as Hendr\ County Emergency

spending the week preparing
for and dealing with Tropical

the Director of Communica-

"We lucked out big time,"
Mr. Kochheiser commented
about the storm, "we got a lot

Volunteers pull invasives

By Kristin Hunter
SThe LaBelle Nature Park is
one of LaBelle's unknown treas-
ures. It is rnade up of 10.11 acres
on the rivei and is leased to the
City of LaBelle by the SoIuth Flon-
daWater Management District. It
is home-to three distinct and
diverse habitats which include:
The wetlands, oak hammock
and scrubs. Those three habitats
include numerous different
plants and wildlife such as the
beautyberry, muscadine grape,
live oak, gofer turtles, butterflies,
etc.
A handful of people that are
members of a coalition of differ-
ent organizations such as the
Riverwatch group, Boy Scout
STroop #9 and Kiwanis, woke up
early on Saturday, October 2, and
worked hard in the midst of the
mosquitoes biting at the Nature
Park. They pulled exotic air pota-
to vines out of the park so that the
vines wouldn't destroy the other
plants. The potato vines are an
intrusive plant that can take over
the park and destroy all of the
native plants and shrubs, so they
worked hard to pull as many
bulbs as possible.
The air potato can quickly

engulf native vegetation in natural
areas, climbing high into mature
tree canopies. It produces large
numbers of bulbils, which facili-
tate its spread and make it
extremely difficult to eliminate
because new plants sprout from
even very small bulbils. It invades
a variety of habitats including
pinelands and hammocks of nat-
ural areas (Langeland and Burks
1998).
It takes a lot of volunteer labor
to accomplish this task. It is labor
intensive, time consuming and

difficult to even make a dent in
the vast potato vines that con-
sume and cover the park. The
group will meet again in October
and December to continue
pulling the potato vines. If anyone
is interested in helping with this
effort they can call Margaret Eng-
land at 674-0695.
Margaret England wanted to
especially thank the Rotary Club
in conjunction with the Hendry
Recreation Department for all of
their continued help and support
with the Nature Park.

SO busts two

drug houses

By Ideybis Gonzalez
The Hendry County Sher-
iff's Office made a sizable bust
last week, putting a stop to
two marijuana grow houses
with a one-two punch that offi-
cials are hoping will put a dent
in the drug activity in the area.
It is possible that the narcotics
at the grow houses may have
made their way to the Clewis-
ton area.
The sheriff's office discov-
ered a grow house on Aug. 29
at 832 Sherwood Circle in Port

LaBelle after an "intensive
investigation," according to a
press release from the law
enforcement agency. The
sheriff's office worked closely
with the DEA on the investiga-
tion, which also took the agen-
cies to another grow house,
also in Port LaBelle,. on the
same day.
The first house contained
an undisclosed amount of
marijuana plants that were
being carefully cultivated

Pregnancy won't end education

By Kristin Hunter
Getting an education and
being a good parent are two of
the most important things a per-
son can do. As a matter of fact,
one must have a high school
diploma to even join the military
nowadays. However, it may be
even more important to be a
good parent.
It used to be that if you got
pregnant while still in school the
chances that you would
. become a drop out were very
high. Now, thanks to a program
run by Joyce Conner, pregnant
teens are getting their educa-
tion.
The statewide Teen Parent
SProgram gives teen parents the
skills they need to finish their
education and become effective
parents. The goal is that the stu-
dents remain in school, gradu-
ate, have healthy babies and
improve their parenting skills.
The program is voluntary and

requires a parent signature.
Parenting 1 and 2 cover child
growth and development, absti-
nence, human reproduction,
family planning, health care,
prenatal and postnatal care and
effective and- app ropriate' disci-
pline. Enrollmelnt's.o enables
the student to participate in a
long term support system. As
long as the student passes Par-
enting 1 and 2 they receive free
daycare and transportation to
and from daycare for them and
their child. The program also
offers "Homebound," in which
a teacher comes to the pregnant
or new parents' home and
teaches them for 2 hours/day
twice/week up to six weeks after
the child is born.
According to myflorida.com,
sexual activity among high
school students doubles
between 9th and 12th grade and
about 50 percent of seniors are
sexually active. So regardless of
whether or not one wants to

