bills, pri-
vate-school tuition or to
pay off debts.
Enumerated Excep-
tions
Generally, the follow-
ing are exempted distri-
butions under 72(t)(2):
Distributions made
on or after the date on
which the employee at-
tains age 59 and a half
Those made to a ben-
eficiary or to the estate
of the employee on or af-
ter the death of the em-
ployee
Those attributable to
the employee's being
disabled
Withdrawals that are
part of a series of sub-
stantially equal periodic
payments, not less fre-
quently than annually,
made for the life or life
expectancy of the em-
ployee or the joint lives
or joint life expectancies
of such employee and
his designated beneficia-
ry
Distributions made
to an employee after sep-
aration from service af-
ter attainment of age 55,
or made on account of
certain levies under the
Internal Revenue Code.
It is sad and really un-
forgivable that our laws
and courts are so inflexi-
ble in a situation such as
the case discussed here.
Isn't it ironic that our
wise Congress seeks to
protect us from our own
folly and lack of fiscal
discipline? Our tax laws
should do better. We as
taxpayers need to hold
Congress and the White
House accountable.

cancer hospital in response
to an increased demand for
cancer services. According
to the American Cancer So-
ciety, Florida is the fourth
largest state but has the sec-
ond highest number of new
cancer cases. Approximate-
ly 5.6 million Floridians are
at risk for cancer, and in
north-central Florida, there
are at least 4,500 new cases
of cancer each year among
residents.
Shands is building the
cancer hospital on South-
west Archer Road, across
the road from the Shands at
UF medical center campus.
Construction is scheduled
to begin in January of 2007
and be completed in 2009.

a Machine Operator III position. This
position will primarily for the landfill.
A person allocated in this position
will operate tanker trucks and landfill
loaders. An employee in a position
allocated to this class performs a
variety of functions in the support of
the Public Works Department arid
Landfill operations such as the

equipment is serviced and

Qualifications include partial high