believe that sex is happening at
such a young age, it is. If teens
are going, to become pregnant
and eventually become parents
they will have the skills to give
their children a full and healthy
life.
Maria Erreguin, a 16-year-old
mother of a healthy two-and-a-
half year old daughter named
Jaqueline, became pregnant
after having sex for the first time
with her boyfriend who was 17
at the time. She said, "When I
found out I was pregnant I was
scared. Luckily, I was able to
take parenting classes starting in
middle school. I missed about
six months of school because I
was a high risk pregnancy due
to my age. I had high blood
pressure, had to have a blood
transfusion and had two
seizures due to preeclampsia, a
problem caused by increased

blood pressure that is accompa-
nied by edema, which is caused
by fluid accumulation in tissue
that causes swelling. Because of
the complications, I had to have a
C-section which left me in the hos-
pital longer than my newborn
daughter. My parents had to take
care of her until I got out of the
hospital. Luckily my parents have
been very supportive because I
don't know what I would have
done without their help. It took
me a year to heal physically after
having the baby.
"Because some girls know that
I've had a baby they will come to
me for advice about sex. First I tell
them about my experience and
how hard it was and that it only.
takes one time to get pregnant and
then I tell them that 'If he loves
you he'll wait and that you need to
wait to find out if he is the right
person before you decide to do
something that could change the
rest ofyour life.'
Because of the parenting class I
learned how to take care of my:
baby. My baby and I have had to
learn everything together.
"The baby's father and I live
together now but we will wait a
long time before we have another
child because it's a huge responsi-
bility and there's a lot that Iwant
to do. I vant to go into medicine
to become a pediatrician. Having
Jackie made me settle down and
realize what's important. She
made me realize how important
school is because I realized, "How
am I going to support my daugh-
ter without an education?" I think
I'm beller because of Jackie. She
made me realize the importance
of school. I want to be able to pro-
vide for my daughter. She moti-
vates me to go to school and do
my homework. I now realize how
important it is to make good deci-
sions. Today I have the baby's dad,
but tomorrow I may not, so I real-,
ize that I need to get an education
to be able to support my child. I
learned this from my parents. My
mom stayed home and then one
day my dad got into an accident so
my mom had to work.
"I do want to get married one
day because I think marriage is,
important but I didn't want to get
married for the wrong reasons. I
don't think marriage is right for
me right now. I'm giving myself a
chance to get to know my baby's
father right now, because he's dif-
ferent than he was when we were
going out, he was different when I
was pregnant and he's different
now.
"I don't think I would have
been prepared to have Jackie

without the parenting class. I
learned so many things by just
opening up the first book that Mrs:
Conner gave me. Mrs.'Connerfhas
helped me to make good deci-
sions for not only myself but for
Jackie as well. The parenting"
classes have, taught me..sudh
things as how to discipline cor-
rectly. I am also learning how to
teach Jackie to be able to make
her own decisions. I've learned
that its better off that Jackie is in
daycare and I'm at school'because
I know she's in a safe place and I
know she's learning while I'm
learning too. The skills I learned
from the parenting classes helped
me to combine my life with Jack-
ie's life. When I'm reading to Jack-
ie I ask her what she's learned. I
see other parents who haven't had
parenting classes struggling to
teach their kids. Jackie is very well
behaved because of what I've
learned in..Parenting classes. I
think every parent should have
some type of parenting class
because it really makes a differ-
ence. I can tell those who have
had the class and those who
Haven't; .
t "I have trade a goal to gradu-
'ate from high school. Healthy'
Families and Head Start ,has
helped me a lot. Some people
thinly they know everything, but I
realized that I didn't and wanted
to learn as much as I could. It has-
n't been easy, but I try to focus on
my goals and make the best out of
everything. My advice to others is:
It's better to learn the easy way
because the hard wav is really
hard."
The Health Department offers
many programs to expecting
moms. Healthy Start deals with
prenatal and postpartum care,
delivery, infant care and targeted
support services for high risk
patients. WIC (Women, Infants
and Children) is a food and nutri-
tional counseling program. Lee
OBGYN Associates will provide a
midwife to visit an expecting
mother about once/month over
the course of the pregnancy for a
total of about 10-12 visits.
According to Patti Brownlee,
the Assistant Community Health
Nursing -Director at the Health
Department, there are three
important things to keep in mind
when thinking of becoming preg-
nant.
#1 Take care of yourself before
you become pregnant.
S#2 Prenatal care is very impor-
tant.
#3 Pregnancy tests as well as
other help is available at the health
department.
The reality is that-there are not
many resources in LaBelle for
pregnant women but there are
some so expecting moms need to
be aware of them.

New vocational

school planned

,ByKristin Hunter
At the school board meeting
hheld August 22, Sonny Hughes,
, the Executive Director of the Edu-
Scation Center of Southwest Flori-
da, made a presentation about
the new vocational school to be
located at educational village on
Helms Rd. The school will be con-
structed by 2009-10. It will be a
'42,000 square foot $5.5 million
project. The school will be a pri-
vate, non-profit school, which
means it will solely be funded by
gifts. He said, "There is an obvi-
Sous need for this type of school in
'a 30-mile radius. There are not
-enough people going into trades
any more because it isn't offered
in high school any more. So we
.want to meet the needs of our
"community by providing training
to those \\ho need or W\'anl it by
reducing the dropout level in high
school. Students who wanted to
attend vocational school could
;stay enrolled at LHS, but attend
the education center of South-
,west Florida instead."
He said the site has been relo.
cated to the educational village on
Helms Rd. from 60 acres off Hwy.
:29 on Bob Paul Property to make
;the whole educational village
.development better. The educa-
tional village will eventually con-
sist of the ECSWF, Edison College,
the new water plant and eventual-
ly a new high school. The school
.*has been having computer and
.accounting classes since 2002 at
its office on Missouri Street.
About 272-292 students have
completed computer classes. The
staff lives by the saying from the
mo\ie Field of Dreams, "If you
build it, theywill come."

Classes will include: child care
assisting, health classes, automo-
tive class, agro-technology classes
such as welding and diesel
mechanics, plumbing and electri-
cal classes and business classes.
Right now they are holding a
hea\v equipment operator class
(CDL license) that will provide
workers for the C-43 project as
well as the building of the new
educational village. The class has
been made possible by a two-
year $55,000 grant from South-
west Florida Water Management
District. The class is. five weeks
long and the students have to be
at least 18 years old to attend. Stu-
dents do not have to have a high
school diploma to apply. Jobs pay
$15-35 hr. when finished with the
five week course, which is about
what a first year teacher makes
with a four year bachelor's
degree.
He went on to say that the C-43
reservoir project at Berry's is call-
ing for a huge number of dump
truck drivers to haul dirt and will
be for some time to come. There
are three projects at the C-43 proj-
ect: one at approximately 11,000
acres, one at approximately
13,000 acres and one at approxi-
mately 20,000 acres with 38 feet
of 3x6 miles of dirt. School board
member, Pat Langford added that
Langford Ford has a hard time
finding people to do automotive
work so there is a need for that
type of trade as well.
Overall, Mr. Hughes said the
\o-tech will raise the economy for
the community by providing
more jobs for people going into a
trade such as plumbers, electri-
cians, dump truck drivers, auto-
motix e mechanics, etc.

Batalone guilty of

sexual battery

On August 23, a LaBelle jury
found Jorge Aguilar Batalone
guilty of sexual battery on a child.
The 30-year-old Batalone is to be
sentenced on September 18 after
a presentencing investigation.
Batalone was arrested January
12, 2004, after an 11-year-old girl
told her mother he had sexually
.assaulted her. The incident took
place at a rotel where Balalone

had taken the victim and two
other young girls to swim. There
was no forensic evidence in the
case because the victim did not
tell her mother for a month after it
occurred because she was afraid
to. However, she did call one of
the other girls in from the pool
after it happened and confided in
her. Batalone also called the vic-
tim's mother and apologized.

14arrested at checkpoints

According to Sheriff Ronnie
Lee, as a result of two DUI check-
points this past week, 14 people
were arrested.
Five people were arrested for
DUI and nine for various traffic
violations. Deputies also wrote
15 citations at the checkpoints.

Also, sheriff's investigators
seized an estimated $132,000
worth of marijuana plants from
two marijuana grow houses
located in Port LaBelle. Two
search warrants were served on
these grow houses on August 29.

Lake Okeechobee rose

three inches from Ernesto

After the passe of Tropical
Storm Ernesto earlier this week,
Lake Okeechobee rose three
inches due to the storm, accord-
ing to U.S. Army Corps of Engi-
neers water managers.
"Since the storm never devel-
oped as had been forecast, the rise
on the lake was minimal," said
Jacksonville District Water Man-
agement Chief John Zediak. "As
the storm approached the lake, it
increased the speed at which it
was moving by a few miles per
hour, thus dropping less rain than
it would have at its original rate of
speed.
"The current situation is good
in a number of ways. Central
Florida received some much-
needed rain and we are .still in
great shape for the remainder of
the hurricane season."
Zediak explained that much
storage capacity remains in the
Kissimmee River basin since it did
not receive much rain during the
same period. He said from this
point, roughly mid-way of the

hurricane season, the lake could
still receive repeats of either the
2004 or 2005 hurricane seasons
and "still be in good shape."
Post-storm inspections of Her-
bert Hoover Dike, whichh sur-
rounds the lake, showed no prob-
lems with the integrity of the
structure.
Zediak noted that an area \west
of Moore Haven and Clewiston
received the most rainfall from
the storm and that local runoff to
the Caloosahatchee River resulted
in high flows at the WP. Franklin
Lock (S-79). Prior to the storm,
the river upstream from the lock
was lowered in preparation for
expected runoff from the rainfall.
As the runoff reached the river,
gates and lock chambers were
opened to their maximums to
minimize impacts.
The Corps also said that no
freshwater releases from Lake
Okeechobee into the Caloosa-
hatchee or St. Lucie rivers have
been made recently or are
planned in the near future.

Hendry headlines of the year 2029

Maybe it's all the liquid sun-
shine we've been getting, cour-
tesy of the Florida Tourist Board,
but I couldn't help but think what
might be the news in the year
2029.
My wife says that's no excuse
but more probably that you
should never underestimate the
power of stupidity, if the quantity
available exceeds the need.
Again in an attempt to ration-
alize this fixation with the year
2029, I got some powdered water
in the mail the other day, but I
don't know what to mix it with. I
guess I shouldn't concern myself
with issues like that and concen-
trate on writing my new.book. So
far I've got the page numbers
completed. But back to those
headlines for the year 2029.
It has been reported that
ozone created by electric cars is
now killing millions in every
country in the world..

In a recent issue of the Collier
County Medical Society Bulletin, I
came across an extremely impor-
tant, articulate tax article. Attor-
ney A. Stephen Kotler who is
Board Certified in Wills, Probate,
and Trusts wrote it. Mr. Kotler
\oriks for Fowler. White, Boggs
and Banker in Naples and his
phone number is 239-598-1221. It
was titled "What do you mean I
waived my homestead protec-
tion"''
I found his article of such seri-
ous tax importance'that I called
him and asked for permission to
reproduce parts of it in my col-
umn. As. it turned out, in an
extremely unusual action, the 3rd
District Court of Appeals in Miami
decided to reverse itself on its
own volition, and by the time the
article got to me, it was no longer
applicable. I still think this is
something you should know
about, because if it happened
once, it could happen again. Mr.
Kotler is an expert inrhis field, and
if \ou have any questions you
may contact him. He was kind
enough to send me follow-up
material on this case and other
interesting material I may use in

by Wayne C.Switzer

the future; I might also mention
:hal ve are in the 2nd Appellate
District in Hendry County.
This is what happened. Mr.
DeMayo, a client ot the law firm of
Heller & Chames signed the law
firm's retainer agreement which
provided in part that Heller &
Chames, P.A. "shall have and is
hereby granted and charging liens
upon the clients interest in any
and all real property and for any
balance due, and that the client
hereby knowingly, voluntary and
intelligently waives his rights to
assert his homestead exemption
in the event a charging lien is
obtained to secure the balance of
attorney's fees and cost." The law
firm successfully used their retain-
er agreement to go after Mr.

DeMa.o c' homestead in court.
Historically, and at this time,
\our homestead exemption is a
pow er Iful protection under law.
There aie a few\ creditors \\ho can
legitimately go: after the equil in
your home.: Examples are the
payment of taxes and assess-
ments thereon, obligations con-
tracted for the purchase, improve-
ment or repair thereof, or
obligations contracted for house,
field, or other labor performed on
the realty.
Generall, a homestead owner
can get around this constitutional
limitation and prl:i\ ide an interest,
which can be reached by a credi-
tor, b\ pro':iding the creditor with
a mortgage on the homestead
proper[\. That is why it is so
important, that mortgages be
recorded.
Since the Court reversed itself,
there is no current change in law
as a result of that law case. Hoyw-
ever, now that \ o know it almost
happened, iou should be very
vigilant in leading over any con-
tracts you sign \\hen purchasing
high dollar items such as cars,
boats, planes, and more, and the
lender asks you to sign on the dot-

ted line, take the time to read
everything carefully.
This is a true story: Some sears
ago I had a client ask if I minded if
he read the declarations page of
an insurance application before
he signed it. I said, "of course not,
go right ahead." This wvas a Flori-
da licensed A+ well known insur-
ance company. Guess what' He
questioned orne of the declara-
tions on the page. He was right: It
said exactly the opposite of what
it \.vas supposed to say. I had been
using that application for three
years and so had.other insurance
agents all over the United States,
Not one person had ever found
that major error. I did call the
company immediately and talked
to one of the attorneys in the legal
department, and they corrected
the applications nationwide, as
fast as possible. Read what you
sign and from now on be mindful
that someone may try this again
and put a provision in a loan
agreement that goes after your
homestead. Any questions, call
your attorney.

tor.

Extra time for

healing at HRMC

Many in the community aren't
aware of a particular program,
referred to as the 'Swing Bed' pro-
gram, offered by Hendry Regional
Medical Center. When a patient is
already in a hospital, but needs
additional time for healing,
'Swing Bed' services can be very
beneficial. Here are just a few
examples of those who would
meet the required conditions:
1. A patient is in the hospital
and has just received a hip or
knee replacement, and no longer
needs medical treatment, but is
not strong enough or capable of
going home. He/she may receive
physical therapy until gaining the
level of'activity prior to initial hos-
pitalizati'n.
2: A patient is in the hospital
for a particular illness, but while
recovering needs on-going IV
antibiotics.
3. A patient is in the hospital,
has become too weak to go home
and still needs additional
care/rehabilitative physical thera-
PY.
Although many coastal facili-
ties offer this same service or a
similar one, the convenience of
being closer to home and to fami-
ly (not to mention the cost of trav-
eling) encourages numerous

David McClusky
patients to transfer to HRMC, if
necessary, as participants of
'Swing Bed' care.
David McClusky, the Activities
Director of the Swing Bed pro-
gram, says, "It's exciting to see
hospital patients getting out of
bed, and going to the activities
room where we can work togeth-
er on emotional, physical, spiritu-
al, social and educational needs."
Most insurance companies
will cover the expense of this pro-
gram, and Medicare will also pay
for the associated costs. To
receive additional information
regarding Swing Bed services,
please contact Marilyn Lamb,. Uti-
lization Review/Social Services
Director at Hendry Regional Med-
ical Center 863-902-4316.

Henderson recibe
prison de por vida
Para la familiar y muchos ami-
gos de la victim Danny Wosley
fue una sacudidad en el corazon
oir que James Henderson pasara
el resto de toda su vida en la pri-
sion. Tal vez para James sera lo
mismo un sacudida en el cora-
zon por la consecuencia que
liene que pagar ahora.
En una confession negociada
el 21 de agosto James Hender-
son se declare culpable de haber
asesinado a Woosley y dos deli-
tos de robo. El Juez del circuit
Edward Volz sentencio Hender-

son a prison de por vida sin
ninguna posibilidad de salir bajo
palabra de honor por el asesinato
de Woosley ademas de cinco
anos por robar la troca del difun-
to y un automovil Cavallier en el
Condado Collier. Durante el pro-
cedimiento el procurador Robert
Antonello dijo que parte del
arreglo fue que si Henderson se
declaraba culpable no iba a ser
condenado a la pena de muerte.
Cuando el procurador le explico
a Henderson si entendia clara-
mente las acusaciones y le pre-
gunto:iEs usted verdaderamente
culpable? El contest: !Sii
Seguidamente se quedo quieto
esperando de pie rodeado por
sus abogados.EI procurador
narro como ocurrieron los
hechos que cobraron la vida de
Woosley.

Llego
a Immokalee donde abandon la
troca y alli robo el Chevrolet Cav-
allier.
Vestido en un uniform de
carcel anaranjado y con sus
manos esposadas Henderson
volteo su cara hacia la familiar de
Woosley, su propia familiar y.
expreso su tristeza por el delito
cometido y espera que ellos
puedan rehacer sus vidas.

Ayuda para hermanas
Dos mrujeres jovenes pueden
vivir una vida normal y saludable
gracias a una vecina caritativa y
algunos profesionles medicos
dedicados.
Yoen y Janet Paniagua estan
recuperandose de las que-
maduras horribles que sufrieron
cuando una olla de presion les
explolo en su cara y cuerpo
porque no la abrieron en el
memento indicado Yoen estaba
visitando su lamiiia con sus dos
hilos. Las dos hermanas estaban
cocinando pozole en la olla de
presion y como no sabian como
usarla la abrieron sin quitar el
vapor lo que ocasiono que la olla
explotara. Las muchachas
suilieron quemaduras de segun-
do y tercer grado. El accident
paso el 4 de agosto como a las 5
de la larde \ fueron trasladads al

hospital Costa de Golfo despues
de recibir primeros auxilios del
personal de Emergencias, como
la familiar no tiene seguro el doctor
recomendo que se fueran a la
casa.
Al dia siguiente la menor de'las
muchachas le conto a su vecina
Julia Scott quien es enfermera reg-
istrada y Testigo de Jehova acerca
del accident. Julia dijo que se
impresiono cuando vio la condi-
cion de las muchachas y llamo a
la doctor Carmen Barris quien
trabaja en En el Centro Medico
Salud Floridiana, ella-las atendio,
les dio medicines extras y llamo al
centro de quemaduras en Tampa,
hasta una de las enfermeras ofre-
cio dinero para la gasoline.
En la unidad de quemaduras
del Hospital de Tampa el director
Doctor Donald Smith estuvo muy
procupado y generoso diciendo
que "el seguro no tenia nada que
ver alli." Yoen permancio hospital-
izada una semana mientras que
Janet fue tratada y dada de alia. A
Yoen le pusieron injertos de piel
de cerdo en el pecho para protejer
el area sensitiva permitiendo
qulae la piel nueva crezca sin
muchas cicatrices.

accident tan traumatico.

Pratt renuncia
Despues de comenzar su tra-
Sbajo otravez una semana despues
Patt Dwayne renuncio como
Director de Bomberos. Don Pratt
mando su renuncia a traves de
Josh Rimes a los comisionados
cuando estos se encontraban tra-
bajando en una reunion el 24 de
agosto. Rimes quien tambien es
un inspector de incendios sera el
nuevo director interino adentro de
laciudad y Malcom Johnson servi-
ra en las afueras sin embargo,
todos los bombers seran
despachados afuera de la estacion
de LaBelle.
El Alcalde Randy Bengston dijo
que el problema de los bombers
sera resuelto hasta que se arreglen
las diferencias del presupuesto.
Una crisis precipitada ocurrio
cuando 8 bombers voluntaries
veterans renunciaron de sus car-
gos como protest por sus difer-
encias con el Directos Pratt. Hacia
como un mes que el habia renun-
ciado pero despues regreso, en
este punto fue que los otros
bombers se disgustaron y las
cosas se dificultaron.
